I'd like to call this meeting of the Charlottesville City Council to order.

We'll begin with our Pledge of Allegiance.

Our city code provides that every two years a council nominates and elects a mayor and a vice mayor.

and we are going to accept nominations.

We'll open up nominations first for the mayor followed by a second and we'll continue to do that until we feel as though all of the nominees have been presented to the council for a vote.

Once a mayor is elected we will do the same for the vice mayor.

I'd like to make a few comments before we get started.

First of all, I want to thank my colleagues, City Council, for supporting me for position on mayor for the second term.

I look forward to working with all of you.

I'd like to welcome our newest Councillor, Bob Fenwick, who is joining us.

Thank you.

I'd also like to thank Kristin Szakos for his service as Vice-Mayor for two years.

I owe a great deal of debt to the citizens of Charlottesville for twice electing me to City Council and supporting me.

It says a great deal about our community, where someone like me can become a Mayor.

Our community appreciates and embraces the diversity which we have.

As a Mayor, I will work with City Council for the future agenda for the community.

I listen to the desires and concerns of the citizens, residents and businesses

I'm available at all times to hear your concerns and ideas.

I'm honored to respect, to represent the great city of Charlottesville and work my very best to protect the interests of our community and work to enhance the quality of life and environment so that Charlottesville can be a great community for all its residents.

I'm honored to have this privilege to serve as the mayor of the city of Charlottesville and thank you.

We have some awards and the conditions and announcements.

Christmas tree curbside pickup.

Charlottesville Christmas tree curbside pickup will occur the week of January 6, that's this week.

Trees must be at the curbside by 7 a.m. on January 6 to be collected sometime during the week.

Trees should not have lights, nails, tinsel, ornaments, or tree stands.

After collection, the trees will be taken to Darden Tow Park and turned into mulch.

Free mulch from recycled trees will be available starting February 1, 2014,

Paintings, drawings and sculptures created by artists with disabilities ranging from autism to cerebral palsy to intellectual disabilities will be on display at the 14th annual VSA Charlottesville Albemarle Visual Arts Show at the Martin Luther King Jr.

Performing Arts Center.

Over 100 area artists celebrate their creative talents at the opening show on Friday, January 10th, 2014

from 6.30 to 8 p.m.

Many of the pieces will be available for purchase with the entirety of the purchase price going to the individual artist.

The city offices will be closed Friday, January 17th for Lee Jackson Day and Monday, January 20th for Martin Luther King Jr. Day.

Trash collection and

CAT Services will operate on a normal schedule.

OK. And so instead of coming to City Council on Monday, January 20th, you can go to the historic George Washington Carver Recreation Center.

Commonly known as Carver Recreation Center.

On Monday from 1 to 3 there will be a special event called Continuing the Dream for the Dr. Martin Luther King Day.

There'll be highlights, first of all a family affair, and we'll have Pastor Hadari Hamilton from the First Baptist Church on West Main Street.

We'll be a keynote speaker.

There'll be the first annual Alicia Lugo Award.

There'll be vocalists, there'll be speakers, Tanya Dowell, Franklin White, as well as musical guests.

There'll be Charlottesville city manager, Maurice Jones will be there.

to speak, and Alexan, one of our own native-born inspirational speakers.

Mr. Mayor, I do have an announcement about the weather that's coming our way.

We'll send the temperatures into single digits tomorrow.

The city, in response to that, will be opening up warming centers in the same way that we open up cooling centers during the summer.

So tomorrow, during the extreme cold temperatures, our daily admission fees will be waived at all the City of Charlottesville Recreation Centers.

They could call our recreation office at 970-3260.

So please use the facilities if you need them.

John Hayden, Westwood Road.

I've been coming before you for over two years on a variety of issues from taxes to race relations to crime, some of which is related with no responses other than to ridicule me and name call.

So let's talk about violent crime in this town, which in my eyes has started to reach epidemic proportions.

There have been over 80 violent crimes in this town over the last year or so from home invasions, armed robbery, shootings, stabbings, muggings, assaults, rape, and even now murder.

Three shootings just last weekend and a violent assault on the mall.

I've related statistics along with the story of a family member being stabbed on the mall while attempting to come to the aid of a woman

and all I get is apathetic stares.

You label my opposition to the Human Rights Commission as racism, yet you turn a blind eye to some of the violent crime that could also be labeled a race crime.

If you would show as much concern for victims of violent crime as you do for Human Rights Commission, this community would be a safer place.

Criminals know they get a free pass when neither the city or the media broadcast suspect descriptions.

Wouldn't it be better to have a thousand pairs of eyes on the lookout for criminals?

But of course that wouldn't be politically correct.

My taxes have increased over 120% over the last 10 years with no appreciable increase in city services.

So it's time to end this liberal social agenda of wealth redistribution.

Among other things, I don't want to pay for free internet for some neighborhoods.

We as citizens have a right to expect you to have our safety as a priority.

I would demand that you spend as much time talking about crime as you did about drones, pot legalization, or Occupy Charlottesville.

If you don't think crime is that big of a problem, go ask the young man who laid in a hospital bed from that stabbing, or the owner of B&R Market who was robbed twice in a year, or victims of that violent attack on the mall.

Before you blow it off, it's not that big of a deal.

I would ask that you have the Police Form of Violent Crimes Task Force to try to combat the violent crime

in this town along with preparing a public report of the crime statistics.

We have a right to know what's going on in this town and we expect you to get your heads out of the sand and do something about it.

Hi, I'm Joanna Salidas, 129 Goodman Street.

At the last council meeting, I was struck by the fact that you all discussed two related items, the context sensitive design resolution and a request for money for the development of a 5th Street property, yet no one pointed out the relationship between these items.

I came tonight because I believe that the design resolution would be a good step forward for the city, and I want to urge you to seriously consider its approval at your next meeting.

Regarding the 5th Street development, you had concerns about the design details of the proposal, such as the density and connectivity.

I have no opinion or knowledge about that specific project, but it seems to me that it is representative of a very common problem, which is that the city gives something

for development, towards a development, but has to accept on faith that the design will benefit the public at large.

You all seem to agree in the last meeting that the time to decide against the Fifth Street project had already passed because of lost funding concerns.

So you voted for it despite an uncertain outcome.

which I am not giving an opinion on, that's not the point.

But as I see it, if the city revamped its codes and guidelines as called for in the resolution to more clearly mandate good design, meaning good design socially, economically and environmentally, then the by nature piecemeal process of these kinds of funding decisions and planning would result in more certain outcomes and those outcomes would be better.

I like it that the resolution calls for a steering committee with broad representation to oversee and work with city staff on revamping our codes and standards and design manual.

For too long, planning and design decisions have rested almost exclusively in developers' hands with citizens and citizen groups left fighting a stacked review process from behind the eight ball.

I also like it that the resolution seeks to advance the implementation of numerous design ideals as instantiated in already passed resolutions such as the HEAL one and complete streets and in the comprehensive plan such as a green infrastructure plan.

These ideals are worse than pointless if there is no implementation.

The way it is now, there appears to be an a priori tendency to approve SUPs and PUDs because they allow for denser uses.

I understand that higher density can allow for greater social and economic opportunities and even be environmentally beneficial.

Density is key to walkability, for example.

But it seems like staff often approves PUDs and SUPs to get density, but the other part of the equation is missing.

The part that would provide the benefits, like street trees, the connectivity, the public spaces, the rain gardens, the small business spaces, and the de-emphasized and slowed down traffic.

In my ideal world, there might be no limit to density, but we'd have a couple of inviolate rules, like we'd have clean, urban, daylit streams.

Better code and standards would ensure better public property and better private developments when the city had leverage through funding, special approvals, or selling land.

I think that at various points, for example, the city would have had considerable leverage in the design of the new Water Street extended end of the Burnett Commons development.

Yet in both these cases, getting something as truly fundamental as street trees only happened because citizens were vigilant and tenacious.

In closing, I do not think the resolution is perfect.

For example, I don't think that the ITE manual is ideal, although I do agree it makes sense as a starting point for best practices.

I also think shared space with slowed traffic is as essential as complete streets.

I have no doubt that there are other details that could be improved.

Nancy Carpenter, Albemarle County resident, 727 Denali Way.

I want to say good evening and thank you for this opportunity to comment.

I sent an email earlier regarding my concerns on public transit and especially funding for the Route 6 elimination of bus stops and discontinuation of night service on the Route 10.

I'd like to correct myself to say that last summer there was discussion about discontinuation of the Route 10 service.

I overlooked that, I'm sorry.

But going on, I'd like to share with you some of the comments that have been told to me in the last couple of days since these new changes.

Don't know why they stopped night service on the 10.

People work and can't get home.

Partially blind couple now need to ride more than one hour around Belmont to get home and would like a bus down Avon like the old 1A or 4.

Council should have allowed CAT to keep $125,000 to continue expand service.

No Saturday service means using taxis to get to job and no trips to city market.

No Saturday service to PVCC means classes no longer are for community students without cars.

Concerned about losing job if I request schedule changes due to the bus schedule changing.

Change in Route 3 conflicts with needing a connection on Route 7.

We'll have to walk to and from work.

Lost stop at Monticello Vista Apartments, hard on elderly neighbors with knee problems having to walk to a more distant stop.

Also, in the July 2013 Albemarle County Comprehensive Plan update draft on transportation under Objective 8 Strategy 8B,

quote, continue to provide public transit service hours to include nights and weekends on appropriate routes to improve ridership and service.

It is important to continue to provide night and weekend hours to serve people who work evening and weekend shifts to return home.

In addition, evening bus service allows those taking night education classes to return home after classes end, longer hours of operation,

increased ridership and ultimately make transit a more viable alternative."

As one commenter and writer put it to me, they're afraid that the results of these changes will be reduced ridership, higher unemployment, and more disenfranchised residents.

Even though the city council recently approved the implementation of a citizen transit advisory board, I would urge city councilors to ensure a very transparent

and Community and Customer Inclusive Process to review and make appropriate tweaks to the system.

There are serious repercussions to the riders.

A public service should take these concerns and work diligently to effect remedies that contribute to less than adverse results from current schedule configuration.

Lastly, though, I do want to commend Mr. Jones and his staff on the hard work that they have done

and taking a paper study and making it a real-time process.

I still believe there is lots of work to do to make this a world-class transit system.

The last speaker didn't mention they cost about $100,000 to screw up the bus system.

My name is Lewis Schultz and I live at East Market Street, 1809 East Market Street,

This is the seventh time since October 3rd that I've come to Council to say that I have evidence that City Manager Maurice Jones, Director of Public Works Judith Mueller and Utilities Director Lauren Hildebrand have violated Charlottesville Code and the Code of Virginia and in doing so have violated federal civil rights statutes.

The Seaville Weekly has done a great article on this and the Rob Shilling Show archives have a lot more information for anyone who would like to look.

I wrote to Mayor Huja and asked for an investigation to receive evidence and sworn testimony.

Council is empowered to hold such a hearing and has an obligation to ensure that those who do the public's work are competent, law-abiding people who respect the civil rights of citizens.

Mayor Huja wrote to say that he declined my request.

No reason was given in that letter, but here in council chambers, Councillors Smith and Szakos have said they have already seen the evidence I have, as if to imply that they had seen enough to know that my claims had no merit.

Ironically, Kristin Szakos has also said both that she has seen what I have and that she stands by the mayor in refusing to see it.

I'm never sure with Mayor Huja, but I think a few meetings ago he said the word evidence as though he had seen something too.

That despite his letter to me declining my offer to show it to him.

I have never given evidence to any counselor to support my accusations because they all refuse to take it.

I'm not going to stand here and speak only to have them saying things in response that are untrue.

I tried to correct misstatements Counselor Smith made a few meetings ago only to have the mayor threaten to throw me out of the room.

So today I wrote to each member of council in accordance with the Virginia Freedom of Information Act to request all information that they have reviewed in making their decisions about a hearing.

I'll speak about the results at the next meeting.

Let's imagine for a minute that the truth has been told.

Let's say council has seen the documents I have.

That means they know that the steep hill bridge is dangerous and that any day someone might get hurt resulting in a significant lawsuit against the city.

They know that the city's engineering, public works and neighborhood development services are responsible for that situation.

They know the particular people who are responsible even.

They have seen very compelling evidence that laws have repeatedly been broken over a lengthy period by city staff, including the city manager.

They know that Steep Hill Street is private property and that the city has no rights or responsibilities to that property and the city attorney has admitted that all of the facts that would lead to that conclusion are true.

They also know that city attorney Craig Brown has been given numerous opportunities to settle these issues amicably.

and to avoid public scrutiny of the city's internal problems and they know that at every turn Mr. Brown has instead put up roadblocks.

They know all of that and much more if we were to believe council's claims.

So why do all the people responsible still have jobs?

No one has had as much as a bad performance review and yet council sits there pretending to be working in the public's interest.

This whole affair and council's response so far show how far we are from the city dreamed of in council's 2020 vision statement.

That statement promises that Charlottesville will build a distinctive world-class city by recognizing the rights and responsibilities of its citizens and by summoning the courage to embrace positive change.

That its customer services and interactions will be guided by the values of quality, responsiveness, fairness, creativity, dignity, empowerment, communication and integrity.

That Charlottesville will become a leader and best practices for local government.

Council no longer even appears to be trying to make that vision come true.

and there's a limit to how much corruption can be covered up for with fancy words.

Let's see.

It's my first time speaking to you guys publicly so I'm a little bit nervous here.

Winston Churchill said that in his first 25 years he wanted freedom, in his second 25 years he wanted order, in his third 25 years he realized that order is freedom.

On New Year's Eve, a woman was knocked down and her purse was taken from her in the downtown mall area.

A week before Christmas, two people were simply mauled on the downtown mall.

The police department somehow fumbled that investigation, but Chief Longo did recover the fumble, but it was fumbled nonetheless.

Human Rights, I'm quite certain, includes the right not to be attacked, not to be pummeled, and not to be assaulted.

He spent $300,000 to create this Human Rights Commission.

I think the number I heard was that Chief Longo wanted $150,000 to put cameras on the mall.

The solution of police kiosks is somewhat laughable.

It's kind of like saying we care about your safety so much we'll occasionally have a single police officer stationed at a fixed point on the mall.

Yeah, the $150,000 for the cameras would catch actual human rights violators rather than the $300,000 that's been spent to catch hypothetical ones.

In closing, it seems disturbingly clear that you're motivated by a desire

to pander to a certain counterproductive ideology and ignore reality regardless of how sublime that reality may be.

Lena Seville, 808 Alta Vista Avenue, Charlottesville, Virginia.

I am a member of the Transit Riders Association of Charlottesville and I wanted to make some comments regarding the process of the changes that we've recently experienced.

And to talk about things that we'd like to see changed moving forward, particularly about the processes where I'm going to start.

In the future, we don't think people should lose bus service in winter.

Leases renew in the spring, and we think it's important

that people be able to retain bus service.

Some people choose where they're going to live based on buses.

So in the future, we don't think if there's going to be serious changes, we don't think it should happen in the wintertime.

And we think there needs to be more outreach when there are changes.

I rode Route 10 the last couple nights that it was running, and it's going to go from its last friend being 11 o'clock to being at 5.30, and I was the one telling people about it.

They didn't know.

The signage is inadequate.

It's one sign sitting right at disabled seating where most people don't sit.

They're supposed to leave those empty.

On the day buses, on the night buses, only two seats can actually read that sign.

And it's not even in big letters.

They've got changes.

They've got detours.

They've got holiday schedules.

They're not really making people aware of what's happening.

Also, they release a lot of things online.

A lot of us writers aren't online.

So if they're going to release things online, then that's another thing that they need to let people know.

That needs to be on the sign.

They need to tell us.

We're in email communication with them saying, we've heard there's going to be changes.

And they still don't tell us that, oh yeah, we have stuff online you can look at.

There needs to be much better notification of public.

I'll skip a few things.

And also there needs to be more consideration to rider impact.

They're coming from a focus of the maps and the bus drivers.

Every time we ask about things, they're not thinking about how the riders are being impacted.

It needs to be part of the conversation.

And we want to be part of the conversation.

For instance, things regarding stop locations.

That was already decided before anybody told us about it.

Also with hours of operation.

There are numerous places where we'd like to know why the stops are there because we think they could be in better places.

We think they've taken out ones that are unnecessary.

We're looking forward to the CAT advisory panel.

We're a little concerned that there's only two spots for riders, one for city and one for county.

As a city resident, that's a lot for me to be able to keep up with as far as if one person on the advisory panel, we'd like to see more riders on the CAT advisory panel or maybe some alternates, one city, one alternate, one county, one alternate.

But we think there needs to be more.

for the riders there, and also the advisory panel should not be a substitute for outreach to riders, to let them know what's going on and give them a place to have some input on what's going on.

Is there anybody else who'd like to speak on any topic they've not spoken so far?

My name is Phillip Jones.

I live at 1011 4th and 11th Avenue.

I'm going to be brief today.

the reason I'm here I'm veteran by no choice jail or military when I was drafted and the reason I'm here today is I spent 25 years in the military active and reserve called back to active duty during Desert Storm and Desert Shield

When I was very disappointed at the 11th of November ceremony at the pavilion, there was not one city councilman there to represent the city or the county supervisor.

And veterans are a very cohesive group of people.

They care for each other and whatnot.

I honor the veterans myself just as well as I honor my birthday.

Veterans is very important people.

If it wasn't for the veterans, you guys and nobody in this chamber probably might not be here this year.

Well, this is my first city council meeting and I was determined it matters by the public that I wouldn't say much and it's not because I don't listen and it's not because I'm not hearing what you're saying, but this is a time for the public to come forward and say what's important to them.

and Zach, I appreciate you coming down here and saying what you said because I have spoken many times and it's not always easy.

If somebody's out there listening and they have something important to say, you don't have to take three minutes.

You can come up for 20 seconds, 30 seconds, whatever.

And I would ask that the citizens across the city use this as an opportunity not just to bring forth concerns

but to bring forth ideas that we can use in guiding this city.

We've got a real tough budget process coming up and we need some help.

Yes, thank you all for being here.

It's always impressive those of you who just keep such close attention to what's going on and we always are inspired and

Really appreciate.

We will be dealing with the context sensitive streets really soon.

We're finding out more about it.

And transit riders, thank you.

We can't do it without your voice either.

No, I think it was appointed late last year.

I believe we were going to have a city councilor on that as well.

Yes, I would like to thank Ms. Salidas.

I think the comments were really very astute and I really appreciate the thought that you've put into it.

And I really look forward to our public discussion because I agree.

That's the point of public discussion so that you refine the resolution so that it can be more workable.

It's not something that can be done by one individual.

So again, thank you very much and I look forward to the public discussion on the 21st.

With regards to the comments made by Ms. Seville and Ms. Carpenter, I really think the community engagement piece needs our careful attention.

I think you've made some very good points about the need for more notification, more signage.

That's all about information and informing the public.

I do think that if Mr. Jones can get back to us, now we've got two Mr. Jones.

Mr. Jones is the head of the CAT and is now Mr. Jones, of course, the city manager.

But as soon as the advisory and Mr. Jones comes up with some sort of a means of monitoring so that we can get a

maybe a quarterly update in terms of what has been the level of complaints, what is the level of contentment, just so that we know how this is working.

And again, just a report that's devised that's clear and simple, but also just extremely informative.

It will be very, very helpful.

Mr. Green and Mr. Hayden, you've talked about police and safety, public safety.

That's a fundamental concern and a fundamental role for local government.

It is a big issue for us during these budget discussions coming up.

We do need to really understand the needs as we are growing as a community.

And finally, Mr. Jones, about your point about being a veteran.

I would have been there.

That was the day I came home after looking after my mother.

I had gone up for a week in November.

She was a veteran.

from the Second World War, an Army nurse that took care of soldiers coming off the field from the Battle of the Bulge.

A month later, she died.

But I would have been there.

And I appreciate, completely appreciate the service that you've done as a veteran and all our veterans.

It's incredibly important.

So thank you.

Yes, I'll just concur with everything else here.

I think that, you know,

One of the things that, you know, in addition to what you all said that we've talked about in the past that I would really like to see us move forward on is the idea of having, and I know it doesn't serve everyone because not everyone is on the internet, but it just is an additional tool to reach people.

in addition to beefing up other tools is an online way that people can weigh in on important issues like transit.

I think that those things work well.

There are some best practices, and I'd like to see us move forward on that.

Also, Mr. Jones, I will give you my regrets.

I have been to every single Veterans Day event since I've been on council, as well as the Vietnam Memorial dedications every year.

I have two comments.

I was also in Seattle on Veterans Day, so I couldn't be there.

But I've been to every other meeting as long as I can remember.

I wanted to make a comment about the transit.

I would especially like staff to look into the possibility of keeping the stop on Wall Street open, not closed, because stop now, which is being proposed, is one in the transit center, one in the Omni.

And it is quite a distance for people to walk

with their purchases, and there are many elderly people who use it too.

And plus, on the Omni side, it is quite steep.

So maybe not that we need blocks, but if you had to carry your bags up that slope, it would be quite a challenge.

So I would encourage staff to keep that stop open.

It doesn't cost us anything, and it will be convenient to our users.

I don't know if you've already appointed citizens.

I will think Lina who has spoken a number of times here.

Maybe she should be appointed to the trial committee.

Mr. Mayor, I'd like to move a couple boards, nominations for boards.

I move Jonathan Dorr for the Social Services Advisory Board and for our Human Rights Commission we just needed to assign terms so the following terms will be to the already sitting Human Rights Commission members and we need to do this because we need rotating terms and it's a brand new commission so

We've sort of divvied it up and of course anybody can reapply.

So for initial terms of one year will be Celina O'Shannessy, Ann Smith, and Seth Whisperway.

For two years, Chris Broome, Sue Lewis, and Aidan Mills.

And for three years, Sterling Akins, Renny Johnson, Sarah Krishnara, and Amy Sarah Marshall.

And of course, these folks have already been appointed to the commission.

and each can reapply as their term is up.

Next is a public hearing on permit parking in 10th and Page and 5th and Labor Hood.

Good evening, my name is Jared Buchanan from Neighborhood Development Services.

UVA, after having several meetings here with community leaders and residents, decided to perform a survey in April and May of 2013 in accordance with the typical permit parking survey established by city code.

Their findings were that none of the warrants established in code were met.

Some of them were close for certain streets and we again met with residents and our office has decided that we would like to pursue the establishment of experimental permit parking control blocks in these neighborhoods.

Those controls would go into effect for one calendar year.

However, our typical permit parking year is August to August, so we would like to start sooner than that, start in February and run through the end of August 2015 so that it would then align with the permit parking year.

For that first approximately a year and a half,

All the permits would be at no charge after that trial period has ended.

Any clarification questions for the staff before we have public hearing?

On the little chart that you all gave us, which is on, I guess they're not numbered, it's on page 60 of ours, but with the different streets and where the percentages of non-residential parking estimated were, it seems like on Page and Paoli Street, on two blocks of Page and on Paoli Street at the 900 block, the numbers are relatively high.

On the rest of the neighborhood, they're not.

Generally with permit parking where it is a concern, where it is truly an issue by the warrants, whenever we put permit parking controls on one street, that moves commuters to the parallel street.

A couple of more blocks and you can sort of see on the maps behind you what's existing over here and what's proposed.

And one other note is that if we were to add Elm and Pine Street, we would have to also expand zone 7 to include those.

You do say that it is assumed based on anecdotal evidence that UVA students and faculty and UVA hospital staff comprise the greater part of the commuters in this neighborhood.

My understanding, and it's somewhat limited on this, is that employees have an off-site parking site that they can park at and shuttle in.

So I just am concerned that as we kind of put this into place, and I do appreciate the fact that you've got another block over on either side of this zone to accommodate any spillover effect, but I would hope that you use your wonderful table here to monitor the impacts over time because if there really isn't enough

I'm not sure that we've necessarily discussed that at this point.

However, we do have other permit parking requests and those are reviewed in March and April.

So that would be a couple of months into the permit parking controls going in place.

I'll keep that in mind.

But piggybacking on Ms. Galvin's question about the assumption that there are students and faculty, it says in our materials that a survey was done June 11th through 13th, but UVA isn't actually in session then.

We pay taxes, and we ought to be able to park in front of our houses, too.

I'm a prisoner in my house every day until 10 o'clock in the morning.

After all I'm done parked, then I can leave.

because if I leave before then, they're going to get in my spot.

So when I come home, I might have to go up to 9th Street and park to accommodate them.

I also have talked with Ms. Ida Wooden at UVA and Ms.

Branch Hill.

And Ms.

Wooden was with us on this, and she said she had a meeting with us and that she was going to do something at the university to put out a notice about them parking in our area.

It's just a parking lot for everybody.

Just come on.

And if you have to push it somewhere else, let it go somewhere else.

We done had it long enough.

And it's just that on a typical day, you heard me here say this before, a typical day, here they come at 6 o'clock, here they come at 7, 8.

The last one, last group come at 10, so they don't come back and get their cars till 6.

So if that's in front of my house, doesn't mean I can't park in front of my house till after 6.

Then they go home.

And when they park, they park like they Fred, so I don't know why they park down there.

They look back at the car like somebody's going to steal them because I told them to take them with them, and then they wouldn't have to worry about them.

And I just think I would like for y'all to really review this, especially that 900 block of pastry.

I live at 900 Page Street and I wanted to speak in support of the permit parking trial.

I spoke here in December and

The commuter parking in our area falls disproportionately both through the area and on different residents so right now as your statistics show we see much more of it on Page and Paoli and I'm sure at the further end

They don't know what the fuss is about.

But I know that there's some permit parking up on 10th Street.

We actually get a little bit of spillover on Page Street now with people, long-term parking vehicles that belong on 10th Street.

The thing I want to emphasize the most is that, as I said, this affects people disproportionately and some of the older people in the neighborhood who have very short frontages on their lots.

they're not leaving their houses in the morning because they find that someone's going to come park in their spot.

So what for me is an inconvenience is an infringement on their freedom and it causes them psychological stress and the physical hardship of having to pull their shopping halfway down the street if they do go shopping in the morning may cause them to make choices detrimental to their health like not attending an exercise class at nine o'clock in the morning because they

No, they can't park when they get back again.

So something that the presence or absence of permit parking for many people in the neighborhood may not be such a big deal, but there's people in the neighborhood for which it's a huge deal.

and should it in a year's time be decided that if the trial goes ahead, should it be decided that permit parking isn't needed throughout the whole area, I would still wish the council to consider the needs of those elderly people who are currently complained of feeling hostage in their own houses.

If this solution doesn't work, you'll need to find another one.

They do not really supply you with parking.

You have to pay and I understand people coming down there parking, but it is a problem.

I live at 206 9th Street Northwest.

I was here in November to talk about the permit parking when it came up then.

I've lived in 10th and Page for 10 years now, including I've owned the house on 9th Street for three years now, and parking has never been a problem.

I understand that it reaches somewhat higher levels on certain streets like Page and so forth, but even so, even according to the study the city did, it still doesn't reach

the threshold of 75% under city code 15-203 to put in parking.

And I understand that the city can do a trial period anyway.

But I'd also like to point out that the city council actually has to take action to make it not permanent.

If nothing's done, then it's just going to become permanent.

And there is no parking problem at all on 9th Street.

And I've never had a problem parking the whole time.

I've lived in 10th and Page.

and so I understand the need for permanent parking in some areas of the city.

I just don't think that it's necessary in 10th and Page and so I urge the City Council to vote against the resolution.

I was not in town for the time when this was all announced during the late summer and fall.

So this was new when I came in, but I just wanted to mostly just voice that on the 800 block, I too never really see any problem finding spots parking.

There's plenty of, I think maybe more people have driveways there, so there's less residential parking, but there's always plenty of open spots there.

and it just seems a little, you're jumping the gun trying to kind of force this when there isn't the evidence that shows that it's past the threshold.

And to Councillor Galvin's, I think it was you that was asking about the University, I used to work there and they

Pretty much every parking lot you have to pay to go to park at.

The hospital I'm not so sure at.

I think they have to park all the way over at U-Haul and then they get bussed in over to the hospital in addition to a couple of small lots by the hospital.

A couple of points, I'm not sure who made the point, and I haven't seen the distribution of the percentages of people parking where, but I think along Page Street,

What might skew some of those numbers is that there's actually a pretty high percentage of handicapped parking spaces that would not be available for the majority of UVA employees who are parking in the neighborhood and walking.

So that may

I don't know if that's accounted for or not in the study, but just a minor point.

But on Page Street, there's definitely spillover from 10th Street.

And I would just second the other, Justin's concerns about elderly residents in the neighborhood who really are impacted by not being able to really access their

It seems like a kind of a odd, I wonder if we really need all of these streets.

Another thing we could consider is on those streets where we haven't heard complaints or where we hear that there's plenty of parking.

could wait to see if, in fact, the spillover, if we put permit parking on Page and Paoli and wherever else we might put it, and wait to see if you have that spillover.

I suspect there's going to be a certain distance after which it's not going to be worth parking there and walking all the way into the university.

I mean, that's sort of a standard parameter.

I actually came in sort of feeling the same way you do, Ms. Smith.

But I think I would be inclined to accept the entire area for the purposes of this, because there is no cost to the residents, and then to really do some more during the school year surveying.

Because I think that chances are, since this was done in June and school wasn't in session, that the numbers here are probably abnormally low.

I support the motion because I think it will give us a chance to find out if it is a problem or not.

I would like us to probe a little bit more on what the university's parking policy is for their employees, because I do think that's part of the research and that's what we could be doing this full year.

Find out really how serious the deficit is for employee parking in that region, independent of the construction.

But I think as one of the Justins had mentioned,

It's going to get worse with the construction activity.

And I'd just like to say I basically agree with putting some permit parking.

I think this is too extensive and I don't think it's listening to the community.

I think the community came back and told us some really interesting information.

I totally respect the staff's assessment.

that they're adding more than needs to be there in order to avoid having those streets fill up afterwards.

I just think this is the wrong approach.

So I just want to support the, you know.

And when there's a cost to it, I may agree with you, but for the moment, I'm comfortable with this.

Next is a report by Mr. Frederick.

Back in December, I prepared a memo to

the city councilors and to the county supervisors regarding a quarterly update on activities at Rivanna.

I'm going to use that as a guideline but I can update because that's been a few weeks now.

I'll update you on some information and I can do this fairly quickly so that we can get to whatever questions you might have.

The first item was the

urban water treatment plants, granular activated carbon improvements.

The board faced a choice between $17.3 million capital project for what we are famously calling a hybrid option versus $19.5 million for a full-scale option.

The board did vote on

December the 17th for the hybrid option which is the lesser cost of the two alternatives and authorized our engineer to go to work on final design based on that.

So that's underway now.

We anticipate final design completed the end of July.

and we're marching on on that project because that is, there is a EPA stage two compliance rule that's governing the activities of that project.

Next is the second item I might refer to as our New Year's resolution which is that the board wants to hold a strategic plan

developed in 2014.

We will begin soliciting for facilitation services in the coming weeks and hopefully by early spring will be actually engaged in that process in detail.

I would anticipate that members of this council would be asked to contribute information to that as well as the public and as well as county officials.

Details are not yet available at this time, but if you have some thoughts in your head as far as what you think the strategic direction of the Rivanna Authority should be, this is a great opportunity for each of you to weigh in on that process.

A workshop was held with the board of directors in December on our five-year capital improvement plan.

This is a plan that's updated each year at this time.

It will go back on the agenda in January at which time the board can, if it chooses, go ahead and take vote to approve the plan.

or make modifications if they wish.

The focus in the past has been largely on wastewater, which may sound surprising since a lot of our public discussion has been around water supply in the past, but actually most of the money has been spent on wastewater.

And the focus now is shifting as our wastewater system is becoming world class with newer infrastructure.

We're shifting now to some of the deficiencies in our older water treatment facilities.

The Ragged Mountain Dam project is still in construction and moving toward an expected April completion date, which is hard to believe.

It's only three months from now.

And we are in the early stages of the planning and dedication service, which you will all be invited to.

We took very favorable bids on the Rivanna pump station which includes a new tunnel to move the pump station from Woollen Mills to our treatment facility and that bid was awarded on December the 17th and we're now in the process of getting contracts executed and the contractors getting their insurance together so we can start construction hopefully

Hopefully a notice to proceed will be ready in February, but it may actually be a few weeks after that before you actually start begin to see mobilization.

And we anticipate initial mobilization will be to the wastewater plant site because they've got to dig a entrance shaft for the tunnel before they can do any work on the opposite end.

It's wise and we will make sure that our staff does coordinate with the

individuals in the Woolen Mills community when the time is approaching when we will be moving into that area.

We do require contractors to provide a construction schedule with enough detail that we can come up with that information.

As this council knows, negotiations are underway with the Albemarle County Service Authority for

and how the city and the county are to divide the costs of wastewater projects done but performed by the Rivanna Water and Sewer Authority.

For the benefit of the public, those discussions are still ongoing.

There is a mediator from the McCammon Group participating in that activity.

And the hope, I think for most people I'm talking to, the hope is to try to get this wrapped up maybe and presented publicly by February.

I've heard some try to say that maybe we could do it a little faster than that, but I've heard others say that February is probably more realistic.

And the final item on this discussion is a solid waste matter that principally involves Albemarle County, but to some degree could come back to the city for discussion.

The county is under contract with, has contracted with the Solid Waste Authority to provide

the material utilization center at Ivy through the end of June.

At this point that time has not been extended.

The county is holding a public hearing actually in two days as part of their regular supervisors meeting and may be giving some direction to their representatives on the Rivanna board to whether or not to seek an extension or not seek an extension.

An issue that may involve the city would be the McIntyre Recycling Center.

Everything we're hearing at this point is that the county is likely to want to continue the services of McIntyre, but no formal decision has been made at this point in time.

That contract also expires June 30th.

If action is not taken to renew it, the default position would be that the center closes.

So for those that are interested in keeping that open, that would be a consideration.

We did, I mentioned the notice to DEQ, we did give DEQ a notice at the end of December regarding the IV transfer station.

It was a flexible notice, it was coordinated with DEQ officials that we may close June 30th, but have not made a final determination yet.

I have conveyed strongly to county officials that

We need to make a decision and settle on a decision and settle on a date.

This is the continued changes or the spirit that things may change is weighing heavily on the employees and there is deep fear among the Rivanna administration

that in the absence of clear direction, employees who feel they may be about to lose their job but they're not certain of a time frame will act with their feet and leave us no alternative but to close.

Yeah, I actually have three questions on three of these topics.

One, and I think they're pretty quick.

The granular activated carbon, the difference between the hybrid and the full scale is $2 million.

It's like maybe a little over 10%.

And we were told that you could go full scale.

Can we go full scale for $2 million after we put in the $17.5 million hybrid or do we have to replace equipment?

It would not be replacing a lot of equipment to answer that question.

That was clear.

The program has been proposed and is being designed to be modular in nature.

The GAC vessels are one million gallon vessels in circular tanks.

You can imagine putting them in sequence.

There is some common piping, we call them headers, that provide the water to the individual vessels, but that's modular as well.

You can put a flange on the end of the pipe where you stop, so all you gotta do is pick up and continue to move forward.

Even the buildings themselves that house the equipment is being set up so that

In observatory water treatment plant rehabilitation, as you are planning to rehabilitate, are you planning for South Fork water?

Because that treatment plant

isn't really the same as South Fork because South Fork is so much dirtier.

Actually the functions of the water treatment plant, the conventional process is very similar for both observatory and South Fork now.

The rehabilitation observatory will accommodate South Fork water.

The changes pertaining to

It's not equipment.

And last thing is, as you fill, is filling the Ragged Mountain Reservoir, do you, I know the pipe, the sugar hollow pipe has a

Fairly limited capacity of which you're using maybe about half of it, maybe a little less than that now.

Plan right now when the construction is completed and we are able to start

filling the Ragged Mountain Reservoir would be to try to proceed to do that as quickly as we reasonably can, which means that, yes, the Sugar Hollow pipe is expected to flow near full.

There are some caveats.

We also come under new rules in terms of amount of water that we release to the Mormons River, and we're limited by the capacity of what's in the Sugar Hollow Reservoir.

We do expect, and we've made this statement before to the public, I don't know how far that information has gone, but we expect, because of the new rules affecting the release of water to the Mormons River, that we'll see the Sugar Hollow Reservoir fluctuate, particularly in the summer months more than it has in the past.

So we may experience more times when the reservoir levels in Sugar Hollow are lower,

than they have historically been.

In a dry summer in recent, I can think within the last five years when we've had a dry summer, that reservoir has dropped more than 10 feet.

It's more important to get the water from Sugar Hollow to Ragged Mountain because Ragged Mountain has a much smaller watershed area so that when we do rain,

A number of people have said Sugar Hollow is very flashy because it can drop significantly during a dry period, but it also can rise fairly quickly when it rains.

Are there any plans to add a third source?

Assuming South Fork is not until the pipeline.

Is there any, are there any plans to use another source besides the Mormons to either add to it or to fill it up more quickly?

As you know, our long-term plan, our current reservoirs on the urban system are the Sugar Hollow, the Ragged Mountain, and the South Fork reservoirs.

There's also a policy decision that was made by the board of directors by 2004 or 5 timeframe that in a drought situation, to the extent there's excess capacity in the Beaver Creek Reservoir, not reserved for Crozet, but Crozet always comes first.

that that water can be released through the Meacham's River to the South Fork reservoir.

But that's during droughts.

Right.

So it's going to be filled with the Mormons.

That's what I guess I'm getting is will the Wagon Mountain, until such time as the South Fork is put online,

Yes, just wanted to, and thank you very much for the good report, Mr. Frederick.

And with regard to the beginning of the construction of the Willen Mills Pump Station, I'm just going to ask, do you have plans to contact the Willen Mills Neighborhood Association?

And if not, just please do so.

So how long is the Mormons River going to be used to fill Ragged Mountain?

I think you're asking two different questions.

You want me to answer both of them or which one?

One at a time.

The Sugar Hollow Pipeline has not been scheduled at this point in time.

Our board's not given us direction on when they want that built.

The South Fork Pipeline has not been authorized until such time as it's built.

Right, and how long will it take to fill that reservoir?

It will depend on weather.

If we were filling it right now it would rise pretty quickly because we've had quite a bit of rain.

We tend to get higher filling in the winter months than in the summer months because the streams tend to have less water in them in the summer.

It's going to depend on whether we have a drought conditions or if we have a period like last summer when we had above average rainfall it would fill more quickly.

We've estimated that could be anywhere from three to four months in a wet condition.

to possibly a couple of years if it is extremely dry.

But it's not likely, the two year option is not very likely.

Okay, so we could expect to have that reservoir fill within two years.

We should be able to do that, yes.

Okay.

And you mentioned earlier on about the EPA has a requirement that we have to meet.

Well, I think the first thing that our attorney would advise the Rivanna Board of Directors is you have a fiduciary responsibility to comply and that's not really something that you really should strongly consider.

EPA has the option, if they choose to, to issue fines and penalties.

Those fines can be fairly substantial.

In excess of $30,000 a day if they want to exercise that judgment.

One more, Mr. Huja.

Can I just ask one more question?

The valve, the new valve at Sugar Hollow, how much can you release now?

It's calibrated so it can release up to a million gallons a day.

I don't know what its full capability might be, but it's going to be replaced within the next six months.

Oh, that's nice.

And those release requirements don't actually kick in until the Dragon Mountain Reservoirs is so-called operational.

And what does that mean?

Operational is when a operating certificate is issued by the Dam Safety Division in the Department of Conservation and Recreation.

That's a Virginia state agency.

Even when those conditions do kick in, when that is operational, there is a period of time, right now Ragged Mountain is at minus 18 feet.

During the period that it is recovering the fill back to its old level, the release requirements are still the same as they are today, 400,000 gallons per day.

or natural inflow.

It's only after we start climbing above 641 that new conditions come into play.

And that was calculated with engineering support during the development of the water supply to make sure that number one, while we want to feed the streams, number one is providing adequate drinking water for the public in the event of a drought.

and we had to consider that, you know, if our luck doesn't hold out, we might start, the dam could become operational at a time when we're in the middle of a drought.

Is the Nature Conservancy still involved with the whole project?

We had negotiations with the Nature Conservancy when we were developing a stream release program and then of course it was presented to the public and supported by our board and then presented to the regulatory agencies.

I don't have day-to-day contact with the Nature Conservancy about this project now.

The brickwork on the downtown mall on Second Street, right outside of Regal Theater, has been damaged for a number of years, at least two years probably.

MMM was the general contractor, as I understand.

If they don't take responsibility, that's going to be the taxpayers picking up the tab to fix that.

And in a couple months we have parents coming down into town that are going to flood the downtown mall and just look shabby down there.

First for me to find out if it's still the responsibility or not.

If there is, will you check that out?

We have, and Mr. Brown, I think, responded to a question.

Well specifically the one right outside of the Regal.

and I discussed, was the granite failing in the cross streets?

Just to clarify one point, I think the city, and I'm doing this from recollection because it has been a few years, I think the city acted as its own general contractor on this project.

MMM was the consulting engineering firm that I think did a lot of the design work.

And then we had a construction management firm and then we had, I want to say 12 to 14 separate contracts

between the city and the brick mason, electrician, plumbers, masons, all the different trades, which normally would be subcontracts with a general contractor, but we used a different approach on this.

So I wouldn't describe MMM as being the general contractor on this project.

They were the engineers that took the designs and

I think that's what you and I exchanged emails about.

I don't know the answer to that.

I want to make a clarification though, because even as an engineering or any kind of a design firm, they have a professional seal on the drawings and so they are liable for the effectiveness and functioning of that design.

The construction of those sets of documents is another story.

but there's still liability to be tied to the designer engineering firm that had put the seal on the drawings.

The staff has been working on a long-term fix.

We all recognize that the concrete that was put in place was just temporary to get us through that fix.

As part of that, we'll also look at the design that occurred.

We'll provide an update to the city council on that.

Well I'm just saying that the cross section of that street should have been designed differently to be able to accommodate the loads of vehicles.

If that was not done, that is a liability concern.

I'm also very interested in temporary fix of asphalt in place of drainage.

My first comment would be directed towards the public hearing or the discussion you guys had about the permit parking in the 10th and Page neighborhoods.

I certainly believe that obviously these neighbors, the people who live there,

should be able to get a permit at no cost.

It sounds like that's part of the plan and the research that you all are doing to decide whether this is a good neighborhood to put permit parking in.

But part of that discussion is when the city's infrastructure doesn't meet the current standards needs for parking.

and whatnot, you can't just grant a citizen parking right in front of their house.

So how do you decide how that parking is utilized in those neighborhoods and who can use those parkings on those specific streets?

I think that's kind of an interesting thing to figure out before you just go slapping a new study up.

The gentleman who was here speaking from the water authority said, oh, we don't know all of the details about this.

He really didn't discuss all of them.

And I realize that that's probably in a report that we can all read online.

It's nice when things are made public.

And I just I hope that this council, everyone who's new and everyone who's been here, continues to push for being open, fair and honest with every person in this community from all walks of all lives.

I'd just like to respond to the question about parking.

From what I understand, it's by zone.

And so anyone who lives in that zone, who has a permit for that zone, can park within that zone.

So it's not specifically in front of their houses, but it's people from the neighborhood can park in the neighborhood.
