Whereas Angela Hawkins has served the Greene County Planning Commission with distinction, providing consistent leadership, sound judgment, and an unwavering commitment to orderly growth and long term welfare of Greene County.

And whereas throughout her four year term,

On the Planning Commission, Ms. Hawkins approached complex land use zoning and policy matters with clarity and directness, ensuring that discussions remain focused, substantive, and grounded in the adopted plans and ordinances of the county.

And whereas Ms. Hawkins demonstrated notable patience and professionalism in navigating challenging public hearings and deliberations, thoughtfully considering diverse viewpoints while maintaining respect for applicant staff, fellow commissioners, and members of the public.

And whereas during her tenure,

I am the new Greene County Chamber President for 2026.

And I just wanted to introduce myself to the board personally.

I'm also a resident of Greene County and a real estate agent as well.

As our county continues to grow, I do see an opportunity for collaboration with the board.

and other departments in the county just as we have such a close touch on our local businesses in our area.

And I would love to strengthen that collaboration and involvement with the county.

Our shared goal is to help existing businesses

businesses thrive, encourage new ideas, entrepreneurship, and encourage growth that benefits the entire county.

So again, just wanted to introduce myself.

I'll probably send out an email to everybody later on and just kind of get that dialogue going.

of the total expenditures shown on the current adopted budget, specifically a resolution authorizing a supplemental appropriation of $12 million in grant funds from the Commonwealth of Virginia to the fiscal year 26 budget for water projects.

And we'll start with the staff report.

I think the title kind of encapsulates the whole thing.

We have $12 million that we're very fortunate to have gotten from the state.

We need to appropriate it because it exceeds the threshold.

Ms. Kemp, Freedom of Information Act and Conflict of Interest Act Overview.

Thank you, Mr. Chairman, members of the board.

Welcome, Mr. Hartung.

So there are slides in your packet, and I am not even going to go through them.

So it doesn't have to click through them because they're way too many.

And I want to save something for you all to read on your own.

And I actually put it in the slides simply because it was already in there.

There are some slides on the Dillon rule.

We don't talk about it a ton on its own.

But if anybody has any questions, I'm happy to answer those.

So first with FOIA, Freedom of Information Act, essentially, FOIA basically is the state law that ensures that your meetings are going to be open to the public and that documents or records, county records are open to disclosure to the public.

So basically it's covering records and meetings.

and these things are both defined within the state code.

Essentially, meetings have to be noticed.

They have to be open to the public and in person for the most part, although there is a state code prevention.

After COVID, there are preventions for some online meetings that we won't get into because hopefully that will not happen again.

But essentially, where three of you are, there is a meeting if you are discussing public business.

That doesn't mean that three of you can't

Go to a wedding or an event or a public forum.

It's just important that you're not somewhere discussing public business together.

Sometimes there's questions about, you know, someone will email all of you.

Where we are right now with the email is that either you reply individually to the person, you know, whether it's me or Ms. Chavar or someone has emailed you, you apply individually or

wait so that you're not sort of like creating a almost like a an instant reply situation that could appear to be a meeting because you're kind of all kind of talking in real time.

As you know, you all do post your agendas, you post them online, you post them live on the bulletin board at the courthouse.

There are provisions for closed meetings and special meetings and things like that, which obviously we utilize and

we discuss beforehand so that they are noticed appropriately.

Committees of the board still need to be noticed, still have to take minutes.

Sometimes people try to call them different things.

Some people think a workshop is in a meeting.

I've literally had somebody ask me if I have a meeting or a gathering at my house, and I think the word super secret was used.

Yeah, that's still a meeting, and you can't meet at your house.

So that's sort of the first part of FOIA.

The second part of the records, which is on a document that's not subject to an exemption.

So emails, text messages, maps that planning and zoning might create, all of that is considered a record for the purpose of FOIA.

And there are many, many exceptions.

I think there's over 100.

public safety records, social services, things like that.

And so there are a lot of exemptions.

But for the most part, the day-to-day records are going to be subject to FOIA.

This includes any emails you may have on your private email, your personal email.

And I know a lot of times somebody may know you from church or wherever.

So they're emailing you on your personal account

IT can't search your personal account.

So the best thing to do is either try to get people to email you at your, you know, at gov email address or at Greene County.

Or sometimes, you know, I'll actually forward it to myself, like to the right email.

If somebody emails me, like my personal email in its business, they forward it to yourself.

So then IT will capture it when they go to do the search for whatever the FOIA is requesting.

And it'll save you a lot of time and

So the county gets a fair number of FOIA requests.

I'm not quite sure exactly how many, but it does have to be posted on your website who your FOIA point person is.

I believe that's Ms. Shafrick.

It still is.

So once she receives a FOIA request,

the county has to respond in some way.

And you have five dozen stays to do that.

So the clock sort of starts, it can be a fast turnaround if somebody is asking for a lot of things.

But the county does have to respond.

So they can either respond saying, here's what you've asked for, I need more time, or we don't have what you've asked for, or we need more time, what you've asked for is a really big ask and we're going to charge you a certain amount of money.

We can charge for copies and staff time because some of these do take, I mean, days for staff to go through because not only do they have to, ITS to pull the records, but then they you have to look through them because a lot of times, myself included, things kind of get mushed together and email strings or discussions or memos and some things may be a turning client privilege, but then maybe some of it not so

AI has not yet, I think, come up with a good way.

A lot of it has to just be manually done.

But maybe, maybe one day.

So also, FOIA requests, just remember they do not have to be in writing.

It can be verbal.

It can be, you know, ideally someone does put it in writing so that staff knows what exactly they want.

But it could be that someone sees you at Walmart.

and ask for budget numbers or something.

Technically, that's a FOIA request.

And the easiest thing for you all to do is to email that to Ms. Shafrick and she will facilitate.

But just be aware that you may not be thinking FOIA when you're at Walmart, but it may happen.

And again, while extensions are normal and granted all the time, there is a time, a pretty strict time deadline on this.

If you have a willfully and knowing violation of FOIA, there's a civil penalty between 500 and 2000.

The court can also issue injunctive relief if you're continuing, you know, the county court continue not to provide something.

Obviously, that's not the position we want to be in.

And, you know, generally, knock on wood,

does not happen.

There is training.

There's the FOIA Council at the state level.

If you have questions, they do issue opinions that are a little bit more searchable now than they used to be.

So if you have questions, please ask me or Ms. Shafrick or FOIA Council.

And they also do exciting trainings, just like this one, for more in-depth

questions that you can attend.

They used to be in Richmond.

I can't imagine they're not some virtual option.

Can you still do your FOIA online?

I mean, most places, is there a form online you can use here?

There is a form that we have available.

Most people say see attached because it's like a list of questions or they just send the questions and say that, you know, like an email, you know, as Ms. Kim's saying, it doesn't matter what format it comes in.

We have to respond.

They don't even have to use the words FOIA.

Oh, the class.

I don't know.

I can try to look into it.

I haven't heard that.

That's interesting.

Okay, conflict of interest which it is kind of a conflict of interest month here.

It is a really narrow rule and it doesn't mean conflict the way you would use it in your day-to-day life.

It is a really narrow law and the definitions within it are very narrow.

For example, you

It says immediate family.

So you or your immediate family cannot be part of a contract or a transaction that will essentially financially benefit or harm you.

Immediate family is defined as your spouse and a family member who lives with you that is your dependent.

So if your adult child is living with you, but they are not your dependent, they would not

be considered immediate family under the Conflict of Interest Act.

I think any of us would say that our children are our immediate family, like just in the vernacular.

It also is a little bit tricky.

I had a question about a live-in girlfriend, boyfriend person.

The thing that I don't know when I'm being asked that, I have no idea who your dependent is, and if that person might be, you know, they're acting sort of like a spouse, but they're not.

I have no idea about individual finances.

So conflict of interest is very, very narrow, and it's very particular to each one of you.

Obviously, you would have different conflicts.

So just keep that in mind when you think questions arise.

Broadstroke covers personal interest in a transaction or a contract.

So if you all have a company or you can benefit from a contract, you probably need to come to me and let's have a conversation about it and kind of work through some of the facts because it's all very fact specific.

Conflict of interest also prohibits gifts.

As you know, you all cannot accept gifts.

I mean, you can accept gifts from friends and family, of course.

Don't get me wrong.

But if the Wawa has been sending you, I don't know, whatever Wawa would send you, gas cards or something, you can't accept those.

If you go to a

a conference and they're all handing out koozies or things like that, that's fine.

There are certain exceptions for the gifts if they're de minimus, if they're sort of being handed out at a conference to everyone, all of that is fine.

Please feel free to ask.

Sometimes people have gone to conferences and I guess it's like a raffle and some of the prizes are really, really good.

So we have had that come up from time to time because they're $500.

It's a Yeti filled with all kinds of stuff and they're expensive.

So please ask and we'll research it and get you an answer.

Conflict of interest, violating it.

Again, it's very fact specific, so it can be a little bit difficult to know without getting some legal opinions what truly is a conflict in terms of what the law says versus a conflict of just

sort of public opinion conflict.

If you have a question or a situation that you think you may have a conflict, my best recommendation is always to come to me, let's talk about the facts.

I generally will write an opinion, assuming there is not a conflict, saying there's not a conflict because it doesn't meet these standards.

And an opinion from the county attorney can be used as evidence

and a trial for conflict of interest.

I then forward, of course, with your permission, I then forward that to your Commonwealth's attorney because a letter from the Commonwealth's attorney saying there's no conflict of interest is an actual bar to prosecution.

So that is actually the get out of jail free card letter.

So that's generally how I do it because a conflict of interest, if you are found guilty, it is a class one misdemeanor, which

I think it's a big deal.

It would be to me.

And knowingly violating, making a misstatement on your financial, your economic interest forms is actually a class five felony.

So just be aware of that as you fill those out.

So again, they're very fact specific.

If you think you have an issue, please come talk to me.

If you don't feel comfortable talking to me, you can also talk to the Commonwealth's attorney.

I think

Just be aware when you're talking to an attorney, which attorney and who they represent.

And Mr. Consolvo does not represent you all individually.

So that's my caveat.

But he's a wonderful person and very nice.

No, I just want you to know who, you know, when you're talking... What your friend is.

Well, sometimes people think that all attorneys are their attorney or, you know, like, and that's not the case.

So just be aware.

This has come up.

If you have an IRA retirement fund, you know, they talk about individual securities.

You can see the inference that if you own stock in Dominion Energy, that you would have a conflict of interest.

But what about the rest of it, ETFs in particular?

Yeah, so generally you wouldn't own enough of a company.

There are values within the code.

And I mean, great if you own that much of Dominion.

But usually, especially with like that kind of thing, you don't own enough to make it sort of tip the threshold.

Now, if you felt like you did, you can always also, even if it doesn't fit into the code, like maybe you just

you feel like you would be enhanced if Dominion got an easement or something, I don't know.

You can always recuse yourself just, you know, sometimes the appearance of a conflict is every bit as important as having an actual conflict in the form of public opinion.

But generally, you know, if you have retirement accounts in a certain, like Luckstone, if you had a retirement account with them and they came before you for a CUP,

On B, I had a question, so I assumed that it was just

something to give the county administrator authority to sign that agreement.

But I found in our packet a resolution to establish authority of county administrator of Greene County, Virginia.

So it goes through broad authorities, like I don't remember us ever adopting this.

But then when you turn it over on the back, it has the further resolve that the county administrator has the following delegated authority from the board to sign the American Tower thing.

So I think we're confusing two things.

This resolution needs to be addressed in and of by itself, if we have adopted it.

I don't remember adopting it, but I would like a simple resolution that just says we give the county ministry, we authorize the county administrator to sign the lease for American Tower.

Does anybody else feel the same way?

So is that possible to do a resolution for that real quick, Ms. Shevrick, or do we just resolve to give you that authority?

So right.

I think part of and looking at this, it's the authority from when I was appointed was restated.

But let me let me double check that.

But the issue is we've got a small lease payment that we, you know, for a tower that for an antenna that's on top of the water tower and they just need the authority to sign off on it.

I guess my other question is about the resolution in general because it gets into some heavy, heavy, heavy

Yes, and it was based on what the statutory authority for county administrators is in the state code.

I think it's a restatement of that.

I'm not leaning on Kelly because it was part of me being appointed.

I mean, it basically gives lots of power to that position.

and this was the 2023.

Yeah, when you look at 15.2, 1541, there are

I guess they list eight sort of responsibilities for the role of county administrator.

And then I think in this, there's also, so, you know, if you named her as the purchasing agent, you know, you could pick someone else, I guess.

She sort of spoke to the Board of Supervisors.

Some localities will have

Some localities do have a clerk that isn't the county administrator.

Just depends.

The statute does say that you all need a FOIA officer or a FOIA coordinator in the statute, but that's also Ms. Shafrick.

I just think we need to readdress this, not tonight, but at a different meeting.

Obviously there are constitutional authorities of a county administrator and a board member and everything else, but that gives absolute authority for lots of things that I know this board's pretty interested in.

So maybe we can do that on the next agenda, work something out, or review it and make sure it's still pertinent.

That is a day that's set aside and organized by the Virginia Association of Counties for local governments to come and meet with their elected representatives.

It's a kind of a soft lobbying day for local governments.

So it's kind of set aside for that.

And there are several, several pending things that

We don't have to decide today what our theme is going to be, but it's obviously been important for us for the last couple of years to be there.

It really makes a big difference when they're starting to vote on things that we care about.

Two things that I think Greene County is going to care about that are proposals that are sitting with the money committees now

is the change in LSI and how they calculate that.

It will mean a lot less money coming to Greene County schools.

And then there's also a change in the formula for reimbursement for the Children's Services Act, which also means a lot less money

coming to the county, and both of those are required functions.

So it just means we'll be doing the same what we're doing with less money.

And in the case of CSA and social services, there's actually, and I said on the CP&T board, a lot more demand as you might expect.

So those might be two things we care about as well as, you know, like there is, we already, you know, said what our legislative priorities are with TDPDC.

They're going to be there on behalf of

our region saying here's what the localities are but this would be a chance you know you meet for like five ten minutes with each one and you know like you just go around and it's also a there's presentations and there's a lot of updates on what the current legislative hopper looks like because that's a very dynamic situation in Virginia they're passing thousands of bills in like a month and so it's

also a good so there's very little chance to weigh in before they vote from a time of bills introduced to so you're really having this one chance to say here's the things we really care about we care about local autonomy when it comes to land use decisions we care about you know all the things that we talked about in legislative

But I went back with Farm Bureau and I took Mallory with me and we sat in it.

I know we've had a long extended holiday, so anybody remember what they did in December?

Soil and Water Bank went to, I think I mentioned that the last meeting, and they had a Christmas dinner, a lunch rather, at Grays Mountain Lodge, that went well.

The last time at Jefferson planning, they'll set it on there.

They're redoing their whole renewed release on that building down there.

And basically, they're remodeling the whole building.

So I think the next meeting in February should be back to a regular meeting inside the building.

Just do want to do a quick year in review like for the last two years.

You know this.

It's always good to stop and look back at all the things that you know the board accomplished.

So going through.

OK, so firstly, thanking all the board members for their service.

And we added Matt, so he just started.

This is your board.

I've organized them under themes that we use for the budget, community engagement.

So we've added more modules to the Citizens Academy.

We supported a lot of community events.

We had a free tire day, which was very popular at the transfer station.

We created a budget book in addition to the citizen's guide and participated in the annual toy drive.

We've had a lot of great infrastructure projects, celebrated the start of the funded reservoir project.

We had a lot of department moves that were successfully done, so everybody's in good space now.

Started work on the $730,000 grant we got for park improvements.

We've already improved the concession stand.

The restrooms are winterized.

the gates up and we need to do you know the parking lot and the lighting which are the big projects but we've got those time to not interfere with soccer so we're looking forward to that

We had to do some work at the voter registration office.

The trailer over there had a massive leak and problems with the HVAC.

So that was fixed.

The floors replaced where they were damaged.

The door actually almost had to wrestle with it to get it open.

So that's been replaced and then painted where the other damage was.

Some examples of agency innovation.

There's a clarifier and some other big pieces of equipment at the wastewater treatment plant that have been working for 15 years, and we've finally gotten those repaired.

and Fick staff was able to get those working right.

Created a cross training program so that water operators can get some experience to be able to sit for wastewater operator licensure as well as get that cross training and vice versa.

Wastewater operators have been over the water treatment plant and so everybody's really improved

their licensed stature.

We had to develop our own Greene County EMS pharmacy.

It was an unfunded mandate from the state.

Everybody had to do it and we're continuing to work on the Route 670 connector road project as a locally administered project and you just advance because it's definitely.

We've gotten awards.

So we had the VACO Award for the Citizens Academy.

We got awarded the $12 million.

And we had our Parks Department, which does so much great stuff, at the Virginia Recreation and Parks Society Annual Conference.

They got two awards, a snapshot moment and the most creative marketing strategy.

and then these are just some stats.

The number of EMS calls in this county has never exceeded 3000 and we went over 3000 in 2025.

The number of stormwater inspections 1400 inspections and we have one person who's who's doing that and that's something that we charge fees for.

We've received, you know, $12,782,230 last year.

calendar year.

Park program registrations, likewise double-digit increases.

We've had 130 dogs adopted out.

That doesn't even include the ones that have been fostered and some other work that's being done with dogs.

And then just the number of vehicle maintenance work orders.

So these are all the work that's being done in the cars that the county owns.

So it's

These are all getting to be big numbers.

So lots of people on our staff get elected to different regional or statewide boards.

So I just want to give you a flavor of how that happens, because Greene County is participating regionally.

And I think that's good for us.

It's good for the region.

and it's a good experience.

People like being able to do that.

So I just wanted to provide you a quick list.

And then that's pretty much, you know, we're just looking forward to tackling the challenges in 2026 and keep going.
