Okay, we have the ordinance that we need to discuss, and we need to make a recommendation for either approval or denial.

Well, we have a public hearing first, and so we'll speak to Ordinance 0-2025-3, the amendment to the Appendix A zoning, Article 10 for the general footprint.

FEMA is a federal agency that administers the National Flood Insurance Program, or the NFIP, and they create the maps for regulatory purposes.

State agencies such as DCR, the Department of Conservation and Recreation, are responsible for guiding and providing technical assistance with floodplain administration to localities, and the locality is ultimately responsible to administer its floodplain ordinance and compliance with FEMA regulations.

Our current effective flood maps are dated June 10, 2010.

The latest flood insurance rate maps or firms have been finalized for Nelson County by FEMA.

They are due to be effective on August 5, 2025.

This involved years of data compilation studies and community meetings facilitated by FEMA.

In order to remain active in the NFIP, localities required to amend, update,

Its floodplain ordinance and submit the adopted ordinance to DCR for review at least 30 days prior to the effective date.

Our current floodplain ordinance was amended in 2017.

It was sent to DCR for a compliance review.

Only minor changes were required, including replacement of definitions for post-firm, free-firm, and new construction, and updating references to the upcoming effective date.

Upon adoption, the ordinance will be sent back to DCR and FEMA for final review and acceptance.

So this will be a joint public hearing.

And we are required by state code also to notify all property owners where the floodplain is changing.

So we've had our GIS overlay those and put together a list and we're doing a mass mail out to comply with those requirements as well.
