I just have a very brief announcement just to remind everybody of the GO Virginia program.

The Virginia Initiative for Growth and Opportunity was initiated recently this past year by the General Assembly and the Central Virginia Partnership for Economic Development has expressed interest in managing an anticipated regional implementation plan.

I see Ms. Cawthon is in the audience.

The resolution Council will vote on this evening as part of the consent agenda supports the GO Virginia initiative to strengthen our economy in the region.

And the Council agrees that the success and sustainability of Virginia's economic future depends on strong private sector growth and supports the state policies that encourage business, education, and local government.

I'll do the announcements first.

The Rose Hill neighborhood is celebrating its 100th year as a neighborhood, as a named neighborhood.

They're going to have a big party on Saturday the 10th, that's this coming Saturday, from 11 to 4 at Washington Park.

So stop by and celebrate Rose Hill neighborhood.

Also, the Dave Matthews Band is being featured in a documentary on TNT on television on Sunday evening at 10 p.m. for those of you who can stay awake that long.

It is featuring their community, so it'll be, there'll be a lot of people in Charlottesville are in it, a lot of organizations that they've supported in Charlottesville are in it.

I think it's gonna be a very interesting program.

And then the proclamation.

is proclaiming Pride Festival Week 2016, whereas the City of Charlottesville is a community that values human rights and respects the dignity of each person, and whereas the City Council of the City of Charlottesville is committed to equal rights for all Americans and opposes discrimination in all forms.

and whereas on May 20, 2013, the City of Charlottesville established a Human Rights Commission along with an anti-discrimination ordinance that prohibits discrimination on the basis of sexual orientation and gender identity and whereas the cultural diversity and heritage of the City of Charlottesville

has been enriched by the contributions of its lesbian, gay, bisexual, transgender, queer, and questioning LGBTQ community and whereas the city's LGBTQ community members are integrally and actively involved with our city's health and safety, learning and innovation, economic energy, and quality of life,

and whereas the Pride Festival celebrates lesbian, gay, bisexual, transgender, queer and questioning community and its proud presence in the city of Charlottesville, therefore be it resolved that the Charlottesville City Council recognizes with pride the lesbian, gay, bisexual, transgender, queer and questioning community in Charlottesville and be it further resolved that the council proclaims the week of Sunday, September 10th through Sunday, September 18th, 2016 as Pride Festival Week in the city of Charlottesville.

Yes, I want to say thank you on behalf of all the residents in the Charlottesville area who are part of the LGBT community and allies

I'm going to thank you for this official honor.

As most of you know, this is a happy, joyous event, the Pride Festival, where all are not just tolerated, but welcomed and appreciated for who they are.

As my son's little league

Koch told me, it's the one event where Charlottesville truly shows up as what it strives to be.

Indeed, the festival does not just provide a safe place for the LGBT community, it's also an event that by drawing together more than 5,000 people from all walks of life, colors, ages, and classes, celebrates the fact that we, the whole community of Charlottesville, has become much more of a welcoming place and that we're closer to valuing all of our inhabitants

as well as the privileged few.

The pride that we all bear at this time is not a sign that we have arrived at or achieved success and equality, but it does mark that we are on the journey together to get there.

So thanks for being part of that journey and I invite all of you to be there Saturday at Lee Park on September 17th from 11 to 6.

That is the main festival.

There will be performances all day long.

It's extremely family friendly.

The local Methodist Church will be having lots of children's activities and cookie decorating and that type of thing.

And there will be food trucks and a beer garden and all of the other fun things that happen.

but we also have a week of events happening.

We're having businesses get together at Whole Foods on the 15th, we're having a film screening on the 18th and this Saturday will be the second annual Youth Pride Picnic at Belmont Park and that's really exciting because it actually draws kids from throughout the region.

We've had kids come to events from Orange, Louisa, Amherst, Waynesboro,

So clearly there's a need for that community.

So thank you so much for supporting that, and I hope to see you all there.

First, we'll start off with voter registration.

So here's an announcement from the voter registration office.

There are only 62 days until election day.

are you registered to vote at your current address.

You can check your registration status online at elections.virginia.gov backslash voter-outreach or an easier way by calling the city's voter registration office at 970-3250 during office hours.

If your information is correct, you do not need to re-register.

The last day to register to vote or to update information before the next election is October 17th.

Call the voter registration office if you have any questions about where you are registered, where you vote, voter ID requirements, or absentee voting.

The office is open from 8.30 a.m. to 4.30 p.m. Monday through Friday in the City Hall Annex Building.

Another announcement.

The City of Charlottesville, excuse me, this is to think about and imagine a day without water.

So the City of Charlottesville has again joined our partners, the Rivanna Water and Sewer Authority and the Albemarle County Service Authority on September 15th to promote the Value of Water Coalition's campaign, Imagine a Day Without Water.

The campaign is to educate

the Charlottesville community on the value and importance of water in our everyday lives.

We will be holding the second annual kickoff event for the Imagine a Day Without Water campaign on September 16th on the downtown mall from 11am to 1pm.

The event will also mark the start of our student art contest to encourage our youth

to creatively convey the importance of water to the Charlottesville community.

Last year we had a large response from the community and involvement from our youth in our art concert.

And we have a proclamation that goes along with it.

whereas water is essential for everything we do in life and whereas we need water to make a cup of coffee, fight fires, swim on a hot summer day or consume a glass of water or even take a bath and whereas most sectors of our economy rely on water and without water our economy would grind to a halt and whereas while nature provides water it takes pipes, pumps, treatment plants and people working 24-7 to deliver clean safe water to our homes and businesses

and then remove and treat wastewater so it can safely be returned to the environment.

And whereas the staffs of the City of Charlottesville, Albemarle County Service Authority and Rivanna Water and Sewer Authority have joined to work together to locally promote Imagine a Day Without Water.

With each of these three governing boards adopting this resolution, therefore it be resolved that the City of Charlottesville, Virginia hereby proclaims September 15th, 2016, Imagine a Day Without Water.

to help Charlottesville residents and Charlottesville utility customers recognize the value of safe, clean water to our community.

For those who may be in need of a GED, I spoke with Ms. Susan Arnold today from the Adult Education Center.

The city is partnering with the Adult Education Center and we are offering GED classes

In order before you to take the GED class, you have to take an assessment.

We have scholarships available for those who would like to earn and obtain their GED.

The assessment dates, you just go down to the GED office, the Adult Learning Center, which is at the IGGS building.

You can take them on September 19th at 6 p.m. You can take them actually tomorrow at 10 a.m., tomorrow night at 6 p.m., every Wednesday from 10 a.m., excuse me, every Wednesday from now until

October 20th at 10 a.m. and then you can take it also on September 20th as well as the 27th at 6 p.m.

So if you need more information about earning your GED, please, please, please contact us and let us know.

The Black Male Achievement, the Charlottesville Black Male Achievement will be meeting.

We'll have our My Brother's Keeper kickoff on September 20th at 6.30 p.m. at the Jefferson School.

We'll be talking about getting our brothers involved

and not only skilled trades, but also the technology industry that is booming here in the city.

So we're trying to be well-rounded in terms of making the community a better place.

And also, Thursday at 6 p.m., the Blue Ribbon Commission will be meeting the Blue Ribbon Commission on race memorials and public spaces.

There's a really amazing conference that's being held in Charlottesville next week from September 14th to 17th called Human Ties 2016.

It's the 50th anniversary of the National Endowment for the Humanities.

It goes for three days.

We have coming to our community luminaries internationally from Salman Rushdie to

David Simon, the creator of The Wire, to all kinds of Henry Louis Gates, Melody Barnes, who is the Director of the Domestic Policy Council under President Obama.

Just a really extraordinary range of literary and artistic figures from all walks of life.

And they'll be here, free events, open to the public.

The website is Human Ties 2016.

Human Ties, they took out the I, there's no I in humanities I guess.

and Human Ties 2016.com.

And I encourage everybody in the community to come and meet and just, it's going to be an embarrassment of riches right here in Charlottesville.

It should be really, really exciting, really exciting.

Also one other item, this is going to be in our consent agenda, but it made sense to pull it out now and highlight it.

I'm very excited about this as the Go program that Ms. Galvin raised.

This is a resolution about online voting.

So the premise of this is the City of Charlottesville, we all believe, should do everything we can to assist citizens to register to vote.

Therefore, we've included this item on tonight's consent agenda, a resolution that provides for assistance with online registration through the City's Department of Social Services.

This expanded service will provide access to the new voting registration online website that has been offered under Governor McAuliffe.

on the public computers in the social services office, which is located in the city hall annex.

Anyone who holds a valid Virginia driver's license or a DMV issued photo ID can register or update the registration online via the Department of Elections website and with some help from the staff there.

And the resolution is going to state, and we are, I want to state, I believe that we're the first Virginia city to do this.

The Fairfax County unanimously passed a resolution a few weeks ago.

but will be the first Virginia city.

Be it resolved that the city council requests every national voter registration act mandated agency in office, the city of Charlottesville's government that has an information desk, an intake desk or other public serving desk and a computer with internet access easily available for public use to make it available for voter registration.

So thanks to staff for working with us on this and my colleagues for supporting it and it's a great effort for expanding the franchise here in Virginia when there's a lot of attacks to take it away.

Obviously there was a issue raised about the air conditioning at Crescent Halls and so we've been in contact with

Grant Duffield, the Executive Director of CRHA.

He's provided us with an update on where they are in terms of replacing the HVAC system there or improving the HVAC system there.

As we mentioned in the last City Council meeting, they brought in portable air conditioners to help with the hallways there.

They were asking folks if they were having problems within their units to call them.

and they would try to respond and address that.

They did have an issue with the old system.

There were parts for that system that had to be made.

There weren't available parts that had to be made.

Those parts have now been made.

They are actually in the hands of the contractor.

and the contractor will be installing the new parts.

They've looked at the new parts, inspected those.

They believe that the parts will work just fine.

They are putting the parts in on Wednesday and Thursday of this week.

So that should address some of the long-term issues when it comes to the chiller there at Crescent Halls.

And then in addition to that, Mr. Duffield has asked me to relay to

The Council and the public that they are going through an annual plan process with CRHA at this point and they are meeting with residents.

They've had one meeting with residents.

They have several more that are scheduled over the course of the next month and they're encouraging residents to come out and talk to them about their concerns.

about things that are going on in their neighborhoods, going on in their building right now, and asking for ideas for improvements over the course of the next year or so.

So six weeks ago a friend called me and told me about an issue at Crescent Halls and

It's still really bad over there.

It's taken a long time for anyone to reach out and do something.

The community has donated

over 100 fans just networking.

Unfortunately, there was one person at Crescent Halls that actually sent me personally an email telling me that the residents were lying and that they didn't need help.

That bothers me.

In addition, I had

and other people that have taken things, milk for elderly people, bread, food, vegetables and now they're being turned away.

This is not okay and it hurts me to know that our most fragile residents are going through this and it hurts me to have the Charlottesville housing people say that they're lying, they're not.

And if you've been out there, you can see it.

There's still the issue of mold.

I mean, it's great that the air condition is being fixed after the whole summer.

Now the residents are worried about winter and heat.

They go through this.

This has not been something that's just happened.

It's been this way for 10 years, but it's because the residents have felt comfortable reaching out.

and felt enabled that someone is listening that we the community are helping.

And we want to work together with you all.

We want you to reach out to whom much is given, much is expected.

And if you have situations within your home, I understand I have a lot of stress in my home, but I don't get paid to help these people.

I love doing it.

But there's a lot of things that need to be done.

And it's taken all this time for one person to go over there and one person to call me.

Me?

I mean, I'm not even a resident.

I don't live there.

But one person to call me and say, hey, I'm going to go over there and find out.

And that was Mr. Fenwick.

OK?

I mean, these people just want to be heard.

I don't think that you want to stay in a place that has mold and other issues that I don't really, I mean the bed bugs, it takes a two week turnaround.

We can do better than this and I do become quite passionate because it's wrong.

It's wrong.

And I want to challenge every one of you.

I don't care if you're male, female, whatever.

We have a place for you at Crescent Halls.

And it is so sad.

You cannot do this to people.

This is wrong.

And it just hurts me.

I don't even live there.

But I know how it is to be homeless.

I know how it is not to have things.

And I'm not going to sit back while this is happening.

And I'm asking you not to either.

These people couldn't even get here tonight because of the buses.

The terminal was locked.

These are most fragile people.

Please do something.

Reach out, Mr. Fenwick.

They're excited that you're coming and speaking with them and that you're reaching out.

And I appreciate that.

And I appreciate that you wanted to do the one week challenge even though you are a male.

My name is Bill Atwood.

I'm an architect.

I've been around about 40 years.

So I'm really here kind of as a reminder.

I have to tell you that I was here when the mall was built, and it took 18 months to build it.

But I don't think there's that many people who realize it took about 18 years to get it straight.

And during that 18 years, a lot of people in this community of all ilks, all walks,

pushed what I saw at that time I see today as a very heavy rock up a steep hill.

I mean we're talking people from University of Virginia, we're talking about Alvin Edwards, talking about Lee Middleditch, David Carr who ran Barracks Road.

All these people got together to push this big rock up this hill.

And it was hard work.

And we still push.

Every day.

We get up every day and push this rock up the hill.

Some days more than others.

But it's a challenge.

And people tell me, you know, it's like Boulder.

Boulder's bigger.

We're Austin.

You gotta be kidding.

I mean, we're a very unique experiment.

We're a very small town.

And we have been able to survive because people have contributed their time.

And lately, to be honest with you, some people are sitting on that rock.

and they're irritating me and a lot of people.

Either get off the rock or we'll push you off the rock because fundamentally we gotta push the rock.

We're still pushing every day.

We've failed in a couple of areas, clearly.

We wanted Charlottesville to be a more of a living community.

We wanted more residences and we need to speak to that every day.

It's hard and we wanted to support working people.

So I really have one thing after all the crazy causes I've been involved with all these years, been the Easter Bunny, everything.

Fundamentally, every vote you take, I ask you to do one thing for me.

You don't owe me this.

Think about the working person.

Think about, does this really help those who go to work every day?

They don't necessarily come here.

We're politically upside down in this country right now because working people feel like

Government may be pushing the other way.

And certainly the rock is pushed more when they're behind it.

And I'm worried now, as I'm older, that all we do is a lot of people that go to work every day and they're not heard.

And I'd like to see that happen more.

I mean, sure, there are causes that gain attention.

People will be happier as a community if they had a job and if they lived downtown.

The biggest disease in urban America now is young people can't live where they work.

And I don't want to be one of those groups.

When I sold my architecture firm, we only had one person in the county.

I live on Madison Avenue.

I came in reference to Crescent Hall.

My heart aches for every one of you up here because I think you're doing a marvelous job, not only as city council but also as some of you on the Charlottesville Redevelopment Housing Authority.

I've been in public housing over 20 years.

I lived once at Crescent Hall.

Sure there's some problems there, but it takes time.

The gentleman before me said the rock.

Well he understand pushing that rock sometimes is very hard.

and that rock need to be pushed and pushing.

When you pushing against that rock and making waves, saying we're not getting this and we're not getting that done at Crescent Hall, it's not true.

Sure, there's a little inconvenience right now, but look at the long run.

You know, smearing shards of redevelopment, having authority named through the mud doesn't help.

Getting out here saying you're not doing it for us doesn't help.

I mean, the young lady hollered, I don't think it's right.

Well, she haven't walked in the mile of anyone that lives in public housing, first of all.

She only going back what she hear.

Sometimes you can't believe everything you hear.

You have to see for yourself.

and I think they're doing a marvelous job if what they do do with what they have.

There haven't been anybody since Mr. Eugene Arrington that loved public housing.

This was a man up before six in the morning and the last thing at night running through his, it's his say, his complexes.

But all that's just to say, hold on, hold out.

and things are going to get better.

Crescent Hall will get better.

But don't let one or two or three of you come in here and say, oh, this is so wrong.

Ma'am, if you could address us, it makes it a little easier.

Oh, I'm sorry.

No, you're doing great.

But that's because my heart aches when I saw on TV lesson there will be a protest

I'm not a person to come out that often.

This is one time I had to come and I had to speak.

I think in the last three months I haven't been out but twice and this is my second time.

Just hold on.

It is going to get better.

Regardless what negativity that's going about, it will get better.

Hello, my name is Peggy North and I live at 208 Gresham Hall.

She said that things are getting better.

Well, maybe it is, but in my opinion, I don't think it is.

I wonder if y'all live in a hellhole like we do.

Wouldn't y'all like to live

not live with a mildew and mold in your house.

Well, we live in mold and mildew every single day.

There are mold and mildew in every apartment in there because the reason why I know is because my friend had his bathroom walls completely out and he seemed to mold in between

the walls of those apartment buildings.

I never had to have inhalers until I moved in Crescent Falls.

Now I'm on four inhalers.

I'm on one anesthetizer, and I'm on four oxygen tanks.

I have to have them every single day of my life to breathe.

and I have got mold inside my apartment and maintenance, I don't know, I've heard that, even if we got any maintenance, ma'am, but my son had a seizure about a month and a half ago and the hallway flooded out

and the floor got soaking wet, the carpet in the hallway and maintenance took the borderline up and the borderline is still not out and I've called numerous of times and times and times again for them to come back and fix it.

They have not fixed it and I had bed bugs and they did for bed bugs and they took the

and the one that stayed out of the little room lock and they said that a maintenance would come and put it back and I would call and call and they would not come back and my son and I told him do not fix it

because he's easily affixed things around the house.

And I told him, don't do it because it was Nathan's job to do it.

And so I don't know what's going on with them.

But I know one thing.

Something's got to be done.

I'm President of the Tenant Association at Crescent Halls.

I'd like to thank Ms. Carey and Jojo for starting this Caring for Crescent Halls page.

Also for everyone who is interested and even cares about what goes on at Crescent Halls.

I'd like to say thanks for the personal comments, but that's a perfect example of how people want to divide and conquer us.

I also would like to commend the residents of Crescent Halls for standing by each other while living in these conditions and though even elderly and disabled still coming forward and speaking up for themselves.

I'm proud to be a part of and a voice for such a strong, wonderful community.

We are being scorned and threatened for speaking out and wanting better living conditions.

We are shocked to see how little the City Council cares about

our neighborhoods, low income neighborhoods in the city.

We are shocked to hear about all the hotels and parking garages and other buildings being built all around us, but our building can't even be helped in any way as far as maintaining, upgrading, or especially redevelopment.

Some of the housing staff talk smart to us, and some of us are afraid to speak out on it for fear of losing our apartments.

Confidentiality has become a serious issue,

Communication is also a major issue.

Some people are not being held accountable for issues, and some issues are never resolved.

We would like to answer our own questions, especially about where we live.

Stop answering for us, especially if you haven't been there and seen for yourself.

We are people.

We may be elderly and disabled, but we can talk.

I'm Helen Cawthon.

I'm president of the Central Virginia Partnership for Economic Development, located at 2211 Hydraulic Road.

I'm also a Charlottesville resident.

Just wanted to thank you all for putting the Go Virginia resolution on your consent agenda today.

Essentially, that is a state incentive fund for localities to work together.

We think planning districts 9 and 10 will be combined.

The partnership already represents eight of those counties plus Charlottesville, and we also work with Rappahannock and Fauquier counties, the only two that aren't included in the partnership's footprint, through the Piedmont Workforce Network, which your own Kathy Galvin is currently chair of that council, which is a big responsibility and we appreciate her leadership of a difficult group sometimes.

I just wanted to let you all know that there is a $35 million total for this initiative, $30 million for actual projects.

What's exciting about it, we'll get regional planning money next year, probably in the second quarter of the year.

to actually begin regional economic development planning.

The money's exclusive for that purpose, but there'll be about 30 million dollars in project money available.

Those of you who don't know, about half of that will be competitive, and half of that will go automatically to each of the regions, which will be designated by the state shortly, on a per capita basis.

So we'll automatically get some money.

The regional council that we'll work with will actually prioritize funds based on that economic development plan.

and recommend projects for approval to the Go Virginia board that'll be a statewide board.

We will know a lot more soon.

The work group has only met one time.

They meet again tomorrow.

And we'll be paying close attention to that so that we can update you all as we know more information.

But wanted to thank you all.

I'm here tonight to talk about Crescent Halls because I lived there too.

And when I was there, it was nasty.

And it hasn't changed.

I had Ms. Denny talking about a protest.

I didn't hear until I got here what the policeman told me.

I didn't know anything about a protest.

So the people that knew about it evidently was misinformed.

Where are the people?

I'm here to talk because people have been calling me and a few other people in Charlottesville letting us know how things are going on down at Crescent Hall.

There there have been posts on Facebook and stuff with far Brandon Collins putting up how things are going which people appreciate that because they want to know how things are moving and He seems to be telling them this things are moving in a positive way That's good.

But when you go down there things are still stagnant and

And you have a lot of people in Charlottesville that have money.

They want to push in and take over and kind of lead and say, this is my project, just because they got money.

And they donate money to y'all for y'all campaign and stuff.

And now that something is happening in Charlottesville that's probably going to go national, they want to get involved.

So they spread their money and lines to people and then they have people that they can actually, I'm not going to say it because I want to so bad, they'll BS people and bring them in here and say things that they really don't know what they're talking about until they go down there and walk those halls.

That's what you got to do.

You can't say I this and I that and somebody told me this and that.

Moving on to the public hearing resolution, we have a comprehensive plan amendment on the Streets at Work plan.

Heather Neumeier is going to be presenting.

And we do have a public hearing after this.

All right, thank you for hearing this tonight.

We're, Amanda, Ponzi and I are here tonight to present to you the Final Streets that Work Plan draft.

This kicked off in 2014, so it's been a long and exciting journey, and we want to thank Tool Design Group, who was the hired consultant to help develop the plan, and we'd also like to take a moment to thank all the stakeholder groups, including yourself.

Without all of the group's work, we wouldn't be where we are today.

So tonight we're going to give you a brief background of where we've been, what is Streets That Work, talk about the community process to date, go over what is actually in the guidelines, and then have time at the end for question and answer.

So to give you a brief background, in February 2014, City Council adopted a complete streets resolution that directed the city to design and build streets that are designed to work for all users.

This chart is showing you that streets that work plan is just one outcome of this resolution, where the guidelines recommend designs that balance the use of Charlottesville streets.

This figure touches on how the street cell work plan is a part of the greater whole.

The street cell work plan pulls from the bike and ped plan, which was approved and adopted in 2015.

We've also partnered with Crystal Rittervold, who's been working a lot with the green infrastructure program.

And then this will greatly inform the code audit, which we will hear presentation and work plan on that later this evening.

So what is streets that work?

So the plan is a comprehensive plan that pulls from complete streets principles and ultimately rethinks the way that Charlottesville's existing and future streets are designed so that they will function for all users and create a sense of place.

The plan includes a set of street guidelines that will aid in future and street designs and prioritize transportation improvements citywide.

The guidelines will truly be applied to all streets that work, or not streets that work, street improvements so that could be public or private.

We actually have already started working with developers even with this not being formally adopted to really educate them on what the plan is and how they can incorporate some of the design guidelines into their future projects.

So any street improvement plan should be consistent with the vision laid out in the guidelines for that specific type of street.

So to go through this quickly, we again kicked off in May 2014 with a multi-day charrette.

Then we had a series of neighborhood meetings in November and December of 2014.

These meetings were great.

We went to all the different neighborhoods, as many as we could touch, and really gained a lot of feedback from these meetings on what citizens felt were hot spots or problem areas in the city.

The map that you see in the middle picture is actually one that was used, all the information that kind of feeds that map was used in the implementation process of this plan where we lay out priority intersections and corridors for the city.

So then in December 2014 we had the greater public input meeting and also adopted our steering committee and then in March the steering committee started meeting.

So one of the first things that the committee was tasked with doing was really nailing down and hashing out what the ideals of the streets that work in Kodak would be and that formed into the guiding principles which you see here.

So in summer 2015 a lot of you attended these but we partnered with three local community events and kind of went out to these events and set up a table and just really talked with the community about what Streets That Work was.

We had some games as you can see in the pictures where even children could play and really take what they felt what they desired in a street and put it out and prioritize it for themselves.

and this was also an opportunity to inform for the upcoming Streets that Work Fall Open House and then in January we gave you an update and in March we had the final Spring Open House and then, go back just for a second, so what's not listed here is then in April we had a joint work session with City Council and Planning Commission and the committee just to hash out a few more things before we finalized the plan and then in June we had a public hearing with Planning Commission and they did recommend approval of the plan

So in the Streets that Work guidelines, they break down the framework streets in Charlottesville and go over the street typologies.

Then they go into further detail and provide design parameters for the street elements, so what makes up a great and complete street.

And then further goes into implementation plan and details out the priority intersection and corridors.

So I'm going to start going over the street typologies.

This chart gives an overhaul of the six street typologies that were laid out for the Charlottesville framework streets.

And really quick, I just want to note what a framework street is.

So these are the most direct routes throughout the city that connect places, neighborhoods, districts and also serve as emergency vehicle routes.

These streets form the basic structure and network within the city.

And the way they came about these typologies were using existing conditions of the streets.

So for example, a number of travel lanes, presence of center turn lanes or medians, sidewalks, on street parking, as well as bicycle facilities.

And they also took into account the land uses that were adjacent and they took these from the future land use comp plan map.

and Amanda will touch on this later but the majority of our streets as shown in this map are actually local or non-framework streets but she'll like I said touch on that later and they were not given a specific street typology just because of the variety of context so really one of the things she'll go over is the fact that you know we have these local streets but they have defining characteristics so really to truly plan for these streets you can pull from some of the design elements listed in the other typologies.

So the next part of the plan breaks down into cross sections and there are three types given for each street typology.

You've got the existing condition cross section and the retrofit scenario which is going to be the majority of Charlottesville just because we face streets that are limited in right of way and then finally the unconstrained right of way cross sections.

So in interest of time, we just picked the downtown cross section to show you, but if you have any questions at the end on any of the others, we can answer those.

So here, this is the existing cross section.

And just to give you context, an example of a downtown street would be Garrett or Water Street.

And here you can see there's 51 feet of right of way.

So in the next cross section, which would be the retrofit, you can see what they've done is they've altered the traveling, which in the previous slide shows you as 14 feet.

They've narrowed those to 11 feet to allow for a curbside buffer where they can install street trees, and that's actually one of the highest priority ranked parameters in the downtown.

and then finally you've got unconstrained so this is the ideal situation if you were to build a brand new street in the downtown which at this point is unlikely just because we are built out but it's always good to plan big so this shows you 58 feet of total right-of-way and they added addition on street parking which is another high priority element in the downtown.

And so then further they break down into actual design parameter charts.

So the cross sections are really just an example of the street typologies, what are good examples of what make up a complete street.

But these really get into the nitty gritty of what you can pull from when you're planning for a street or doing a street improvement project.

And each street typology, like you see here, lists the high priority street elements as well as the medium and then goes into specific design for each element.

So as Heather mentioned, local streets represent the vast majority of the street miles in the city and have a wide variety of design characteristics that need to be considered when making decisions about future design.

Local streets and commercial areas have different needs than local streets and residential areas.

And in many cases, assigning a specific typology could significantly alter the character of those areas.

So to maintain flexibility for these different contexts, the design guidelines recommend a maximum standard so local streets should not exceed the standards for a neighborhood B street type.

Streets that Work also introduces the concept of a shared street as an approach for local street design and shared streets are essentially low volume, low speed.

We're talking 10 to 15 miles an hour in which people walking and biking can safely coexist with people driving.

The downtown mall crossings are a local example of a shared street environment.

And so while Streets at Work introduces this concept more broadly, we really are going to need to work through developing specific standards that would be incorporated into the standards and design manual to ensure safe design.

So some of the design considerations would include things like, what are the appropriate traffic volumes for which a design like this would be appropriate?

How could we ensure that there are staging areas for passing traffic or emergency vehicle access and things like that?

So the street element chapter of the plan builds upon the recommendations for each street typology by providing additional information and guidance for the different elements that make a street work in all of its various capacities.

The chapter is organized in three sections, starting at the street edge with sidewalks, so the area between the curb and the property line, the roadway, the area between the curbs, and then intersections.

Chapter 5 describes the process for street design and construction, presents a prioritized list of corridor and intersection improvements, and recommends using pilot projects to alter streets on a temporary basis before making permanent changes.

So in terms of process, the city has a development review team in place to review

site plans for private development and the team is listed on the on the left hand side here so you can see all the different departments that are represented and it's recommended that the development review team also review plans for street projects to ensure the streets that work guiding principles are met.

Different types of street projects go through different review processes depending on the scale of the project and the lead agent.

And so the following charts show the basic process for street design projects depending on the project initiator.

So you can see on the left how it looks when a developer initiates a project compared to how a city would initiate a process, whether it's a CIP project or a retrofit scenario.

Throughout the planning process, citizens reported a number of street-related problem areas and needs for public improvement.

So this map on the left shows all of those different areas.

And because resources are limited, the Streets at Work plan developed a standard set of criteria to evaluate all of the locations that were identified throughout the planning process.

And the criteria that were used are shown on the left there.

Eleven total criteria were used and were assigned relative weights, which I'll show you shortly here.

So this map series shows how each of those data were used or how the criteria were used and mapped using GIS software to create heat maps.

And so this was kind of a layering effect that happened to create the prioritized list of projects.

So on the left, sorry it's not clear, but that is safety factors where this is where we had

Sorry, perceived safety, which was based on the public comment.

This represented all of the areas that received public comment.

In the middle, crash, actual crash data from the police department received 15 points, and then planned bike and pedestrian improvements received 10 points in the waiting.

On the left, places where there were missing ADA curb ramps and pedestrian push button access was mapped and that was given 10 points.

In the middle, locations of schools were given another 10 points.

On the right, 10 points were also given to the location of parks.

As another safety factor, we mapped those locations where there was higher speed limit and therefore a higher possibility of

injury or death related to a crash and so that was given five points.

Functional classification, those are those roadways that are designed to carry and move through traffic are highlighted and those receive five points.

And then bicycle and pedestrian demand, those locations that have a high concentration of businesses and employment and residences receive five points.

and last but not least transit stops and locations were given five points so you can see the density of location of transit and then other CIP projects so places where there might be a water line or sewer replacement

factored into these projects.

So all of these 11 heat maps were combined to create an overall map and a composite score that was based on the prevalence and assigned weight of each criteria.

And this map here shows the top 10 corridors and the top 10 intersections.

And so you can see that many of these are found around the city's downtown core.

with its concentration of jobs and residences and other amenities and other areas of note include the mixed-use corridors of West Main and Preston Avenue.

The top priority intersections are all located within, I'm sorry, the priority corridors are located also within a mile of the city's downtown core.

I'm sorry.

The priority intersections are located along priority corridors.

Sorry.

And many of these intersections carry high volumes of traffic, have complex geometries, and create barriers for bicyclists and pedestrians.

So this is the list of the corridors and then the list of the priority intersections.

So to close out the public involvement process, we temporarily demonstrated the design elements of streets that work along Second Street southeast between Water Street and Monticello south of the downtown mall in April in conjunction with the Tom Tom Festival.

And the pilot project really demonstrated how we could change the street, alter the street with narrower travel lanes, curb extensions, marked bike lanes, and provided an opportunity for the public to provide input.

We were really thrilled that there were hundreds of people that were able to experience streets that work live and have great interactions with CAT and our representatives from FIRE to understand how all of the pieces work together and we received a lot of positive feedback.

It was a fun event and I think it was really successful and so we wanted to thank all of the people that helped make that a success and a possibility, not the least of which, Tool Design Group,

the streets that work code out at Advisory Committee and particularly those on that committee including people, I'm sorry, volunteers from Place and the Bicycle and Pedestrian Advisory Committee, the Tom Tom Festival, the graduate students at UVA whose capstone course really helped pull a lot of this together, the Thomas Jefferson Planning District Commission and the Charlottesville area tree stewards who lent us some trees for the day as well.

In terms of next steps, we first would like to request that City Council support the resolution to include streets that work as an amendment to the comprehensive plan.

And as Heather mentioned, we are continually trying to apply the streets that work design guidelines to various projects, both public and private.

We have three projects that are

you know, lined up that we received funding through the HB2 smart scale.

Round one, East High Street, Fontaine Avenue, and Emmett Street that will allow us to really apply these principles.

We have the Locust Avenue pilot project that we are continually

monitoring and gathering speed data to test the effectiveness of that configuration.

We're also continuing to pursue state and federal funding for Streets That Work projects, which you'll receive an update later this evening on two different funding opportunities there.

And then last but not least, the code audit and standards and design manual update, which is also on the agenda later tonight.

I have, Mayor Signer, I have a comment and a couple questions.

First off, thank you very much for a job well done.

This is an excellent piece of work.

I never thought I would see this day when I introduced that resolution in 2014, so I personally thank you.

This is a beautiful job.

So after I said that I do have, of course it raises questions, because you're going to start using it, right?

So just to give you a hypothetical, so what if, and you're dealing with now redevelopment, and you've got some city blocks that have been made into big mega blocks, post urban renewal, so you know your average city block is about

250 feet by 300 feet as a rectangle.

And you've got things that are gonna be 1,700 feet by 1,000 feet.

How will you introduce this in a way that allows us to get back to walkable block sizes when we are redeveloping?

And this came up in the Green Infrastructure Workshop

And while they're coming up, just because the word redevelopment is sometimes used in different contexts, this isn't just public housing redevelopment.

Yes, it's general citywide redevelopment.

Exactly.

Yeah.

And I think one of the things that is discussed in the plan is block sizes and appropriate block lengths and things like that.

And so we would be kind of looking at that as a guide.

Obviously, we need to change our zoning codes with that particular item to be able to effectively enforce that.

That's on our radar.

And any reason, last question is, I understand the Planning Commission actually adopted this in June.

I have just a quick factual question.

So you kind of alluded to this and I just want to make sure that later we're going to be talking about the smart scale HB2 state funding and we have a couple of projects that involve intersections and pedestrian stuff and roads.

All right, first just a random question in your presentation.

Well, I'd like to echo the sentiments of the job you've done.

I'm a big

proponent of letting the city staff do a lot of the work that expensive consultants can do.

And I think you two have proven that the staff is more than capable of doing this kind of work.

So you saved the city a lot of money, and for that I'm very appreciative.

And just a general comment, I'll be voting in favor of Streets at Work because it is undeniably a decent effort at beautifying the streets of Charlottesville.

We must keep in mind that Streets at Work does not address transportation problems about which our citizens complain often and painfully.

Those are the problems of making life with vehicles in our residential neighborhoods safe again.

Streets at Work does not address critical safety problems because it is not designed to solve them.

The consultant for Streets at Work himself said in April that Streets at Work is not designed to address problems with speeding and irresponsible driving.

And I believe that.

And yet speeding and irresponsible driving are by far the most frequent transportation issues brought to us time and again by the residents of this city.

And those words in no way take away what I said about the appreciation that I hold for you two doing this.

I would just like to make one comment, Mayor Signer, if I may.

It is my understanding that a consultant, Tool Design, worked with the both of you to get this project done.

I want to add my thanks to you for a lot of work and a lot of thinking about our community's future.

I clearly went into this from policy and staff alike.

My name is Morgan Butler, and I'm speaking for the Southern Environmental Law Center.

Thank you for holding this hearing tonight.

We would like to provide some positive comments tonight on the Streets That Work plan.

Our comments will bleed into the code audit update that's scheduled as a later item on your agenda, but it's not for a public hearing.

I hope it's okay if my comments cover both of those related topics now.

Regarding Streets That Work, we urge you to adopt the plan as an amendment to your comprehensive plan.

The guidelines it contains will help ensure that our public streets better serve the multiple roles we need them to play by making walking, biking, and transit safer options for city residents.

This, in turn, will help pull more cars off the road, which helps limit air pollution and reduce the demand for parking.

But the guidelines are about more than just transportation.

They also contain elements that, once they're implemented,

will help enhance the vibrancy of city streets by encouraging street trees, improving sidewalks, and shaping basic aspects of building design that affect street life and the pedestrian experience.

We commend city staff and the Planning Commission for their great work on the plan, as well as the counselors who called for it and whose leadership helped keep it moving forward the past couple of years.

As for implementation, our understanding has been, and the staff's presentation

tonight indicated that the Streets at Work plan would be used to inform parts of the code audit.

And that's a good segue to the second part of our comments.

Looking at the staff report for that update on the code audit, it's a little unclear, but the scope of the work currently being proposed seems to have shrunk considerably from what was discussed during a joint work session and included in the white paper staff produced back in September of 2014.

It's not clear whether some key topics are still included, such as site design, building scale, setbacks, and parking ratios, just to name a few.

Instead, the staff report focuses on just two items, updating the standards and design manual, and completing the city's attorney review of what sounds like a much smaller subset of potential short-term code changes.

Much of what had been included in the initial round of code audit work is not mentioned at all, and we're concerned it could fall off the radar screen completely.

So we're hoping that when this item is discussed later tonight, the public will get more information on the scope of what staff is proposing to do, and more importantly, what staff is not proposing to do.

Once it's clear what staff does not expect to do, it's a lot easier for you as council to provide direction and determine whether a consultant is needed to move those missing pieces forward.

But those pieces are far too important to abandon or let fall through the cracks, and we ask you to make sure that doesn't happen.

This is a conditional release of road widening, drainage and public access easements to accommodate retail development at 1200 Emmett Street.

This is the first of two readings, so we don't need a vote tonight.

So before you tonight is a request to release

Easements at 1200 Emmett Street.

This is a property owned by Capital One.

This is currently at the intersection of Emmett and Barracks, the north side, and the contract purchaser, which is CA Land Holdings LLC, represented by Alan Taylor, which the contract purchaser is here tonight, too, which can also answer questions.

But there's a lot of some legal things I'll

defer to city attorney on, but basically there are some rights of way drainage and pedestrian easements in this property from 1962, which is an easement providing public street improvements, including drainage, road widening and sidewalk construction.

And then from 2007,

for sidewalk construction over the two entrances that used to be the gas station there.

And these easements were granted to the city in 2007 to close up that missing gaps.

And so the contract purchaser is asking to release these easements in exchange for some dedication of public right of way along barracks.

but this would be conditional release until the site plan is approved and the dedication of the easements are granted.

These easements would not be released until that happened.

They would be held.

Staff recommends holding these easements that are providing design constraint and financial challenges and

I can just give a little bit of information.

So this is a retail development on the north side that is working with the city and also with the CVS development which is on the south side to offer new road improvements to Barracks and Emmett.

which would allow two additional turn lanes and a widening of the road.

The easements that is there right now, which is all on the north property, there's room to provide those improvements, just enough room to provide all the improvements that would go into the intersection.

but again that's an easement and not a dedication so with the work of the other development who is also going to be providing right-of-way and with this development dedicating right-of-way there will be room to provide these intersection improvements and those improvements are being pursued through an HB2 grant.

So that's basically

Actually, I have a question.

Maybe Ms. Ponce can come up and see if there's any coordination.

Brendan Duckett, I'm the assistant city engineer and I'm putting together the HP2 smart scale for that.

Basically what we're taking, there's enough easement right now on this property on 1200 to accommodate the turn lane.

Between the two developments, they're taking all of that area and splitting it between the two.

So you're convinced that this is something that will help make that project possible?

I've been working with an attorney for the owner of the 1200 Emmett Street project and on the city side of things our absolute bottom line objective is to make sure that we

Hold on to sufficient right-of-way to make those improvements possible so we're working really hard to make sure that the the documents reflect that we don't give up any right-of-way on the north side until we know that the The other half of what we are ultimately going to need has been dedicated on the south side.

So those documents reflect those arrangements and

I think the escrow agreement will work well and the rest of it, the funding for the improvements and that sort of thing will come later and we'll address how those improvements take place through some separate agreements with the developers as they get started on their own work on their sites.

So I think these agreements in front of you are just the basic agreements that we need to put in place so that everybody can sort of

Hello again, my name is Heather Neumeier and I'm the planner for this area.

And tonight before you is a request for a special use permit for a restaurant drive-thru window at the property address 1248 Emmett Street.

The tax map is 40 and parcel 2.5 and the site is approximately 0.7790 acre and is an urban corridor district with the entrance corridor overlay.

The preliminary site plan in conjunction with the special use permit is proposing to demolish the existing Lord Hardwick restaurant and construct a Zaxby's restaurant in its place.

And for those of you who don't know, Zaxby's is a franchise chain of fast casual restaurants that originated in Georgia.

The proposed actually again fronts on Emmett Street North and the proposed drive-through location is at the rear of the building and the application also proposes a public easement to the city of Charlottesville for the future of Meadowbrook Road shared use path and creek improvements and this I believe is attachment four in your packet.

and the portion that they would be contributing will contribute a piece of what is needed for the greater shared use path that Parks and Rec is working on a plan for.

So noted in your report tonight is relevant code sections, one of which is the urban corridor district description, the entrance corridor overlay district description, as well as the entrance corridor guideline vision statement, and then the excerpt from streets that work that is specific to this parcel, the street typology mixed use A.

And so when staff was reviewing this, we all reviewed it in light of the current zoning, both the entrance corridor guidelines as well as the urban corridor district intent, the streets that work guidelines and the comprehensive plan.

While the proposed drive through window is predominantly auto dependent, the proposed conditions are believed to improve

provide improvements that follow streets that work guidelines, they mitigate potential adverse impacts, and they encourage the balance between vehicular, bicycle, and pedestrian traffic.

and you know I'll just note on a side that part of the application noted the amount of trips that go through 29 a day 61,000 trips so while it's important to balance pedestrian bicycle improvements which the streets that work plan enforces you know that was part of weighing you know a drive-through window could be appropriate here considering the volume of traffic as well so making those things meet and balance those two things are very important in the process

and so the planning commission leading up to the public hearing that occurred on August 9th reached out to the applicant in addition to the conditions proposed and asked if the applicant had considered providing a curbside buffer.

In your attachments you will see an updated site plan layout where they have actually switched and relocated the trees to go between Emmett and the sidewalk and provided tree grades so that they could still accomplish the seven foot wide sidewalk which is also noted as a high priority in the Streets That Work plan.

So the Planning Commission did recommend approval and the proposed conditions, which are listed in attachment one, focus on pedestrian improvements, the provision of bicycle facilities, limiting hours of operation and refuse collection, lighting and noise.

Many of the conditions I also would like to note stem from a series of meetings the applicant city staff in the neighborhood had where the applicant was agreeing to try to address some of the neighborhood's concerns.

Was there a question about the hours that one of the conditions the Planning Commission added was hours of 10 to 10?

Yes.

I think the applicant brought it forward and they can speak if I'm misspeaking, but I believe with the current condition and the way the hours are laid out, Zach's fees would not commit to coming.

And I understood that that time window was not only for the drive-thru in the restaurant itself, but also for garbage collection, was that right?

There was some talk at the Planning Commission meeting about a sound study.

So one of the things that I'm kind of having trouble with is that we approved the cookout and the cookout is up and running.

It's going well.

So the cookout actually, there was a building before its use and I can't remember the use, I think it was Long John Silver.

And so they had a drive-thru and so if a non-conforming use exists and a use comes in and doesn't change the building in any way or the use, it can stay without having to go through the special use permit process.

That is incorrect.

I know it's kind of like the hangout for the high school kids after football games and basketball games and stuff.

But when I mean issues, I mean like we haven't seen any fights or violence or

Can you speak, okay, a couple areas in the memo we got, which shows that the development is inconsistent with the comprehensive plan.

We're very accustomed to getting presentations from developers who apply.

They're very sophisticated and comprehensive.

A lot of money has gone to them in time meetings, but there's still, that's kind of the top level policy issue for us.

So, not to go through all of them, but I think

in terms of it being so auto dependent and the intent of the zoning districts states specifically that this is going towards a more pedestrian friendly environment.

But I will say in the staff report where it lists the deficiencies with the comp plan, there are proposed conditions to combat that.

And then the other piece of it is, you know,

The balance of having such an auto-heavy corridor and saying, okay, here's a use that would be seemingly appropriate because of the amount of cars, but having said that, we still want to uphold the comp plan and what it stands for and the Streets at Work plan and working those two together to mesh them.

you'll see in a lot of the proposed conditions having the improved pedestrian access points and having the providing the bicycle parking there and having the extended sidewalk and having the trees in between the street and the sidewalk which honestly I think

It does.

So that was referencing, there was a condition in there that said provide for outdoor seating and that planning commission opted to remove that condition.

So would there still be outdoor seating?

There could be, I think.

My name is Reed Murphy.

I'm one of the owners and partners at the building management company.

We're a local development firm here, and I know it's a long agenda after Labor Day weekend, so I'll be brief.

I really want to emphasize that we're a local presence.

We've really invested in trying to get to know these neighbors and understand their concerns.

But it feels a little bit like we are

Issues with enforcement with noise, lighting, trash are falling onto this future development rather than focusing on enforcing kind of the ordinances for noise and trash pickup and lighting that are already in place.

So we have worked closely with Heather to try to pay attention to the Streets at Work issues and the seven foot sidewalk in the front with street trees along Emmett Street.

We're willing to dedicate to Chris and the program for the trail easement along the back, along the creek.

We're willing to dedicate that land to the city for that purpose, because we think those are the kinds of things that make our city

Great.

The issue specifically about operating hours, we did go back to the franchisee, the potential user there, and asked them

you know how they felt about the operating hours because that came up at the planning commission meeting after the floor was closed and we didn't really have a chance to talk about that.

And they worked really hard with corporate at Zaxby's but the sense is it really puts them at a competitive disadvantage.

In fact, I talked to the guy, the Zaxby's franchisee this morning and he explained that probably their

The strongest competition in the market is Canes and they're not restricted in their hours, Cookout not restricted in their hours.

Are there hours they could live with?

Most of their stores close at around 1130.

Some of them are earlier, some of them are a little bit later.

So could they live with

So we're the developer and the property owner.

I guess when we made this application, we were the contract purchaser.

So now we're the owner of the land.

And when I've asked them, what can you live with?

Give me something that I can work with.

And their response is, you know, we can't we don't want to commit to that.

We don't you know, the corporate responses.

I don't know what they're going to approve.

So our hope is that we can be a part of a solution to manage the noise, manage the light.

So there's an existing stand of trees and landscaping along the back of the property kind of on the Emmett Street side of the creek.

And we've agreed to add an augment planting there along the top of that hill there with some red cedars.

So the

sort of updated site plan that I think is in your packet shows eight along one portion of the parking lot and then five more as you go further north along the back of the parcel.

There is a condition in the recommendation from the Planning Commission to provide an additional buffer in the

In the finger island that's between the drive-through aisle and then the drive aisle that goes on the very back of the parking lot and it's it's intentionally vague about whether that's a landscaping buffer or a concrete wall or there was some concern at the both at the meetings with the public and

at the Planning Commission meeting about some safety concerns there and whether you're building kind of an enclosed area between the back of the building and the back of the drive-thru aisle that might be a safety issue because it's not visible from other traffic or from other places in the parking lot.

So we asked that that not be part of the condition.

The Planning Commission felt like they wanted that in there and we'll agree to do that

and whether that's a wall or I think that can be sorted out in the site plan process of what that materiality of that screen is.

Well there's mainly just whatever buffer is between the drive-through window and the neighborhood.

I understand the neighborhood goes down that road, I mean it's long.

So that's fine what you said.

But before I forget, you know it's not too often

People come in here and the neighbors, the neighborhood say that they worked with us, that the applicant worked with us and I applaud you for that.

That's very important.

But the sound study as well, how would that work?

Right, and I appreciate you asking that question because we were a little bit puzzled by that ourselves.

I'm not exactly sure.

how we do a sound study for a building before it's built and we did reach out to the manufacturer of the squawk box or the speaker box for the drive-thru and get the acoustical information from them on the decibel levels and the readings from the box and it's 75 decibels at the, well four feet from the speaker and I think it's in your packet.

Julia Scarry with Drape Raiden Associates is our engineer on the project and

And while Reid's doing that, I'm Julia Scarry with Chaper Aiden.

The decibel level at the back property line is 40 decibels.

So it's well below the 55 decibels that Planning Commission recommended.

And it is used for the downtown corridor.

The downtown corridor.

So there's a chart in there that has concentric circles sort of showing what happens to the sound as you get further and further away.

That's for the speaker, right?

Excuse me for interrupting.

That was one of the big things that we heard from the neighbors was that certain other adjacent properties, the speaker from the drive-thru was their actual primary complaint.

Point well taken.

So, I think it's both.

I think there's, you know, there's enforcement opportunities there.

I reached out to the neighborhood watch folks thinking, is that a way that we can mitigate this, be good neighbors, and help be a part of the solution there.

So.

Yeah, I don't know.

We can restrict the volume on the loudspeaker where that's not going to change the high school kids after the football game.

Especially if they win.

I would like to make a motion that is consistent with what the Planning Commission approved

And I'm just going to say up front that I cannot support this project.

And here, there are three reasons.

The first one has to deal with the relationship with the conference of plan.

The second one has to do with the fact that the zoning is not enforcing that comprehensive plan.

And the third one, we are terribly underutilizing some very, very valuable land.

You're responding to the existing zoning.

I get that.

As a decision maker, I am looking at these other bigger picture questions.

So just for the sake of the people here and my colleagues,

When you read the 2013 comp plan about urban design and entrance quarters, this is an entrance quarter, it says, facilitate development of nodes of density and vitality in the city's mixed-use quarters.

Encourage vitality, pedestrian movement, and visual interest.

It says, emphasize placemaking, examine opportunities to create destinations, ensure new development, including franchise development, complements the city's character.

In the mixed-use corridor district itself, it states that it's to serve as a vital center for economic growth and development while encouraging development that's friendly to pedestrians and alternative modes of transport.

The streets that work that we just passed tonight calls this a Type A, mixed-use Type A street.

It says building design, siding, heights, and setbacks must define the street and promote pedestrian experience.

The section goes on to say that in most mixed use districts and neighborhood centers, it is more important to provide a consistent street wall to define the street as an outdoor room and to provide varied setbacks.

The building type and use does not provide a consistent street wall in this case.

There is more parking lot than building on this site.

It only uses 7% of the lot.

So again, the question I asked, are we simply ignoring our comprehensive plan and our entrance corridor guidelines?

I think we are.

So about the zoning.

So if we were really serious about implementing our comprehensive plan, how would that zoning look?

And we have a maximum building height established, but we don't, in a maximum number of floors, we don't have a minimum.

If we had established a minimum, for example, a minimum height, a minimum number of stories in our zoning, it would have pushed the envelope to be something more urban.

If we had insisted that our zoning promote active building with a much more greater percentage of the lot, as we've done on West Main Street, we would not have had only seven percent of the lot built out.

Why

if we have in our comprehensive plan a goal to evolve towards a pedestrian environment away from an auto-centric environment, why did the SUP chart allow a drive-through?

That's a clear example of how our zoning is not implementing the vision.

So I guess that, and then the third thing I'll just say, when you look at about an acre

Lot on West Main Street, for example.

Those are six-story buildings.

They generate about a half million dollars in property tax revenue.

This one little barely an acre site is $2,000 per year.

So we're not thinking about this in terms of

If this was even a two-story building built out at 80% of the lot, parking relegated to the rear, we could have doubled, tripled, tenfold the property tax revenue on that site.

This is really an underutilization of our urban land.

It doesn't comport with our comprehensive plan.

It doesn't even comport with the objectives of the zoning district itself.

And we've been, over time, just approving these single use

Auto-Oriented Uses and, you know, I counted them, over 70 SUP requests and rezoning requests in the four years I've been on council, and they've all revolved around this disconnect.

So I, at this point in time, I really, I really can't support another project that is not in conformance with our vision,

We either have to change that vision to comport with this existing zoning or change the zoning to comport with the vision.

You guys don't need to stand.

What I want to do sounds a little crazy.

Can I first ask Ms. Galvin a question about her comments?

Yes.

Because I just want to be clear that both the staff and the Planning Commission have said that this is more in compliance with the comp plan than not.

We all have to read the comprehensive plan and the statements that I just read to you.

I just couldn't see it.

I disagree.

Mr. Bellamy, so Parliamentarily, Mr. Brown, how does Mr. Bellamy ever second it?

So that's what we're, that's what's on it.

the Zaxby's which is the you know we know that when we do any kind of diversion from zoning and through a special process like this it goes with the property and not with the project and so at this point the project that we are looking at for this site is Zaxby's and I think there's a fair amount of support in the community they've been the purchaser has been very good with the community I think Zaxby's has come and talked to folks and so

and if Zaxby's has said that a 10 to 10 is a deal breaker for them, then we would be approving this, you know,

without knowing who might be the development in there.

And I'm going to agree with that.

I would like to make a friendly amendment that it be 10 to 12.

And I would also just like to get a kind of, you know, I don't know, a guess is probably maybe two week a word from the person who is presenting for the property owner of

of whether they think that that is something that they could take back to Zaxby's or not.

I am going to side with Ms. Galvin on this.

I think that

vision of the city is reflected in the comprehensive plan.

I totally respect the work that's gone into creating a fast food restaurant on the site and having a drive-thru and making the economics of that work.

I respect the work that the firm has done.

But I do think that we're making decisions in the 25, 50, 100 year future of this corridor and I spend a lot of time down there.

I go to the Korean restaurant there to get lunch and I experience the lack of it being pedestrian and

Friendly and in a way that we want that quarter to grow and I think it is reflected in the comprehensive plan so I think that that to me I think is one of our charges and it's where I end up on this particular I would maybe be more open to this if there was outdoor seating but I think that you're right I think that the utilization of the space and the building that's being put there for the city's goals is

The special use permit standards are very broad for our consideration.

We have a lot of policy that is written into the statute that guides how we make decisions in special use permits, and I think that we have

complete right to want that corridor.

We just put bike lanes in the center of it.

You know, it's a major infrastructure is going to try to change, Emmet, for the generational view.

And I would like for it to be a place where we could stroll and where we could kind of hang out rather.

And I don't think that this is going to, you know, make permanent, semi-permanent, a fast food use of that parcel.

And I don't, I think if we can do something better, if developers could do something better,

I think my second reason is we're headed into a major, a lot of work on a comprehensive plan and zoning, and I think that it's very important that we show by our votes where we are on those bigger policy pictures and the vision of the future.

I'd like to just make, I didn't prepare comments about this, but I do think that in a corridor that has 61,000 car trips a day, it's never going to be a non-autocentric corridor.

It is the extension of Route 29 as it comes south.

It goes right into the University of Virginia.

We've got 20,000 students and all the other folks who are associated with the university.

We have the shopping center across the street, which people drive to from all over the region.

and I think people are in their cars in that area.

I think that the thing I like about this project is that it increases the walkability while responding to the fact that there are so many vehicles there and I don't think it's ever going to be a place where you live and work in the same place.

I mean there are going to be parts of our community that are auto-centric and I think that we want the sidewalk to be walkable.

We want that experience of walking through there to be

a good one and I think that this project actually responds to that not only on the front with the trees and the seven foot sidewalk but on the back with the trail that goes through to increase the kind of recreational walking experience through that area and those we won't get if we don't have an SUP for this area so I think that we could end up with just a very bland office building and a sidewalk or we could end up with this which I think is actually an improvement of the pedestrian experience

I would just like to add that was very well put.

We're going on to item number five, a resolution, House Bill 2, smart scale submissions, bicycle and pedestrian safety program transportation funding.

Tony Edwards and Amanda Ponce presenting.

As you're already aware, we've been talking about HB2 Smart Scale, which is the new title of the program, and the grant applications that were currently involved in trying to collect data to support that.

Staff has identified two potential Smart Scale projects which would be submitted at the end of this month.

Other grant applications would follow and have a deadline in November.

In addition to that, the city is seeking funding for pedestrian safety improvements under the VDOT Bike and Pedestrian Safety Program or the BPSP program.

The intent of that program is to promote proposals that would address known safety and or accommodation issues or smaller scale that could be completed quickly.

In 2015 Timmons Group reviewed the city's 72 signalized intersections for compliance with the Americans with Disabilities Act.

Staff has identified projects based on the results of that study and that in concurrence with the Streets That Work plan.

So we've identified two smart scale projects as you're aware of the West Main Street streetscape being one of them which would

be a vast improvement over the existing corridor that we're interested in having since it's gained a lot of interest from the private sector recently and trying to get ahead of that development as much as we can by funding that project.

The city has recognized the need to create for the new vision for that corridor, not only for today but for the future.

Barracks Road intersection improvements at Emmett Street we've mentioned earlier in previous presentations.

This would include right turn lanes that would be added to the northbound Emmett Street corridor and a westbound turn lane on the Barracks Road entrance into that intersection.

It also includes, along with the carcentric improvements that was mentioned earlier, bike and pedestrian and transit improvements there.

We're looking at new bus shelters along there and pedestrian refuge islands and things of that nature.

Thirdly, the ADA pedestrian signal improvements that we mentioned, the BPSP program, we've identified eight locations that we would like to apply for additional funding on through the state program.

Fourthly, the authorization for the city manager to make and execute applications for these federal and state funds for transportation projects.

This allows the city to mainstream application process and satisfies council's desire that would

that when federal or state funding is made available for the priority transportation project applications could be made and project administration agreements could be executed on behalf of city council in the most expeditious manner possible.

So as staff's recommendation that we have your direction to move forward with these smart scale MBP-SP funding application projects

Good evening, Councilors.

That was an extensive

Project, several staff participated in the project, in particular Amanda Harder, our staff engineer, the assistant city engineer,

Brenham, Martin Selman, and there are also several other representatives from the appropriate city department that got together to review the document and to make sure that some of the concerns related to the operation, public works, public services were adequately addressed.

So we have a document that reflects interdepartmental contribution and relations.

I appreciate the work our staff put into that.

Secondly, I thank the City Council for swift action on this particular project because basically it sets the stage right now for the code audit to begin, even though we already started work on the code audit.

The code audit proposal dates back to 2013 and it's got a lot of historic perspectives to it which includes the proposal or suggestion that was made in 2013 by design

This place design task force for the city to look into comprehensive code review and then trying to ensure that the codes and the policies are aligned with the comprehensive plan.

And subsequent after that, in 2014, there was a week-long community charrette to collect feedback on the future of city streets and public spaces.

This was also followed by September 2014,

White Paper that was issued to the City Council, D.A.R.

Planning Commission, and then the Place Design Task Force, and that was on September 23, 2014.

Furthermore, in 2005, the Bicampere Master Plan was concluded and basically informed the completion of the street that was adopted

this evening by the city council.

And of course, the by compared master plan was also acted upon by the city council last year.

And today, in 2016, the West Main Code change, which was also part of the progression of activities towards the code of it.

The code change was acted upon by the city council this year and

The other component of the West Main project is also being handled at this particular point in time by roadside and highway consultants, which leaves us to the reason why I'm here today, essentially to let the city council know we are proceeding with a proposal to conduct a comprehensive code audit and

And with that, something that I've noticed, I've heard from neighborhoods, to the city hall, to among the development communities whenever I meet with them, is the issue of code audits.

I think, for some reason, we've stretched the definition of code audits to include a whole lot of things and some kind of medicine that will cure everything.

In terms of definition, code audit is basically a legal review of development regulations and policies.

And then if there are deficiencies, there will be updates designed to correct the deficiencies so that it will align with the comprehensive plan.

That's what code audit is.

In some communities, they call it wholesale revision to the zoning ordinance and subdivision regulations and what have you.

The current issues that we have right now in the form of conflict with the development regulations have manifested in itself in several areas in terms of barriers to affordable housing, lack of opportunity that will encourage a mixed use development, lack of opportunity regarding a shared parking

parking opportunities and there are also the existence of threats to establish residential neighborhoods and some of you probably are aware of the issue we have at St. Clair Avenue with the incompatible residential infill development although

That particular infield was permitted by the zoning ordinance.

But if you look at the height, the way it is, it looks out of scale.

We also have another example in Rose Hill neighborhood.

And some of the issues related to the code audit, we're getting ready to undertake.

Now, let me point out that although we are doing this code audit,

The zoning ordinance in its entirety has served this community, I believe, well.

And I don't think there is any community in the United States that has a perfect zoning.

When your zoning is working for you and development regulations, it's a good zoning.

However, there's always, at some point, either as a result of growth and development, the deficiencies in the zoning ordinance and development regulations start manifesting itself.

So at that point, it becomes apparent for the community to look at their development regulations and then identify the conflict, and then make an update, and then move forward from there.

And some of the things we are proposing to do in terms of discord ordinance in the interim is a legal review, which is already in progress.

We're also looking at alignment of the standards and design manual with the comprehensive plan, and then, of course, integration of the streets that work provisions

into the standard and design manuals.

This particular review will include the following process.

It will include a reference to a streets that work plan in terms of updating the standards and design manuals.

will also include new standards to implement the bike and pedestrian master plan, also update the lighting standards and also update the tree planting and green infrastructure provisions.

The code audits aligns with the council vision statement and also the city's strategic plan goal number two.

In terms of the timeline, I think the timeline that is contained in the

and the staff report that was sent to the city council.

I believe that the resolution you have, which was originally proposed by Councilor Galvin and then Councilor Galvin, myself and Lisa,

You know, we work together in terms of the final timeline.

I believe the proposed timeline is consistent with the original timeline we proposed.

The only thing I'm asking the City Council is to consider extending the proposal for the comprehensive plan because if you

If you think about the comprehensive plan or future land use map updates, those things take a lot of citizen involvement and engagement, so that will require an extra amount of time.

So if that, the comprehensive plan timeline can be extended to June 2018, we will appreciate that.

And then finally, the other thing I would like to

to ask councilors, if you look at the resolution that is being proposed on page three of the resolution, there is a list of elements ranging from housing, density, height on page three.

Before you make the motion to add transportation,

and traffic because we've got a lot of traffic issues.

And our new traffic engineer has several concerns with traffic issues and the ordinance, so that also needs to be looked at.

I will entertain any questions you may have.

And then one more thing before we go to the question.

I got the mayor's email regarding the cost

If council can adopt the resolution, we can come back with a more refined cost.

Because right now, there are certain elements and data that we need in order to make informed decisions in terms of the cost of hiring additional resources to a consultant.

So it just would be parenthetical

And just to clarify, this actually does get at some of the things that we heard in public comment from Mr. Butler that he was concerned were not in the memo, but they are in this resolution.

So parking, land use, building height, mass placement, density, housing types, block size, curb cuts, design control, interest corridor districts, plan unit developments, special use permits, rezoning requests, submittal requirements, review processes, integration into the streets that work in green infrastructure and transportation and traffic.

Well, it's the traffic related issues.

I told the traffic engineer, he has several complaints.

I told him, you know what, we're going to do code audits.

Just like I did, you need to list your concerns and then once we begin the process, then we'll address those.

Okay, yes.

So let me start at the beginning really.

A code is a legal document.

Some of them from the state, some of them from the city.

That's correct.

Some of them may be fit.

We're talking about the zoning ordinance.

We're talking about the subdivision regulations.

Then we'll also be looking at the standards and design manual, engineering purposes.

And does that flow from the building code?

There might be some, there is a need to make some changes, but usually that is

So it will or will not be considered?

We're not looking at it.

Maybe it will be.

We're not looking at it.

So if you have legal documents, they have to be pretty precise.

And you're going to sort of reflect the comp plan against those.

And the comprehensive plan is very general.

And in many cases, it's contradictory.

If you say we want a green city and we want to promote economic activity, well, at some point, you might support economic activity that does not give you a green city.

So that's the framework that I'd like to phrase this question with.

How do you take a precise legal document

and match it up with a comprehensive plan that is by its nature very general.

Yeah, the comprehensive plan is a general document.

It's a vision.

Some communities, they can make it precise and specific.

The zoning ordinance, the subdivision regulations,

maybe Floodplain Ordnance and what have you.

They are designed, including the CIP, they are designed to implement the comprehensive plan.

Say that last sentence again, please.

The zoning ordinance, the subdivision of regulation, the floodplain ordinance, and erosion and sedimentation ordinance and what have you, those are development regulations that are designed to implement the comprehensive plan.

They are specific in nature.

Well, if you don't want to have a special use permit, you can just have a by right, but provide criteria and requirement under the by right.

And then you don't have to worry about SUP.

That way, that might make your ordinance or regulations more predictable.

So you don't anticipate?

The other thing is that when you have SUP,

It basically gives the Planning Commission and also the City Council some kind of opportunity to actually dictate

more or less how the development will occur because you can add additional requirements, you can help create the outcome of the project and then also in terms of SUP and the rezoning.

For Virginia, for instance, he also gives probably opportunity for

No, I don't because that's what all the communities in the United States do.

You create your legal document and

in the form of ordinance and regulations to implement the comprehensive plan.

And then, like I said earlier, somewhere along the road, because we have developments, and as development begins to occur after you adopt your comprehensive plan and development regulations, somewhere along the line there is bound to be some kind of conflict.

So maybe this ordinance outlives its usefulness or may reach a point where it's no longer

aligning with the provisions in the comprehensive plan.

So at that point you do a review and you update the development regulations and the comprehensive plan to reflect the conditions at that point going into the future.

I'd like to move that we pass the resolution to complete the city of Charlottesville's regulatory framework review and write revisions such that it aligns with the 2018 Conference of Plan update.

It was the alternative choice that was provided, but I would like to make clear that as amended, as per the recommendations of Mr. Ikeifuna, which means striking the specific references to the dollar amounts on page one and two,

It's as amended as we have it.

And those are the changes.

And I guess, may I ask a question?

It's listed in our agenda as a report and not as an action item for a resolution.

I may say something on page three of the staff memo.

It says alternatives.

If council has any other items or alternatives, it is recommended that council provide specific guidance as to expectations and time for performance and indicate whether the use of outside consultants is desired.

And it requests the council approve the work plan.

I think we're just missing a word on the agenda.

Unless there's grave concern about this.

I think we just need to be really careful in doing the agendas that they, if it requires action, as this one says it does.

I believe the resolution started bubbling up when the amendment went up but it's okay.

And I would just like to thank Ms. Robertson and Mr. Ikifuna because you answered my questions on Friday in such a way that revealed a depth of what you were intending to do that simply wasn't reflected in your staff memo.

And in that conversations that we've had in exchanges,

I believe it really became a great, great work plan and I really appreciate the work you've put into this.

I'm Nancy Carpenter from the Rose Hill neighborhood, and I wanted to extend an invitation.

I hope that you all will be

able to come to Washington Park this Saturday from 11 to 4.

We are highlighting the history of Rose Hill being a neighborhood in the city for the past 100 years since August of 1916 and we found out a lot of real interesting history about that area and a lot of things I didn't know about the place and are looking forward to having people come in and look at

how this place has changed but stayed the same and really how it was indicative of a village within the greater Charlottesville community and looking forward to some hot temperatures but maybe a little clouds so it won't be so miserable but it is something that is near and dear and would hope that this is a project with the history that will continue on getting those pieces and parts that add to that story

for the past 100 years so that whoever's here 100 years from now can do a 200 year anniversary.

That's all I wanted to say.

Washington Park, OK. Not only we're going to be graced with a proclamation, but we'll have some gospel music for a couple of the local churches.

We're also going to be recognizing a lot of the,

Well, I wouldn't say children's, but the sports leagues that were active in the 50s and 60s, some of the players will be there.

We're also going to have a local band that apparently had their first gig at Washington Park decades ago.

The Cliffs, very well known and well loved in that area and in the city, and maybe some other surprises, I'm not really sure.

They're not playing.

But it is interesting that all three members, Boyd, Carter, and Leroy all grew up in that neighborhood and came out of such a strong musical tradition in that area.

One last thing.

I think a few people will be there and I didn't realize that Roosevelt Brown had actually coached that team that year and provided some very good plays that I think also helped with them being undefeated and there's also going to be some information about a documentary that was premiered at the Maupin Film Festival called Colorline Scrimmage that will be out there so people can

Well, I did find out they were co-champions with Portsmouth that year.

They weren't the only undefeated team, but I also found out that

UVA that year had a really crappy team.

They were 28-0 and losing streak.

And I think the other local high school team was also doing bad so that if you wanted to see really good football that season, Burley was the place to be during that season.

So I'm just throwing that out there.
