I'd like to call this October 12, 2021, Regulating of Nelson County Board of Supervisors.

The first thing we're going to do is give public comments.

I want to go over the rules that we have for that.

I will open the comment period.

I'll call speakers first from the sign-up sheet after all of those people that came to speak when everybody else came forward.

Speaking of the microphones, I clearly state your name and address for the record.

If you're speaking on behalf of the group, please identify the group you're representing and direct your comments to the board.

Once we close this up, the comment period that's no further comments will be taken.

To accommodate all the people who wish to see the individual speakers or ask to keep their comments to three minutes, I will cue you when you've got half a minute left.

A couple of weeks ago, I got to pick your name and address.

It's Hunter Woodson, 1931 Bride and Mills Road, Arrington, Virginia, 22922.

A couple of weeks ago, I noticed that the Christmas tree out here at Union Bank was dead.

So I started to contact them to talk about it.

And they told me they were going to put it down.

And I was wondering what we're all going to do.

So I went out and searched for a commercial-grade outdoor Christmas tree that could be put up and taken down in the last many, many years.

It would be beautiful and something that everybody would look forward to.

So then I found out what the price was when I started fundraising.

Contacting local businesses and things like that and seeking out sponsorship.

and all and they loved the idea but with COVID being what it was last year they didn't have the funds and things that we needed on your sheet that I passed up before you see the tree that is now cut down and the tree that we would like to buy.

It's a 20-foot pre-lit tree, very beautiful, everybody knows it.

Last years and years and years, that company said that it should last about 10 to 12 years for a 90-day season of use.

But we would only use it for 45 days out of the year, so we could probably double that.

It's made with solid steel, and the sign on the outside can be replaced.

It's very nice.

I want to thank the Board of Supervisors for the opportunity for recognizing October as National Domestic Violence Homeworkers Month.

In recognition, the Nelson County Business Program will host its annual Candlelight Book, and that's tonight, at the Heritage Center at 6 o'clock.

So we welcome you all to come and join us.

It's a time for us as a community to come together and mourn for the lives lost and celebrate survivors of domestic violence.

Since the pandemic, we have seen cases of domestic violence dramatically increase across the country.

Nelson County's numbers have increased as well.

In the past year, there were 231 victims of crime that my friends have served.

Out of that number, 114 were cases of domestic violence.

So that's half, half of what I do in cases of domestic violence.

So in closing, I'd like to thank the Nelson County Commonwealth Attorney's Office for the work they do in prosecuting these most difficult cases.

The Nelson County Sheriff's Department, the deputies for the work they do, we all know that

These domestic calls can be the most dangerous calls that they answer.

This morning I had an opportunity to read through my book that I

What I recommend is give you all an opportunity to go through and I can come back this evening and answer any questions that you have, if you have any.

The theme is, of course,

Confederate Memorial, and I've seen good purpose in keeping their oath for returnism.

We can really leverage that thing.

There's a whipping post out here, as you may know.

Anybody who wants to argue that point would be to take you down to the circuit court archives.

You've got the little house on the front of the courthouse lawn.

At the entrance to the courthouse, you probably know this, you know, you bring it to the corner, I don't know how to eat, in March of 1865, General George Custer came up here and they laid waste in a certain court of records

Actually, it's a sort of petticoat.

It's one of those brigade commanders who came up there.

That type of thing.

It could really leverage for the people who are into this in history.

Regarding the history of Lovingston,

If you come in the northern entrance or the southern entrance, you'll see signs of both of those entrances.

Lovingston historic district, where you have come in the north entrance to see a car wash, come in the south entrance to see a fuel farm and gas station and a bank.

Lonely When You Come In means your interests and they want your interests.

You look up on that note over in front of the courthouse and see a statue.

That's a magnet for tourism, including, of course, as I said earlier, the edifices there.

Look at down at the bottom of the hill here where the Money Miller office was.

That, of course, used to be

Jesse A. Parkersey, before that it was a NIN, and before that, during the Civil War period, it was a, it was Lovingston Hospital, and one of the patients there was a guy named, by the name of Robert Barton, I don't know if his nickname was Skip or not, but anyway, I read his letters, he was there, and he also went over to Parcellia,

which I don't know if that was a hospital or if it was just a class major.

I'm Ann Norwood, 3509, Stage 3, Toronto, in Lovingston.

I'm sure that by now you've all heard about the Rockfish Ranch Resort project on Stage Big Road, 25 short-term hotel units, a 17,000 square foot wedding venue, which, by the way, is three times bigger than any venue that has offered at Wintergreen, spa, trails, office, etc.

You may not be aware that Rockfish Ranch has pulled its special use permits for the resort and plans to attain its goals to apply right in the spring.

You understand the plan did not change, just the way that the corporation is going about getting it built.

The planning office has determined that the 25 commercial motel units qualify as vacation homes, which is an appalling misinterpretation of the zoning ordinances.

The corporation plans to install the vineyard and from there follow an underhanded path from vineyard to winery to accessory building that will be used as an event venue.

The plan is another appalling subversion of the county ordinances.

Their path is one that has already been taken by several wineries in the area who have built large wedding venues without going through the specially used permitting process.

The most egregious and concerning issue with their approach is that it removes any examination and input by the Planning Commission, by you, the Board of Supervisors, and by the citizens of Nelson County who these projects most adversely affect.

There are currently 31 wedding venues listed in Nelson County, population 15,000.

This is 30 times more than the number of wedding venues per person in Las Vegas.

Isn't it time we took a hard look at what's happening in this county?

Commercial corporations are buying land and taking advantage of poorly worded definitions and guidelines to create inappropriate development.

And why do corporate developers and their lawyers have more say than the citizens writing interpretation of developmental bylaws?

It is imperative that you make significant changes to the county ordinances and clarify the definitions, intentions, and limits

If an out-of-town commercial corporation can develop an expansive resort with event venues and lodging without ever having to go through the special-use permanent process, then there has been a failure of the county zoning ordinance, a failure of common sense, and a failure of county leadership.

Good afternoon.

My name is Barbara White.

I live at 4647 State Bridge Road.

Thank you for the opportunity to speak this afternoon.

Planning the Rockfish Ranch project has me deeply concerned.

We will hear from others on various aspects of this project.

My focus will be on the potential impact to our beautiful natural resource, the Rockfish River.

By way of background, my husband and I searched for nearly a decade to find our ideal place to live and found it here in Nelson County about seven years ago.

My one special desire is that we find a property with water, and God chose to provide us with 1.5 miles of heritage along the Rockfish River.

We enjoy the river immensely, and it has been our privilege to share this special, clean waterway with family and friends.

We certainly want to continue to be able to do so, as do our neighbors.

Our property is just downstream from Rockfish Ranch.

Any adverse impacts to the river that may be caused by Rockfish Ranch, most likely from the gas, will flow immediately to the Norwoods, and to us, and to everyone else beyond.

With the existing three cabins and 22 more proposed to be built, there could be about 100 gas staying on the property at a given time, and potentially some day gas as well.

Onboard Summer Day, it is not hard to imagine the majority of these people heading to the river, and this will be a curve all summer long.

Concerns for the river related to guest usage and the Rockfish Ranch project in general include the following.

Debris that may accidentally or carelessly be allowed to enter the river.

Erosion due to increased numbers of people entering and exiting the river.

Probable trespassing, as some guests seek to extend their use of the river beyond the boundary of the Rockfish Ranch property, putting in and or taking out on neighboring properties, as well as parking on private property.

The possibility of septic seepage into the river, potential runoff for products that may be used on the property.

Mr. Travis Wilber of Rockfish Ranch took the time to meet with us and several of our neighbors on Sunday evening.

We appreciate his time, his self-reported work to clean up the portion of the river along his property, and his stated commitment to protecting the environment.

However, regardless of his personal efforts, he cannot control the actions as yet.

He may find those who violate appropriate river use protocols, but any damage done will inevitably flow downstream, having little or no lasting impact on the river water arriving at Rockfish Ridge.

While many guests will be respectful, some will not.

It will go home leaving us, the permanent residents, to deal with their mistakes.

It's also worth noting that a 9.75 mile long portion of the Rockfish River further downstream is designated as a Virginia Scenic River.

Any adverse impacts that reach that area would certainly be most unwelcome.

Mr. Chairman, if we could address Mr. Woodson real quick with regards to a Christmas tree in Livingston.

Is that okay?

Mr. Woodson, if you could approach the podium real quick.

Excellent.

So at this time, obviously, you know, the loss of the Christmas tree is a big deal for Lovingston.

You know, it's a landmark in terms of the Christmas parade.

You know, it may not be seen as much of a major gesture, but people do like it.

And that time period during the parade is a place we can celebrate.

And definitely one activity that Lovingston is known for in Nelson County.

This is why I understand, Woodson, you created an LLC at this time.

We were in Christmas College.

Absolutely.

Great.

Beyond that, currently the total amount for the invoice for this tree is, we have an additional $1,500 for our invoice, 10% down, but the remaining balance that we need is $10,776.43.

I think it would be appropriate that the board participate and I hope we could do a healthy amount if not all of it trying to get this Christmas tree because times of the essence Christmas season is coming

And at this time, we are planning on having a Christmas parade.

Yes.

And that's exciting.

And we hope to maintain that and give our folks a sense of normalcy.

That's right.

Yeah.

And the cottage would do a tree lighting ceremony and everyone would enjoy it.

Excellent.

At this time, you know, it is my hope that we could potentially offset those costs to hopefully at least potentially $10,776.

I'm interested in the board's thoughts on moving forward.

It's not planned, it's temporary.

It's artificial, so in the event that, let's say that space didn't work, you can then move it down.

Larry Wells are down there in their blossoms.

They'll always be able to correct mobile things.

How do we plan on storing them?

This is a good one that Kevin is going to be talking about.

The full storage out in Arrington.

I forgot, Pennsylvania Creek can't get one of their shipping containers to store this.

Did you look into the process of having a live tree?

I did.

I reached out to some of the brokers and didn't hear back from them or anything.

But there's a whole lot of upkeep with a tree.

I think one piece of this is in the event you were to plant over there, it's land that could be potentially sold or realized by the bank at some point.

Mr. Chairman, I move that we pass Proclamation P2021-01 on Nelson County Board of Supervisors October is the Domestic Violence Awareness Month.

As it is read, whereas the problem of domestic violence are not confined to any group or groups of people but across all economic, racial, and societal barriers and are supported by societal indifference.

And whereas the crime of domestic violence violates an individual's privacy, dignity, security, and humanity due to systemic use of physical, emotional, sexual, psychological, and economic control and or abuse with the impact of this crime being wide ranging.

and whereas no one person, organization, agency, or community can eliminate domestic violence on their own, we must work together to educate our entire population about what can be done to prevent such violence.

support victims and or survivors and families and increased support for agencies providing services to those community members and whereas the shelter for health emergency has led the way in the county of Nelson in addressing domestic violence by providing 24 hour hotline services to victims and survivors and their families offering support and information and empowering survivors to chart their own course for healing and

Whereas the Shelter for Health and Emergency recognizes an essential service provider during the COVID-19 global pandemic continue to provide services and be a safe haven for victims of domestic violence in the County of Nelson.

And whereas the Shelter for Health and Emergency commemorates its 42nd year of providing unparalleled services to women, children, and men.

who have been victimized by domestic violence.

Now, therefore, be it resolved in recognition of the important work being done by the shelter for health emergency, the Nelson County Board of Supervisors do hereby proclaim the month of October 2021 as Domestic Violence Awareness Month and urge all citizens to actively participate in the elimination of personal and institutional violence against women, children, and men.

Mr. Chairman, that is a motion to approve.

But we need to recommend to the board that within this crisis that we've gotten through as a community nation, that those problems are going to be exacerbated.

And we need to think about ways in which we fulfill what the proclamation says.

I don't have a whole lot to report today.

I would like to report that we've completed the little rusted projects over on City Creek and High Bay.

They've been completed.

We've also had some concerns from citizens about high grass along some of the millions of different spots we've been out doing some spot mowing before we do our fountain cut.

Before we do our fountain mowing in four lanes, which will occur after November 1st, that's kind of when our pollinator restrictions expire and we can cut the entire, right away.

So they are doing some spot morning on that.

Mr. Barton, 655, our traffic study has been completed.

And we are going to be putting out some additional warning signs.

And we also reviewed the guardrail at the time of agreement.

We have some concerns about that.

and as soon as I get the final draft or the final document we'll put those into place.

So hopefully that'll be when I get that signed and sealed study we can get it on the ground.

I have a commitment from my traffic engineers to do those studies on the next three weekends.

We are looking at Route 6.

River Road was one location.

We're looking at Route 6 out in Mountain Road.

We're looking at Route, I mean, excuse me, Route 6 and 151, then 151 and 638 Avon, as well as 151 and 634, and also 151 and 664.

That is good news.

We'll be taking those counts over the next, I think that we're going to go to the next three weekends, so that should capture the increased traffic during, you know, during the fall autumn, big change in season.

It's going to be done locally, so I don't see it taking very long.

It's not like what we do on Big County, you know, our own county mine counts, and they have to be processed, they have to be generated.

We have a consultant firm that does that, of course.

I don't see this taking a big long drawn out.

Mr. Hillel made a mention to me in our conversation about some

Rockfish River Elementary which is down there in 151 Way and then over here at the high school.

There may be some on the back side where they are able to see dogs in other lights.

But Mrs. Boyer, if you know, I brought you, I called again this weekend to another truck and come up with an underpass under the railroad by the Tijerwood Bridge.

And they had to turn around.

It got outlawed again.

But they were able to turn around.

In the previous time, the police had to shut up.

The Sheriff's Department had shut up.

They had to get two records.

Now, I looked at that sign.

You have a sign.

I can't imagine a trucker coming through the back road from Gladstone, sees that sign, which alerts you 11 foot, whatever.

There was some way to alert a truck driver to see the sign of something.

Because it happens every once in a while, at least.

They can go if they can't get them.

But they have a sign.

They don't see it for some reason.

They don't do it twice.

There's a sign on it.

You know the truck's coming off 29.

No, truck's coming off 60.

Yeah, they miss it.

There's a sign of intersection of 6th and Cairo Road.

But I mean, I think I asked them to look at this again and they really, our traffic engineer, really didn't make any recommendations.

But, you know, you tell them it's still happening, so I'll take that word.

Don't doubt that.

Before I sat in this chair, I always thought that the VDOT part was more part of the Board of Supervisors meeting.

It's not anything at all.

I'm not looking for consensus on that.

So on Adile Road, I have two things that have come up recently that have been just building.

And with the increased traffic, there's two things.

One, where Lakeside comes into Adile Road, which is kind of midway between the two 25 mile an hour curves,

is a school bus pickup and that school bus pickup is, I understand there's 10 students that use that daily to get on and off the buses and what happens I believe is that as soon as people go through the 25 mile an hour curve they accelerate and of course they're accelerating right across the front of Lakeside where there has been some

Major concerns by the parents who have their kids there getting on and off.

I don't know if keeping a 25 mile an hour speed limit to there is a solution.

I don't know if having a bus stop sign is a solution.

But that's not within the existing 25 mile per hour speed limit.

The only real 25 mile per hour speed limit is that brief residential area just before you come in.

I would say yes but I think you'd have to

They come up from Lakeside and there's families that live in that little development and they're coming up that they have to get on.

The bus can't go down into Lakeside, they have to pick up on Adile.

So that's one thing that I would really like you to look at.

The other thing is that where Adile comes into

The site line, if you're on Adal Road, you want to turn south on 151, Giuseppe has landscaping in front, which

I don't know if we have any control over that, but the speed limit going through Nellysford, I believe, is 45.

Yeah, and that might not be sufficient to, I almost got lunched on that over the weekend.

I don't know, I wouldn't count on that, but I'll look at it.

One thing I've noticed, and I've got another issue in another county, I don't think there's a stop-all right there at that intersection.

There's no stop-all right there.

A lot of times if there's no stop bar there, people don't really know how far to pull out toward the main line.

I don't believe there is.

If there's not a stop bar there, what I see a lot is lawyers do not get close enough to the end of your traveling because they're afraid they're going to be sticking out.

into the traveling and the intersecting highway.

So you maybe need to watch it, need to look at traffic and see how far people are pulling up, pulling up to the intersection.

Because if you stay back too far, you're not going to see it because it's always, you know, most times it's always up to the block to get out of sight, but if

It may not even be that, Jim.

I appreciate that.

I got one other thing, and this is

Serenity Ridge, which is located in the Drumheller off of River Road.

They're a retreat center and they host people all over the world who come in to spend time there.

And they have a couple of pretty large potholes that appear to be VDOT

I'm under your purview that are up there.

And so when you come to the entrance, the first thing you see at the entrance are the duvet potholes.

It would be great to.

It's at the end of Drumheller, which is up on the bridge top right there at the entrance to Serenity Ridge Retreat Center.

So you can just check that out as well.

They're trying to gear up for a big season and they want to be both safe and quick looking.

And then finally, the improvements that you did at Huffman and the Hollow where Davis Creek passes through there and there was problems with the culvert and the drainage and stuff like that.

The folks that contacted me about that said that the crews have been out there religiously clearing things and with all the rains we've had, the big rains, it's been really wonderful and wonderful to see them out there and they wanted me to express their gratitude

The work that you have done on that.

I didn't really introduce this very well.

Susan Rorrer is not yelled today, so she's filling in for us.

The Information Systems Department staff, Susan, Andrea Craig, Rachel Arthur, and Rachel are both here.

The county's census data to include the prisoner populations Susan reported on last month.

And her report, before it's packed, it notes the population range that each district must be, which is between 28-42 and 31-03.

So that report shows any necessary judgments

And Central District is going one out of that range.

What Susan previously presented to the board is moving the Central District

over into this area of the east, just across the road there at 29,151 to make an adjustment.

But this map is option two, which does a few more re-alignments.

This area that's not currently in the north district would be revised to incorporate that area into the north district.

I think we're still thinking about moving people across the road here.

And it's hard to discern, but here, I think there's three other locations that move population from the south into the east.

So then here is where scenario two balances the population more so than the first option that was presented.

We can give the board this map.

Ms. Britt has taught me that the state's commission missed every meeting given by her.

So we're not sure yet when the board has to finish the local redistricting plan, but this is sort of where the staff is at this point.

We assume by end of November or sometime in December.

I don't think we really need to even out anybody.

which is Ernie.

Well, as Susan pointed out last time, I'm going to read this for you.

Yeah, and potentially also look at the Afton scenario.

I mean, I don't really see it.

Skip doesn't need to have anything happen to his.

The West District really doesn't need to really cross the road.

Let's just focus on Ernie's is my suggestion.

I think that's generally kind of what we want to do and it's whether it's taking, give us some Tommy, give us some to me.

It's always in the ethnic census.

Steve, where do you think the fifth district came up?

Well, you said fifth.

OK.

I don't think there's two.

Yeah, that pink area is the central district if that's what you're asking about the fifth.

You said that green up at the end is actually two districts.

The center section.

This section you get right here.

You don't see the divided line very well.

That may be it right here.

Well, as you can see right here at the table, more equally balances that 5% requirement that each district has to be within.

What the IT information staff proposed, as I continue to reiterate,

Seemingly the simplest thing is just to move 120 people from the west side of 29 over to the east side of 29 in Woodsville.

And then sort of you're still within the 5% range in each district and not that many people affected.

I wasn't saying that.

I don't, you know, outside of the numbers and outside of where you draw the lines and where the little, you know, census blocks are, you know, I don't see anything about either proposal that's specifically, you know, contentious or bill breaker or anything like that.

This is that little red section is I think the scenario that would be more in concert with keeping the populations more equal.

Where is it at?

Yeah, we'd have to look.

There's Barry Hill Road, and Ford's Place.

Well, it must be all over the nose then.

I think about 120 or so people have to go somewhere.

Is there a change necessary in the work district?

I haven't heard, I brought this up with some citizens that aren't usually proactive about the same thing.

No, because this triggers, the deadline triggers another 14 days, not just if they have to see the airport or the structures, but also the congressional maps are due on Monday, October 25th, so all of those things have to happen, and then there are things

But as Steve said, it looks like that we are going to be all in one in-house district.

And from what I'm looking at at the seventh district, that's the same.

The only thing that I want to mention in that is in looking at the maps, we're not in the 20th, we're not in the 59th anymore.

They're completely redrawing the maps, so our district's numbers will change.

Yeah, I failed to mention that.

For us to be at one cohesive one would actually be good for us.

Susan is ill today and so I'm sort of substituting for her and I'll just make reference to her memo and support.

I think because this subject was on the September agenda it was carried forward tonight.

the board's radio expert to be here today and share his input with their board.

So, from last month to this month, Susan actually was contacted by another vendor representative, so we concluded that proposal within the information Susan's reported on on this subject, using that consideration that we could purchase Ken Wood, Randy Eddins, rather than both of us.

So Susan's memo outlines the total cost and then she breaks it down by subgroups such as the cost for the sheriff's department locals and portables only, fire department, rescued, and then the government services, schools and services authority.

The grand total, including installation charges, just for chair fire and rescue, was 800, with motor roll as a discount, was $844,249.02.

And then, as I noted, there's an alternative from Kenwood, which

may not be the exact name of the company, but those are the radios that also is set out by service, Sheriff Fire Rescue, and the combination of those three, Sheriff Fire Rescue, with the discount that Kenwood provides, just below

As you'll note, the staff's recommendation is not to consider the motor roller radios, excuse me, the human radios, but we have a motor roller system and if the board decides to go forward with any of this, maintaining the consistency of the open network seems to be a viable consideration.

Is all your stuff working?

Not at all.

That already is work, but what is happening is over a period of time we've added new positions.

We just received two new positions from the state and then we still have some vacancies, well new vacancies for SRO positions.

And whenever we get up to a level of filling all those vacancies, we have no radios.

So we would have to buy new radios for those positions that would be granted.

I don't know of there being anything better than what we have other than the updated models on the motorola.

I mean it's just like in-car systems whether it's

I have to look at the memo here, but I believe Susan's memo that she knows that the motor relative radios have more functionality than the kidney radios.

Yeah, we're not aware, at least in my office, that there was a concern with them.

It was worth the surface concern.

All that stuff is no big deal.

So one of the other things that we have noticed is in the past like when we have you know collaboration with other agencies is being able to program our radios where we can communicate.

For instance when we were with Skyline Task Force they had Motorola radios but they had a different model and there was no way to communicate with them.

So that was another thing that I remember from years ago and I think because we had an older model

That would only be whether they were happy, we were happy, and they were low-band or something.

A lot of that stuff can be worked in.

I think we've been off with somebody who comes up from there or whatever and makes sure we get things programmed while they probably have the capability of doing that.

There are two representatives clear in the back before we have some questions for them.

These radios is the citizen's report paperless in and the written report seemingly don't have an end of life at this point.

And she says, there's no product in the pipeline to replace the radios the board's considering.

They have five years to support once the end of life is announced.

So the problem we ran into before is once the radios were purchased, the radio, overall radio project, it was two to three years before those radios came into service.

And then five years later, so they're out of service.

They're not being manufactured.

For any of the women who have been here with Rodney, the thing that gets me is you start a project, it takes two or three years to get it done, and then by the time you get them into use, you have a lot of things.

So if the board's consideration was just for the sheriff's department, that cost, it's set out in the memo, it's $100,000, $10.40 plus the expense of programming, installation, and that consumes the report as combined with fire and rescue.

It should be less than 46,000.

Just over 46,000 is what she's documenting.

I would say about 200,000.

There were some of the last vehicles that we, that you all purchased.

We didn't notice at the time, but that becomes one of the issues with the center console areas.

We look at this as a potential use of the ARP moneys but in terms of discussions we just thought if the board is agreeable to it and just take the $5,000 out of the contingency the board will be able to request and just maintain the balance of the federal funding for now.

I'm trying to share with the department compensation, the bonuses, and compensatory time and holiday approvals.

The state compensation boards authorize the use of their state ARPA funding for reimbursement of a one-time $3,000 bonus.

plus the associated FICA costs of $230 for all occupied sworn hotboard positions at the time the bonus is paid.

That would be at a cost of $3,230 each.

The bonus must be paid in later than November 30th, 2021.

There are 15 sworn hotboard positions anticipated to receive the bonus as of October 2021 at an expense and reimbursement of $48,450.

And how this works is the county would receive reimbursement from the state comp board once the expense has been certified by the sheriff's department and the county to the comp board.

And then these sworn comp board positions that are occupied for less than 231 hours at the time the bonus is paid would be reimbursed once that threshold is met.

And that should be, let's say the bonus was paid in October, that would be in November for sure.

In concert with that, staff is proposing a bonus for the locally funded sworn deputy positions.

The county locally funds 10 full-time and two part-time sworn deputy positions currently.

As of October 2021, there are seven full-time and two part-time of these locally funded positions.

The local cost estimate includes one full-time deputy that is currently occupying a non-sworn position in the comp board and is not eligible for the comp board reimbursement.

So we're proposing an equal one-time bonus of $3,000 for locally funded full-time deputies and $1,500 for part-time deputies.

The total local cost of the proposed bonus is $29,070 and you can see the breakdown there of $25,840 for full-time and $3,230 for part-time.

So at the October 2021 staffing levels, estimated total cost of the bonuses is $77,520.

This includes the bonus plus any associated FICA costs.

Our anticipated comp board reimbursement would be $48,450, bringing the anticipated local cost to $29,070.

We are proposing to use $34,624 in estimated vacancy savings from

The second part of this proposal has to do with paying out comp time and holiday accrual for Sheriff's Department staff.

And those will be as of October 1, 2021.

And this would provide the department with a clean slate going forward following implementation of paid overtime and holiday hours as of July 1, 2021.

The total comp time and holiday hours are estimated at 1527.6 with an estimated cost of $31,990 including the FICA tax.

We are proposing to use the current overtime balance of $21,282, September vacancy savings balance of $5,554, and other benefit savings in addition to the FICA tax of $5,154 within the current Sheriff's Department budget to cover this cost.

So this shows the breakdown of the local funding sources.

We have the available overtime balance and vacancy savings from July to September.

of $55,906 and available benefit savings in addition to the FICA tax of $5,154 for a total of $61,060.

And you can see this covers the estimated bonus of $29,070 and then the comp time and holiday accrual payout of $31,990.

Staff also proposes to use expected additional vacancy savings within the department beyond these uses for future overtime and holiday pay costs as needed for the remainder of the fiscal year.

At current staff levels, the estimated vacancy savings of salary and FICA tax as of October 31st is anticipated to be $24,609.

So none of these would be recurring costs.

Correct.

We will be using existing funds within the Sheriff's Department budget.

I think one of the higher premises of mine is that this would be potentially a recurring cause.

Our premise right now, as can be reported, is it's covering holiday overtime costs.

As we move forward, the Board approves what we presented today with continued vacancy savings.

The Sheriff's Department right now has six vacant positions.

So as long as

We have initial vacancy savings.

We carry this forward month to month.

We get to the point where there's no more available vacancy savings or other funds to cover all the overtime.

Ward, to say you want to pay budget additional funds to go forward for the fiscal year.

Then in the spring, when we present the budget, we would likely include additional funding to pay for holiday and overtime in fiscal year 23.

What happens with the Sheriff's Department is it's not unique to our department.

When someone's off, the department's not.

They'll see you in staffing.

If they have any vacancies, they're given contact out to the person who's covered, to the person who's off.

So what happens is we just continue to accrue compensatory time that's sort of a vicious cycle for the sheriff this way and really proving that obligation for the sheriff on the floor.

And people get paid for the moment they're

But at this point, I think we can cover these costs going forward with vacancy savings.

And we're able to do these things to pay because of vacancies.

Sadly, in the time that we're in, I just heard local agents in Lynchburg, for instance.

For courthouse security staff, the entry level is about 35, 35 once we're in that range.

They recruit one to the academy.

So for instance, if you're a college graduate, a lot of times we recruit college graduates, criminal justice degree.

The county years ago, I think, matched the entry-level salaries here.

And they pay a little bit more because of like college degrees and stuff like that.

They get a stipend.

Are women looking to be employed in this situation?

We've actually had an increase, I guess, since I took office, I would say, in attracting

I'd say more females since I worked here in the mid-2000s.

Is that part, you know, I say it, that's how a team, that's how you do it, right?

I would like to add in terms of salary, the 37 and 39 are entry level with no experience.

That's through use of accounting supplements.

Who is primarily responsible for the retreat?

We try our best.

This deal was carried forward from September, September meeting, as I reported during the September meeting, and meetings with Amherst County that we've had had requested architectural partners to begin to submit this proposal, which is very comprehensive about the potential development

And what the facility would entail if it were to be assigned a dilation center.

So it's a multifaceted and very comprehensive preliminary architectural feasibility report that architecture partners will complete that gives certain profit as their

Engineering, and some consultant for the site assessment.

The cost is just below $60,000.

Yeah, I mean, you know, it's hard to vote on something where we don't have all the facts and one of the things we thought was very prudent was to find all the facts and that's why feasibility says it's being done.

That's more than half of what they have.

One of the things that I would really like to clarify is that whatever revenues come forward in this project, which ones are providing benefits to

to us in equal share or in whatever share except then to what's going to be happening in Amherst.

The Chatham facility, which I really wanted to go down to visit, but I'm going to set up a time to go down and visit someone or someone to share with me around.

The terra firma for that is recurring revenue from businesses that are there.

These are all going to be businesses that are going to be enamored.

They're going to be primarily providing services to enamored counties.

The equity in that for benefits for our county become really marginalized.

The things that this could be that would be beneficial to our county will question that they would be beneficial, but the costs are not going to be shared equally and the benefits are not going to be shared equally.

The costs on paper may be, but to, you know, to, for the county to undertake a development in Amherst County just seems

Not just about ideas, so.

I'm certainly not opposed to exploring the possibility of us doing our own thing.

I think at this point we've gotten to the point where we need to have the answers to the questions we've been asking on this facility.

I want to clarify a comment, Mr. Reed, that we've addressed several times and you brought it up again just now so I'm a little confused but you said that Amherst was not willing to locate a similar facility in Nelson and that is not true.

It has been addressed more than once in meetings with that committee that that is the case, that they would not consider a location in Nelson County.

But there have been discussions about other properties if this one didn't work out, and if they were in Nelson, then absolutely.

So I think I have an email from you that contradicts that.

Absolutely, you do.

The average board is not against doing something to Nelson.

I'm very aware of the divide of the awards.

It's difficult for me to speak as quickly as I want to.

Mr. Farr is right.

The representatives said if there was a property in Nelson that would work, they'd be open to it.

The problem is there's not necessarily a property in Nelson right across the river that they would agree to.

That was what I heard at the meeting.

And if I may, the board knows I'm not really supportive of this project because my expectation is at the end of the day, someone's going to have to pay for it.

And I don't see this committee paying for it.

It's going to be the two counties would be my guess at this point.

The study will tell you how much it's going to cost.

What concerns me is that the last meeting I asked the county administrator, he asked me about our business partner project.

And I said, would you be interested in Amherst working with Nelson to be a part of our project?

Because a regional project, such as our business partner, would get more Go Virginia money if we get to that point.

The answer was absolutely not.

So, do we partner with them when they don't want to partner with us?

I don't know.

I just think, and I certainly can be proven wrong, at the end of the day, the expectation is going to be for the two counties to pay for this thing.

Because I don't see otherwise when the county administrator said, and Amherst said, this could take 10 or 12 years, but that may be what is required if the two counties don't pay for it.

Also, there is an invitation.

what that facility looks like.

And in fairness, at the meeting that I've attended, when the question about local taxes, if there are businesses to be located in this facility, in this complex, the Amherst reps have said that either

The revenues, tax returns should be reinvested into the facility or shared between the two towns.

The two members of the board, supervisors and analysts, have been very, you know, not unbalanced.

I certainly want to say that in all fairness.

I just have concerns that at the end of the day, there's going to be an expectation.

I mean, sorry, the county administrator basically strongly suggested that to you, but he won't go on record saying that.

So I've updated the Coronavirus as of the 12th, which is the most recent, 12th of this month, Department of Health data for Nelson County.

We only had three new cases as of the 12th, and our seven-day average was five cases.

So looking at the

The chart for Nelson on the Department of Health's website would seem to be declining as far as the number of cases, but it can pop up at any given day.

September 16th thereabouts was 16 cases.

Calm down has popped up to 11, and we'll go down to five or seven, we'll pop back up.

But the trend right now is decreasing, so hopefully that continues to be the trend.

Nelson is still visited as, under the health department and CDC guidance, as an area of high transmission.

So the recommendation is to wear a mask in indoor or public settings even for individuals who are not vaccinated.

To wear a mask indoors in public settings is for anyone.

For individuals who are not vaccinated, the guidance is to wear a mask in practice, social distancing in all indoor settings and in crowded outdoor settings.

We're still maintaining somewhat of an honor system here where people can

The American Rescue Plan, we're still looking at uses of the funding, some considerations, which was discussed today.

I know the role of radio purchase, potentially purchasing two ambulances, which we discussed with the pay program.

One now, one maybe in the spring.

We haven't vetted this yet, but the funding to be used for tourism program and then one of the things we're really looking at is with the recreation project is the potential use of the funding for purchase of the land and maybe some of the development of the park.

We sent an inquiry to the Federal Department Treasury about that potential use because the guidance says you can use the funding if you're a qualified census tract.

Well, our tracts are eligible, but they're not established as qualified census tracts because the demographics and other jurisdictions within our region are worse than ours, I guess, is the way I would think.

So Kinsley, since we're eligible, you could do it.

The recreation department project is determined by the board.

If you're really good at having you can use the money.

The question is, would that be questioned or not?

with the abundance of funding out in that country.

And it's probably doubtful.

And I'll note this in a few minutes about the status of the regulation project.

But that would be a very viable consideration if the board was open to that.

And back to the virus status, we're waiting on the issues of federal regulations.

This is an executive order that employers with more than 100 employees are going to be required that all their employees be vaccinated or be tested weekly and that regulation from OSHA is going to be forthcoming pretty soon is our understanding.

So we'll have to deal with that.

Piney River Water System, two subjects.

The consent order for DEQ is about to be exempted, excuse me, for the health department.

The GA system is working very effectively, so the department has taken, has recognized that

And secondly, we're still working on that East End Co. Palm Station, but we're just about around the corner.

Just a couple of installations that will return the station to the way it's supposed to operate completely.

The comp plan, the request for proposals was advertised in the local newspaper on October 7th, and proposals were due by 2 p.m. on November 5th.

So that's in process.

The food reads total, I have a correction, we realized there are 100 plus visitors on September 25th, which was done in less than an electronic list.

Even for me, that's somewhere else in the mountain to realize.

The County Code of Ordinance is the draft Transient Oxygen Tax Amendment and the cigarette tax to actually enact the tax.

We're deferring to the Board's November meeting, so we'll have those public hearings advertised and those two ordinance considerations will be on the November agenda.

Solid Waste and Recycling, DEQ staff inspected the transfer station on September 8th and received a letter dated October 6th, low findings of deficiencies.

and then most recently, county staff, and this is something Mr. Reed assisted with, has been assisting with, we had a discussion with an engineer from UVA and the director of the Urbana-Salem Waste Authority about resuming glass recycling.

So what we can do now, and we're working on this, but it's more difficult than I thought it would be,

The Rabanna site, which is on Dick Rhodes Road in Albemarle, will accept glass regardless of the source for Nelson County.

At this point, at no expense to the county or its businesses.

They know that that can change in the future.

So one of the things I think we're going to do is notify our businesses that they can take the glass themselves there while we're working on a solution for the county because the issue we have is where particularly our residential collection sites are set up

The way they're operating, they're spare pads that can be used for glass, but the transfer trucks use those spare pads when they take an empty container.

They put it down on the spare to then get the full one.

They put it down, I think, on another spare, pick up the empty and put it in here, so we don't really have an extra pad to do that glass, so that's a challenge to

I think that's what we're going to do.

Future, there's an entity in North Carolina that's accepting this glass from Havana, and so is this a matter of can we work it out or not to put a glass or stocking back in place?

Another challenge is we have to buy new containers, which are about $8,000 each, $8,000 to $10,000, so we're not, the door's open, we don't have all the bugs that worked out yet.

The PAIMS is where we receive a proposal from MPOA to expand the program.

It would add about three permanent full-time staff, and it costs about $250,000.

But we're looking at that to determine if it's really necessary to add those three additional personnel to expand the program.

So we'll report back on that.

There's an internal analysis we can do to see not only the call volume, but who's answering the calls.

And we're pretty confident that about 97 plus percent of the calls are being

Current initiatives, the recreation project, we had our second team meeting by Zoom on October 1st.

We haven't had one this kind of variety scheduled and not confirmed yet.

The business part of that meeting also was by Zoom on 10-1, and it's moved along very well, but they're not as far along as the Rec Center projects.

What I see is a work session maybe towards the end of November thereabouts to look at both projects, because we should have both studies done and the information

Building Assessment just to note that to the board again added that there was a joint CIP committee meeting with the school division and we shared that information with the board I think last week about the school division's information which is pretty substantial

The two Lovingston and Gladstone TAP applications were submitted by the friendly district commission by the October 1st deadline.

We have a firefly report that was sent down to the board that was considered by the broadband authority today.

And lastly, the county had an appeal of a notice of violation

Since the board lists projects, that's a historic consideration for the future board meeting or during the budget.

And the list is expanded, I think that Mr. Martin had seen previously that they mentioned this, but I didn't see the cost estimate.

And no county staff were able to attend the meeting.

But I think one of the principals from architecture partners was at the meeting and went over the list.

And one of the things was a major renovation of the high school, two options, one was just letting

And there were several other multi-million dollar projects.

For example, the placement of the vulcanized roof over the high school miniscule was about four and a half million dollars plus.

So something that could be challenging.

They have a significant amount of federal funding, but I'm not sure exactly how they're going to use all this funds.

But they could use it for infrastructure.

And the state has, as far as I understand, but we haven't seen it yet, from their federal ARP funds, they may have a significant program for school

The care spending in the schools, I've learned recently that the loss of learning of the students of this country from far greater than what's anticipated with virtual learning, and that we have a number of third graders throughout the country, and in this

I think that it's going to end up being significantly more to try to catch the children up to where they should be all the way through.

I see that in Iverson High School today.

One of the primary things we dealt with was teaching the children to write.

and these were juniors, and by the time you're a junior, you should be able to do that.

And I tell you, you probably didn't deny me, but however, that's something that's critical for our children.

Yeah, but you talk about capital expenditures.

So that'll be the challenge.

I don't recall the total number, but their capital items that were presented in the last committee meeting probably exceeded, look at the big picture, 30 to 40 million dollars.

Dealing with foster care, which is one of the things we've talked about.

Darlene mentioned that she is aware that there are grants that are available to help communities find foster care.

Now, they're not long-term things where they hire somebody.

A year or two, you can get a grant.

Now, I know that probably that would be the responsibility of social service to make you aware of that.

But Darlene was saying that all of the stuff comes into the county administrator's office.

And if you could, you know, about grants and foster care, particularly on foster care, you should be aware of that.

Keep an eye out for it.

We don't have any foster care.

We have three foster care variants of families, I think, in Nelson County.

Everything's just about to shut down.

And, you know, this is an issue that's come up constantly.

Mr. Carter mentioned the capital improvement planning meeting that we have at the school and he boarded the presentation to every one of the architectural partners presented to share with us that evening.

Two big things right now that are the top priority for both it seemed Jesse was at the meeting as well and we all agreed that the roof replacement

Pascua Noseful, and the brick remediation are two things that need to happen.

The brick on the vocational wing, the addition from the 70s, those ties rustle away and the brick is going to fall off the building if we don't do something

That's about a $830,000 project if we did it this year, $850,000 next year.

So that's something that needs to be done.

And the roof replacement is about, like Steve said just now, about a $4,750,000 project.

But those are two maintenance issues that need to be addressed.

And then they also have some dreams of updating the high school

Because when the middle school project was done, basically all the old high school got was a little bit of lipstick, and that's about it.

And they were going in, looking at a couple of different options.

One being much less expensive, where they just do minimal finish work.

And then going in and doing major renovation work at the high school.

That is where do the kids go to school when this project is being done?

And then that brings in more expensive trailers or something temporary for them to do.

And this was all around a bigger conversation of is it worth, do we do renovations to the existing structure or do they look at building a new high school facility and then maybe using that facility for something else?

Mr. Barton and I participated in the Lark Intendence Group, and it was really informative, went forward, it was really good.

I'm real happy with the scope of work.

They're all loving hands.

The Planning Commission is taking quite a hard look at what we have right now in terms of zoning for vacation homes, short term rentals and such.

I went through and discovered that in the last

For four months, we have had 32 applications for business licenses that have to do only with vacation homes, Airbnbs, or short-term rentals.

Work and everything else, obviously.

We've had 18 in the last two months.

That's a trend that looks like it's actually accelerating, if you want to look at the last one.

So it's a concern for the Planning Commission.

I believe that they're looking to take a look at this before the comp plan goes.

The first order of business are public comments.

These are matters that are not being covered by the hearings that are followed.

I'm going to go ahead and read the protocol for public comment procedures.

The chair, myself, I will call the speakers up from the sign-up sheet.

Try to speak clearly.

Once the comment period is closed, no further comments will be taken.

In order to accommodate all people wishing to speak, individual speakers are asked to keep their comments to three minutes or less.

And so what I'd like to talk about is, in general terms, the direction of the county and things I think we need to be really concerned about, and things that I see also represent an opportunity for the county as well.

And I'm especially concerned, as is probably no secret, about large resort-type, event space-type developments that put the significant demands on residential neighborhoods.

and what is the benefit to the county for such a situation.

And we could claim a short-term benefit perhaps with some tax money and some temporary jobs for construction and so forth.

But I think we have to look further down the road because we also know that young people are leaving the county in record numbers.

We're already seeing, for example, diminished enrollment in our elementary schools.

And that's going to propagate itself right on through the pathway.

If we develop things like this and put in these net spaces and so forth, what are we going to tell our children is the reason to stay in Nelson County?

Are we going to tell them, gee, if you aspire to get really good grades in school, perhaps you can stay in Nelson County and become a housekeeper.

Or maybe if you're really good, you could become a wait stick or a line server.

And is that the future we want for our children?

Now I think we've got some opportunities that we can exploit and I think we need to look further than what's going to happen next year or two years from now.

So, for example, let's think about what we've got.

We've got excellent transportation to be around 29.

We're within less than an hour of two well-serviced airports.

We've got the best internet, perhaps, in the whole state, right here in Nelson County.

I know that my internet at home is literally three times faster than the internet I have at UVA, which is pretty amazing.

So what can we do with that?

And I think what we can do is encourage children to stay in the county.

and to have opportunities for much, much better employment and much, much better opportunity is to encourage small, high-tech operations that require almost nothing in the way of infrastructure, either in roads or power or anything else and need not much space and frequently be developed in existing buildings and even houses.

and can provide really strong high-tech employment but diversifies straight through the county.

And I think that that is a real pathway for our course.

We have everything right here that those people need including natural beauty and a peaceful way of life.

It would be very attractive.

We also have locally good resources at UVA through the engineering school.

Virginia Tech is not too far down the road and also provides good resources to help people develop these small high-tech operations and I think that's a real pathway forward that we need to look at very carefully and to look at not encouraging these large event spaces and things like that.

I don't think that's productive.

For the community, it's not productive for the residents, and I think that it is a bad pathway to take.

This is a request to rezone property from B1 conditional to R1 residential with a concurrent special use permit request to allow two vacation houses.

This was heard by the Planning Commission, Public Hearing was held on September 22nd.

The property is located at 161 Avon Road in the North District and is 1.19 acres.

Applicant is Scott Kohler, also owned by Scott Kohler is the LLC, 161 Avon Road.

The property is currently split zone, it's this little blue box here.

So the yellow is going to be R1 and this little strip of B1 is the B1 conditional.

So the southern portion contains one dwelling and accessory structure in zone number one and the northern strip containing another structure is zone B1 conditional.

Resoning number 98 was granted in 1988.

That resumed that northern strip to B1 with the condition that any rights and uses provided for under B1 zoning, other than those allowing operation of an auto body repair shop, are not permitted.

There was a rezoning application in 2016 that did not come to fruition when our contract purchaser of the property was requesting to rezone from B1 conditional to B1 to allow manufacturing use.

The GIS site does not distinguish between B1 and B1 conditional.

According to the applicant, the previous owner was utilizing the structure as their primary residence.

It's unclear when the structure was converted to the dwelling use.

In discussions with the current owner, staff recommended the proposed rezoning to R1 to align the zoning designation with that of the adjoining properties with the concurrent special use permit to allow both structures to utilize as vacation houses.

At their meeting on September 22nd, a planning commission voted five to zero to recommend approval of the rezoning and special use permit.

There were no speakers at that public hearing.

There is residential and agricultural nature.

It's located along an adjacent corridor containing commercial uses.

Zoning obscenities are 1 and A1.

Also, this property up here was rezoned to A1 last year.

That's not been updated on GIS, but that's the Wildman Dam den and breakfast and farm brewery location.

The property is accessed by an entrance on A1 Road.

They're working with VDOT to determine what modifications would be required

They're going to do two entrances, one for each house or one entrance for both.

The applicant will be required to receive a certificate of occupancy from the building inspections department for the structure that was previously utilized for auto repair.

There's also contingent upon review by the health department who's also reviewing the system right now.

Property is located in an area designated rural residential in the future land use map, which would allow low density residential, compatible non-residential uses

and rural areas where agriculture is not the predominant use.

These sites are adjacent to identified development areas and adjacent to existing institutional or small scale industrial uses.

And then up there before you are both the factors for rezoning practice as well as the factors for special use permits.

So for rezoning, we're going to look at good zoning practice, public necessity, general welfare, and convenience.

For special use permits, we're going to look at the use not changing the character and established pattern of development as a community, the use being in harmony with other permitted by-right uses in the zoning district, shall not adversely affect the use of neighboring property, shall be adequately served by public or private water and sewer facilities, and it shall not result in destruction, loss, or damage of any future

And I'll add that with this acreage, this isn't something that we could allow new dwellings on.

It's because the structures are existing non-conforming structures.
