And I'm here to let you know that there are many of us out here that are hoping that the thoughts of swimming pools and baseball fields might be put aside for a while.

Because of the fact there's so many unknown spaces now, especially economically,

And that was an excellent man who spoke about water last time.

He did a great job and it's obvious that would be a heavy requirement on water which is becoming more and more precious.

We're very blessed to have a lot of water here, good well water in Nelson County.

And then after we saved all that time and money and energy, maybe the county would somehow investigate what happened during the COVID story.

Because as far as my research goes, which is quite vast and deep, we put our children through a real bad, bad experience.

And it was completely unnecessary.

They were not at risk of dying.

The world wasn't going to come down upon them.

I'm Michelle Regine, living at 2620 River Road in Farber.

Okay, I have a very simple one-line query, and this refers

So by July 10th, the governor mentioned that from July 10th on that the counties could set the speed limits for our local roads.

And I live on Route 6, which has a 55 mile speed limit.

Most people traveling on Route 6 from 29 to 151 go way above that.

So it's one thing if I'm driving the speed limit.

God forbid I'm driving five minutes, not five minutes, five miles an hour below, if there's a turn or something's about to cross the road.

I'm putting myself in danger.

And I've spoken to Ernie, who's my supervisor, about this, not only on my road, but also on 151.

You know, to kind of reexamine the speed limits over there, especially where you have businesses such as Nellysford, I think that should be 35 miles an hour, where cars are going in and out, where Ashley's is, to have that slower, and where you have commercial areas generally because you have traffic and very, very much so when you have Blue Mountain, what is that, the restaurant, whatever,

And that's about it.

And I've just basically given you a one-liner that you can read.

The request for the board to RFP to Blue Line Solutions and helping them to get that speed control and this goes on with the cable reinforcement now.

I think we'd skip off the board and that's good.

We probably tilted back the other way.

And if Tommy was here, I believe he would go on with it too if he knew that really there was no way the county could lose any money with the deal.

And as I did, I didn't even want to say if that money could be earmarked to the school system, there wouldn't be a question about whether they were trying to make money off of it if we had dedicated that money to the school.

Second item on my agenda is that we get VDOT to look at the

and Mark Street, 29 in Cali Hill.

Get it on the North Trail or six year plan.

There's some good ideas there.

I think that, I know we've already made a resolution to reduce the fatalities and accidents by 50%.

So very ambitious goal like that, and I think that would be a long way towards it.

At least that we got that sort of a long-range plan.

Third thing on the agenda, there was at least three.

I don't have a whole lot to report today.

Just want to talk a little bit about the storm we had last week and the repairs that are still ongoing.

We had two roads closed yesterday.

One of them was Mill Pond, and that road was reopened yesterday afternoon.

We have one more road that's closed today, and that is Route 645 Carter Road.

That bridge on that road sustains some damage.

As my understanding, that is being finished today, and we anticipate opening that road here this afternoon if it hasn't already been done.

We do have quite a bit of

Washouts, erosion, clogged pipes, pipes that were uncovered.

We are working our way through those now.

And most of the area was up around Schuyler, north of Windshine, up towards Schuyler, kind of up to Rockfish River, Water Basin.

So even across 29, it was a pretty heavy rain up there on Hickory Creek and all up through there.

So we do have crews from

Campbell County, Appomattox County, and Amherst County all working up in that area.

So I think we'll get those roads back in shape pretty quick.

That is about all I have to say.

We are going to depend on cutting the two-lane primaries.

They should be mowing them now.

It's our intention to mow the four lanes.

and have that completed before Labor Day or before the holiday.

I don't know if the learner pickup contractor has finished up here or not, but he should have finished up here in the last week or so.

So those are some things that are going on.

And I heard one comment about the speed limit, the legislation.

And I will be sending the board

through Ms. McGarry, some information on the legislation that was passed that allowed localities to reduce speed limits.

One thing that's a misconception, it is for a locale to reduce the speed limit, it has to be on a road that's already posted with a 25 mile per hour speed limit.

It's not just a 55 mile per hour road, it's a 45.

If it's posted 25 miles per hour, any locality can lower the speed limit.

It doesn't require traffic study and it can be lowered to either 20 or 15.

But I want to send you all some bullets on that to give you some guidance on how that works in the process.

I mean the biggest ones y'all have are right here in Livingston.

Maybe a few subdivision streets elsewhere.

Most of them are here in Livingston.

There might be some where in Colleen.

But most of my subdivision streets are on street studies within the Village.

And is that not more effective than changing a speed limit?

Well, our studies have indicated we did not have a, we have not recommended any change in the speed limit in Gladstone as opposed to 25.

And we've also determined that due to the geometry of Gladstone,

They provide great traffic calming, which there's a whole section.

There's a whole guide on traffic calming, what has to happen for that.

And I'll send you that so you can take a look at that.

Well, how recent does the study have to be to apply?

Well, I mean, I think it would have to be one done very recently before we would accept it.

But I will send you a fact sheet on that, give you some pointers, and if you have any questions, we can discuss it.

I want to thank you for VDOT's efforts.

And Schuyler, obviously Rockfish River Road got hit pretty heavily over this past storm.

They're very responsive, got a lot of trees out of the way pretty quickly.

And we're then cooperating with electric companies.

It was really great to see the community notice that.

So please send that message over to the Shipman Foundation if you can.

There are a few roads that I wanted to touch base on where the culverts got washed out pretty severely, but we can take that past here, specifically over on Rockfish River Road.

I do know that it's going to take some additional right-of-way and that will require a survey and that will be recorded.

So on Thursday night, I just want to thank you all.

I understand you all have to have some snake charmers as well while you're out.

Quite a bit of snake activity from the storm.

That water makes them move.

The board's request for the VDOT traffic study on Route 29 is a high school, middle school complex.

You had sent us some results from that.

Well, basically, the request for us to study to try to come up with a plan to get some breaks in traffic.

or any other traffic control measures, they did not recommend or did not recommend anything other than the officer working the intersection.

I mean, unfortunately, sometimes you just can't,

All right next up we have Departmental Report from Animal Control.

Before Mr. Wright speaks, I just wanted to just sort of introduce this item.

Several years ago, we did this somewhat on a regular basis where we had each department head come and just provide a fairly brief overview of their department, present their monthly report, and answer any questions.

So this is just an effort to get that kind of revived.

Notice that the calls for service, there was a spike in the numbers.

I don't know how closely y'all look at that, but that usually anytime there's a severe weather, I don't consider what we've had recently pretty severe and extreme calls for service as a spike.

So that might be why you're seeing those numbers.

The fees collected,

Nothing out of the ordinary there, but since we've made the increases last year to up all the shelter fees, I think we've all seen a number just gradually go up from there.

So I think that you're going to see that continue as well.

So that's my prediction that you're going to see it just consistently stay up like that because of the increases.

Nothing really out of the ordinary for the month there.

We did hold, I've been here since January 2, 2013 and we held our first, for me it was my first department head meeting with the county administrator.

Our challenges and successes, and not to be arrogant, but with animal control, every challenge, our goal is to make it a success at some point.

So it's just the way we approach it.

But with that said, challenges that we're looking at infrastructure-wise, I mean, you guys, I think, have been involved in the process where we put the new

One of the last things we talked about was he had a PO for that so I think it boils down to the roofers backlog of work we're determining when that gets done at this point so the ball's in his court now so thank y'all.

And the other thing I'm not sure if y'all have been breached on the infrastructure situation at the shelter with the drain.

We've got

In the center of, well have you guys been briefed on that at this point?

Well I'll make it brief.

We just got a drainage issue in the center of it that is where all the waste from the animals goes into that and then the kennels are back to back.

Pretty extensive construction, so I'm working on getting some blueprints drawn up, some quotes, and she'll be getting with you guys on that to kind of help us kind of navigate what the best, you know, right forward is going to be on that.

But anyway, I'll be providing some information on that to help us with that in the future, so we'll be attacking that.

And we've got several things

And it's recently been an issue.

And I'm not going to get into specifics with a particular issue, but how the public

Back on that January 2nd, when I came on board for the first day, when I accepted the job, I really didn't know a whole lot about what animal control needed anyway.

So I was just coming in for something to do here, and then I kind of learned from there.

And I think each person that you run across is going to find a different idea on how they view animal control.

But I think the biggest misconception is, and a lot of

to some distaste or they don't agree with something.

So they project that through social media.

One of our goals to work on is trying to figure out the best way moving forward to project exactly what we do.

Because since I've been here, the role has changed so much in animal control.

I don't believe that the citizens in the community

Citizens are aware of our capabilities and what we do, you know, out of our vehicles, for instance.

And this came into play with one of the recent complaints is that they see us doing nothing by the road.

I mean, that's what they say.

And I mean, nothing is, that's an insult to me because nothing is nothing.

So people need to understand that we are completely independent in our trucks.

I mean, pre-COVID,

The board approved us to get on more computers where we can be dispatched through our trucks, we can do our reporting from our trucks, and it makes us more effective because we're able to stay in the field longer.

Certainly as we're picking animals up, we're going to be moving back and forth, but you know, trade pickup is not on what we do.

We have a lot of criminal investigations we're doing.

So with us having to have probable cause to go over this property, we're going to make certain phone calls to get that necessary probable cause.

We're going to make sure for the Office of Safety that we have all that information before we do all that properly.

So it does take time to go after some of these things and go at it in a safe way.

We don't want to harass our citizens, so we're going to make sure we have that probable cause as well.

With that said, during that meeting with the county administrator and the department heads, we spoke about Maureen possibly helping out a little bit, possibly with the webpage, helping with that, some possible social media, and I invite anything from our resources here to kind of help project that image out into

County, and also invite anything that the citizens may have that may help.

We're just about putting that positive and projecting that positive image out there into the community.

And I would also like to say some of the things.

I mean, I feel like we're doing a wonderful job.

Just again, I think there's a lot that people don't realize.

say that one of the, since January has come around, we've got a new sheriff here.

The sheriff, the new administration with true leadership in that position has allowed us to be a part of something that is projecting something really positive.

The sheriff has included us in the cop camp, which gave us, I mean, we had people come up,

those days and just say, hey, I didn't realize that you guys had all this.

And that's what it's about, the awareness and educating people.

And to be around the kids in school and just what comes out of their minds, the questions they have.

I think it's a good thing, and I'm thankful for that for the Sheriff.

And also the other thing, and it's tied to this as well, because he's included us in a lot of things.

Alert training that recently took place at Rockfish was some of the best training and I don't know if the citizens are aware of exactly.

I know the Sheriff put it out there but that alert training is something that it's just it's amazing to have under your belt to be able to have that training and that confidence and the knowledge how to go in an active shooter situation.

I want to comment on something I should have said earlier when we first started but I noticed the ribbon on your shield and I'm assuming that is in memory of the Smith County Deputy Hunter Reedy who was killed earlier this week and within the last week.

and we in Nelson certainly sympathize and empathize with that situation after Officer Chris Wagner here in the community, so thank you all for your support and showing the support to Smith County.

All right, next we have, we'll move on to new and unfinished business.

I'm just going to briefly introduce this item.

We have Jennifer Fitzgerald from the Nelson County Service Authority, who's going to be doing most of the presentation on this item.

We have been briefing the board over the past few months that this would be something you'd be considering.

It has to do with the Lovingston sewer

Project, and an agreement that is required through the financing entity, which is USDA World Utilities Service.

They require a support agreement be executed between all the entities in order for the service authority to take on the 600-some thousand in loan from that entity.

Good afternoon.

I'm Jennifer Fitzgerald, Assistant Executive Director with the Nelson County Service Authority.

I believe included in your board package was the brief description of the proposed project that's on the board.

I just wanted to highlight some of the information provided.

Approximately 16,000 linear feet of clay pipe is currently serving the Lovingston community.

And of that, 8,000 linear feet will be either replaced or aligned with cured and replaced pipe.

The CIPP technology, which is a trenchless rehabilitation method,

is used to repair existing pipelines as a jointless, seamless pipe lining within the existing pipe.

The benefit of this technology is it does not require excavation or rehabilitation to rehabilitate a pipeline that is either leaking or structurally unsound.

This method will extend the life of a pipeline for up to 50 years, which is almost the time frame of the current pipe that has been in the ground.

This will eliminate the inflow and infiltration issues that we're currently having throughout

our system with large rain events.

Currently we have one to two manhole overflows or blockages per year.

This is mainly caused by root intrusion of pipe.

We all know that sanitary sewer overflows are a public health concern that impacts the environment and also is prohibited by the Virginia Pollution Discharge Elimination Permit issued by the Virginia Department of Environmental Quality.

We also will be replacing 31 manhole covers

and frames, along with the lining of the sewer laterals and manholes.

The project will start off with the sewer line being CCTV inspected, which is the process of using a camera to see the inside of the sewer lines.

The camera is fed into the sewer lines to find the issues without having to dig.

This is a very effective way to monitor the pipe without having to disrupt the current sewer line or dig up someone's yard.

As you can see on the project schedule on page two,

We didn't expect that the agreement would take so long to be approved by USDA, Office of General Counsel, and we also did not expect the untimely death of our project engineer.

So the initial start of the project was supposed to be July of 2024, and we are projecting that this delay is going to probably delay the project five to six months.

The project budget is listed as $2,235,000 with a grant of 71% of that expense.

The project is estimated to take about 18 months.

Is this grant, I guess this is pretty similar to the one that we got in Schuyler, isn't it?

Gotcha.

So is it based off of income?

That's the maximum amount.

Well, this is, I mean, that's great.

That old terracotta pipe, that's been a recurring issue in any ring of man, and manholes down, especially on Front Street, have been issues multiple times.

It's another great thing for Lovingston.

It's very timely also.

I do want to advocate, as I have to Robert and you as well as staff, that if we could look into maybe some community development block grants related to water infrastructure as it relates to the pipes, because that's also around the same age as the terracotta pipe.

However I can advocate or assist,

I'm willing to do so.

So you're going to put the cameras in and assess the pipes.

No, the process itself is very effective.

It cures in place.

Yeah, it's a sleeve.

So it sleeves it in.

It's pretty sophisticated, pretty cool.

There's this pump and it shoots this fluid in.

This pipe goes and basically sticks to the exterior and then hardens up.

We did that in the Skyward.

Mr.

Chair, I might have some more information I'd like to add.

So we have provided Resolution 2024-59 which does create, it's a moral obligation to

basically financed the loan portion of this project, which would be a commitment of approximately $28,000 a year.

And it kind of depends on what the interest rate ends up being at closing.

The other obligation is we have to establish a 10% reserve for 10 years until there's one annual payment accumulated, which would be equivalent to the $28,000 per year, basically in debt service that the board would

provide to the service authority for payment of the loan portion of this project.

Mr. Chairman, I move that we approve resolution R2024-59.

That's the category of supervisors.

That is a resolution to approve a support agreement in connection

with the issuance of a revenue bond by the Nelson County Service Authority.

All right, so you all should be familiar with the Wild Roads Solar Project proposal in Gladstone.

The Planning Commission heard the special use permit request

at their meeting in June, and that was twofold.

One vote is called a 2232 review.

That's a state code section, 15.2 2232, which requires a locality to review solar projects for substantial accordance with their comprehensive plan.

So that was one vote.

The second vote was the recommendation for a special use permit.

They voted 4-1 that the project was not in substantial accordance with the Comprehensive Plan and they voted 5-0 to recommend denial of the Special Use Permit.

The applicant appealed this 2232 determination by the Planning Commission to the Board of Supervisors who can uphold or overturn that.

Part of this appeal document,

I've requested a waiver on the requirement for you to hear the appeal within 60 days.

The reason for that is to allow the board to review all three items at the same time.

One, the 2232 substantial accordance vote appeal.

Two, the special use permit.

and three, the siding agreement, which is the financial piece of the project.

There may be a change with that.

I had spoken with Janine Johnson, and she mentioned possibly November.

So essentially today, you don't need to take any action, just a general consensus to accept this waiver.

Special use permits have to be voted on within a year of the application.

So October, November, when it comes forward to you, we'll have all that information ready.

And as Candy mentioned, Ginny and the applicant for Wild Rose is here if you have any questions.

I mean, yeah, I don't have a problem with it.

I was just looking at October and November.

I didn't make Ms. Johnson aware of that.

The paperwork for the special use permit was submitted when?

essentially put off purchasing a new ambulance and then possibly acquire this unit 56 from Rockfish.

And in lieu of paying them $50,000 for that unit, we discussed forgiving $50,000 from their current interest-free loan.

They have a current outstanding balance of $145,312.50.

Previously, the board had approved a purchase agreement for this piece of property on Cali Hill Road.

This property is

Tax Back Number 57-A34K, described as all but certain tract or parcel of land with improvements thereon and appurtenances thereto, belonging situated in the Lovingston Magisterial District of Nelson County, containing two and 3700 acres, more or less, with said lands fronting on US 29 and Cowherd Hill Drive.

And this property is adjacent to the current county and property on which the maintenance shed is located.

The purchase of this property was intended to provide a stormwater management detention pond area in case of future road widening and paving.

And the consideration for purchase of this property is 90,000.

So Resolution 2024-62,

just authorizes either myself or Mr. Payne to accept the conveyance of this property.

We are still working with VDOT on trying to schedule a date to discuss the Route 151 speed setting results.

I think VDOT's having a little bit of trouble getting some dates that work for their staff, but as soon as we know something, we can let you know.

You all did approve the Lovingston Sewer Rehab Project funding.

As Jennifer mentioned, we will have a project announcement ceremony sponsored by the USDA Enrolled Development

and also the service authority in collaboration with the board.

It's planned for 11 a.m. on August 20th at the courthouse complex.

So if you all could RSVP by August 16th, that would be wonderful.

If the weather's nice, we'll have it outside on the courthouse grounds.

If not, it'll be in the old court supervisors.

Next, Nelson, along with our PDC regional partners, are invited to participate in a regional application through the Department of Housing and Community Development.

This would be for a planning grant that would enable the participating parties to seek federally funded digital inclusion grant funds and also broadband equity access and deployment funds, of which over 500 million will be available over the next few years.

Albemarle County's Broadband Accessibility and Affordability Office will be the lead applicant and grant manager, and participating localities would work with a hired consultant to facilitate their conduct of focus groups and stakeholder interviews regarding broadband access, connectivity, and affordability.

Herein seeking authorization to sign a multi-jurisdictional MOU in order to participate in the localities applying for the planning grant.

I believe it's a $25,000 grant with the local match.

I believe the MOU is included with that.

I think it also, and this is a question that I had posed to PDC staff, I think it also has the potential to produce and ensure redundancy.

So do we need a vote on that or just a consensus to authorize me to go ahead and sign the MOU to apply?

Participating in our VACO regional meeting, which will be virtual on Monday, August 19th, where we'll discuss 2025 legislative issues in order to help VACO develop their legislative program for 2025.

It's my understanding that they're leaving that on the legislative side for them.

I'm going to report on the regional jail expansion.

The project is in the schematic design phase and updated project costs are now $49,005,385 versus the concept design estimate of $49,021,414.

And in the next four months, the following steps will take place.

In September, they will conduct a prequalification of general contractors and design development submission and budget update will be provided to the jail board.

In October, they will conduct a formal value engineering and design development submission to the Virginia Department of Corrections for approval.

Late October and November, construction documents will be developed with 75% completion in December.

As far as other items, some of the data that we received, ACRJ had a clean audit opinion for FY23.

In June of 2023, our utilization was 1,093 bed days with a total of 13,827 bed days for FY24.

Our average daily population was 38, which is 14.31% of the total.

The average daily population in total was 265.

As of last report, Nelson has one person on home electronic incarceration out of a total of 10.

Really on a personal level learning about the value engineering and what that can do to a project and I have questions on value engineering with social services building eventually.

But I got a tour of the jail, which was good timing because I got to see what they wanted to do with the jail.

I'll move on to our 2026 reassessment RFP.

The county received three proposals, and we will be scheduling pitches or interviews with at least two firms, hopefully the week of August 26th.

And pursuant to competitive negotiation procedures of the Virginia Public Procurement Act, the firms interviewed will be ranked according to the criteria and percentage weight described in the RFP, and then the county will negotiate a contract with a top-ranked firm.

If an agreement cannot be reached, the negotiations begin with the second highest ranked firm and so on.

The contract is anticipated to be finalized by the end of August or early September with the work to commence in September of October of 24.

The hired firm will then begin with the sales study and the bulk of the reassessment work will be done during calendar year 2025.

Final completion of the reassessment will be contractually by December 31st of 25.

and assessments will be effective January 1, 26.

There will be informal hearings with assessors as requested by citizens followed by Board of Equalization appeal hearings during the February and March 2026 timeframe.

Let's see, per the board's directive, staff is tracking and charting the data for both meals and lodging tax collection.

Revenue collections in July have been added along with a note regarding that the T&T tax rate changed from 5% to 7% as of July 1, 2024.

And those reports and charts are attached to this report.

We are working on establishing a location for our FY 25 board retreat.

The retreat will be a one-day retreat somewhere in the timeframe of September 17th to the 20th.

Disorder depends on the venue and when we can get that procured.

So we're working on that.

We'll be working with Chair Parson on that agenda.

In terms of the broadband authority dissolution, staff has been working with the Treasurer's Office to complete final steps

in closing the authorities bank account and opening a new Nelson County broadband bank account.

This is one of the final steps in the transition along with Mr. Payne completing final filings with the SCC.

And then you all have received department and office reports for July or August, which were provided with your packet.

I would err on the side of doing units, because each one should be registered by itself.

Because I have a feeling that because of the blank checks that the county receives from the platforms such as booking.com, Airbnb, and all that, they're probably keeping it as whatever the flat number of units it is and whoever reports.

They were supposed to start doing that, so I'm not sure if they actually are.

It could be, because I could just see them just throwing the flat number, 1100, whatever it is.

Actually, I was highly saddened and interested in the access to medical care and things that you have when you go to jail.

It's actually exceptional compared to the average job.

So, say you get arrested.

When you go and get booked at the Admiral County Jail, 30% of the people entering are due to some mental health issue.

So there's a mental health assessment by a nurse practitioner, full physical exam,

You're there longer than two days.

You get a full physical, actually getting touched, blood work and everything by a practitioner.

And there's access to nurse practitioners and doctors, one-on-one, over 30-minute appointments.

There's a dental office.

I mean, they have their own pharmacy.

They have a handle on that situation.

It's impressive.

PDC did not meet this month.

EMS did not meet this month either.

I mean, we have social services still.

I've reached out to a couple of people, but this is a district central.

And I've talked to a couple of people and gotten a couple of no's.

So I wanted to bring something up.

I've been approached by the local Fleetwood Harmony Masonic Lodge.

They have been working on a fundraiser to help raise money to provide a cover over the caboose at the Piney River Trail, which has been restored and is sitting there.

exposed and we've talked to Parks and Rec and to Candy about putting some sort of cover over that.

So Fleetwood Harmony Masonic Lodge has several members that are very tied in with that.

Ted Hughes was very active in restoring that caboose and Roger Huffman, his son-in-law.

So it was a project taken up by the lodge.

They raised a little over $6,000 for the cover

The estimate I believe, Candy, do you recall somewhere between 18 and 20,000 because the caboose is going to have to be moved due to a power easement and the cover would get in the way so it's going to have to be moved a little bit and then constructing basically like a pole barn but something, you know, a nice looking pole type structure over the caboose to protect it.

because I know the yeah I'm pretty sure that Parks and Rec had some estimates and it was in that upper teens around you know under 20 I believe so the question now becomes you know what does the count you know what do we want to do with that $6,300 that the

that the Freemasons have raised and do we want to kick in the balance and put the cover over the caboose or do we want them to use that money for something else or return it to the people who donated?
