Bucky Walsh
Chair, Electoral Board
00:00:03
And I note the presence of a court
00:00:26
The item of this meeting was to take a question of which doctoral policy we have with regard to early campaign.
SPEAKER_00
00:00:38
This issue came up...
Bucky Walsh
Chair, Electoral Board
00:00:46
Subsequently to Bratton's document, it was published in the midst of the
00:00:57
The reason there are two similar documents is there was great concern about or enforce a policy.
00:01:09
Policy might do in any way shape or form, certainly had no intent to do so, was not ever known.
00:01:21
Also,
00:01:25
about how much we are with in terms of things.
00:01:36
These all created without any discussion with the board and this is the first time for us to discuss what's in it.
00:01:54
and the documents that are here, we have very little Inovo material.
00:02:17
You try to do that, you never mess things up rather badly.
SPEAKER_00
00:02:55
Okay, I need to add
00:04:54
Can you all hear me?
00:04:59
Yes.
00:05:01
Can you hear us?
SPEAKER_06
00:05:05
I cannot hear you.
SPEAKER_00
00:05:09
Small area on the audio.
SPEAKER_05
00:05:11
Yes.
Bucky Walsh
Chair, Electoral Board
00:05:12
The speakerphone.
00:05:25
I can hear that Sherry and the board, but the board is in and out, says Liz.
00:05:47
I've changed the microphone.
00:05:49
Is that any better?
00:05:51
much better thank you unfortunately that's the microphone on my computer so that means when Andrea speaks you'll never hear her you might or might not speak Jim here Jim and uh Valerie wow so she's trying to fly under the radar should we come and get behind your laptop when we want to say I can I can hear I can hear Jim I can hear
00:06:18
Well, I am sorry for the audio difficulties.
00:06:21
I will report this to IT and let them work on it.
00:06:24
So hopefully it'll be addressed before our next regular meeting.
00:06:26
But at this stage, I think we need to soldier on.
00:06:32
So.
Jim Heilman
Secretary, Electoral Board
00:06:33
Okay.
SPEAKER_06
00:06:33
Other public comments?
00:06:36
Quick question.
00:06:37
I've seen the document, the policies document, but then I look at the
00:06:47
It is online.
Bucky Walsh
Chair, Electoral Board
00:06:50
Did you print it a few days ago?
00:06:52
Because it just went up.
SPEAKER_06
00:06:53
Yes.
Bucky Walsh
Chair, Electoral Board
00:06:54
It would have been, hadn't been, because it went up on the 12th.
SPEAKER_05
00:06:58
Are they identical?
Bucky Walsh
Chair, Electoral Board
00:06:59
They are intended to be very, very similar in effect.
Jim Heilman
Secretary, Electoral Board
00:07:04
We're talking about October 9 versus October 12?
Bucky Walsh
Chair, Electoral Board
00:07:08
Yes, and one's labeled a policy and one's labeled guidance.
SPEAKER_06
00:07:11
Oh, okay.
Bucky Walsh
Chair, Electoral Board
00:07:13
No, no.
00:07:13
There are different things.
00:07:15
A policy is a policy.
00:07:17
Guidance is a here's something you ought to know, as opposed to here's something we're going to enforce.
SPEAKER_05
00:07:22
So the content of the two documents are the same, but there's a difference in language.
00:07:30
Some is imperative and some is
Bucky Walsh
Chair, Electoral Board
00:07:35
Well, there are a few other substantive differences in the policy.
00:07:40
It says that if the various campaigns can't agree on who's going to go where, then they have to ask the registrar to assign them to places.
00:07:50
And this doesn't have that anymore.
00:07:51
This simply says, okay, the space is divided evenly and you take turns rotating through the spaces every day.
00:07:57
So what happens next if there's disagreement is baked into the guidance.
00:08:03
If you can simply agree, then you don't need to do any of that.
00:08:10
But I was trying to, based on Jonell's feedback, short circuit the registrar out of having to administer this.
SPEAKER_06
00:08:25
Mr. Caron?
00:08:26
Yes.
SPEAKER_03
00:08:28
I was actually on the line today and I did not see that the guidance part was online available.
00:08:33
So I broke late this afternoon to each of you.
SPEAKER_06
00:08:39
I'm sorry.
Jim Heilman
Secretary, Electoral Board
00:08:44
Briefly was able to scan your email.
SPEAKER_06
00:08:48
I could not look at the attachments.
SPEAKER_03
00:08:51
Oh, yeah.
SPEAKER_05
00:08:53
Thank you for that.
SPEAKER_03
00:08:55
So my overall concern, I think I understand that you want to
00:09:00
I'm sorry you didn't see it.
Bucky Walsh
Chair, Electoral Board
00:09:05
I'm looking online and it's there.
00:09:07
I haven't touched it for a couple of days.
00:09:11
It's one of those things if you don't refresh the page since the last time you were there, it won't probably give you the proper link.
SPEAKER_03
00:09:23
I've seen a lot of inconsistencies and applications of what the law is and isn't and I think there are a lot of people that don't understand what is appropriate and not appropriate or what the law says about the 40-foot perimeter but I will say this that I'm concerned about the electoral board trying to create
00:09:51
regulations and policies that perhaps they don't have the authority to do, and then to put on our registrar or to extend those things that perhaps Virginia Code doesn't provide for.
00:10:05
I also say I'm very concerned about people who aren't in the act of voting.
00:10:12
I've witnessed this numerous times, marching into the early voting area to file a complaint.
00:10:19
I personally think that that is a negative set of interactions that happens in a voting area.
00:10:25
And I would like to see that there's some guidance or instruction that if people have complaints about what's going on either within the 40 foot or beyond, that they go directly to the registrar's office separately to file it and get out of the voting area.
00:10:46
I've seen many people congregating immediately outside the doors, groups of people, and election officers don't stop it, but sometimes they stop it and they've made some threats to people.
00:11:00
I'd like to see that addressed in a way that, you know, isn't, it is more respectful, but I have seen election officers
00:11:13
congregating outside the dorms with people who aren't voting and aren't working.
00:11:17
So there's been an inconsistency of applying the law and of educating people about what the law is.
00:11:26
And I think those things can be addressed in a really great way.
00:11:32
Could it be that it's just a simple no loitering or congregating sign, among other things, because the law has a lot of things that you can't do within 40 feet.
00:11:42
And so with regard to if people knew that, but I think a lot of people that I saw congregating there knew what it was.
00:11:51
They were just not approached that they shouldn't be there as opposed to other people who were.
00:11:57
So there's been a real inconsistency of that by election officials.
00:12:03
And as my other point that I feel very strongly about, even though it go into detail,
00:12:08
Point over the paragraphs of your draft policy, but where my concerns are to be clear.
00:12:14
But I'm just not sure that you don't have the authority to do a track.
00:12:18
I don't think you want to be in the position of establishing regulations or policies that you may not have authority to do.
00:12:29
I understand you're wanting to protect free speech and that type of thing.
00:12:33
You also have to be concerned with fire code, ingress,
00:12:38
Egress, ingress, that type of thing.
00:12:41
But I think it's a matter of being consistent in applying what the laws are and not creating things that there's no authority for.
SPEAKER_05
00:12:53
May I suggest that we be a little bit more formal in our recognition of speakers, right?
00:13:01
So I'm just wondering if we can just
00:13:08
asks people, I understand that this is Mary Ann Gustafson, and thank you very much for your remarks.
00:13:15
But I'm wondering if we can be a little bit more regimented.
Bucky Walsh
Chair, Electoral Board
00:13:21
Sure.
00:13:22
And what would you like?
00:13:23
Have them identify themselves?
00:13:25
OK.
00:13:26
Anything else?
SPEAKER_05
00:13:27
I guess I would also maybe suggest our usual three-minute limit.
Bucky Walsh
Chair, Electoral Board
00:13:36
Yes, who would like to be the clockkeeper?
00:13:38
I've tried doing that in the past, and I find it prohibitively hard to run the meeting, run the Zoom, and keep the clock.
Andrea Ruege
Senior Assistant County Attorney
00:13:47
Well, quite regular.
Bucky Walsh
Chair, Electoral Board
00:13:53
The reason I ask is other boards and committees sometimes ask people to identify what magisterial district they're from, which supervisor to forward your complaint to.
00:14:03
There are other information that is asked from some speakers.
SPEAKER_05
00:14:07
Okay.
00:14:08
All right.
00:14:08
I just didn't realize we'd moved into that portion of the meeting officially, and I'm grateful to Ms. Gustafson for her remarks, which I think were very informative.
00:14:20
So thank you for that.
Bucky Walsh
Chair, Electoral Board
00:14:22
Is there anyone else who would like to speak?
00:14:29
Okay, is your hand up?
00:14:32
Would you identify yourself for the group?
Clara Belle Wheeler
00:14:35
I would concur with what the former speaker said.
00:14:46
I worry that by putting yourself in jeopardy,
00:14:51
by overstepping bounds that are outlined in code.
00:14:57
As far as the 40 foot, and as I said at the last meeting, you have jurisdiction to the 40 feet.
00:15:05
The space beyond that is courtesy to the campaigns.
00:15:15
What they do or don't do really
00:15:19
short of a 300 foot prohibition on a loudspeaker.
00:15:27
The types of work they do is their business as long as they're not infringing on the voters and breaking the law and impeding them anywhere.
00:15:39
You can't impede a voter no matter where you are.
00:15:45
But I think that to the point that was made that may not be in your guidance,
00:15:50
I think there needs to be some carefully worded instruction, since the registrar is in charge of in-person absentee, on what the, they would call the officers, registrars, assistants, associates, whatever, can and cannot do.
00:16:07
And civil discourse, screaming at people, is inappropriate.
00:16:14
And that's taking place.
00:16:17
I mean, you can't have officers at the police
00:16:19
coming out of in-person absentee, whether they're regular or they're cheap, screaming at people that they may perceive should not be standing when, in fact, they're merely coming out and trying to figure out where to go.
SPEAKER_05
00:16:37
May I ask you a clarifying question for Bill?
00:16:41
So is it your understanding that some officers of election have raised their voices with campaigners
00:16:49
or voters.
00:16:53
Thank you.
00:16:55
Well, I'm glad that you brought that forward.
Bucky Walsh
Chair, Electoral Board
00:16:59
Did you have further comments?
Clara Belle Wheeler
00:17:01
That's the comment.
00:17:02
I think that needs to be, I'm sorry that I think it needs to be understood, but I think it needs to be explained to the people who are working in debt.
00:17:13
You certainly wouldn't do that in a precinct or a polling place on election day.
00:17:18
It's not appropriate here.
Jim Heilman
Secretary, Electoral Board
00:17:20
So you're saying that there are election officials that have been screaming at people outside the door within the 40-foot line?
00:17:28
Is that what you're saying?
Clara Belle Wheeler
00:17:29
Within the 40-foot line and possibly even it's kind of hard if you're screaming for the voice not to care.
00:17:38
Yes.
Jim Heilman
Secretary, Electoral Board
00:17:42
I have not seen that happening.
SPEAKER_05
00:17:45
So I think
00:17:46
What I understand
00:17:49
If I could just boil down what maybe the two of you have said, is that right?
00:17:53
I mean, I think your comments were in concurrence, right?
00:17:58
So I think that the two things that you're driving at here is that you think that the board may be straying outside of its statutory authority in establishing a policy or even suggestions about behavior, yeah?
00:18:17
But as far as the campaigning outside the 40-foot line, is that correct?
Clara Belle Wheeler
00:18:23
I'm not saying you are.
00:18:24
But you're just saying it.
SPEAKER_05
00:18:27
Right, of course.
00:18:28
Yes, very much so.
00:18:29
OK, so that's issue number one.
00:18:32
and thank you.
00:18:33
And the other issue, the separate issue is that it's possible some officers of election have been a little aggressive in their treatment.
Bucky Walsh
Chair, Electoral Board
00:18:43
Well, if they're screaming, I'm gonna go to more than a little.
SPEAKER_05
00:18:45
Well, a little bit, yeah, no, of course, absolutely.
00:18:48
So those are both, I think, really important things to bring forward and thank you.
SPEAKER_03
00:19:00
Thank you.
00:19:01
Okay.
Bucky Walsh
Chair, Electoral Board
00:19:02
I think your three minutes may be up to my colleague's point about watching the time.
00:19:15
So you're going to go on anyway, even though I've said you're out of order.
00:19:19
I'm going to ask you not to do that again, since we're going to take strict adherence to our rules.
SPEAKER_06
00:19:27
Jim, did you have something you want to say?
Jim Heilman
Secretary, Electoral Board
00:19:34
I think the main thing that we were concerned about was the area, the campaigning area.
00:19:45
That has been established as the campaigning area by facilities management, not by us.
00:19:53
But facilities management has further said, well, that area for campaigners, what happens in that area should be up to the electoral board.
00:20:05
Is that the way you all understand what has happened so far?
Bucky Walsh
Chair, Electoral Board
00:20:08
That's how we got to where we are.
Jim Heilman
Secretary, Electoral Board
00:20:09
So other things to me right now are strange.
00:20:17
The issue is that campaigning area.
00:20:21
And what should happen in that?
00:20:23
It's an area for campaigners, their tents, their signs.
00:20:29
It is not an area for vehicles to be parked.
00:20:33
I think that
00:20:36
To some degree, we should limit our guidance here to discussing that area.
00:20:43
And my thinking is that our guidance or policy should be that that area should not be a place that any vehicles park, period.
00:20:56
And the only people and campaigners can be there right now.
00:20:59
We have the blue pen and we have the red pen.
00:21:01
We have two and a half,
00:21:04
parking spaces in between.
00:21:07
That could be for an independent campaigner if there was one that wanted to come campaign that.
SPEAKER_05
00:21:13
Or are we also talking about just people who have an opinion?
00:21:18
People who have an opinion and they have a placard and they'd like to stand there?
Jim Heilman
Secretary, Electoral Board
00:21:24
I suppose that could be part of it, yeah.
00:21:30
But it is not a place for vehicles to park.
SPEAKER_05
00:21:32
As a safety matter.
Jim Heilman
Secretary, Electoral Board
00:21:34
as a safety manner and that it has been designated for campaigners, not for vehicles.
SPEAKER_05
00:21:43
Well, I think we also had input at the last meeting that there was a vehicle that was parked there that had some placards on it, you know, related to the election in some manner.
00:21:57
And because that vehicle was there,
00:22:00
Another truck that I think was just a voter or a member of the public thought, you know, these are our parking spots and they tried to, you know, snug into another spot that was kind of close to one of the tents and it just was a little bit uncomfortable.
Bucky Walsh
Chair, Electoral Board
00:22:16
Parking there is all about safety.
00:22:18
It's not about message.
00:22:19
It's all about safety.
SPEAKER_05
00:22:20
Right.
00:22:21
So I do feel like it also invites, not only is it a little bit of a safety matter with respect to the campaign tents, but also it invites other members of the public to think, oh, well, here's an open parking spot.
00:22:36
It's very close to the entrance.
00:22:37
I'll park here.
Jim Heilman
Secretary, Electoral Board
00:22:38
That is why the orange cones have been put up there.
00:22:42
The orange cones, I believe, were supplied by facilities management.
00:22:46
but the Orange Cones facilities management is not going to come out at eight o'clock in the morning to put up some cones there so it has been up to the election officials that arrive early to put those cones out there and they have been doing that and at least in the last several days that I have been here the cones have been effective and
00:23:13
There has been an occasion of someone from the campaign tent moving one of the cones out of the place that it was.
00:23:24
I moved it back to where it was supposed to be because of what the cones are for.
00:23:29
Otherwise, I think that has been, no one has run over the cones or anything like that.
00:23:37
When I stop and I'm here virtually every day, I stop at both tents.
00:23:41
I ask them if everything is all right, going OK. And I get nothing but everything is fine.
00:23:50
I have not gotten any complaints about screaming or anything like that.
00:23:54
And I have stopped at those tents.
Andrea Ruege
Senior Assistant County Attorney
00:23:59
Mr. Chairman, may I address the board?
Jim Heilman
Secretary, Electoral Board
00:24:01
Please.
Andrea Ruege
Senior Assistant County Attorney
00:24:02
Please.
00:24:02
This afternoon, Mr. Mallory, who
00:24:06
participated in our meeting.
00:24:07
He forwarded a policy which was adopted by the Board of Supervisors on October 16th of 2019 regarding parking lots and use of vehicles in the parking lot.
00:24:18
So I have, it's a lengthy policy.
00:24:21
I only printed six copies of it because I did not want to kill too many trees.
00:24:26
So I do have, I can also forward the, get a copy too, but if anyone from
Bucky Walsh
Chair, Electoral Board
00:24:34
Is there a summary you would care to call to our attention?
00:24:43
Send it on back.
Andrea Ruege
Senior Assistant County Attorney
00:24:47
So under this policy, the parking lot here at Cub Fifth has been designated a non-public forum.
00:24:59
which means that it's not generally an area that's open for public extraction.
00:25:04
There are certain provisions and exceptions that are made.
00:25:08
Its policy gives the chief executive
00:25:12
the ability, or the county executive excuse me, the ability to regulate what is going on in the parking lot.
00:25:18
And we can also designate that authority to designate which would include a department head.
00:25:24
So likely any parking lot issues would need to be brought to FES for adjudication rather than anything involving the registrar or the board.
SPEAKER_05
00:25:34
So this is, I think, contrary to what we've heard,
00:25:39
the last meeting.
Andrea Ruege
Senior Assistant County Attorney
00:25:40
And this policy was adopted a number of years ago.
00:25:43
I don't think it's very easy to find or locate on the county's website.
00:25:47
So I just got this a little bit before this meeting, so I had an opportunity to get it to the board.
00:25:55
But I do think that this policy addresses a lot of the concerns that are raised or have been raised during this process.
Bucky Walsh
Chair, Electoral Board
00:26:04
Does anything in the policy speak specifically to the use for elections?
00:26:10
Because that probably would have predated our current usage.
Andrea Ruege
Senior Assistant County Attorney
00:26:14
It does not.
Bucky Walsh
Chair, Electoral Board
00:26:14
Yeah.
00:26:15
OK. Yeah.
00:26:17
Very good.
00:26:18
Well, thank you.
Andrea Ruege
Senior Assistant County Attorney
00:26:19
That's very welcome.
Jim Heilman
Secretary, Electoral Board
00:26:21
Just really briefly, a little history.
00:26:26
When early voting first was established, and it was established that room A would be for early voting,
00:26:34
there was a back and forth negotiation between facilities management and the registrar's office as to what was going to be allowed initially facility I believe it was facility management and FES is I never that is facility what I call facilities management initially did not want any kind of campaigning at all signed or anything
00:27:05
but they were convinced that this now being a voting space and that voting spaces traditionally have been allowed to have yard signs and to have campaigners.
00:27:20
And so they said, okay, we will say that this part of the entrance road can have yard signs.
00:27:29
They must be put up in the morning and taken down in the evening.
00:27:33
This part of the parking lot can be for campaigns.
00:27:40
And I won't repeat what I said before because that's what it is all about.
00:27:46
They did, back in the beginning, establish much more parking spaces for voters.
00:27:55
that has kind of fallen apart.
00:27:56
And the only ones that have actual signs saying voter parking only are four spaces up on top as you come in.
00:28:07
Before, we've had signs saying voter parking here, and they've had voter parking signs right at places.
00:28:13
Those have not been done for this election or for, I think, the previous election or two.
00:28:21
But that's a little bit of the history of how we got to what is allowed and what is not allowed now.
SPEAKER_05
00:28:30
May I remark on what you just said?
00:28:33
I think that's very consistent with facilities calling the shots about the use of the parking lot and so on.
00:28:43
Consistent with this policy, yeah.
Jonell McFadden
Director of Elections and General Registrar
00:28:46
Can I address the phone?
00:28:48
Sure.
00:28:50
I send all of you this electronically.
00:28:52
Thank you.
00:28:54
And I'd like to just read four sentences coming from
00:28:58
I think that what he said at the last meeting actually is consistent with what this policy is saying because he's talking about the grounds as a whole but then he's saying okay there's this little island that we have carved out just for campaigners so and so this is what he said about this he said in short meaning in short
00:29:27
Oh, let me see.
00:29:28
The impetus for my sending a message to Mr. Mowry and to Bruce Jones is that this weekend there were some protesters.
00:29:37
It's invisible, Charlottesville.
00:29:40
And I'm not calling them protesters.
00:29:41
They are defined as protesters.
00:29:43
They are defined as activists.
00:29:45
And they are planning to come on Saturday.
00:29:47
I think they got some mistaken information that we were voting on Saturday.
00:29:50
We are not.
00:29:51
but we hear also on Sunday.
00:29:54
And so Mr. Mowery sent this in response.
00:29:58
And I'll just read you the four pieces at the end.
00:30:01
He said, in short, the only space campaigning is allowed is the designated parking space area.
00:30:11
Anyone not voting or conducting county business is not permitted to remain elsewhere on the property.
00:30:19
This applies to on weekends as well.
00:30:22
If individuals are not actively voting, they were ruled to leave.
00:30:27
During the week, I have instructed my staff to ask anyone who is not voting or conducting county business to depart.
00:30:35
This includes individuals such as the gentleman with the truck covered in election signage.
Jim Heilman
Secretary, Electoral Board
00:30:43
Just so I get it right, the only space campaigning is allowed is the?
00:30:49
Five spaces.
00:30:50
You talked about that.
Jonell McFadden
Director of Elections and General Registrar
00:30:51
Correct.
SPEAKER_05
00:30:52
And I guess that would also apply to the young woman who's been approaching people.
Jonell McFadden
Director of Elections and General Registrar
00:30:59
Correct.
00:30:59
It would.
00:31:00
It would.
00:31:02
Only what they're saying is only
00:31:04
those five spaces is where any kind of campaigning, people conducting things for campaigns or candidates can happen only within those five spaces, not elsewhere.
Bucky Walsh
Chair, Electoral Board
00:31:18
Well, that takes a lot of the concerns off the table.
SPEAKER_05
00:31:21
It does.
00:31:22
The facility is gonna hold that.
00:31:25
It really does.
Jim Heilman
Secretary, Electoral Board
00:31:26
But how does this go as far as someone from the tent
00:31:34
going out of their tent and saying, as a voter approaches, we hope you will vote for blah, blah, blah.
00:31:44
We hope you will vote against blah, blah, blah.
Jonell McFadden
Director of Elections and General Registrar
00:31:46
When I'm reading this, it means they can't do that.
00:31:49
They have to stay within those five spaces.
Jim Heilman
Secretary, Electoral Board
00:31:55
Well, that's certainly something different.
SPEAKER_05
00:31:58
Well, I've always just seen, well, let me ask you,
00:32:02
I've always just seen people sitting inside the tent and then voters walk past and maybe they say, oh, you know, would you like a brochure or something like this?
00:32:12
But I don't, I haven't seen people from inside the tents, you know, sort of prowling the parking lot.
Jim Heilman
Secretary, Electoral Board
00:32:19
But I always thought that was allowable because they were outside the 40 foot lot.
00:32:24
Distinction is though you're on public property.
SPEAKER_05
00:32:26
Right, this is the difference because we're here on the county property.
Jim Heilman
Secretary, Electoral Board
00:32:32
Is that your understanding, Andrea?
00:32:35
So if we put in our guidance or a policy to match this.
00:32:43
Well, I'm questioning whether we need anything.
SPEAKER_05
00:32:45
This is my thought.
Jim Heilman
Secretary, Electoral Board
00:32:48
Well, I'm saying we would have to tell campaigns that you are no longer allowed to walk out on the pavement to talk to folks.
Bucky Walsh
Chair, Electoral Board
00:32:59
Outside of your parking spaces, yeah.
Andrea Ruege
Senior Assistant County Attorney
00:33:01
Well, my understanding is that parking lot, the parking space area has been designated.
00:33:07
So if they're staying in that parking space area to do the campaigning, that would be permissible under the policy.
00:33:14
but roaming to the other end of the parking lot, we've now ventured into the non-public forum portion of the parking lot so that type of activity would not be allowed.
Jim Heilman
Secretary, Electoral Board
00:33:26
So we're just walking out into the area that is...
00:33:35
Okay, let's say, okay, we've got the five spaces.
00:33:39
Yeah, you're here, you're in the tent.
00:33:42
Within the boundary that stretches out into the asphalt from the edge of your tent, we're going to say you are no longer allowed to walk out into that area.
Bucky Walsh
Chair, Electoral Board
00:33:55
We're not going to say that at all.
Andrea Ruege
Senior Assistant County Attorney
00:33:57
facilities is going to say that well i'm just trying to understand is that what if there's a complaint of that nature that people should be directed to contact facilities to figure that out and i would encourage the board to not involve itself in that type of well someone needs to tell the campaign tents and the campaigns themselves
Jim Heilman
Secretary, Electoral Board
00:34:20
that you are no longer allowed to do that.
Bucky Walsh
Chair, Electoral Board
00:34:23
We can provide them with a copy of this letter and you've got, you've already provided them with a copy of the map I assume.
Jonell McFadden
Director of Elections and General Registrar
00:34:29
Yes.
Bucky Walsh
Chair, Electoral Board
00:34:29
Yeah so.
Jonell McFadden
Director of Elections and General Registrar
00:34:31
Yeah I could and actually I can ask them just to write something to address the campaigns and then include this information here and just.
Andrea Ruege
Senior Assistant County Attorney
00:34:41
And I'll share with the board my understanding there was a request potentially earlier this year that the governor wanted to come and do some announcement on the steps of the other county office building, which is also a designated non-public forum.
00:34:56
And in the event that there's something that's going to be happening like that, that individual or group needs to get a permit issued by the county to be able to conduct that.
00:35:05
So the decision was made that the activity would not be happening on the steps of the county office building, that it would happen somewhere else.
00:35:11
But that is the process for these non-public forums, how that's going to happen in those spaces.
Bucky Walsh
Chair, Electoral Board
00:35:16
Doesn't involve us at all.
SPEAKER_05
00:35:18
Right.
Bucky Walsh
Chair, Electoral Board
00:35:21
Yay.
SPEAKER_05
00:35:22
Right, music to hear.
00:35:23
So it sounds like, is this going to impact, so Indivisible has this planned for this weekend, it sounds like this impacts them as well.
00:35:29
It does.
00:35:31
As someone said, they'll ask them to leave.
00:35:32
Oh, okay.
Bucky Walsh
Chair, Electoral Board
00:35:33
Unless they've gotten a permit.
00:35:36
But again, not our concern.
00:35:39
We're not actually here, so really not our concern.
Jim Heilman
Secretary, Electoral Board
00:35:43
Well, my concern is that someone, who is the person responsible for telling these folks that there is a change in what you can do?
Bucky Walsh
Chair, Electoral Board
00:35:52
As a courtesy, we will do that, but facilities has this responsibility.
SPEAKER_05
00:35:57
I think Jonell said she would give to each of the campaign tents this policy.
Jonell McFadden
Director of Elections and General Registrar
00:36:04
And also to the representatives, I'll email it to the parties themselves.
00:36:09
And I'll ask facilities if they would just write something to introduce this and direct it direct to the campaigners themselves instead of coming through.
Jim Heilman
Secretary, Electoral Board
00:36:22
I'm so glad we had this little talk.
SPEAKER_05
00:36:23
I'm so glad.
Jim Heilman
Secretary, Electoral Board
00:36:24
I still have that.
00:36:27
Completely come to an agreement on what can be in the five spaces.
00:36:37
And I get back to the main thing I think that we need to say is vehicles cannot be in those five spaces.
SPEAKER_05
00:36:45
So is it your understanding that we could make a content neutral restriction of some nature just for a safety purpose?
Bucky Walsh
Chair, Electoral Board
00:36:56
It doesn't sound like we have any authority whatsoever over those five spaces and that facilities is choosing to exercise their authority.
Andrea Ruege
Senior Assistant County Attorney
00:37:05
Okay, I would also say that in the middle of an election is likely not the best time to make any changes.
SPEAKER_05
00:37:11
No, I think that's fair.
Jim Heilman
Secretary, Electoral Board
00:37:13
The facilities was the one that said that we need to be the ones that say what happens within those five spaces.
Bucky Walsh
Chair, Electoral Board
00:37:19
Notice how the hot potato has moved back to them.
00:37:26
Did you have a question?
00:37:27
Is there any further discussion of this topic required?
Jim Heilman
Secretary, Electoral Board
00:37:42
Well, Mr. Chairman, can you
00:37:45
Kind of sum up and say that based on the information that we have received from the county attorney and from the facilities management that we will be establishing no policy.
Bucky Walsh
Chair, Electoral Board
00:38:01
What you said.
00:38:04
You said.
00:38:06
Based on the information we received from
00:38:10
our able attorney and the letter that the registrar read from county facilities or FES.
00:38:20
It is apparent that the electoral board does not need to establish any policy or guidance that this falls in the domain of the facilities or the FES department and that they are going to take such enforcement actions as may from time to time be necessary.
00:38:39
You talk too fast.
00:38:41
It's a long-standing problem.
00:38:49
It'll be in the transcript, yeah.
Jim Heilman
Secretary, Electoral Board
00:38:59
Basically you're saying based on the information from the county attorney and from the county, it is apparent that the electoral board need take no action.
00:39:09
That's basically it.
Bucky Walsh
Chair, Electoral Board
00:39:11
I think that's where we are.
00:39:12
Any disagreement?
SPEAKER_05
00:39:14
No, none.
Bucky Walsh
Chair, Electoral Board
00:39:15
Okay.
00:39:17
Was there anything else we needed to do at this meeting?
SPEAKER_05
00:39:20
I don't think so.
00:39:22
I think the meeting was called for this group.
Bucky Walsh
Chair, Electoral Board
00:39:24
Do you have a question?
00:39:24
You have something else we need to do.
00:39:29
The registrar runs early voting and I'm sure she heard that and will take such necessary action as may be appropriate.
SPEAKER_06
00:39:49
If someone is coming as part and is coming up to say social services and are going through in front of the tents,
00:39:59
They've got social services, there's no issue with that.
00:40:01
It's just with people who are not coming here either as employees or to conduct business here in the office.
Jim Heilman
Secretary, Electoral Board
00:40:13
That is kind of a problem where normal polling place, nothing else can be happening, but obviously this is the government.
00:40:25
Government employees must come in and government employees must park down there and government employees must walk up the steps.
00:40:35
So you can't control that.
Bucky Walsh
Chair, Electoral Board
00:40:45
Then I'll move to adjourn.
Jim Heilman
Secretary, Electoral Board
00:40:48
No, we can't adjourn because I thought we were doing some EO points.
Bucky Walsh
Chair, Electoral Board
00:40:53
I asked if there was any other business we needed to take care of and nobody spoke for that.
00:40:57
Andrea had a couple of questions.
00:41:01
Should we go to a closed session for that?
Jim Heilman
Secretary, Electoral Board
00:41:05
We need to get a closed session to discuss the CEO.
00:41:08
Yeah.
Bucky Walsh
Chair, Electoral Board
00:41:09
Well then let me...
00:41:23
Movedly the Albemarle County Electoral Board convene a closed meeting pursuant to section 2.2-3711A of the Code of Virginia under subsection 1 to discuss and consider applications of prospective candidates as officers of election and to discuss the assignment of officers' election to polling places.
00:41:42
All those in favor say aye.
SPEAKER_00
00:41:44
Aye.
Bucky Walsh
Chair, Electoral Board
00:41:45
Any opposed?
00:41:46
And we'll be in closed session as soon as everyone leaves.
00:41:49
Thank you.
SPEAKER_06
00:41:56
The precinct assignments will be sent out.
Jim Heilman
Secretary, Electoral Board
00:41:59
I think I have been.
00:42:00
Oh, yeah.
SPEAKER_06
00:42:01
No.
Jim Heilman
Secretary, Electoral Board
00:42:01
No, no, no.
SPEAKER_06
00:42:04
I'm assuming.
Bucky Walsh
Chair, Electoral Board
00:42:07
I move that the electoral board certified by a recorded vote that to the best of each member's knowledge, only public business matters lawfully exempted from the open meeting requirements of the Virginia Freedom of Information Act and identified in the motion authorizing the closed meeting were heard, discussed, or considered in the closed meeting.
00:42:25
Second.
00:42:26
All those in favor, say aye.
00:42:29
Aye.
00:42:30
Hearing none, opposed.
Jim Heilman
Secretary, Electoral Board
00:42:33
Moving on with how we have been doing it, I move approval of the updated roster of chiefs and assistants to take in.
SPEAKER_05
00:42:41
I second.
Bucky Walsh
Chair, Electoral Board
00:42:42
All in favor, say aye.
00:42:44
Aye.
00:42:44
I don't think we have anything else from our closed meeting to vote on.
00:42:49
So I move to adjourn.
SPEAKER_05
00:42:53
Second that.
Bucky Walsh
Chair, Electoral Board
00:42:55
And then we are adjourned.
00:42:56
Peyton, thanks for joining right at the end.
Jim Heilman
Secretary, Electoral Board
00:43:02
Peyton, you are now the assistant chief and Jack Dewitt.
