Board of Supervisors Regular First Meeting   5/4/2022

Good afternoon.

I call to order this meeting of the Albemarle County Board of Supervisors for 1 p.m.

on May 4.

The opportunities for the public to access and participate in the hybrid meeting are posted on the Albemarle County website, on the Board of Supervisors homepage, and on the Albemarle County calendar.

Participation will include the opportunity to comment on those matters for which comments from the public will be received.

Our supervisors present today are Supervisor Jim Andrews of the Samuel Miller District, Supervisor Diantha McKeel of the Jack Jouett District, Supervisor Ann Mallek of the White Hall District, Supervisor Bea LaPisto-Kirtley of the Rivanna District,

Supervisor Ned Gallaway of the Rio District, and myself, Supervisor Donna Price of the Scottsville District.

I would also like to mention that our County Executive, Mr. Jeff Richardson, our County Attorney, Ms.

Cynthia Hudson, our Clerk, Ms.

Claudette Borgerson, and our Senior Deputy Clerk, Mr. Travis Morris, are also present in the meeting.

I also want to give a thanks to our Albemarle County police officers who are present here today, Officer Esquirel and Officer Freestock, and thank you for your service and watching out for us and everyone in the community every day.

I have a couple of items to note.

I joined Donna and several of our school board members last night, was it just last night?

Last night in this room to celebrate 42 teachers who had received the Golden Apple Awards from the Nunley family.

The Golden Apple Awards ceremony is a recognition

for our teachers from all over this area, private schools as well as public schools.

They're nominated for the award by their peers, by the families, and by the students.

So it's really a very special award.

And 42 awards were given out.

and once again we really want to thank the Nunnally family who has supported this program for two decades, for 20 years.

And I know Donna will probably want to make some comments as well.

Item that I want to mention today is that on Tuesday, May the 10th from 5.30 to 7 at Albemarle High School in the cafeteria, the Lambs Lane Master Plan will be presented for the public.

And just to remind everyone, there's been a committee of citizens and

educators, as well as unelected and school board members that have been working on a master plan for the Lambs Lane Campus, which is the campus that includes Albemarle High School, Jack Jouett Middle School, Greer Elementary School, and Ivy Creek, and soon the Boys and Girls Club.

And so there is a first draft now, a design of this master plan and it will be shown to the public again Tuesday, May the 10th from 5.30 to 7, Albemarle High School cafeteria.

And it's one of those presentations that you can just drop in and drop out as you want, but there will be at the beginning of the meeting a short presentation by the planning group.

So maybe if you can err on the side of being a little bit earlier might help.

Oh, and there's a flyer on the table if you want to pick one up to remind yourself.

It is spring so there is a lot going on.

So on Saturday, April 23rd, I was fortunate to be able to join Dan Eggleston and four generations of the Wood family to celebrate the dedication of the LF Wood Training Center at Seminole Trail Fire Department.

And there are some shots of Patsy in the blue cutting the ribbon with her daughters.

Fundraising was done by the company and this is made of Connex boxes all stuck together and can be reconfigured in different ways for different people to train and they certainly invite members of other companies to come and train as well and easy access to training keeps our firefighters safe and it's very important.

On Arbor Day celebrated last Friday with a hike to the boundary or Corner Oak at the top of the mountain in Mint Springs Valley Park.

A dozen tree stewards and family members joined in to celebrate this more than 200-year-old tree's survival through hurricanes and derechos, providing cooling shade for orchard workers where three different orchard farms come together at this point.

Several hiking families and a bicycler also had found their way to the top of the mountain trails which converged there.

Albemarle County Parks

and Recreation's Jim Barber made sure that we did not get lost and recognized the Charlottesville area tree stewards for their work monitoring specimen trees and also providing hundreds of trees and the manpower to plant them in Albemarle County Parks.

We'll all keep watch also on the white oak at the airport.

You may have seen it.

It's the second largest white oak in the Commonwealth.

a heritage, one of the heritage trees there as well.

The Alliance for the Chesapeake Bay has information for tree planting resources and economic and ecological benefits for increasing our tree canopy everywhere.

The Crozieros and Crafts Festival is coming this weekend just in time for Mother's Day.

A few showers on Saturday but full sun on Sunday so please get out there and find your mom or grandma on something special.

There'll be music and food and hundreds of artists who are juried and sell their wares there.

and also in Crozet, 19,949 Kelly Bronze turkey eggs made the trip safely from England and once they hatch they will be turned out in the forest and fields of the farm to live like turkey should and they are spectacular creatures when you see them out in the field.

I do believe on Saturday there will be an arts festival in Dardan Town.

Well, I fully endorse Turkey's living as they should, so I will take the moment to say that.

I have a few.

Sunday, May 1st, I really had a great time going to Thistle Rock Farm.

for the first annual May Day Beltane Celtic Festival.

I learned that there are four Celtic seasonal festivals.

The first one is Imbolc, which is the beginning of spring.

The second one is Beltane, which is halfway between spring Equinox and summer Soltis.

The third and fourth I won't pronounce properly, but they're spelled

Samhain, which is the end of the harvest season, and Lunasada, something like that, the beginning of the harvest season.

But what was really neat about this was once again being reminded about the diversity of our cultures that are here in Albemarle County.

And of course we have a lot of Celtic background here and it was really great and I really appreciate John Kluge and Christine Mahoney opening their property to everybody.

on Sunday.

Also, I've been kind of house-sitting, dog-sitting out in Nelson County where my daughter and son-in-law have a house and recently was able to walk along the Rockfish Valley Foundation Trail

in Nelliesford in the Wintergreen-Afton area.

And it's a beautiful trail.

It's over there by Bold Rock Sidery.

It's great for families because it's pretty level.

But they also have a 17-station representations of all the different creatures that live along that area.

And so it's really both fun and informative.

Children will love it.

And so I really encourage people to take a look at that.

I'm not going to pass without saying we're now at 993,100 American dead from the pandemic.

The daily average now across the country is two times what it was just a couple of weeks ago.

Fortunately, while the cases may be up, it appears that this is a much less deadly variant than the previous ones that have come through.

But it's still just a reminder to get your vaccinations and be careful.

And I want to just follow up with Supervisor McKeel.

It was such an exciting time in here last night for the Golden Apple Awards because, again, there's so few times over the last two years people have been able to get together.

And the energy you could feel in the room as these teachers and their families were able to celebrate.

In the none least 21 years they've been sponsoring this event.

It was really wonderful.

So that's all I have.

Oh, and so Supervisor LaPisto-Kirtley has an addition.

Well, not an addition.

I want to make sure.

Did I say Saturday or tomorrow for the Darden Town Arts Festival?

I thought you said Saturday.

If I said Saturday, then that's correct.

So those who are out there tomorrow have a good time doing other things.

We do have four proclamations and recognitions.

First one we're going to start with, a proclamation recognizing the centennial of the Charlottesville band.

Thank you.

It's an honor to be able to read this today, the proclamation recognizing the centennial of the Charlottesville band.

Whereas, the Charlottesville band mission statement reads, we are the Charlottesville band, local musicians enriching community life through excellence in musical performance and education since 1922.

And through our free concerts, varied repertoire, and partnerships, we provide our members and audiences with experiences that entertain, uplift, and inspire.

Whereas the Municipal Band of Charlottesville was established August 17, 1922, and gave its first concert at a park in downtown Charlottesville on August 29, 1922.

And since its founding, the band has played hundreds of free concerts at civic functions, patriotic occasions, and celebrations, including events to honor several presidents of the United States,

as well as the Queen of England in 1976.

Whereas since admitting them to the band in 1957, almost 600 women have played with the band.

And Peggy Madison, one of the first 18 women to join in 1957, continues to play with the band to this day.

And the band has had more than 1,700 musician members and continues to be one of the oldest continually operating community bands in the United States.

Whereas in 1920 and 1921, the band upheld its commitment to a century of free, uninterrupted music, playing through the pandemic with its ensembles performing at safely distanced outdoor concerts in the summer, with the full band performing a December holiday concert in downtown Charlottesville.

And whereas in 19, sorry, whereas in 2021, the Municipal Band of Charlottesville changed its name to the Charlottesville Band to reflect its standing as an independent band,

Now, therefore, be it proclaimed that we, the Albemarle County Board of Supervisors, recognize the Charlottesville band as a valued resource for our community as it celebrates its centennial.

Yes, I am the vice president of the Charlottesville band and I just want to thank you all for your support over the years and it had allowed us not only to stay in existence through the pandemic but we also were able to have our small ensembles perform outside for a lot of people including some who were very lonely or not well and kind of keep us in the community during that time.

And I just want to mention, because I think some people forget, a lot of young families come to our concerts and tell me that it's the first time they bring their kids to live music because it is a free concert and they can be outside lots of times.

It's easy to go in and out.

Our members include high school members, retired people, CEOs, mail deliverers, you name it, they're probably in the band.

We just all have a love of music and a love of sharing it with the community.

And lastly, I just want to invite everyone to our first concert of the summer season, which will be June 7th, and I'm going to make sure I say it right, at Claudius Crozet Park, so in the county, at 730.

Unfortunately, because with the pandemic, we've

I'll just start by saying how wonderful it is to be able to do this and I very much appreciate, I mentioned to some people that we were doing this and they said that they've heard the band at the naturalization ceremonies, they've looked forward to it in many different ceremonies so it's made a big impact on the community and the fact that you have someone playing there who started when I was born and I'm not young.

I'll go next.

I really enjoyed the Christmas concert this year and as I'm sitting there thinking, how do they do that in the cold?

So thank you so much.

The arts are so important to our community and we really appreciate it.

I just wanted to say thank you very much for all your years of service.

You are probably one of the most popular non-profits in this community, if not the most.

And I just wanted to say one of my fondest memories as a child was attending the Stanton Municipal Band Concert.

Very similar organization, and I know we have families and children all over this community that just really, really appreciate the ability to go and hear the concerts for free.

All I can say is without bands, we wouldn't have football games.

Thank you very much for being a band.

All right, Board, we'll move on to our next item, which is a proclamation celebrating Asian American and Pacific Islander Heritage Month.

And Supervisor LaPisto-Kirtley, I'll turn the floor over to you.

whereas Asian Americans and Pacific Islanders make up an estimated 5.6% of the US population and a 7.3% of the population of Albemarle County and whereas Asian Americans and Pacific Islanders have flourished and succeeded in the county of Albemarle and are a vital part of our community's history, making important contributions to the cultural, civic,

and whereas in spite of the strength shown and successes achieved, Asian American and Pacific Islander communities face systemic barriers to economic justice, health equity, educational attainment and personal safety.

compounded by the stark gaps in federal data, which too often fails to reflect the diversity of this community in terms of languages, ethnicities, and religions.

And whereas Asian Pacific and Asian American and Pacific Islander communities have faced increasing harassment and hate crimes during the COVID-19 pandemic, particularly targeted towards women and elders of the community.

and whereas present-day inequities faced by Asian American and Pacific Islander communities are rooted in our nation's history of exclusion, discrimination, racism, and xenophobia, including discrimination legalized through the Page Act of 1875, the Chinese Exclusion Act of 1882, the incarceration of Japanese American citizens during World War II, and the targeted surveillance of South Asian Americans.

especially those who are Muslim, Hindu, or Sikh after the national tragedy of 9-11.

Now therefore be it proclaimed that the Albemarle County Board of Supervisors do hereby recognize and celebrate May 2022 as Asian American and Pacific Islander Heritage Month and encourage our community to observe this month by learning more about our collective history including our darker chapters so we can use

lessons of the past to create a more inclusive and equitable future for all of us.

It's so nice to see you all in person.

I'm going to try to do a hybrid thing today.

Firstly, I want to thank you for your continued commitment to telling a more inclusive story of who we are as a county by highlighting these different parts of our community through the proclamations.

Today I'm thrilled to introduce Attar Zahran.

He is a student from Albemarle High School to accept this proclamation.

Attar is a second generation Indonesian-American Muslim student.

He's the president of the Albemarle High School's gaming club and a member of the Islamic Society of Central Virginia.

Thank you, Attar, for taking time out of your school day to join us here today.

Hello, on behalf of the Asian and Pacific Islander community, I'd just really like to say thank you for recognizing this month.

As stated before,

A lot of oftentimes the diversity of the Asian community is overlooked commonly associated with Eastern Asia, but there's a big presence in Southeast Asia, South Asia, countries like Indonesia, Malaysia, India, Bangladesh, Pakistan.

All these countries have a major presence in the world and also in Albemarle County.

I am from Indonesia, so I can speak on behalf of Indonesians.

I can't speak on behalf of the wide variety of countries and languages that are present in Albemarle County, but I can also speak on behalf of the Muslim community, which is a big part of the Asian community as a whole, religion especially, Islam, Christianity, Buddhism, Sikhism, all of these different religions that are apart.

The Islamic community in Albemarle is a big hub, is a prime beacon for an example of the Asian community in Albemarle County.

We do great things.

We've been here for decades.

We have many active members.

We've done great things, projects for the public, Boy Scout troops, youth programs, and also the presence in Almonte County Public Schools.

We have a lot of Muslim students.

We have a lot of Asian students.

from all over, really, India, Bangladesh, Pakistan, all these countries that would really appreciate it if we were recognized.

Thank you, Mr. Zaran.

And I will look around from my left to right if any supervisors have comments.

I'd really like to see you.

I have some I'd like to make.

I had the great good fortune to live twice in the Philippines, to have family who've lived in Japan, Hawaii, and Thailand.

I had a trip scheduled to Indonesia, but unfortunately the Navy canceled it, so it's still on my bucket list and I will make it.

I also had the good fortune to travel throughout the Pacific Rim and to learn and come away with so much to be grateful for for the contributions.

that all of you have made.

And so that's all on the positive side.

When I read the last whereas in the proclamation, however, we are reminded of the things that we have not done well as a country.

And it is my pledge to you to ensure that I can do everything I can to make sure that we never again face that type of discrimination based upon the national origin or religion of a person.

I would like to ask you to move about three inches to your left.

You're no longer the masked speaker.

Thank you very much and thank you for being here to accept the proclamation and keep up the good work.

We're really proud of you.

So I had mentioned at our last board meeting that a few weeks ago I had the opportunity to be at an Iftar celebrating Ramadan and beginning to learn.

And what I've come to learn as part of that process is you take the time to reflect, self-reflect so that you can figure out how to self-improve and do better.

And these proclamations, when they come forward, is always a chance to reflect on my own knowledge of what it means to be Asian American.

And when you stop and think of how many different cultures, languages, lifestyles can exist under that large category of Asian American, it's pretty phenomenal.

I don't want ever to get lost in my own worldview of thinking that there's just one grouping that can be labeled that way.

There's so many differences and variation and diversity within that category.

and that is what we need because that's what makes a community happen.

You can't have a strong vibrant community without that type of diversity.

So I'm appreciative for the work that you're doing and having these guests come join us because it's always an opportunity for me to stop and reflect on what I don't know and what I need to learn because that's what it's going to take for me to be able to do my part in making sure that we have

inclusivity, et cetera.

So thank you.

And I'll just add, I don't want to repeat because I really, certainly everything that you all said is, I totally agree with.

Just to add though that these proclamations are our way as the leaders in Albemarle County to recognize the importance of the diversity that's in our community and to celebrate it

and to hopefully positively impact the way that our community feels about diversity and the folks that we're recognizing.

Whereas the municipal clerk is a time-honored and vital part of local government that exists throughout the world and serves as an information center on functions of local government and community.

And whereas the municipal clerk is the oldest among public servants,

and provides a professional link between the citizens and local governing bodies and agencies of government at all levels.

And whereas municipal clerks have pledged to be ever mindful of their neutrality and impartiality, rendering equal service to all, and whereas municipal clerks continually strive to improve the administration of the affairs of the Office of Municipal Clerk,

through participation in education programs, seminars, workshops, and the annual meetings of their state, province, county, and international professional organizations.

And whereas it is most appropriate that we recognize the accomplishments of the municipal clerk, now therefore be it proclaimed that we, the Albemarle County Board of Supervisors, do hereby recognize May 1 to 7, 2022,

Proclamation recognizing National Correctional Officers Week, May 1st through 7th, 2022.

And I'm thrilled to be able to make to read this proclamation as your representative on the Albemarle, Charlottesville Regional Jail.

And I see that we have folks in the audience here from ACRJ.

So let me read this first and then we'll ask you all to come up.

Proclamation recognizing National Correctional Officers and Employees Week.

Whereas National Correctional Officers and Employees Week was first proclaimed on May 5, 1984 by President Ronald Reagan when he signed Proclamation 5187 creating National Correctional Officers Week to recognize the men and women who work in jails, prisons, and community correction across the country.

and whereas National Correctional Officers and Employees Week became the official name the first week in May when in 1986 the United States Senate officially changed the name from National Correctional Officers Week and whereas National Correctional Officers and Employees Week has been designated as the week of May 1st, 2022

through May 7, 2022 by the United States Department of Justice and the Federal Bureau of Prisons, and whereas National Correctional Officers and Employees Week honors the work of correctional officers and correctional personnel for their service with honor, respect, and integrity.

and whereas National Correctional Officers and Employees Week in Albemarle County recognizes employees of the Albemarle-Charlesville Regional Jail for their role in safeguarding the citizens of Albemarle County, providing a safe, secure, and humane incarceration of offenders within their custody.

Now therefore be it resolved, we the Albemarle County Board of Supervisors do hereby recognize the week of May 1st through May 7th, 2022,

as National Correctional Officers and Employees Week, and all the Albemarle County citizens are encouraged to pay tribute to the correctional employees in the Albemarle-Charlesville Regional Jail for the vital public service they provide.

Well on behalf of these men and women behind me and the other 140 who are still back at the jail, thank you Board of Supervisors very much and Supervisor McKeel, thank you for bringing this forward and Mr. Walker, thank you for your support.

drafting this proclamation.

Our work sometimes can be behind the scenes.

And as long as we do our job, we're not really noticed.

And that's the way it should be.

But over the last two years, these men and women and the others back at the jail have really come to the forefront in the courage that they showed during the pandemic especially.

Every single day, these men and women walked into that jail knowing full well that COVID was there.

They left their families at home, went into that jail, not only risking their personal safety, but that of their family when they went home.

And every single day these men and women show up to do their job and keep those inmates safe in this community.

Thank you.

And I'm sure the supervisors will have some comments.

And officers, you're welcome to either remain standing or if you want to take your seats, whichever, but I do think we'll have comments.

I want to also thank you in support and all the work that you do to help your offenders learn new skills and be able to have a better life once they're released.

So I had the opportunity not too long ago to come tour the facility with Colonel Coomer and one of the items that we talked about or what I learned about was trauma-induced design and of course that was brought up about

the inmates, those who are housed there.

But one of the questions that we had a brief conversation was about is that, is this type of design the same approach for our employees that work there?

This is not a job that I think any of us, pandemic aside, believe was not a high stress job.

So I think, and I hope I'm not out of line, I'm sure Supervisor McKeel has had the opportunity to say this, that this board will be fully supportive

at least I believe this Board will be, this Supervisor will be of the renovations that are done and it's not just with those who are being housed there in mind but for those who are working there so that you have the proper facility that you call your job to go to every day and one that will keep in mind the social-emotional stress that you are under doing this type of work.

So thank you for that.

everybody there and how you manage everything and I look forward to continuing to support you.

Yes, and before I say anything, I just wanted to offer an opportunity.

Colonel Coomer, did anyone from your entourage there want to say anything?

I just wanted to offer and make sure.

We don't want you to feel like you are here.

Well, obviously, we are just thrilled to have you here and to be able to recognize your service, the service that you have performed with honor and dignity and dedication.

and two, the safety of the inmates, the safety of your fellow members, staff members and employees, and to the safety of our public.

And I will just also comment that I was really thrilled when every one of the supervisors up here jumped at the chance to tour the jail.

So we have all taken the tour of the jail which was great and I will add to that that all of the city council members have also toured the jail and at this time several of the Nelson County supervisors as well.

I think that speaks to the importance that the elected officials in this community are placing on the work that you do and the importance of the facility to our community.

And Colonel Coomer, I really appreciate your comments about the risk that your officers and staff face during the worst of the pandemic.

We all observed how those

residential facilities with the close spaces and close interaction was where most of the infections took place.

You all did a tremendous job there.

And the best thing that we can say, I think, about the correctional officers is you're largely invisible.

And the reason I say that's good is because it means you're doing your job right.

and that means that we don't have the issues there that many confinement facilities have.

So while you may be visible in the news, you are ever present in our thoughts and we thank you for the job that you do.

Thank you all very much and thank you for taking time to be here this afternoon.

And I just want to take a minute out and say thank you for the $625,000 that you guys gave to us last week.

I think it was last week or the last meeting.

and you know, there's a lot of great folks out there in the housing affordability space.

There is no silver bullet.

But I also want to take a minute and share with you what that $625,000 is going to do.

That $625,000 is going to produce 12 homes, 12 new construction homes, valued roughly about $4 million.

It's going to be at Spring Creek.

Excuse me, I apologize, we're on county.

Spring Hill Village and Avon Park.

and we're going to actually put folks in homes by the end of this year, those 12 units.

So I just wanted to take a moment and say thank you and say thank you for doing this.

Good afternoon and happy Star Wars Day.

I'm Neil Williamson, President of the Free Enterprise Forum, a privately funded public policy organization focused on Central Virginia's local governments.

This morning, the Charlottesville Area Association of Realtors released the first quarter home sales

I've provided each of you the local snapshot page.

Albemarle sales volume is down compared to last year, but median home sales price is up.

Median is $476,750.

To quote the report, inventory remains at historically low levels in Albemarle County.

There were 173 active listings at the end of the first quarter, which is 78 fewer listings than a year ago, or a 31% decline.

Inventory is now about a quarter of what it was two years ago.

In the Density Deferred, Density Denied report, the Free Enterprise Forum documented this and prior board's actions that reduced residential carrying capacity limiting the number of homes below comp plan targets for rezonings.

Please know not all dense developments are affordable, but most affordable developments are dense.

Mr. Smith just highlighted the success of the Piedmont Community Land Trust in creating long-term affordable housing by working with Albemarle County.

By leveraging nonprofit funds and utilizing local government dollars, the land trust is able to subsidize the cost to qualified first-time homebuyers.

In 2017, Albemarle County entered into a

private-public partnership with Pinnacle Construction and Development and established 96 new affordable multifamily units, Brookdale Apartments, tied to a performance agreement.

The terms of the agreement require the units to be occupied by families whose annual income is less than 60% of the area annual median income.

The agreement calls for the units to remain affordable for 30 years.

In exchange, the property owner is rebated a portion of the local real estate taxes paid

The community land trust housing non-profit for sale model and the Brookdale for rent for profit model provide examples of what has created sustainable affordable housing right here in Albemarle County over the last five years.

CARS market reports documents you have a housing affordability issue.

I've highlighted these two specific programs that utilize several leveraged programs in order to create the subsidy to make that gap.

The county was included in some of those by direct investment.

The question I have is how do the two proposals you are reviewing today measure up to these examples?

If you want housing affordability, you must increase supply and applicant incentives.

Absent both,

Landowners will proceed by right and you will get lower density, larger lots, and few, if any, affordable units.

My name is Andy Bowman.

I'm the chief of budget.

I'm joined to my right by Nelsie Birch, our chief financial officer.

And as the chair has said, today is really a step of eight actions.

That is the final step in the fiscal year 23 budget development process.

When we take a moment and look back where we have been through this process, and really for anyone in the public who may just be tuning in, my comments today are going to be very brief and high level because they follow a series of seven budget work sessions that have been held.

We've had a series of public hearings.

Board members themselves have held additional town halls and engagement

and even prior to the dates on this calendar, this board has been providing direction shaping this budget from October through December as part of the five-year financial and other long-range planning process.

So this brings us really to the final steps today, which are eight actions to approve the ordinances and related resolutions for all of these things which are interrelated to both adopt the budget and appropriate the funding.

So I'll walk through these one by one.

I'll pause each one for any board questions, comments, and then we can take action on those one at a time.

So I'll begin first with the tax rate resolutions and ordinances.

And though we'll walk through these one by one, just to give a snapshot of what all of these ratings and ordinances look like on one page.

And this is information the board and the public has seen before, just to recap.

We have the real estate, mobile homes, and public service tax rate of 85.4 cents.

That is the calendar year 22 rate that is also the same as the proposed rate in calendar year 23.

That rate will go into effective, sorry I misspoke.

The calendar year 21 rate was last year.

The calendar year 22 is this year.

And that will go into effect on January 1st in the bills that will be going out in the coming weeks.

For personal property rate, which also applies to machinery and tool taxes, the current rate is $4.28 per hundred.

It is proposed to be reduced to $3.42 per $100 assessed value, also effective January 1st.

Much of that change is due to the unique situation we're in with supply chain and used car prices.

The board held on April 20th public hearings on the next three items.

The food and beverage tax, which would be an increase under state law that is now allowed from 4 to 6 percent.

That would be effective July 1st.

The transit occupancy tax would be increasing from 5 to 8 percent, also effective July 1st.

And finally, the disposable plastic bag tax, which would be 5 cent for each disposable bag, and that would go to effect on January 1st of 2023.

So with that, I'll walk through these.

There will be four actions related to tax rates.

The very first one is a resolution, attachment A, that would set the real estate and the personal property tax rates as shown on the slide.

We've now completed half of the actions today.

We will now move on to the budget resolutions.

So this is a screenshot that the board has seen something close to before of what our total all funds budget looks like, totaling $586 million.

That is a number that is greater than the board last saw due to some changes primarily in the school budget.

And I want to talk through what these changes are.

We are in just maybe a unique timing situation this year, where we published our online materials a week ago today.

The board of supervisors held a work session on the 27th, and the school board held one on the 28th.

So I want to take a moment, as was noted in the staff report, to really talk through what the changes are that are reflected in some updated resolutions we've provided to the board and to the clerk.

So first, to cover some of the budget-neutral changes that are in the staff report, these are really items that are not increasing the budget, but taking money from one part of the budget and allocating it to another.

The first three items on this slide reflect the reorganizations of staff from one department to another.

For the last three years, the Office of Equity and Inclusion has been the home of the position that serves the ANSI Community Center and that operations.

That position is proposed to be reallocated to provide the same services under the structure of the Parks and Recreation Department.

We also have a reorganization between our Community Development Department and IT Department where there are changes in both directions related to geographic information services and records management services.

So that is reflective of that reorganization.

Again, similar services just being structured differently.

The fourth item on this slide is the allocation of the business process optimization reserve, which is really a lot of the funding that supports the county's upgrade and modernization of its core systems.

As part of just the ease in communication and transparency of this, we really wanted to, at the time of the recommended budget, share with this amount in one total rather than to say it's a little bit of money here, it's a little bit of money there.

But now that we're at a time where the board has expressed comfort in that recommendation, we are actually allocating those costs to the departments where those expenses will actually take place.

The fifth item is more of an accounting reporting change, where our plastic back tax was previously identified as part of the general fund, but because there are state restrictions that are very specific in how that can be used, it's more appropriate that we account for this as a special revenue fund.

And finally, another accounting reporting clarification.

In the recommended budget, we included two agencies who share one fiscal agent, the Central Virginia Small Business Development Center and the Community Investment Collaborative.

There's one line item.

But based on reporting standards, it would be appropriate to break those out as two programs that have one common fiscal agent.

So not a change in services.

Those last three are more just about the reporting and accounting side.

So the next changes that are in addition to the staff report is first to recap the April 27th Board of Supervisors adjustments, which are reflected in the updated attachments that we provided to the board and the clerk.

Just to recap what those items were, the board approved from the American Rescue Plan Act Reserve, allocating about $698,000 to the housing fund and about $1 million to the Boys and Girls Club for their Albemarle Campus Club project.

The Board also supported additional funding for the Department of Social Services that would add additional positions and accelerate the start dates of some positions to the budget.

In addition to the local funding, that also increases the budget to about $56,000 for state and federal revenues for their share of those positions.

And then finally, we have in fiscal year 23 in the capital budget, there would be $254,000 that would be moved from an athletic fields capital project to a placeholder for the strategic plan and comprehensive plan updates.

And I'll say the total amount of what is being moved from fields and athletics is much greater than that, but most of those costs are in fiscal year 24 and beyond.

So that funding will remain in that placeholder until there's direction on how the board would like to proceed with that, whether that be in the fiscal year 24 process or sooner.

So that is the board meeting, but I want to take a moment to recap what took place on April 28th at the school board meeting.

I would like to thank my counterpart with the schools, my Akuma Zawa, who is here and has assisted with putting together these updated changes.

So to go through these one line at a time, the school fund has received a revenue update, which is really two major changes summarized on the right-hand side.

The first is more accounting-oriented, where the school division has looked at how some of their federal programs are reported and really determined it would be more appropriate to budget them as a special revenue fund rather than the school fund.

So the school fund, due to that change, would decrease $3.1 million.

The school fund is also receiving, as part of all of their revenue updates that are restricted to education purposes, would have then a plus $1.8 million, which is being used for items such as fuel, utilities, other costs that school division staff have been updating through the budget process.

Next, in the second line, the school special revenue funds increased about $18.6 million due to these restricted revenue updates.

This is due primarily to the reclassification of federal funding, that $3 million I mentioned,

And even more significantly, there is more than $12 million in ARPA funding that is related to ARPA and has restricted uses under ARPA.

The school division has identified a lot of funding they have received in the current fiscal year.

Just like the county, that funding was received up front.

And the school division has been monitoring to determine what will be spent in fiscal year 22 versus what would then be deferred to fiscal year 23 based on the timing of programs.

The third line item is an update that is not a change in dollars, but is just a clarification that is a request to combine in the appropriations resolution the school's maintenance and replacement program with the indoor air quality capital project.

This change is to allow flexibility for managing existing systems and systems that are currently in the CIP for replacement while we're drawing down federal revenue to help offset those costs.

This is really to administratively assist staff where you may be doing an HVAC project where a portion of that is maintenance and replacement, a portion of that is the upgrade and is happening concurrently, and how do we assist staff to simplify that we are being compliant with how we work to manage those maintenance costs together.

Finally, this last item of about five million dollars is that the school board is intending to send five million dollars to the CIP to support to be determined capital projects.

This funding comes from some funding that was initially identified in the draft budget request that was presented to the board in March.

Plus, since that time, the public schools have identified in their fiscal year 2022 budget management some funding that can further be sent to the CIP based on their revenues and expenses to date.

This really continues the theme from the past several months where both the board of supervisors and the school board have directed one-time funding to support the CIP.

This funding is to be determined and will be identified by the school board after the adoption of the state budget.

The board may recall that the current county budget includes $3.6 million of state funding that is currently in question with the impasse of the state budget.

The Board of Supervisors previously asked the public schools, what is the fallback plan if that state funding comes through?

This plan is responsive to that direction.

So if the state keeps that $3.6 million intact, the school board would propose using that $5 million in one way.

If that $3.6 million were to fall out of the state budget, then the school board would come back at a later date with the alternative proposal for how that would be used.

This is a placeholder that is really to signify the intent of the school board, knowing that the specific use would be identified later.

So with those updates to the staff report and where we were from the proposed budget, this brings us to number three, which is the fiscal year 23 budget resolution.

Paul's here in case there are any board questions and discussion, but staff would recommend the board adopt Attachment E. All right.

I do believe this is the time if board members are looking for adjustments in the budget going into the next fiscal year, this would be the time to talk to us about that.

This is a topic that's what I would consider a carryover topic from the last time that this board met where you were talking about athletic fields.

I did know earlier in the week and thank you very much for the heads up that there could be at least two board members that would like to talk about this today and we can be prepared today to talk to you about what we know now if the board would like to explore enhanced field maintenance at the Darden Tow Park on the four fields that are there.

So we'll be happy to try to answer any questions that the board has and then if it has budget implications and the board is so inclined we can talk about

As we go into fiscal year 23, as you know, July the 1st,

If the board were to show a majority or consensus today that we would like to explore increasing the quality of the fields at Darden Tow, our first step would be to go out and get a expert in the turf management world to come in and do an assessment and take a look at the current state and give us some advice on a nutrient management program that would

obviously have an ongoing annual cost associated to it.

In other words, if you're trying to increase the quality of the fields, here's what we would suggest that you do, and that would require us, it would take probably close to a year, one process to go through that, and it would also probably include taking the fields offline at some point in time later this year, probably in the fall, in order for the treatment and the process to take hold.

and so the consultant would come on, walk us through that process and also look at a field management program that would probably include all of the fields that are under the umbrella of county government.

and then come back to us with some pretty precise cost estimates and that would be into fiscal year 23.

So at a minimum today, if the board were to say we're interested in that, we'd like to explore enhancing the field maintenance and the quality of the fields at the Darden Tow property.

Our first step would be just to get direction from the board to bring a consultant on board.

I'm going to project that that's going to be somewhere in the neighborhood of $20,000.

That's an initial estimate from our staff of what that would cost.

I believe, Mr. Bowman, if the board was inclined to do that, we could do an appropriation in June.

Yes, we could.

We could do an appropriation in June and we could make that adjustment.

That would be one-time money.

and we would be very careful as this assessment was completed to make sure that the board understood what we're looking at in terms of one-time money and then what we're looking at in terms of ongoing investment.

By this time we'd be into fiscal year 23 and we could report back to the board.

So that would be a high level, Chair Price, that's a high level first step if the board is inclined to do that.

The only thing I would add is that that estimate would include, when you said fields under the county purview, it also would be an assessment and a plan that would tie to the irrigated fields, of which the majority of those are on school property.

So it would come back with both Ed, Darden, and Towel an assessment

and a plan to improve maintenance and what that looks like along with those other properties on school property, excuse me, fields on school property which would be done in collaboration with schools.

And our goal would be to be back so that we could implement this starting in the fall and it would likely take

I'm happy to make a comment because this is probably the best time to make comments.

Our vision statement says, to create unparalleled outdoor and recreational experiences.

And our mission statement says, a system of parks, trails, and recreational experiences while being stewards of the environment.

We have 13 parks with 3,255 acres and 14 parks with Biscuit Run with 4,445.

We are talking about, in 2019, Albemarle County had nine organizations representing over 7,000 participants, adults and youth, that were requesting rectangular field space.

It was evident in 19 that Albemarle County not only lacked the available fields, but lacked the ability to provide quality fields based on high usage.

Not surprisingly, in 19, our professional Parks and Recreational staff brought forward a CIP request to replace four existing fields at Dardan Tow with artificial turf and lighting.

Installation of artificial turf at Darden Tow gives that urban park field space regardless of the weather conditions and supports the high usage.

Installation of grass fields at Biscuit Run could add capacity while maintaining a commitment to the Commonwealth.

There are instances where the application of artificial turf makes sense.

It's never my first choice.

but sometimes it can be the best option to achieve a goal.

A grass athletic field is comparable to an artificial turf field in that both are constructed by humans and are artificial creations with environmental impacts.

And I would ask, why do the buffalos roam?

They roam because they eat the grass and they move on to let the grass regrow.

A natural grass athletic field that is overused does not provide a healthy ecosystem.

Nor does it meet our community's functional requirement for recreation and athletic use.

And a mud hole is not an environmental success.

Nor is asking people to play in goose poop an environmental success.

and the needed irrigation system often provides to be a waste of potable water in communities that resist the use of pesticides and herbicides.

And I will say that if you were watching right now, the 30% of our country that is struggling with water, I'm sorry, not 30%, much of our country in the West is struggling right now with water.

People are being told to cut their water usage

in the West by 30%.

That could be us on a dime.

We are already experiencing a lack of groundwater.

I'm very worried about what our wells are going to look like over the next year or two.

I will just add that the vision and mission which were read could very well be carried out using natural grass fields and be healthier and safer for our children and adults who play on them and for the environment.

And I would certainly

not be in favor of using any potable water to irrigate fields.

I'm kind of, I'm not quite sure how to react because we've already, this board is already

on a split three to three regarding natural grass or turf fields.

So that is no longer the issue.

The issue now is whether or not we improve what is Darden, Tow, and some of our other athletic fields.

The issue now is whether or not we spend

$20,000 in order to look at not only Darden Towel, but other fields that we have to see how we can improve those for our children.

So to rehash what we've already done, frankly, in my mind, seems punitive.

And I don't want to make this a punitive type thing.

I want to improve

What we do have, currently do have, that doesn't mean that we don't look for more additional park space in the future, perhaps with turf.

The issue was whether or not this was the right sports venue.

Maybe we look for a better sports venue or look for a sports venue in the county.

This wasn't it.

Darden Tow wasn't it.

But having said that, like I said, we've already discussed this issue and it's whether or not we improve what we have for our children to play on.

Do we then abandon them?

Do we abandon our children and let them play on fields that aren't

up to what they should be or do we spend some money and look at the fields and how we can improve those.

Also with Darden Town we could probably get some hopefully additional funding through with Charlottesville to improve those fields to a certain level so that the children can play on those fields.

And then additionally look at the other fields we have around.

I believe that we need to look at all of our fields, turf and otherwise, in the county to make sure that everything is up at a certain level and we only do that by examining what we have.

But we do need to, there's an urgency in some areas, Dardan Tower in particular, maybe in other areas where we do need to improve our fields for the quality of playing for our children.

Well, I think the current state and quality of the field shows that we abandoned what these kids and their activities long ago.

Trevor, if I could ask you a couple questions.

I'll certainly invite Mr. Kirchenberger down too in case there's something that I wouldn't speak on.

But this is a direct field assessment.

The work we've done in the past has been at a programmatic level.

considerations of synthetic turf versus grass, that part of the Kimberly-Horen Associates scope was not to go on field by field and do that level of assessment.

And I would believe what would come out of this is

you know

a seeding schedule, weed and pest control, a mowing schedule, a watering schedule, which would be needed, and a rotation schedule.

So those would be some of the outcomes of that.

So the options that were before us already,

This would be saying, we're not doing either of those, but this is how we would go about approving that.

Do you have, I guess we don't know.

We'd have to find out what the costs are.

We had a local field turf management company come out to the northern tile and give us what I would call kind of a gut check estimate on what that would take.

I'm hesitant to throw numbers out today because I would want more study.

Well, in any case, once they do it, because we'll have to start resting fields as part of the plan, which was theorized in the maintenance plan that you had in front of us a week ago, in any case, we've got a greater field deficiency and a lower capacity moving forward.

No matter what we do, because we stay as we are.

We don't put any money in it.

We've got poor quality fields that continue to deteriorate, and we don't have field capacity.

We throw money at it.

We take fields out of rotation.

We start to rest them.

We're paying to have lower capacity.

We might get better quality.

We don't know that yet.

And that could take years to get that better quality, if I'm guessing.

You've already told me it'll be a year for the consultant

No, sir, I didn't say that.

We'd like to turn to the consultants.

So we would look at it and really it would be multiple parts.

Our focus initially would be an assessment on Darden Towel so we could get a report out and bring that back to the board that would be hopefully more immediately actionable.

And in thinking, timing, it would be like fall to fall that we would want to do the work.

This fall, it would then theoretically rest

And this is our best quality fields, right?

That's what Mr. Kirkenberger stated.

You know, if I've got water damage somewhere in my house, I don't just paint over it.

You have to go to the structure and fix the issue and the problem.

We've had in front of us an option that would fix our system of fields, that would increase capacity, that would increase quality everywhere.

not just for the current fields, but for the future fields that would come into the system.

And to try to break this down now to just say, well, we're seeing if we're investing money into DART and TAO to improve it, well, I'm not throwing money at something that I think is not the structural fix.

When I joined this board, part of the conversation about how do you make decisions on deciding where the money gets programmed.

and I've mentioned, others have mentioned, there was a lot of short-sighted decisions made around the Greer expansion, when Greer got put into place.

Short-sighted, well-intentioned, people thought they were making great decisions, I'm not criticizing that, but ultimately it was short-sighted, they threw money at something, because they said, well, we can't do the full thing, we're going to throw money at doing half of what we should have done, and we've been paying for that ever since.

In the urban ring, elementary schools seek capacity.

This is no different.

Why would I throw money at something when it doesn't fix what I think the bigger issue is?

We have a complete system of fields and the entire system is broken.

The only place where it seems to work effectively is on our high school sites because they have an athletic synthetic turf field in operation with a system of grass fields that they can play on.

If that doesn't tell us that that's a wise investment, I don't know.

So I'm not supporting throwing bad money at something that's just

something that's trying to make us look good because we couldn't come at a decision that I think is right for the whole system.

I think that's insulting to do to folks, frankly.

We're going to maybe improve the quality of this particular place, but we have solutions on the table that can fix the entire system around the whole county.

I think that's what our taxpayers deserve.

and that's where I stand on it, but I won't be supporting throwing money at something that I think is a look good effort that won't get at resolving the issue.

It's interesting that the most contentious and most controversial issue this board has faced in the near two and a half years I've been on it is whether or not to put artificial turf on four fields in one park.

To me, the proposed motion, which I do not support, is simply putting a band-aid on a gaping wound.

I concur with Supervisor McKeel and Supervisor Galloway and I won't repeat your comments but I do adopt them as my own.

This is a proposal to spend pennies when dollars were necessary and I am not willing to accept this and move on as if we did something actually positive when we had an opportunity

as Supervisor Galloway said, to actually fix the system.

And I simply cannot do it.

I call foul on that proposal.

I think we're just simply kicking the can down the road.

It's been years that we've known our fields are inadequate and that we needed to do something like this.

The other thing it does is this is shifting a lot of money out of the CIP into operating.

And that was our opportunity with the CIP.

Four fields.

Four fields.

out of 13 parks, thousands of acres.

And yes, I don't turn to artificial turf first, but I think that was the one solution that could have fixed the entire system.

And yes, is there an environmental impact?

You bet there is.

Everything we do in life has an environmental impact.

And I'm not going to say to the children and the youth and the adults of this county who want to play on adequate fields that I was willing to spend a few dollars, a few pennies, when dollars were necessary.

And I do not support the amendment.

With that, the next action requested is to appropriate the fiscal year 23 budget that the Board has just adopted.

The budget itself is just a plan.

The appropriations resolution provides legal authority to spend funding.

I will note, certainly not going to go through the multi-page resolution in detail, but like in past years, the resolution authorizes the county executive to reallocate funding in very specific situations in the resolution.

For transparency purposes, whenever that is used, we report to the board in our quarterly financial reports, and this delegated authority is really intended for items that are more administrative or reporting in nature.

If there was ever an item that was policy-based, that would instead be brought to the board as a supplemental appropriation request.

I will highlight that there is, as part of that authority, an administrative change, I'm sorry, an administrative authority change this year that would authorize up to $18 million to be reappropriated as part of this initial resolution for encumbered purchase orders.

To give an example of how this would work, the county may have a contract in place to pay for replacement police vehicles that were funded in the current fiscal year, fiscal year 22.

If due to supply chain issues, those vehicles arrive in fiscal year 23, that expense appears in fiscal year 23 and we need to move the budget from fiscal year 22 to 23.

What we are proposing is allowing this authority up to that $18 million amount now to allow us to administratively move more efficiently from one year to the next in order for the county to meet its contractual obligations and to be able to track these changes more properly in our financial systems.

We do this because when our staff, whether you're a department head or a project manager or whatever your title may be in this organization, when you have the information in the financial system faster, that allows you to move forward and manage your budget with more confidence and continue to implement and manage all the programs and services that we do.

So that is the rationale for this change.

Good afternoon.

Ms.

Good afternoon board, and we had the last minute change to the dais, so the old thumb drive situation.

All right, so good afternoon.

This presentation is for special exception 2022-13 5715 Ivy Road at the intersection of Brock, Fish Gap, Turnpipe, and Three Notched Road.

My name is Leah Brumfield.

I am a senior planner two in zoning, and I will be presenting this special exception for a resident manager on a rural area parcel under five acres in size.

So while we did recently adopt regulations regarding homestays and in fact regarding homestay resident managers almost exactly a month ago, the regulations for this particular special exception for resident manager on a rural area parcel under five acres in size did not change at that time.

This was permitted before a month ago and it is still permitted to be a request.

Fortunately or unfortunately, we will not be using the new regulations.

So this particular special exception is similar to five other requests that the board has considered over the past two years for a resident manager on a parcel in the rural area under five acres in size.

So since we just clarify everything that's going on right now, the limitations on residency, which are by right a owner occupancy required for a home stay.

Homestays in the rural area on parcels under five acres in size are permitted up to two guest rooms by right.

They must be located in residential dwellings, must meet standard primary structure setbacks, and have screening from other parcels.

They must have onsite parking, and they must go through the standard zoning clearance process, which includes neighbor notice and safety inspections.

So when we are considering the special exception, the factors that the board is listed to consider in the homestay ordinance is whether there would be any adverse impacts to the surrounding neighborhood, whether there would be any adverse impacts to public health, safety, or welfare, proposed special exception, whether it's consistent with the comprehensive plan, and whether it's consistent in size and scale with the surrounding neighborhood.

Also, I will note that, as with all special exceptions, this and any future requests for homestay resident managers does not set a precedent for approval.

Each special exception comes to you unique on its own merits and is weighed favors factorable and unfactorable based on the individual situations of each request.

So this particular proposed homestay is for Tax Map Parcel 5755 and immediately west of the parcel is 5781J where the applicants and owners reside.

This is marked on this map with an orange asterisk.

Both of the parcels, both the owner's home and then the abutting parcel, which is the subject of this particular special exception, are owned by Lloyd and Mary Ann Burke.

Additionally, directly to the west of their parcel, the one with the orange asterisk,

which is not shown on this map, is another parcel also owned by the applicants under an LLC called Feather Nest LLC.

The owners own that parcel and operate the Barn Swallow Artisan Gallery on that parcel.

So it is separate ownership based on

the name, but it is actually the same owners as well.

Directly north of the parcel is Route 250.

Meacham's River is to the west, and to the south is large, heavily wooded residential parcels.

So this particular special exception is a request for a resident manager to fulfill the occupancy requirements for a home stay use.

Currently, the parcel in question is occupied by the owner's son who lives at 5715 Ivy Road, the proposed homestay location.

It is marked on this particular plan with the green asterisk.

The owners have also constructed an accessory structure.

It primarily serves as a music studio and it is marked on the map with the purple asterisk.

So the proposed homestay would be in the dwelling 5715 on the 3.15 acre parcel and have two guest bedrooms.

And the proposal is that during rentals, the resident manager who lives there would stay in the accessory structure, thus still staying on the property during the rentals.

So staff did not receive any comments or concerns from any neighbors and due to the proximity of the owner's residence to the proposed homestay, as well as the availability of the accessory structure for the resident manager to stay in, we do not believe this request would cause any adverse impacts to neighborhood or public health and safety.

Again, additionally, this is in very close proximity to Crozet and the access to that is through major roads

So this also consists supports the consistency with comprehensive plan factors and supports tourism without impacting neighborhoods of rural character.

Yes, I mean, this is exactly the kind of circumstances I think that we were looking at to try to expedite.

The quick question, though, is that the particular circumstances for the special exception, I mean, they're unique to every situation.

No, this special exception would be in taking into consideration the circumstances but not limiting it on future uses.

It's something that could be written into the conditions, but we don't really have any precedent for that as far as writing the conditions.

Because we're looking at the use of the accessory.

Sorry, we have two of these today.

We're looking at the use of a resident manager.

And that is both for the owner and also for the uniqueness of the parcel with the accessory structure and the residents on it.

No questions, and having driven up and down that road a million times in the last 15 years, I never even noticed the driveway.

I have a question for the county attorney.

Okay, so to kind of put it into practical terms, the parents live in one house, they own the adjacent property where the son, the resident manager would be.

and decided they need to move into the city.

So they sell their lot but they want to keep their son as the resident manager there.

And I understood that, but I wanted to make sure we clarified it.

That is part of the concern that I will always have with resident manager situations, because while everything right here looks wonderful,

Because it goes with the land, then a change in ownership, the resident manager would continue to be legally permitted through the special exception of this homestay, and that is always a concern that I have when we approve resident managers rather than owner occupancy.

I wanted to clarify because every time someone else asks a question, it gives me another one.

is still required and when someone new buys the property they buy it with the same requirements saying yes you have to live here in order to carry on this use and therefore hire the resident manager.

I'm asking if my explanation is correct because that's what I've been galloping along with all this time is that all of the conditions

with which this person could be given permission would then apply to the new owner.

That is correct.

Yes, so my understanding is, because I have the same concerns regarding things that we approve go with the land, but my understanding is that state law

Just a quick question.

My understanding is that there is a way that this is flagged somehow or another.

So when people buy this property, that doesn't go away.

So that the new owner, say it's 30 years from now and there's a new owner, there is a way as they purchase that property that that is flagged so that they are aware of that.

Well, this becomes a part of your zoning law, your zoning ordinance.

I'm just trying to make sure that there is a way that this is transmitted to a person that's going to purchase the property.

We have our expert here, Mr. Svoboda.

I don't know about expert.

Bart Svoboda, zoning administrator.

It won't be found in the title search because it's not recorded at the clerk's office.

What we see now is that when folks purchase the property, they ask for kind of a parcel history or whether the property is in compliance.

And we have to track that by state law, these actions that we take on the parcel.

So not through a title search per se, but there is a mechanism to ensure it's okay.

Yes Chair Price, just to clarify as far as I think one of Supervisor Mallek's concerns was that if a new owner came in there would still need to be a resident

They would apply for it with a resident manager.

We would say, oh, you have a special exception.

You can have a resident manager.

Thank you and I think that does probably address at least my concerns for this particular one but it does raise again the concern about the legacy that granting a special exception goes with the land and I'll also say thank you Ms.

Brumfield for clarifying for me that LLC because had the ownership of either of these two parcels been an LLC I would be looking at it very differently.

And we will now move to item number 11, special exception 2022-09, 1317 McCauley Street Homestay.

I know you guys missed me in those last 30 seconds.

We have another special exception today, special exception 2022-09 for 1317 McCauley Homestay.

This is for the use of an accessory structure on a residentially zoned parcel.

And this, again, was something that was not influenced by the changes in the zoning ordinance last month.

So this particular one is on a residentially zoned parcel in Crozet.

The homestays on residentially zoned parcels can only have a homestay in an accessory structure if they're granted a special exception by the board.

This is not a change.

and again along with limitations on structure type.

These home stays are permitted to guest rooms by right, must meet primary structure setbacks, have on-site parking and go through the standard zoning clearance process which includes neighbor notification and safety inspections.

So in this case, again, the factors that the board may consider are adverse impacts to the surrounding neighborhood, adverse impacts to the public health, safety, or welfare, special exception consistent with the comprehensive plan, and consistent in size and scale with the surrounding neighborhood.

So this particular homestay would occur in an existing garage structure and would consist of a single guest room.

The use would not include construction of any new structures and is therefore consistent with the size and scale of the neighborhood as it already exists in the neighborhood.

Additionally, the homestay use itself is permitted by right.

This special exception is only for the structure.

That's the only exception under consideration here.

For example, if the owners put a homestay rental in their basement, that would be a by right use.

They could have the two guest rooms.

and under that this special exception would not increase intensity of the Bayh-Wright homestay use, only permitting it in a different location.

Staff did have initial concern about the setbacks of the structure, but after measuring the site, we confirmed that it does in fact meet the residential side setback.

And so the structure is no closer to the property boundary than a house could be.

Additionally, the other concern was for parking.

As you can see on the aerial, the existing driveway does permit up to three cars to be parked, which is the required number of cars that must be parked off-site.

And that would be reinforced in the recommended condition of approval number one.

Additionally, staff did not receive any comments from any neighbors, any concerns from anyone about this homestay.

So if the special exception were to be approved, the applicant would then follow the normal homestay zoning clearance process, including sending emergency contact information to abutting owners and undergoing a safety inspection.

Since this structure was previously a garage, the safety inspection would require proof of a certificate of occupancy for detached sleeping quarters to make sure that this is safe for humans to sleep in overnight.

I think adjacent either just to the south or hop over one is another homestay and I wanted to know about

ways in which users can be required to park off the street because at the corner of Pecali Street in St.

George there are continually cars poking out into the travelway that we have not been able to solve for years and so some kind of condition or something where staff doesn't have to make multiple visits but can say you're not in compliance you have to shut down until you fix this

Sure, so that is actually a prime example of a use case for our short-term rental registry which this location would be required to be on the registry and since that is in a separate section of the ordinance because we adopted it through the state code allowance that is

a way that we can count strikes against home stays.

And there is the three strikes rule which is basically if you are found in violation three times, you're done.

And so we would need staff to come out and document three times that they were not meeting the conditions of approval.

Yes, and this particular location I don't believe had any violations against it.

We will now move to item number 12.

We will now move to item number 12, an action item designated outdoor refreshment areas at the shops at Stonefield.

Madam Chair, members of the esteemed board, my name is Roger Johnson.

I'm the Economic Development Director for Albemarle County, and I have the privilege today to talk to you about designated outdoor refreshment areas.

You'll hear us refer to those as DORA.

We are specifically asking today for your concurrence for an ABC application from the shops at Stonefield.

As you'll learn here shortly, part of the process requires a consultation with the local government.

So what is Adora?

Adora is a designated geographic area licensed by the ABC annually that allows the consumption of alcoholic beverages, wine, beer, mixed beverages, in a public space, in a private space, which would include things like streets and lawns, and within any business without an ABC license so long as the business agrees.

Here's a couple of visual examples.

On the top right hand corner, you'll notice that this is at our downtown mall.

You may be aware that the TomTom Festival actually had an Adora application as well.

I will mention to you that I spoke with the Director of Economic Development from Charlottesville and there were no complications with this particular event.

Another example happened locally here in Scottsville back in December.

I was able to reach out to the town administrator, Mr. Matt Lawless.

Mr. Lawless confirmed that everything went well and that the businesses had higher revenues as a result of this particular event year over year.

And in fact, one business reported they had the highest revenues in their history.

This is also happening around the state.

An example of a designated outdoor refreshment area here is in Roanoke, Virginia.

And there are other areas that we could have cited as many local municipalities have adopted these particular designated outdoor refreshment areas.

So why are we, Economic Development, standing before you today recommending that this application be allowed?

We want to support our existing businesses.

And the way we do that is through a door, which allows for alcoholic beverages to be purchased from permanent retail on-premises licensees located within the designated area, and only those can be consumed.

So there will be no food trucks.

There won't be outdoor alcohol brought into this particular event.

It would have to be purchased locally in the designated area, consumed locally,

And also, it's important to note that you can't go from one location to another.

For example, in Stonefield, you could not pick up a margarita from Torchy's Tacos and bring it into Burger Batch.

That was not allowed.

You'd have to either consume it or dispose of it before moving into the other location.

I will also mention that when this happened on the downtown mall, some particular restaurateurs and servers set up shop just generally outside and allowed folks to come more freely to access those particular, and it worked out well for those particular consumers.

So what do we need to do to establish ADORA?

Again, it's an ABC license.

It's not anything that we're going to do here locally as a municipality.

They will accept an application from three different entities, either the locality themselves, through a business improvement district, or through a nonprofit organization.

As you're going to learn a little bit more in detail, we're asking a nonprofit organization to be the applicant to the ABC.

They have two different types of criteria.

The first is up to 16 events per year.

and each event could be up to three days.

If you're willing to stay within this parameter of the DORA, you must consult with a locality, which is what we're doing today on behalf of Stonefield, and you must submit an ABC application in the amount of a little over $500.

And what we're asking you to do is to provide a letter of support that verifies that Stonefield consulted with a local municipality and they will submit that with their ABC application.

If a area in our community wanted to do more than 16 events in a year,

or for more than three days for one event, it would require that you pass an ordinance and it would also require a different level of ABC application, which is slightly over $3,000 in expense.

So what's needed for the ABC license?

You need a map that includes both the scope and scale of the DORA.

You need the dates and hours of operation and you need a public safety plan.

Also required at the events are specific containers that are no larger than 16 ounces with the name or the logo of the retail establishment from which it was purchased.

In an example on the bottom right you will see some actual Doris have also included guidelines on where the boundaries are and other such information.

An additional requirement to the event is you must have signage that clearly demarcates the boundaries.

On the right hand side of your screen you'll notice some signs from the shops

These are the sandwich board signs they use to designate their particular area.

Why do I give you that?

Oh, there's one more, another requirement.

That is that the applicant and or their designee must provide security to ensure compliance with the ABC guidelines.

So what is Stonefield actually asking for?
