SPEAKER_08
00:04:37
Yes.
00:04:38
Very well, the minutes are approved.
George Goodwin
Member, Planning Commission
00:04:40
Next on the agenda is the consent agenda.
00:04:42
We do not have a consent agenda tonight, so we'll move on to the public address period.
00:04:48
Public address period is a time when anyone in
00:04:51
Here tonight any member of the public can address the Planning Commission on any topic that is not a public hearing this evening.
00:05:00
So I'm going to open the public address period.
00:05:03
The public address period is open.
00:05:06
And I ask if anyone would like to address the commission on a topic that's not a public hearing.
00:05:13
Come forward, you'll have three minutes.
00:05:16
And if you represent an organization, please let me know.
00:05:21
And Ms. Ravern, I believe I have a card for you.
00:05:23
I think you're speaking about something other than the campgrounds.
00:05:28
So, very good.
SPEAKER_03
00:05:29
I can see what I wrote.
00:05:32
Very good.
George Goodwin
Member, Planning Commission
00:05:33
Thank you.
SPEAKER_03
00:05:34
I'm Rebecca Sue Rayburn.
00:05:36
I live at 1665 Holland Creek Road, Patrick Henry District.
00:05:41
I've communicated by email twice with Mr. Quarles and have not received an answer or even a I got your message so I'm here to say what I have to say.
00:05:52
My husband and I bought a lot, a five-acre lot in 1974 and built our home.
00:06:03
Over the next few years, by 1980, we had bought the side-by-side lot so we'd have the privacy we were seeking to live in the country.
00:06:13
I'm concerned about the proposed changes to the land use regulations, lot size, setback, road frontage required, all those things because I want
00:06:29
to be able to let my children have those lots and use them to build on.
00:06:34
I also want perhaps the ability to divide some of this property, family right, for my grandchildren.
00:06:46
worry about their ability to use the land and what the frontage requirements might be.
00:06:54
So if they don't have enough frontage, are they not gonna be able to use it at all?
00:06:58
And I'm concerned about the setback requirements.
00:07:02
400 feet is a very expensive driveway.
00:07:05
And on some of my lots, that might push it back to the back line.
00:07:09
And then I couldn't build a house because I'm on somebody else's property or whatever.
SPEAKER_05
00:07:14
So I have questions.
SPEAKER_03
00:07:16
Will property be grandfathered in?
00:07:19
So if it's a pre-existing lot,
00:07:21
will it be allowed to exist as it is?
00:07:24
Will the grandfather in the division possibly, a family subdivision or a family division, and do the proposed changes make it possible for the average citizen to even afford to live in Louisa County?
00:07:40
I know you're concerned about development and too much growth, but you've let every business that wanted in, data centers, warehouses,
00:07:51
Business Parks come to Louisa County.
00:07:55
There's a cement factory at Ferncliff that nobody in Ferncliff wanted, but we got it.
00:08:00
And a plant of some sort back there behind the Exxon.
00:08:05
So I heard that there was a survey sent out or given.
00:08:10
I never received the survey.
00:08:12
I never heard about the survey.
00:08:14
My neighbors never heard about the survey.
00:08:17
and so I get all kinds of mail from the county.
00:08:22
This survey could have been sent to me.
00:08:24
I could have actually answered it as could my neighbors.
00:08:28
So that I'm not happy with.
00:08:30
And then I heard that 2,000 people answered the survey.
00:08:34
Well, how many people live in Louisa County that you might be basing your judgment on 2,000 opinions about rural landscape?
00:08:44
Anyway, that's my concern.
00:08:46
I have difficulty driving at night.
00:08:48
I did not want to come tonight because I don't want to go home in the dark, but I'm here.
00:08:53
And I guess I'll have to come to the planning, you know, the public hearing.
00:08:58
Maybe my neighbor can bring me I don't know.
00:08:59
But anyway, that's all I have to say.
00:09:02
And would you tell Mr. Quarles I expect to hear from him when I communicate with him?
00:09:07
I think that's pretty shoddy representation.
00:09:10
Thank you.
George Goodwin
Member, Planning Commission
00:09:14
Would anyone else like to speak during the public address period?
00:09:22
Very well, I'm going to close the public address period.
00:09:25
Public address period is closed.
00:09:28
And move on.
00:09:30
I don't believe we have unfinished business at this time.
00:09:33
So we move on to the public hearings.
00:09:36
First public hearing is in Forestville District proposed addition Goldmine Creek, Ms. Braithwell.
SPEAKER_04
00:09:42
Yes, sir.
00:09:43
Thank you.
00:09:44
I will start tonight by addressing just a few things I know you're going to ask me.
00:09:48
So the first thing is if it pleases the chair, you have a lot tonight.
00:09:54
So I'm going to skip the location descriptions as they're in your parcel and just hit the most important things.
00:09:59
And I also want to start by letting you know that this set of applications is just over 3,500 acres.
00:10:09
So that's what you will be recommending tonight if you choose to.
00:10:14
And I know Mr. Hicks is going to ask about the
00:10:20
Purpose of the application, I just want to preface this by saying this is a substantial amount of individual applications that have been lumped together for your ease and my ease.
00:10:29
So we didn't have 20 or 30 public hearings tonight.
00:10:33
We just had, I think it's six.
00:10:35
So I can't answer that question for everyone.
00:10:38
There is a healthy mix of preservation, a healthy mix of eminent domain in each application.
00:10:42
So I know that's a question that I'm asked on every one.
00:10:44
So I just wanted to clarify that before we begin.
00:10:47
So to begin with the Goldmine Creek,
00:10:49
Application, all applications tonight have been recommended by the Ag-Forrest Rural Preservation Committee in case I forget to say that again.
00:10:56
Goldmine Creek is Landowners Clifton Farms LLC, Lucy Coleman, William et al, Mansfield LLC, Samuel Kelly, Georgie Fells et al, Joyce Talley, and John R. Miller.
00:11:07
It is 20 parcels on A1, A2, R2, C2,
00:11:11
I'm sorry, and C2.
00:11:12
It's 638.48 acres.
00:11:16
The uses are timber, fruit and crop production.
00:11:19
I believe that there are individuals present landowners present.
00:11:23
I don't know if they want to speak.
00:11:24
But I can stand for questions at this time.
George Goodwin
Member, Planning Commission
00:11:27
Would anyone in the commission like to ask any questions for the staff at this time?
00:11:37
Very well.
00:11:38
I'm going to open the
00:11:40
I'm trying to figure out how to do this correctly.
00:11:42
I'm going to open the public hearing on this.
00:11:44
The public hearing is open.
00:11:46
Typically the first speaker in the public hearing is the applicant.
00:11:49
We have many applicants here, several applicants.
00:11:54
Would the applicant like to, do we have a single applicant representing this, all of this?
00:12:05
Would any of the applicants for this like to speak on this?
00:12:13
Very well.
00:12:13
We'll dispense with that and we'll move on.
00:12:15
Would anyone like to speak on this public hearing?
00:12:21
Very well.
00:12:22
Seeing no one, public hearing is closed and we'll bring it back to the Commission for questions.
SPEAKER_13
00:12:33
Any questions from the Commission?
George Goodwin
Member, Planning Commission
00:12:35
There being none, the Chair is going to turn the Chair over to the Vice Chair and I'd like to make a recommendation for approval or that we recommend approval to the Board of this addition to the Goldmine Creek Agriculture and Forest School District.
SPEAKER_02
00:12:56
Is there a second?
00:12:57
Second.
00:13:00
Any discussion?
00:13:02
Carried none.
00:13:03
Ms. Johnson, roll call vote please.
00:13:05
Mr. Hicks?
00:13:06
Yes.
00:13:07
Mr. Painting?
00:13:07
Yes.
00:13:08

00:13:11

SPEAKER_02
00:13:12

00:13:14

George Goodwin
Member, Planning Commission
00:13:16
Very good.
00:13:16
Moving on to the next item which is AFD for Elsville

00:13:22

00:13:56
Use is timber.
00:13:57
I can stand for questions at this time.
George Goodwin
Member, Planning Commission
00:14:00
Any questions for staff at this time?
00:14:05
I'm going to open the public hearing.
SPEAKER_13
00:14:07
Is the applicant present?
George Goodwin
Member, Planning Commission
00:14:11
No.
00:14:11
Would anyone like to speak on this AFD?
00:14:16
Nope, very well.
00:14:17
Then we'll close the public hearing and bring it back to the Commission for any comments on this AFD.
00:14:30
There being none, the Chair would normally look to Louisa representative for a motion here, but he's not here with us tonight, so the Chair will entertain a motion from the Commission.
00:14:43
Mr.
SPEAKER_02
00:14:43

00:22:09
You should have heard me at Ag Boristle.
00:22:11
I was reading it really quickly.

So thank you.
George Goodwin
Member, Planning Commission
00:22:14
Thank you very much.
00:22:15
Very well, we'll move on to rezoning 2026 for Matthew Berg request.
SPEAKER_13
00:22:25
Mr. Cole.
SPEAKER_01
00:22:30
Good evening, Chairman and members of the Planning Commission.
00:22:34
My name is Ian Cole and I serve as an Associate Planner with the Louisa County Community Development Department.
00:22:39
Before you this evening is a rezoning application, REZ2026-03, submitted by the applicant Matthew Bird and the owner, Wayne Bird.
00:22:49
The request is to rezone from Agricultural A2 Growth Area Overlay District to General Commercial C2 Growth Area Overlay District.
00:22:57
The subject parcel is three acres, shown in the blue box before you, and is located at the intersection of Zachary Taylor Highway and Route 208.
00:23:05
The parcel is further identified as Parcel ID 28-109 in the Mineral Election District.
00:23:13
The 2040 Louisa County Comprehensive Plan designates this parcel as mixed-use in the Lake Anna growth area.
00:23:19
Staff believe the proposed rezoning would align with the surrounding area's mixed-use character that comprises of mainly commercial developments and some agricultural parcels.
00:23:29
Furthermore, the proposal mirrors the 2040s plan's objective of broadening the county's tax base through the establishment of new businesses.
00:23:36
On a broader scale, the parcel is situated between three major projects.
00:23:41
The commercial gateway project to the west, the planned unit development of Ware's Crossroads to the south, and the cut-along resort development to the east.
00:23:53
Looking at the property's zoning history, the 1969 zoning map shows that both the subject parcel and the surrounding area were originally zoned agricultural.
00:24:01
Since that time, the subject parcel has still retained its original zoning classification.
00:24:07
As part of the review process, community development staff evaluate the potential impacts of proposed developments on public facilities and services.
00:24:15
Staff facilities analysis for this rezoning request is provided on page 204 of your packet.
00:24:22
The applicant has stated their intent with this rezoning is to use the existing structures found on the parcel as office slash retail spaces.
00:24:29
To mitigate its impact on public services, the applicant has voluntarily offered a proffer that limits the number of uses that would be permitted if the rezoning is approved.
00:24:39
The proffer statement is included in Enclosure B with the permitted uses highlighted in Enclosure C. Any use not highlighted will be excluded under the applicant's proffer.
00:24:52
The neighborhood meeting for this rezoning was held on July 8th.
00:24:55
There were no members of the public in attendance.
00:24:58
This concludes staff's presentation.
00:25:00
Staff has included site photos on this slide for the Commission's review and is available to answer any questions.
George Goodwin
Member, Planning Commission
00:25:06
Are there any questions for the staff at this time?
SPEAKER_07
00:25:18
Is the applicant's intentions to use the structures that are on site or is the applicant's intentions of rezoning, removing the structures and going back with one of these listed proffered structures?
SPEAKER_01
00:25:29
So the applicant has stated in their application specifically that they intend to use the existing structures found on the parcel.
00:25:35
The one you see before you, the main structure is residential and the one on the side that I believe is on the right hand on your point of view is a non-residential structure.
00:25:45
But they intend to use those two for office slash retail spaces.
00:25:49
Wonderful.
00:25:49
One of these permitted uses.
SPEAKER_07
00:25:51
And in the future, if that building was dated or needed to be replaced or updated or so forth, the applicant
00:25:58
under this new zoning would be able to take that down and conform within these proffers for whichever structure they decide to comply, correct?
SPEAKER_01
00:26:09
They intend to demolition the buildings or renovate them in a sense.
George Goodwin
Member, Planning Commission
00:26:16
Any other questions for staff?
00:26:21
Very well.
00:26:21
Thank you, Mr. Cole.
00:26:23
We're going to open the public hearing.
00:26:25
The public hearing
00:26:27
The speaker for public hearings is customarily the applicant, if the applicant would like to.
00:26:34
You'll have 10 minutes if you wish to use the time.
00:26:37
If not, that's fine.
00:26:39
Would anyone else like to speak?
00:26:50
Thank you.
00:26:52
If we need to, we'll have questions for you though.
00:26:58
And back to the Commission for comments.
00:27:00
Any comments from the Commission?
SPEAKER_08
00:27:09
Very well hearing none.
00:27:10
Mr.
00:27:11
Chair.
00:27:12
Mr. Goodwin.
00:27:12
I think I do have a question.
00:27:17
And this is a question for the applicant.
00:27:20
As you are
00:27:22
largely surrounded by the new development next door.
00:27:27
Have you had conversations with them?
SPEAKER_06
00:27:29
Yes, sir.
00:27:30
My cousin Wayne, the owner, has had multiple conversations with them.
00:27:35
Okay.
SPEAKER_08
00:27:36
And have they gone?
SPEAKER_06
00:27:37
Very well.
00:27:38
Very well.
SPEAKER_08
00:27:40
Okay.
00:27:41
Thank you.
00:27:42
That's all I have.
George Goodwin
Member, Planning Commission
00:27:43
That's true.
00:27:44
Thank you.
00:27:45
Okay.
00:27:45
Thanks.
00:27:46
Any other comments or questions?
00:27:51
I'm going to turn the chair over to the vice chair and I'm going to make a recommendation for approval for the Board of Supervisors for rezoning 2026 this change from agricultural A2 to general commercial C2.
SPEAKER_02
00:28:07
Thank you very much.
00:28:09
Do we have a second?
00:28:10

SPEAKER_08
00:28:11
Very good.
SPEAKER_02
00:28:12

00:28:20
Mr. Hay.
SPEAKER_02
00:28:20
Yes.
00:28:22
Mr.
SPEAKER_13
00:28:22
Paintings?
SPEAKER_02
00:28:23
Yes.
SPEAKER_13
00:28:25
Mr. Disosway?
00:28:25
Yes.
00:28:26
Mr. Dickerson?
00:28:26
Yes.
SPEAKER_02
00:28:26
Mr. Goodwin?
00:28:26
Yes.
00:28:28
Motion carries.
George Goodwin
Member, Planning Commission
00:28:33
All right.
00:28:33
Next up is Amendment to Chapter 86, Land Development Regulations for Campground Considerations.
00:28:43
Ms. Buckler.
SPEAKER_05
00:28:44
Good evening Chairman Disosway and members of the Planning Commission.
00:28:47
The last public hearing this evening is an amendment to chapter 86 land development regulations relating to campgrounds and camping considerations.
00:28:57
At last month's meeting, Deputy County Administrator Christopher Coon reviewed the proposed amendments with the Planning Commission.
00:29:05
Those include definitions to include a major and minor campground definition.
00:29:12
which each has certain criteria, revised definition of a campsite to be an unapproved campground, added a definition of recreational shelter, amended the matrix table to provide the districts in which a major and minor campground would be allowed, amended 86-111 use of travel trailers and campers for dwellings prohibited, amended 86-114 for short-term rentals,
00:29:39
added, as I said previously, the matrix which added minor campgrounds by right with restrictions in A1, A2, the A1 growth area overlay district and the growth, A2 growth area overlay district and the resort development district added major campgrounds with the conditional use permit in the C1, C2, C1 growth area overlay district, C2 growth area overlay district
00:30:06
and it is already required in the A1, A2, A1 growth area overlay district and A2 growth area overlay district and added additional clarification on storage and limited recreational use on private properties.
00:30:22
That concludes the presentation.
00:30:25
If you have any specific questions about the amendments, I believe the Planning Commission reviewed those last month and had no changes to the proposed amendments as they were presented.
George Goodwin
Member, Planning Commission
00:30:37
Any questions for staff at this time?
00:30:43
Very well.
00:30:44
Thank you, Ms. Buckler.
00:30:45
We're going to open the public hearing.
00:30:47
Public hearing is open.
00:30:49
I have a card here.
00:30:52
So we're gonna start with a card.
00:30:54
And then after that, if you'd like to speak, you can come forward.
00:30:57
You'll have three minutes to speak.
00:30:59
Let me know if you represent an organization.
00:31:01
That changes the time allotment.
00:31:03
When you step forward, please state your name and your voting district.
00:31:07
First up by the card is Dale and Mary Ellen Turner.
00:31:12
So I'll let you all decide who's coming up.
00:31:20
Very well.
00:31:22
Welcome to both of you.
00:31:23
It's still three minutes.
SPEAKER_11
00:31:27
We won't talk football this evening, even though we could talk about that.
SPEAKER_03
00:31:32
I'm going to kick in tonight.
SPEAKER_11
00:31:38
My name is Dale Turner, and my wife's name is Mary Ellen.
00:31:42
And we live at 891 Kinsville Road in in the Louisiana voting district.
00:31:49
I'm writing to express serious concern regarding the proposed changes to the Louisiana County campground zoning ordinance discussed at the recent planning workshop.
00:32:00
During the session, it was noted that enforcement changes are being considered because the county operates on a complaint based system.
00:32:10
However, these proposed changes stem directly from an anonymous inflammatory letter submitted to the zoning administrator
00:32:18
that specifically targets Mary Ellen and me.
00:32:23
The letter makes explicit allegations of misconduct claiming on two occasions that we are paying someone to look the other way and that outcomes depend on quote who you pay.
00:32:36
Accusing individuals and county employees of bribery alleges a serious criminal offense under state and federal law.
00:32:46
Anonymous accusations containing unsustainable criminal allegations should not serve as a catalyst for county-wide policy changes.
00:32:57
Nor should significant taxpayer funds and staff resources be expended pursuing them.
00:33:04
Standard policy should dictate that unverified, unsigned complaints are either set aside or referred to the Louisa Commonwealth's Attorney.
00:33:15
if criminal conduct is alleged.
00:33:18
Without accountability for the accuser, anonymous tips can be easily weaponized for personal grudges or private disputes, forcing local government to spend taxpayer dollars chasing unverified claims.
00:33:35
We strongly urge the county to maintain a complaint-based enforcement structure that requires legitimate
00:33:42
signed complaints from identified Louisa County residents.
00:33:47
Ordinance revisions driven by anonymous attacks set a damaging precedent for all property owners in Louisa County.
00:33:57
And Mary Ellen and I want to thank you for working on this and for everything that you've done.
00:34:03
And we would suggest that we would like this taken care of
00:34:09
Thank you.
George Goodwin
Member, Planning Commission
00:34:23
Would anyone else like to speak?
00:34:34
Please come forward.
00:34:37
Again, state your name and your voting district.
SPEAKER_00
00:34:40
Sammy Kelly, Mineral District, and I'm representing Christopher Unn Campground.
00:34:45
I'd like to make a statement and voice a couple concerns that I have concerning the proposed definition and requirements for campgrounds.
00:34:52
The existing campgrounds in Louisa are not the cause of the new rules and should not be affected by them.
00:34:57
We all went through a long process to
00:34:59
established a current campground and have complied with both state and county law.
00:35:03
It seems that any recent laws addressing temporary housing in Louisa County negatively affect the existing hospitality businesses that did not contribute to the issue.
00:35:12
I am concerned that if these new campground definitions
00:35:15
Any requirements are accepted.
00:35:16
People will be led to believe that having a minor campground is a simple way to make money.
00:35:21
I wonder if they realize that there are not only county requirements but state requirements that must be met.
00:35:27
State code for campgrounds currently require additional building and signage as well as bath houses and dump stations.
00:35:33
The state does not separate minor and major definitions for campgrounds and I think the proposed
00:35:39
I understand why people in the county would want to start a minor campground with taxes, groceries, and other expenses going up every year.
00:35:54
It seems to be an easy way to bring in additional income without a lot of work.
00:35:57
However, to take revenue away from the existing campgrounds that had to put in a lot more time and effort to establish their business.
00:36:05
Finally, the state requirements for sites per acre are different than what is proposed by Louisa County.
00:36:10
Can the county's ruling be enforced if the state requirements are different?
00:36:13
Thank you for your time.
George Goodwin
Member, Planning Commission
00:36:16
Thank you.
00:36:21
Would anyone else like to speak?
00:36:27
Very well, seeing none, I'm going to close the public hearing and bring it back to the commission for comment.
SPEAKER_08
00:36:44
Mr.
00:36:45
Chair.
00:36:45
Mr. Goodwin.
00:36:48
At an earlier meeting I was through some elongated story accused of moving the goal post and just in the interest of public transparency I spoke with that gentleman and I reminded him that one of the Commandments addresses bearing false witness
00:37:16
And the other one is the reason we're here is there are no goalposts now.
00:37:24
So it's not a matter of moving them.
00:37:27
We're here because we don't have any.
00:37:29
And I want to talk about a couple of things.
00:37:34
First of all, very simply, this whole thing is a misnomer.
00:37:40
To call this topic a campground when what was brought from us doesn't meet any one of our imagined use of a campground.
00:37:52
We think of buddies or a family getting together for a weekend or a week.
00:37:58
This is about using structures indefinitely for the purposes of work.
00:38:06
or other purposes.
00:38:08
So I think the whole thing having this called a campground ordinance is it's lacking.
00:38:17
Another concern that I have is that we are once again mixing commercial and residential land use.
00:38:33
And I thought we beat this horse to death when we went through short term rentals.
00:38:39
And the county did not want to get into commercial use of residentially used property.
00:38:47
But here we are again and we're not only not addressing it, we're expanding it.
00:38:53
That bothers me.
00:38:58
The fact that we're proposing these, and I'm addressing what we're calling a minor campground, that we're proposing these without the CUP but by right means that neighbors don't get a chance to state their concerns or their support.
00:39:21
They don't get to talk about privacy, their own.
00:39:26
They don't get to talk about neighborhood safety.
00:39:30
They don't get to talk about what it does to the value of their property next door.
00:39:38
All valid topics that neighbors ought to have a chance to talk about.
00:39:46
But the real reason that I want to talk about this
00:39:51
Minor campground is that we, at least I know I am guilty, we form an opinion about these ordinances based on the people who bring them to us and are represented.
00:40:09
And we tend to characterize the ordinance by those people.
00:40:14
These are responsible people.
00:40:17
They're doing it in a responsible way.
00:40:22
They're renting it to responsible people that in most cases are vetted by one of our largest businesses.
00:40:30
Truly vetted, it's a security installation.
00:40:35
But I want to suggest to you, Mr. Chairman, members of the board and members of the public, the bucket rarely leaks from the top.
00:40:47
It usually leaks from the bottom.
00:40:51
You look at the unintended consequences of this ordinance and I believe that we are encoding a whole new category of land division.
00:41:05
A whole new category.
00:41:09
If I have three acres of land, I find it very interesting that I can't bring in two brand new manufactured homes and park them on my property.
00:41:23
But I am allowed to bring in two unroadworthy vehicles on the back of a rollback and drop them in my backyard forever and ever I'm in.
00:41:33
That's wrong.
00:41:35
There's something definitely wrong with that.
00:41:38
And again, we're basing this on our perception of responsible people, renting to responsible people and doing it in a very responsible way.
00:41:52
But remember where the bucket leaks, at the bottom.
00:41:59
I cannot support this ordinance as it is written and will not.
00:42:04
I have no problem with the major, quote, campground because they are campgrounds.
00:42:12
Now there are some people there that are renting those spaces because they work here in the county, but they are being operated as a campground.
00:42:23
Minor, quote, campground, not so much.
00:42:27
and I will wager you that there's not anybody sitting at this dais up here and very few people in this audience that can't tell a story about somebody within three to five miles of your house already leaking from the bottom of the bucket because we have no goalposts and this is a sorry excuse for a goalpost.
00:42:53
I can tell you about an RV
00:42:57
that has been parked over eight years, less than two miles from my house.
00:43:04
There's an orange extension cord running from the house to the RV through a window.
00:43:11
Number one, you're not charging the RV through a window.
00:43:17
And number two, if it takes eight years to charge it, I'm not sure.
00:43:22
I think I would agree with them never having moved the thing in eight years.
00:43:27
But that's where it's going to leak.
00:43:30
And I'll say something snarky.
00:43:32
I really debated with myself about whether to say it.
00:43:35
The comprehensive plan addresses preserving the rural nature of the county.
00:43:43
This will not be doing that.
00:43:46
This will be creating the rural nature of the Appalachian part of the state as we stereotypically know it.
00:43:54
I will not vote for it, Mr.
00:43:56
Chair or members of the Commission.
00:43:58
Thank you.
George Goodwin
Member, Planning Commission
00:44:00
Thank you, Mr. Goodwin.
SPEAKER_05
00:44:02
Excuse me, Mr. Chairman.
00:44:03
I just wanted to bring up, there was another email that you had and I wanted to make sure that it was made part of the record from Joshua Turner.
George Goodwin
Member, Planning Commission
00:44:13
I was going to mention that, but thank you for bringing that up.
00:44:17
This was sent to all members of the Planning Commission.
00:44:20
We all have a copy up here and it's rather extensive, so rather than read it, we're going to make sure it's attached to the minutes of the meeting as part of the public hearing on this.
00:44:38
Thank you.
SPEAKER_11
00:44:44
Very well.
George Goodwin
Member, Planning Commission
00:44:45
Are there other comments?
00:44:54
In the intervening time from the last meeting to this meeting, looking at some of the things in here from the perspective of not campground, but workforce housing, which I think is a lot of the direction Commissioner Goodwin was going down.
00:45:19
I can understand the requirements here for having a campground in the sense of what a campground would normally entail with camping and recreation and
00:45:36
Things like, as the gentleman has already spoken to us about Christopher Run, the types of things that a campground typically would be that you would think of.
SPEAKER_11
00:45:46
And I think a lot of what's developed here works well for that.
George Goodwin
Member, Planning Commission
00:45:52
However, if we're going to use this for workforce housing, then I think there are things here that maybe
00:46:07
and overkill or maybe just not right for workforce housing for making the requirement.
00:46:16
I won't disagree that Campground Minor is a, I don't know that I ever really understood that one in all of this.
00:46:31
As a campground major, if we keep that definition, I think the first question is whether or not the minimum of 10 acres is necessary.
00:46:43
I understand that part of that was driven by the landscape and buffer requirement of 200 feet.
00:46:54
and the other piece of that question is if this is workforce housing, the typical workforce housing that we have for the typical workers here at the aforementioned large industrial complex in the county, those workers tend to tend to either work or sleep.
00:47:16
and I don't know that 200 foot buffering is necessary for that.
00:47:21
That may be a rather large buffering requirement.
00:47:27
So that may allow for the reduction of the 10 acres necessarily and most of the workers don't require if you're going to put in a
00:47:44
A recreational vehicle or a camper to live in during an outage at the power plant, you don't necessarily need the acreage that you need here, represented here.
00:47:58
You could put those in reasonably close together and they don't tend, from what I've seen,
00:48:06
In my years in working in the industry with folks that live in that kind of housing for outages that travel around from outage to outage, we don't necessarily need that much space between them.
00:48:19
They tend to go home, eat, go to bed, because they're working 12 hours or more a day.
00:48:30
Generally it's not an issue there.
00:48:34
I've been wondering in the intervening time now, do we need a campground definition and a workforce housing definition as a separate item with some separate requirements for each one so that campgrounds truly
00:48:59
are regulated as campgrounds and apparently there are some state code requirements for campgrounds that maybe we didn't have reflected in here that are not in alignment if the gentleman spoke earlier is correct, which I would assume running a campground he would be correct in this.
00:49:19
So I wonder if we need some more work on the campground major side of this, and do we need a separate piece of this for workforce housing that fixes that issue as well so we don't, and Mr. Goodwin, in your discussion, we don't blend these things together and come up with something completely different than what we had in mind.
SPEAKER_08
00:49:50
Thank you, Mr.
00:49:51
Chair, and I want to apologize to you and to the commissioners and the members of the public.
00:50:01
I got excited.
00:50:03
I'm very passionate about this because this goes against more than anything in my 11 years of being on the Planning Commission of what the vision is that I thought we had for Louisa.
00:50:21
It's going in the exact opposite way.
00:50:24
And yes, I got passionate and I am apologizing to all of you for what is probably best described as an outburst.
00:50:37
Thank you.
SPEAKER_09
00:50:49
Mr. Chairman, I would certainly suggest that we take a little harder look at what we have and see if we can clean this up and maybe better what we set forth here in light of what Mr. Goodwin has presented and Mr. Kelly and Mr. Turner, what they spoke of it all.
00:51:11
I think there's a lot of concerns here from ownership and people that run these that we could take a better look at and maybe provide something more accurate, better detail.
George Goodwin
Member, Planning Commission
00:51:29
Very well then.
00:51:31
It sounds to me like there may be a motion to table this for further work.
00:51:37
Is that a correct statement?
SPEAKER_09
00:51:39
Do you need it as a motion, sir?
George Goodwin
Member, Planning Commission
00:51:40
I think we would need that as a motion, yes.
SPEAKER_09
00:51:43
Mr. Chairman, I would like to make a motion that we table this to a later date.
George Goodwin
Member, Planning Commission
00:51:52
Should we table it to the next meeting?
SPEAKER_09
00:51:56
Make a motion that we table this to the next meeting.
George Goodwin
Member, Planning Commission
00:51:59
Very well.
00:52:00
Before, well do we have a second?
00:52:02
Second.
00:52:03
All right, moved and seconded.
00:52:05
Discussion.
00:52:06
Yes, discussion.
SPEAKER_08
00:52:08
And Mr.
00:52:08
Chair, what about the public hearing aspect?
00:52:11
Are we closing that or when we bring it back will we be able to reopen it?
George Goodwin
Member, Planning Commission
00:52:16
I'm afraid the public hearing has already been closed.
SPEAKER_08
00:52:23
Mr.
00:52:23
Chair and Council, if we separate these two into campground and workforce housing,
00:52:33
Does that allow us then as a separate legislative, not legislative, but commission piece of business to open a public hearing again?
00:52:43
I think the public should be able to hear it if we're going to bring it back significantly different.
SPEAKER_10
00:52:48
Come up with a completely new proposal that needs to be advertised if it's too different from the one that's here.
George Goodwin
Member, Planning Commission
00:53:00
If we were to make two separate proposals, one for campground, one for workforce housing, I would think workforce housing would be a brand new entity that would get discussion.
00:53:17
Campground, I suppose we would be under the existing
SPEAKER_10
00:53:22
I would suggest giving you and Miss Smith the opportunity to discuss this.
SPEAKER_08
00:53:41
I really would think the public ought to be able to speak on this since we are revamping it and they deserve a right to speak on whatever we're going to bring back.
George Goodwin
Member, Planning Commission
00:53:52
Mr. Dickerson.
SPEAKER_02
00:53:56
Would it be better if the motion was amended to afford the Board of Supervisors as a recommendation to reject it and re-evaluate it as workforce housing and campground so that we could have public hearings on both of those issues at a future time once we rework them both?
SPEAKER_08
00:54:16
Whatever works, I'd just like for the public to be able to speak.
George Goodwin
Member, Planning Commission
00:54:22
Well, absolutely.
00:54:23
Mr. Barlow.
SPEAKER_13
00:54:26
I think you can reopen a public hearing if you want.
00:54:30
It just means that it's going to be re-advertised.
SPEAKER_10
00:54:33
Yes, it's going to be advertised, public advertisement.
00:54:35
I said you can re-advertise.
SPEAKER_09
00:54:38
Just because you closed it.
George Goodwin
Member, Planning Commission
00:54:39
If we can reopen it, then we'll do that.
SPEAKER_11
00:54:43
Re-advertise it.
George Goodwin
Member, Planning Commission
00:54:45
Ms. Butler, you're taking notes.
00:54:48
We'll need to re-advertise.
SPEAKER_05
00:54:50
I do have one question just for clarification because it sounds like there may be substantial changes that we need to make to address the issues that you all have brought up.
00:55:05
Is this something that
00:55:09
We could bring up and do a work session on and then reschedule a new public hearing to make sure that we, because if we bring back another document
00:55:24
and it doesn't address the issues that the Planning Commission has brought up.
00:55:28
We're going to be right back in the same position again next month.
00:55:32
And I think maybe to bring another document, work with if it's still Mr. Painting and Mr. Quarles as part of that work group on some more changes and bring it back into a work session format again next month, then we would know going forward if we're headed in the right direction.
SPEAKER_03
00:55:54
Does that work?
George Goodwin
Member, Planning Commission
00:55:56
Very well.
SPEAKER_05
00:55:56
So legally I just want to make sure.
George Goodwin
Member, Planning Commission
00:56:00
So the motion should be that should still be a table or should be?
SPEAKER_10
00:56:08
We're going to table it.
00:56:11
We're going to table it now, but it's going to be for us to bring it back next time.
00:56:19
Work session.
George Goodwin
Member, Planning Commission
00:56:20
Very good.
SPEAKER_07
00:56:23
To clarify on this, in this work session what we're looking at is a couple things on both sides, minor and major.
00:56:49
But I do agree with George, and I've looked into it this month too, but I didn't want to want George to deliver that.
00:56:56
He's put a lot of work and thought into this.
00:56:58
And there is so many ways this can be taken advantage of in a complaint based county and minor.
00:57:04
And I've just been sitting there all week long thinking of all the ways this can be taken advantage of.
00:57:09
So when we're taking this back to review,
SPEAKER_01
00:57:12
Are we looking at removing minor altogether and just going with a major definition and qualifications?
SPEAKER_07
00:57:20
Because when I think of a minor or workforce housing, I think of adu is substantially greater in so many ways than this, but that's just from a structural standpoint.
George Goodwin
Member, Planning Commission
00:57:32
But are we looking at adu adu
SPEAKER_07
00:57:37
Accessory drawing unit.
George Goodwin
Member, Planning Commission
00:57:38
Accessory drawing unit, thank you.
00:57:40
I didn't click in, sorry.
SPEAKER_07
00:57:41
And those, and our requirements on those, blending, correct me if I'm wrong, but they need to be no greater than 50% of the square footage, conditioned square footage of the main house.
00:57:53
So if somebody has a house on three acres of land and that house is 2,000 square feet, the max ADU they could have is 1,000 square feet.
00:58:03
which is actually pretty nice for a workforce housing that's mainly sleeping there and then going to work.
00:58:09
It's much suitable workforce housing than a camper.
00:58:15
So when this goes back and look at, just to be clear, are we looking at potentially removing the definition of minor altogether and refining major in this revision?
George Goodwin
Member, Planning Commission
00:58:27
I would think from what we've heard,
00:58:31
Evaluate Removing Miner.
SPEAKER_07
00:58:33
Okay, that was a better choice.
George Goodwin
Member, Planning Commission
00:58:35
Evaluate major campground and evaluate workforce housing as a separate item.
00:58:46
Thank you.
00:58:46
Make sure that the ordinances that we finally produce address each other properly.
SPEAKER_07
00:58:53
Thank you for clarifying that for me.
George Goodwin
Member, Planning Commission
00:58:55
Thank you for helping me clarify.
00:59:07
We can talk after the meeting.
00:59:18
Mr. Goodwin, does this plan address your questions and concerns?
SPEAKER_08
00:59:23
Absolutely, and I appreciate it.
00:59:25
I do appreciate it.
00:59:27
As I said, I don't think this is ready for prime time.
George Goodwin
Member, Planning Commission
00:59:31
Very well.
00:59:32
Mr. Dickerson, yours as well.
00:59:36
Yes.
00:59:36
Very good.
00:59:39
All right.
00:59:40
The chair would entertain a motion to table this item for further work on clarification or potential removal of or evaluation the removal of minor campground
00:59:58
and further clarification between major campground and workforce housing to be represented in a work session in September.
SPEAKER_09
01:00:17
Do you want me to remember that in regards to that?
01:00:19
So moved.
01:00:20
So moved.
01:00:21
Absolutely.
George Goodwin
Member, Planning Commission
01:00:24
Moved and seconded.
01:00:25
Any further discussion?
01:00:29
Yes.
01:00:31
Yes.
01:00:33
Yes.
SPEAKER_08
01:00:34
Yes.
George Goodwin
Member, Planning Commission
01:00:39
Very well.
01:00:40
Thank you.
01:00:42
Next item is new business and I don't believe we have new business at this time.
01:00:51
Discussion items, Ms. Buckler?
SPEAKER_03
01:00:56
We'll combine discussion with reports, how's that?
SPEAKER_05
01:01:07
was going to be a public hearing next month on a rezoning for Maple Creek Estates.
01:01:14
That has been postponed.
01:01:16
I'm not sure when that'll be coming back.
01:01:19
There are no Ag Forstel district applications for September.
01:01:24
They decided to take a month off, but you will have nine so far in October coming up.
01:01:33
A lot of work session.
01:01:35
items to go over in September finalizing the zoning amendments with TDR information and the campground information.
George Goodwin
Member, Planning Commission
01:01:46
So Ms. Buckler do we have any public hearings in September?
01:01:53
Then maybe what we should do is have a little bit of an extended work session in September and
SPEAKER_05
01:02:02
I mean we could, I'm not sure if we can extend the work, I mean we could start the work session at five, work till the regular meeting and then extend the discussions into the regular meeting under discussion items.
George Goodwin
Member, Planning Commission
01:02:13
But whether or not we need to have the regular meeting, that's what I'm saying.
01:02:17
If we don't, if we have no public hearings, we may not have a need to have the public, or to have the regular meeting, so we just have a work session and have that as needed.
SPEAKER_10
01:02:29
As a work session.
George Goodwin
Member, Planning Commission
01:02:30
As a work session.
SPEAKER_08
01:02:32
Yeah.
SPEAKER_10
01:02:34
Yeah, is that can we do that?
01:02:38
You're thinking there's gonna be no public hearing.
George Goodwin
Member, Planning Commission
01:02:40
That's why I just asked.
SPEAKER_05
01:02:41
There's no public hearings.
SPEAKER_08
01:02:46
Mr Chair, the bylaw does imagine.
01:02:48
Does allow us to do that.
George Goodwin
Member, Planning Commission
01:02:50
We just don't have a regular meeting and you're calling a work session so it's covered in the bylaws that provides time for the two pieces that need to be looked at.
SPEAKER_05
01:03:03
and we can confirm that and we'll let you all know.
George Goodwin
Member, Planning Commission
01:03:07
Let's work towards that path and that'll give us, it'll expedite the work we have and give us time to do it right.
01:03:14
Yes sir.
01:03:15
Thank you.
01:03:18
Anything further?
01:03:21
No?
01:03:21
Very good.
01:03:22
Then the chair will entertain a motion to adjourn.
01:03:26
So moved.
01:03:28
Moved and seconded.
01:03:30
We are adjourned.
