Good afternoon, everyone, and I call to order this regular meeting of the Albemarle County Board of Supervisors on March 16, 2022 at 1 o'clock p.m.

This meeting is being held pursuant to and in compliance with ordinance number 20-A-16, an ordinance to ensure the continuity of government during the COVID-19 disaster.

The supervisors who are electronically

This meeting are Supervisor Diantha McKeel of the Jack Jouett District, Supervisor Jim Andrews of the Samuel Miller District, Supervisor Bea LaPisto-Kirtley of the Rivanna District, Supervisor Ann Mallek of the White Hall District, Supervisor Ned Gallaway of the Rio District, and myself, Supervisor Donna Price of the Scottsville District.

The opportunities for the public to access and participate in the electronic meeting are posted on the Albemarle County website, on the Board of Supervisors homepage, and on the Albemarle County calendar.

Participation will include the opportunity to comment on those matters for which comments from the public will be received.

Just following up on what Jim just said, maybe we should write a letter about that.

because I think all of us, I don't know anyone who wouldn't like the time change to daylight, permanent daylight savings time.

I don't have any announcements other than just to thank all of you for your willingness to sign up for tours of the ACRJ.

I appreciate your interest in getting into the facility prior to our decision that's coming next fall about the renovations.

I have a couple of shorties.

It is the spring, so it is time for the drinking water clinic for testing of well water, which is sponsored and tremendous savings to the homeowners, sponsored by Virginia Cooperative Extension.

Pickup date, May 2nd.

Drop off samples May 4th and information can be obtained and the forms can be obtained by calling the Cooperative Extension Office, 872-4580 and I'm sure they will have things online as well.

Also being spring, it is time for the Earliesville Volunteer Fire Company scavenger hunt, which is one of their fundraisers that they do for outfitting their building.

After all these 65 years, they have raised a tremendous amount of money and are in their third facility now in that period of time, which is really exciting.

So the scavenger hunt will be in your car.

We've done it for several years.

It was especially good during COVID when people needed to get out but didn't want to mix with others.

So you drive around different places, host places, wineries, and businesses within the Earlyfield Fire Company's 78 square miles that they are first to cover for.

The date is March 26th and advance tickets can be purchased at the firehouse or online at the fire company website and I hope that lots of people will come.

I'm also the proud holder now of a gold card and I wanted to make sure that people were aware of this because for people who like to go to plays, to music, to sporting events at Amarillo County Schools,

This is available for seniors.

It's one of those great benefits for getting old.

And now Leo and I each can go and see our grandchildren play sports and not have to wrangle with an online ticket purchase, which is really great.

So I hope that people will take advantage of that.

and my last item is a bit of sorrow because we really lost a treasure last week.

Rosie Mae Garrison Keaton was born in 1928 and passed away on the 2nd of March last month.

She was the last surviving Albemarle citizen who was born in the mountains, which had become Shenandoah National Park.

She was four when her family was evicted from their land and they moved into western and northern parts of Albemarle County.

Rosie had a sparkle when I met her at age 79 and still had it when making cider at age 91.

She loved music and was a regular with her husband Woodrow playing mountain music into the early 2000s.

and gatherings all around the district.

The Garrison family is one of the hundreds who are memorialized at the chimney erected by the Blue Ridge Heritage Project at Byron Park.

And, oh thank you Serena, there it is.

Rosie and her family were among the 125 descendants who dedicated the chimney on November 5, 2016.

The stone came from a farm up the road and the chimney was built by masons from the area.

They've also built the pavilion next to the chimney, which provides shade and rest for hikers in the park as well as for families who visit the memorial.

And her twinkle will live on and her granddaughter and songs will live on forever.

That was really very moving.

It's good to remember the impact on people.

even though it may be for the greater good, there are individuals that have to change because of that.

So thank you, that was really nice to hear.

I have several announcements.

We've continued to receive communications from our community members about debris on the roadways or on the rights of way from

Primarily the January 3rd storm and it's been, you know, now well over 60 days.

And we hear those those communications and we do pay attention.

That largely falls under VDOT to clean that debris up unless it happens to be on a utility line and then it's the utility company.

The board received an email last week that identified that the Culpeper VDOT district estimates that the debris that will be removed will exceed 600,000 cubic yards.

Now what does that mean?

If you look it up, that's a cube 0.193 miles long

wide and high.

And if you put that into feet, that's over a thousand feet long, a thousand feet wide or deep, and a thousand feet high.

The damage that was incurred and suffered in this district was immense.

So I want to applaud the crews who still are out there clearing the debris

and simply ask that our community continue to have a little patience.

It's probably going to be another month or two before they are able to fully clear the roads.

That volume is just unbelievable when you think about it.

I have some good things that were really nice to talk about.

Last week I had an opportunity to meet with some people from the Downtown Crozet Initiative

I was very impressed with what they have done and we have information today about Broadway Blueprint.

We're a similar sort of initiative.

I've talked to the mayor and town administrator down in Scottsville.

This is a great way for community members to get together and put into

plans, the vision that they have for their particular area.

And I really want to thank everyone who's been involved in that.

Their ideas for improvement with the plaza and pro se was really impressive.

Thank you for the opportunity to be there.

A couple of weekends ago, a group down in Scottsville gathered together and we collected trash along the highway.

And one of the great things about doing that is not only improving your neighborhood, but I had the opportunity to spend 90 minutes in conversation with Vice Mayor Daniel Briscoe of the Scottsville County Council.

And it's really just a wonderful opportunity to meet your neighbors and for us, of course, both of us serving our community in these positions, it's also a great way to collaborate.

And I want to thank those individuals who organized and participated in that.

We had a great book signing down at Baines in Scottsville.

I'm telling you, Scottsville's the place to be, just like the bumper sticker, London, Paris, Rome, and Scottsville.

I also had a chance to go and see the picture of climate justice exhibited at the Jefferson School a couple of weeks ago, where it was really significant to see how many different component demographic groups in our community are working together to improve

our policies so that we will not further degrade the environment.

And also, just this week, we received a proclamation from the governor in recognition of Women's History Month.

While we and the county had already done a proclamation, so I will not read it into the record, I do want to thank the governor's office for having taken the step and sending us that proclamation and I will give it to the clerk to be appended to the record.

Finally,

Today, if you've looked at our agenda, you'll see when we get to the consent agenda, item 8B is a resolution declaring the local emergency has ended.

That's positive news, but we're not out of the woods yet.

Two years ago this week, we went virtual.

Two years ago, I estimated that we might lose as many as 250 to 300,000 Americans from this pandemic.

Today, we're at over 960,000 Americans have died.

80 million Americans have been infected.

That's about 25% of our population.

Today, the health organizations are paying close attention to the stealth Omicron BA2 virus.

It's a sub-variant of the Omicron that we just went through, but it's considered to be more severe.

It resists the monoclonal treatments, but boosters will help.

So if you haven't gotten your shot, get your shot, get your booster.

Now one of the good things, the good piece of news, is that over the last couple of years,

Only about 10% of Albemarle County's population has been infected with the virus versus about 25% around the country.

And our infections, our hospitalizations, and our deaths are similarly lower than most places around the country.

So while we are looking to return to what this new normal will be, we cannot ignore the fact that this virus is still out there.

And I want to encourage all of our community members

to continue to practice safety, get your vaccinations, get your boost, so that we will be able to continue to get through this.

Yes, thank you very much.

I've neglected to say that on April 2nd and 3rd that Prophet Rotem Polar Grounds Road, they will be having their

annual or biannual cleanup of the roads and picking up litter so all the residents get out.

And so if you live along there, even if you don't live along there, it'd be great to go out and help.

I have the honor and privilege of reading a proclamation recognizing March 2022 as the 20th annual March for Meals Month.

And this is in the form of a motion.

Whereas on March 22nd, 1972, President Richard Nixon signed into law a measure that amended the Older Americans Act of 1965

and established a national nutrition program for seniors 60 years and older.

And whereas Meals on Wheels America established the March for Meals campaign in March of 2002 to recognize the historic month, the importance of the Older Americans Act nutrition programs and raise awareness about the escalating problem of senior hunger in America.

And whereas the 2022 observance

of March for Meals celebrates 20 years of providing an opportunity to support Meals on Wheels programs that deliver vital and critical services by donating, volunteering, and raising awareness about senior hunger and isolation.

And whereas the Meals on Wheels program in Albemarle County has served our community admirably for 44 years, serving 322 homebound citizens,

and delivering 66,720 home delivered meals in 2021.

and volunteers for the Meals on Wheels program in Albemarle County have provided nutritious meals to seniors, individuals with disabilities and others throughout Albemarle County that help them maintain their health and independence, thereby preventing unnecessary falls, hospitalizations and or premature hospitalizations.

And whereas the Meals on Wheels program in Albemarle County provides a powerful socialization opportunity

for millions of seniors and other homebound citizens to help combat loneliness and isolation and deserves recognition for the heroic contributions and essential services they have provided amid the COVID-19 pandemic and will continue to provide to local communities, our state, and our nation long after the pandemic is over.

Now therefore be it proclaimed that we, the Almar County Board of Supervisors, do hereby recognize March 22 as the 20th annual March for Meals Month, and we urge every citizen to take this month to honor the Meals on Wheels program, the seniors and other disabled citizens they serve, and the volunteers who care for them.

It's really important.

We have had a large increase in people who need our services since COVID began, so we really appreciate this awareness.

And I would like to say thank you to Donna for coming next week to our Week of Champions, where we're going to highlight some of the people in our community who are helping bring more awareness to this cause.

So I really appreciate it.

Yes, I really appreciate the program that helps so many people that

aren't able to get food or meals or be able to cook their own food and that are elderly and disabled, and this really is of help.

And I think it's a way for the county and the whole program, Meals on Wheels, to respect the fact that as people get older, we should do everything we can to assist them to live their lives.

They've done so much for us when everyone was younger and when they were younger.

and so we should also be cognizant of the fact that they add a lot when they're older also a lot of wisdom and I think it's great that we can do this and help people out.

Yes, I mean I want to second those remarks and just emphasize the importance of connectivity of peoples and I think that Meals on Wheels is one of those examples of how we can maintain connections with people and I really appreciate you being here for this, appreciate what you do.

Supervisor McKeel?

This is really a wonderful program and I hear Meals on Wheels prices being sung often at the Java board meetings.

But so we do really appreciate your work in the community.

And I'm sure, especially during COVID, it has been critical for seniors to receive meals.

But as Jim just alluded, the delivery by a human being, a real person that sometimes you can actually interact with and socialize with is almost just as important really as the food and the nutrition.

So thank you very much.

And we appreciate you being here.

I echo the thoughts.

I, the personal contact with the person who brings, I mean, those are decades long relationships sometimes, very much like a family.

And one of the things we've lost since we don't have as many multigenerational families living in the same

compound as we used to when I was little, and my grandmother lived with us from before I was born.

So I've been very familiar with that, and I'm lucky that my grandchildren live nearby where we are.

So without that, it is so hard for people to have any sense of somebody outside themselves, which makes their worries worse and their loneliness terrible.

I also was glad to see in the photograph that the generation changed from Mary Scott Blake to her granddaughter as far as passing along the mantle of being a delivery person is really wonderful.

So thank you very much for what you're doing.

One thing I worry about was sometimes on the news when there's a storm, it says meals on delivery, meals on meals closed.

And that is always worried me because is there a backup plan?

Are there things in the freezer?

So January was terrible.

I don't know if you all know this or not, but we spent those three weeks delivering blizzard bags.

So there are three meals of shelf stable food so that we could get it out to them every week.

We'd have a break and we'd say let's send out more food in case we have snow next week and then it happens.

Thank you very much.

There just seem to be some constants in life.

You know, they say there's only two, you know, taxes and death, but Meals on Wheels seems to be one of the constants throughout my life.

And in a way, it almost surprises me that it was only in the early 70s that it started because it just seems like for as long as I can remember.

And you really have been a mainstay of organizations that take care of people in need.

And the other thing I've noticed over the course of my life is we always seem to have

It may be financial like the Great Recession from 2008 until just a few years ago and now we've got the pandemic.

But to know that there are organizations like Meals on Wheels and people like you and all your volunteers that work to take care of people as some of the other supervisors have indicated, you know, we don't have that family network that we used to.

and we're all looking forward to moving back to a sense of normalcy and personal connection.

And I'm really excited about next week.

So thank you for inviting me to be a part of that.

The board, I move in the form of a motion, a resolution of appreciation for Gustav Gregory Kamptner, whereas

for a total of 27 years serving the County Attorney's Office, including six years as County Attorney.

Gustav Gregory Gregg-Campner has provided the Board of Supervisors and County staff with critical legal advice regarding significant and complex issues in a variety of specialized areas related to land use planning, zoning regulations, ministerial processes, and enabling legislation.

freely sharing his expertise with colleagues across the commonwealth through his highly regarded and annually updated land use law handbook and related classroom teaching.

And whereas Greg's many contributions were recognized in 2015 by the local government attorneys of Virginia, which presented him with a prestigious chairing award in honor of his distinguished public service that reflects a personal commitment

the highest ethical and professional principles in which has enhanced the image of local government attorneys in the commonwealth.

And whereas during his six year tenure as the county attorney, Greg advanced numerous important board intergovernmental and public-private partnership initiatives, including the expansion and renovation of the county courts complex and performance agreements for the Southwood Redevelopment Project

Woolen Mills Willow Tree Adaptive Reuse Project, Barnes Lumber Mixed-Use Site Redevelopment Project, among many others.

And whereas Greg further distinguished himself, guiding the county through significant disruption brought about by violent civil unrest in the summer of 2017 and subsequent events, and through the application of the new state code enabling localities to move

remove or relocate war memorials, and through his extraordinary work providing critical leadership and all around good counsel for Albemarle County and other localities throughout the two years of the COVID-19 pandemic, providing research findings, developing policies and procedures, and preparing model ordinances for the declaration of a local emergency, the continuity of government operations,

and the prevention of the spread of the COVID-19 virus.

And whereas, as an exceptional attorney who has consistently provided the highest level of dedicated, ethical and valuable service, Greg has been indispensable to the county government and is the epitome of a faithful public servant.

Now, therefore, be it resolved that we, the Albemarle County Board of Supervisors,

do hereby honor and commend Greg Campner for his many years of exceptional service to the county of Albemarle, its residents, the county attorney's office, the broader community in which we live, and the Commonwealth of Virginia.

Albemarle County is strengthened and distinguished by Greg's dedication, commitment, and professionalism in meeting county government and community needs.

Be it further resolved that this resolution shall be spread upon the minutes of this meeting of the Albemarle County Board of Supervisors as a lasting invisible testament to the esteem in which Greg is held by this board and previous boards for his lasting legacy of government service and the tangible results from his work to make Albemarle County better for future generations.

Thank you very much board and I'll go way back to 1995 and thank Larry Davis for bringing me into the county organization and thank the board in 2016 for appointing me county attorney.

I've been very fortunate to spend a good part of my career here doing what I love to do.

or an organization in a community I care so much about.

I also appreciate and thank my family who put up with my weird schedule.

I can recall probably 20 years ago or so, I happened to be home on a Tuesday night, which was a rarity because Tuesday nights, as anyone knows, in the family government are planning commission nights.

And one of my children said, dad, we don't know what to do with you on a Tuesday night.

They had their own lifestyle set up on Tuesdays and then later Wednesdays.

I also want to thank my office who have made my job a lot easier.

It's a wonderful group of attorneys, paralegals, and our legal services coordinator who, as I said, they make my job easier.

They have a tremendous amount of expertise and dedication.

They also make it a pleasure to either

work virtually or to be in the office amongst them.

Also, I do want to highlight Marsha Davis, our legal services coordinator, who's also my assistant.

And Marsha is the one who steers me in the right direction and reminds me of all the different things I need to do each day.

She will be retiring at the end of June of this year.

So our office will be going through a major transition.

but they are resilient and I have complete confidence that they will continue on with the tradition of our office.

I also want to just thank the organization overall, the county executive's office and county staff, particularly over the last several years, the last two in particular, working in virtual meetings with the duress and the

The pressure that we were under to keep government going, there was a certain lightheartedness that worked its way into meetings where we were dealing with some very serious issues.

And that really, I think, definitely helped me, but I think it helped all the others who were involved in these meetings.

So thank you very much, Board.

Thank you, Mr. Kamner, and I do know that every supervisor would like an opportunity.

We're all going to miss you, and Chair Price was correct when she said we all wanted to read that resolution.

That comes from the heart, and I will tell you, in my career, I have spent, had a number of attorneys, really, really good ones, but I will say you are the gold standard.

You are absolutely the gold standard and I'm going to miss you a lot.

I've only worked with you a little over two years.

Frankly, I wish it could have been more.

I would have loved that.

But your reputation precedes you.

Your kindness, your thoughtfulness, your thoroughness, your brilliance.

I think you just frankly you've kept us all on the level playing field and you've kept us, as I like to say, you've kept us out of jail so I really like that part.

You have been so dedicated for all these years and exemplary in everything you do and just on a personal note I am truly, truly going to miss you.

You really are a good person, and you're a fantastic, outstanding attorney, and you're going to be hard to replace, but we'll do our best.

Well, I guess I'd start with I'm getting really tired of having to say goodbye to some

So as our attorney, is there a way we can outlaw retirements?

I think the thing that I think stands out the most is over the last 12 months, as things have started to move, and I've started to interact with more people around the Commonwealth, that I don't think I appreciated or really knew or understood just how high in regard you are held by those around Virginia.

and you should be commended for that because that comes from all of the attributes that I see working with you on a regular basis but everybody from afar witness and that you know as a board member I have an intense trust and comfortability with you as our attorney and I think that's critical for elected officials to be able to do what we do making policy and to govern.

You know your commitment to Albemarle County I think is really

Centralized in the fact that you're a community member.

You love this county and you worked for it.

And your commitment to it is one that I've appreciated and a lot of other people should as well.

And your faithfulness to the county as an organization and as your employer is to be commended.

You know, the wisdom of your council, it's not just the ability or the legal knowledge that I'm speaking to, but your ability having watched others

who are very easy to say no, but you have a mindset of trying to figure out how to get to yes and to do so in a wise way, in a creative way.

And I've always appreciated that.

Nonetheless, of course, it was just a hard no.

Just can't do that.

You certainly were willing to do that, but it was also the idea of trying to understand the board members or the supervisors' willingness to try to get to a different answer and how legally that could help us get there.

and that I think is incredibly important for a board in their attorney.

I will name the person who told me what your daily work schedule is and I'm not going to list that out but talked about kind of how your day goes and the time and commitment that you put in and I was astounded.

So you've definitely well earned the time in your retirement to go enjoy the things that you like to enjoy and putting the work aside.

So I suspect in doing so that you will do so with the humility that you've held the position.

So I wish you all the best in retirement and hope that you will enjoy it forever.

And this supervisor is incredibly grateful to your service.

I'm a little newer, so I have not had anywhere near enough time to work with you and regret that.

I will say, though, that when one starts to think about becoming a supervisor and you look at all the things that you need to learn, someone, I'm not sure who, told me, well, you know, if you really want to understand the kinds of things you're going to be doing, go read Greg Campner's land use law handbook.

it's online and I appreciated that advice so I'm looking forward to the new edition which I know you'll have lots of time to devote to I really appreciated that so I also note that that there's more time set aside for proclamations today than usual and I think it's because everyone has a lot to say here but I'm the one that's new so I'm going to keep it a little bit shorter you are

I am realizing nearly irreplaceable, so it's a tough job for us.

I'm thrilled to have worked with you even for the short time.

I have a lot of admiration and thank you for your service.

Greg, in thinking back, I don't really remember a time when you and Marsha weren't around.

and it's very much like you to mention Marcia.

Certainly the whole organization will desperately miss both of you.

And I wanna thank you for all of those, personally, all of those unscheduled calls that I made.

And all those hours you spent advising me over the years.

almost always with a smile when we were in person or a laugh when we were talking on the phone.

I get it.

But at the end of the day, you made our organization better.

You made our community better.

And you made us as supervisors better.

And for that, we thank you.

And that's all I'm going to say.

I think we have another opportunity as you're going away at your retirement party to say some more.

Thank you, this is hard and I think the gathering coming up will be hard as well.

My first memory goes back to 2000 when Greg became assigned to try to wrangle the people who were trying to put together a fledgling conservation ethos program into pen to paper.

And we were a terrible burden to him because there were 16 people who all wanted 16 different things.

and so he was trying to get us there and I think back then you looked a lot more like that photograph in the picture you held up and so we're responsible for all of your gray hair and I'm sorry but as others have said you have such respect all across the commonwealth and as I began to get involved in state supervisor things in 2008 everybody said oh well you're from Albemarle so you know all about me we know about gray and all the leadership roles that he's taken in the

in the organization and have brought such recognition to the county and honor to the county on your behalf and our behalf and have given us so much a higher bar to reach and I'm so grateful for also your efforts in finding solutions when we have our tear in our hair out trying to figure out what to do.

You seem to embody lifelong learning and I hope that you keep that task and that the next 27 years you find all sorts of other things that you want to be involved in.

But I'm so grateful for the interactions we've had and the guidance you have provided.

Not to get me off the ceiling but to get back from the edge of the cliff.

That's the way I describe it.

I'm about to jump so somebody help me.

But anyway this is great.

You've pretty much heard everything that someone can say, and of course I echo what the other supervisors have mentioned.

We've all faced those situations, you're looking to hire somebody or whatever the situation, and they ask you, well what are the character traits that you think are important for that individual?

Fidelity, loyalty, candor, wisdom, counsel, I mean the list is almost endless.

To me the two most important have always been ethics and integrity.

And your performance both as a professional as well as the way you live your life are the epitome of those character traits which I believe are really at the core of who you are.

If you look in Black's law dictionary next to the terms of integrity and ethics, you'll see a picture of Greg Pampner.

And I encourage everyone to look in the law dictionary to find it.

And what has been so significant in that is those of us who live in the political world and have to deal with competing interests and influences, sometimes we have to struggle a little more to find what we think is the balance.

But we've always known that when we go to you,

You can draw those lines that need to be drawn and give us the guidance that helps us to make not just the best decisions, but the right decisions.

And I will always, in 45 years as an attorney, I think the act that we as a board have been able to do that I will probably be most proud of was to have been the first

local government in the Commonwealth of Virginia to be able to remove Confederate iconography from courthouse grounds.

I just don't think those belong in a courthouse at all.

And you helped us to do it, along with others on county staff, but to do it the right way.

And I will always take great pride in our having been able to do that.

I'm Peter Krebs from the Piedmont Environmental Council.

A number of supervisors mentioned some rites of spring, and I'd like to add a few more to the list.

There's daffodils, allergies, spring break, and also reviewing the list of rural roads slated for paving.

There are numerous factors that contribute to the decision of whether or not to pave a given road, but conservation and recreation values factor prominently into these decisions.

Albemarle's unpaved rural roads are an unmatched treasure in terms of scenery, fresh air, and cost-free public access to open space in rural communities.

They embody the rural characteristics and connection to nature and history that are so important and valuable to us all.

Because paving is a one-way process and can change the character of a community, it should be undertaken cautiously and with intentionality.

I would simply recommend following the example set by our peers in Loudoun County, which is taking a very methodical approach to preserving select rural roads to balance historic environmental, cultural, and transportation goals.

I thank you all for your service and for your intentional and methodical approach to governing the county and helping shape a positive future for us all.

I didn't want to pull anything from consent but may I make a comment on an item that was on consent?

Yes please.

I just want to note as I'm sure everybody else has noted that in the consent agenda we approved the declaring that the local emergency is ended and it's just about a handful of days past the two-year mark that that

local emergency was put into place.

I'd love to ask a historian when the last time is that we had a local emergency that lasted that length of time.

But I think it is certainly worthy to note that that did pass and that Mr. Richardson, Mr. Kantner should be commended for their leadership through that two-year period.

and all of our staff should be commended for the work that they have done to guide us through this local emergency.

There's still work left to be done and it will still be mindful of it all but I didn't want that to just come and go on the consent without at least having a chance to acknowledge it.

Thank you, Supervisor Galloway, and I'd just like to give any other supervisors an opportunity if you would like to comment on it, not necessary, but if anyone has any thoughts.

As I mentioned at the brief remarks by supervisors at the beginning, the reason we have come through this so well in comparison with the rest of the country, we're in about 10% infection rate versus approximately 25% around the country, is because of every

And that's our community members.

But it's also, as Supervisor Galloway mentioned, and Mr. Walker, Mr. Richardson, Mr. Henry, your teams, Mr. Campner, that have worked for months on end, you were working literally 24-7, 365 to keep our county safe.

And we all owe a great debt of gratitude to your standing firm in the face of some opposition

through social distancing, masks, promoting of vaccination.

So I concur, and I thank you, Supervisor Callaway, for bringing that up.

Ned's comment made me realize that we have learned so much from COVID and our success in addition to those other things is based upon a willingness to change processes for the better and we've learned how to do things better that will help us far into the future and I'm thinking particularly of

having remote participation in meetings from our citizens is something that they find very important and I'm very glad we can continue that but also that people in our communities that our neighbors have relearned something they knew their grandparents knew which was how to really care better for their neighbors and to watch out for each other and to check on each other and I hope that those things will continue as well.

So today we will be having a quick work session, hopefully quick.

on the 2023-2028 Secondary Six Year Plan.

As a reminder, the Secondary Six Year Plan allocates state and federal funding for construction, maintenance, improvement of roads in the Secondary Six System.

And the Secondary System are those with the route number of

This document is updated and approved by the Board of Supervisors annually.

And in FY23, we have an approximate amount of 694,000 available that must be used for

Paving of unpaved roads.

That's where most of the money is in the secondary six-year plan is it's required to be used for paving unpaved roads.

The process for addressing unpaved roads is guided by a document that the board approved a number of years back called the Albemarle County Unpaved Road Policies and Review Process.

And the project selection for paving comes from the priority list of secondary road improvements, which is also approved by the board.

and as a reminder also the board's preferred method for paving those unpaved roads is through a program called the Rural Rustic Road Paving Program and the reason that we choose that is because it is a faster, less expensive way to pave roads and it also allows us to retain some of the rural nature of those roads, being able to pave them while still reducing the width so you

This is a map that shows you the unpaved roads in Albemarle County.

The ones that you see in blue are unpaved that are not on our priority list for unpaved roads.

The ones in red are the ones that are currently on that list for unpaved roads to be paved.

And then the ones in green are ones that supervisors have requested that they be removed from paving.

So those are not considered for paving right now.

Just a quick update on the Albemarle County unpaid road policies and review process.

I've had some discussions with some of you and we've identified some small issues that we would like to try and clean up regarding those.

So this does set the

Add roads to the paving priorities list.

And in that policy, it states that the request should provide some form of information or confirmation of broader support for the paving project.

So when someone requests a paving project, then they typically write us and they will have some, some number of the residents on the road will have agreed with them.

either through a petition or through additional emails.

We have talked about this and we would like a little more clarity to that statement and so Stamp is recommending that the board consider requiring a petition signed by 50% of the adjacent property owners along that segment or getting primary access from the segment.

So this would allow us to just have a better standard for recognizing if there is support among the landowners along that road for the paving prior to moving forward with putting it on the list and eventually moving towards the paving process.

I will come back to these questions at the end of the presentation and give you all an opportunity to weigh in.

The other issue that we were hoping we could discuss is that within the priority list of unpaved roads, we have a section called unpaved road segments removed by the Board of Supervisors, often referred to as the do not pave list, and those were also shown

So what has come up frequently is that we continue to get requests for a road to be paved, even if it is on there.

And sometimes this comes, say for in one situation, there was a small segment of a road that had been removed from the paving list that somebody wanted to add on and even the supervisor agreed that this small segment should be added

We've also recently gotten some requests for a road to be paved that is in the Samuel Miller district that the previous supervisor, Supervisor Palmer, had removed from that list.

and those people think have called me and they've asked whether or not now that Supervisor Palmer is no longer on the list or on

I just don't have a process for this.

So what I'm just asking for the board for right now is some direction that you can provide on whether or not we want to consider in the future a way to remove those lists from the do not paid list.

So just the consideration that we can come back to in a little bit.

Moving along to some of the six-year plan project updates, these were projects that were on the previous secondary six-year plan.

And they include the Rio Mills Connector Road, which is that connector road that goes from Rio Mills over to the new Berkmar Extension.

That project had secondary six-year plan tele-fee funds.

on it

Wesley Chapel Road and Reservoir Road were on the previous six-year plan and all three of those are now paved and those projects are complete.

Burt Mill Road was on the previous plan and it is going through the environmental review and some preliminary work right now, right this spring, and we are expecting to get that paved in the fall of this year.

That's the same case for Hammocks Gap Road and Harris Creek Road.

They are doing the preliminary work on those and we expect paving to happen in the fall of this year on both of those.

The other project that is still out there with funding on it is the Berkmar Drive Extended Project.

Similar to the Rio Mills Connector, this road included some tele-fee funding

and also some additional revenue sharing funding so that we can move forward with this project.

That is in design right now and construction is expected to begin sometime in late 2025.

The recommendations for this upcoming secondary six-year plan are that we would Once again, I'm asking for some direction on this questions I discussed earlier We would also like to complete the paving of Harris Creek Road, Amex Gap Road, and fully fund Red Hill School Road as those highest priorities on the secondary six-year plan for paving.

We would also like the board to recommend moving forward with funding on Cove Garden Road so that we can send notification letters to those adjacent landowners to determine the support and this is part of that process that we have that when a road comes up for paving we send a follow-up letter at that time to all the property owners.

We collect their comments and then we come back to the board for that final approval for the rural rustic

recommendation and to move forward with the paving.

So that's where we are with that one.

We would like the board to endorse the updated priority list for secondary road improvements.

That's included as attachment A3 in your packet and also the county's draft secondary six-year plan which is an attachment C.

If we move forward with that, we would like to schedule a public hearing for May 18th so that we can get this completed in time for development of the final six-year plan and approval by the Commonwealth Transportation Board in June.

And that is all I have for you, so I'm happy to open the floor to questions and

I can pull up that slide once again, but it was just the two questions were just to have the board weigh in on whether or not we can add to the policies that we require a petition with 50% of the landowners to add a road to the priority list.

supervise, well I would think your question if you have 50% or more of people asking for that road to be paved that that would also answer your, and if the board wants to do that, that would also answer the second question which is if a supervisor is no longer there and then you have 50% of the residents wanting that road paved

then it seems to me that that should happen.

That's just my preliminary take.

I'd like to hear from the others, but I do have a question regarding hammocks gap.

Is that, I know it was paved a portion going in like 0.7 of a mile.

Is that, are you planning to fully pave that hammocks gap or just partial?

Those are just partial paving projects so I think it was Hammock's Gap was the one that we can only pave from where it's currently paved up to the bridge after that.

One of the standards for the rural rustic is that you have to have a certain width to be able to pave to and we can't meet that width past the bridge.

So it's only getting into the bridge.

And going back to the questions you asked, I would think that if we did say, well, if a supervisor wants us on the unpaid list, I mean, how long does that last?

Is it five years, 20 years, 30 years after that supervisor is no longer in that position?

It just seems to me that if we go with what the residents want, at that time with a 50% that might help.

I'm trying to understand your question a little bit better, Kevin.

To get to the 50% support of

It has to be on the list initially.

No.

So just to get on the list, we require that there be some element of support shown.

But that element of support is not defined.

And that's the list to be paid?

Yes.

So to not be on the list to get paved, it can just be a supervisor saying, don't put it on the list?

Yes, that is what that is the historically how it has happened is that a supervisor just says, I don't usually a request would come in for it.

And the supervisor would then say, I want this removed.

I never want this red paint.

And my question is, well, does that mean it's never never or what happens if the if the ownership changes out there?

Well, it seems to me that if the supervisor changes, that supervisor's wishes would come into play.

And that would come into play based on the election.

And since elections matter and who you elect to put in those positions, how they feel and think about certain things should matter.

So I certainly don't think that if I'm a supervisor and I say don't put it on that list, and then somebody comes in and replaces me and they would like it on that list, they would probably have a reason to do so.

I would say you'd have to follow the will of that current supervisor and then they have to deal with their constituents as to the decision.

If they disagree, if the constituents disagree with the decision from the previous supervisor to the new supervisor, then that sounds like an issue for that supervisor trying to have to work through.

But I certainly wouldn't think that if I said, here's what I think or don't put it on, keep it on the unpaid list.

I don't think that I'm saying that as an infinity answer.

That's only there until I'm there.

Those are my thoughts.

Yeah, be careful what you wish for.

I guess that's the first thing that comes to mind.

So when you say 50%, it sounds very reasonable, and I appreciate that.

I'm going to give an example of a road that I think needed to be paved, but created some consequences that I don't think people really fully appreciate it.

And that's Reservoir Road.

I'm very familiar with it.

I used to run on it a lot.

You know, because of Camp Holiday Trails and all, it gets a lot of traffic.

But what happens is you've got a very curvy road with no real shoulders to speak of.

And once the paving raised it up, it basically made it impossible

for people to ride their bikes, run, walk safely with the amount of traffic.

I'm not saying we should go back and do anything about that.

But when you say 50% say they want the road paved, I'm afraid of people saying, oh, well, that sounds good, without really understanding what it's going to do to the character of their road.

And so I would push a lot.

further than just paved or no paved checkbox.

I think people deserve to know what's the shoulder going to be like?

What's going to happen to these curves?

How much higher is the road bed going to be?

What's the walking adjacent to the road going to be like?

Are they going to be having to stay on the paved part because otherwise they're in a ditch?

So I understand and I really do want people to be able to say if the 50% or more of the people on the road really want it paved, that this is open for all the other criteria to be paved.

But I want to make sure that everybody understands what's going to be like after they pave it.

Because it's going to change the traffic, it's going to change the use of the road.

And that's a long winded answer to your 50% question.

With respect to the

Designation of a road to the do not pay list, I have to accept that elections matter and this is now something that the new supervisor would weigh in as to whether or not that's a priority.

I'm not fully understanding how, you know, that's kind of a little perk of office that I hadn't really thought through.

So those are my comments.

I'll go with the second one first and then swing back.

I agree with everybody, elections matter and a supervisor determining something should not be, that determination should not last forever.

So, very simple for me.

That's cut and dry.

And I think that answers the question, Kevin, right?

At least for me, yes.

Okay.

Given Jim's example, when Jim gives that example of what happened to that road, I would suggest that that road was not well designed and the paving would be a shame.

and that concerns me a lot because we should not be putting down roots that create those problems, right?

I would hope that we're doing a better job now and I can't remember, to be honest with you, when that road was paved.

It's been, I can't remember, it was a long time ago or not.

Just recently, Jim said recently, that would be my concern is I hate to react

to give guidance for the future based on an example that sounds like to me it was poorly thought out and poorly done.

And I'm not blaming anyone.

I'm just saying that what he describes is not what we would hope we would be putting down in our community, right?

Jim, you have your hand up.

I don't know.

Okay, that sounds good.

So that's my first thought when I hear that, that we, I thought we were doing paving roads and looking at at least shoulders of some sort and bike lanes now.

And I get the fact that we don't have the money to do extraordinary things everywhere, right?

But that sounds terrible.

I'm a little concerned over the 50%.

I think maybe the standard ought to be higher than 50%.

I would not say, because all that, you're not really getting a sense of the neighborhood with 50%.

And I'm not sure how to describe that better.

And I'm not, you know, you go to 55, do you go to 75?

I don't know, but I would not be happy with 50%.

I think that you need to have a better sense of the neighborhood, in my opinion, or the community than just 50%.

That will give you a sense of,

really the flavor or the wishes of the community because at the end of the day, for me, it's more about what the community wants than what I think is a supervisor because they're the folks that have to live in that community and along that road.

Yes, you have helped, absolutely.

And I realize as I'm hearing the Supervisor's comments that maybe I should just give a little bit more information about that process, though.

So the 50% that I'm asking is

to get the road on

and that happens very often a number of years after it gets added to the list when it actually comes up for payment because it got funded then we send a letter to every property owner on that road and give them an opportunity to comment and I take all of those comments and I bring them back to the board so if I get comments in support or against that road being paved

Ward, and then the board can make the final decision on whether or not to move forward with that payment.

So there is a second catch.

So the 50% is just to get on the list.

It does not mean that you're going to be paid.

So there is a chance for everyone on the road to weigh in.

So just to clarify.

Thank you and that's a great clarification and in those years you'll have new people on that road you'll have different people you'll have and I get that.

I still say I think 50 percent we may be low on what we're requiring.

I would look at and I don't know it sounds silly but 55, 60.

I don't think you have to take it to 80 right but I do think 50 for me 50 percent

is probably not high enough to even get it on the list because it doesn't reflect really as much of the entire community's feelings.

And I'll let it go with that.

As you will learn, I may know already, this is an issue of long, long time interest and concern for me.

And it's as much about the policy and decision making and the other impacts as Supervisor Andrews supplied as much as the road, because we have

To me, my understanding has never been that one supervisor could take anything off the list for the Do Not Pave.

I tried to set up Do Not Pave for Dickwood's Road for 10 years, and it was not until the board majority was willing to recommend it that it actually happened.

and the reason that it became is for many years before 2008 when I started working on it, there were many, many residents who were horrified at the prospect of the road being paved because it is a major cut through.

It connects people from Nelson County and Point South all the way to the city of Charlottesville right there in Ivy and it is also a major

Training ground for the public schools for their cross country teams and the prospect of a whole passel of cross country high school runners coming face to face with a high speed dump truck was pretty terrifying.

The dust is an issue that you have in the country.

And I have heard myself being in a group where a real estate person is trying to sell something says, oh, don't worry about the dust next year, it's going to be paid.

Whether they willfully said something that wasn't true or they thought it was true and just were repeating gossip that they had heard, that creates a longtime sense of grievance on the part of many of those residents who used to be in the White Hall district and are now in the Samuel Miller district, who felt like they'd been betrayed.

So it is not merely a reason about transportation and maintenance and that kind of thing.

There is a lot of quality of life in a rural area that is involved with what kind of road it is.

And so I hope that we will take some extra time beyond today where we could really learn about the Loudoun program that was mentioned and talk about those other elements of road in addition to transportation which are incredibly important for the many different kinds of users.

I mean, I used to ride my pony all over.

from our place to Garth Road to Farmington to Oakwood all over along the roadways that is absolutely not possible anymore because the traffic goes by at 60 miles an hour instead of 30 or something or someone used to slow down and go around us like you would do for a bicycle now so I understand that needs are going to evolve

and I'm not saying we have to go back to the 1950s because that would be ridiculous but there are these public spaces that have many different uses and I hope that we will take the time to think about that.

I think that it should be a board action to remove to put a street on the road on the do not pay list as it was for Digwood's Road.

and there may have been two supervisors who led that concern but it definitely was a board action to do that and just as it should be board action as it is today to put one on the list for consideration but for decades all it was one landowner who would call up the reason we have a problem is because there used to be a petition to get on the list back in the 80s and 90s and then that went away

and then one person could call up and get on the list and then they would come in year after year and say well we've been on the list for six years and we haven't done anything but there never had been any process and it gets this built up sense of angst that gets worse so in answer to your questions having given that preamble I think that board action would take care of it and that way and the community view is the source of where the supervisors

intent is going to come from anyway.

I mean, if people had complained to me for years about their lives being ruined, I would not have been informed enough to be able to push it forward to the board level those years ago.

I definitely agree that it should be higher percentage 70 to get on the list period because that saves a lot of time and it puts the responsibility where it should be with the people in the neighborhood to develop a sense of

Cohesion.

Later on today we may talk about roads where people have been arguing with each other for 20 years about this and that's sad but there needs to be a pretty substantial in favor one way or the other I think otherwise we're just setting staff up for a whole lot of work that isn't necessary and a lot of argument in the neighborhood.

Having the do not paid list published is what will prevent those misrepresentations from happening.

and one citizen did call me up the other day having seen this agenda and said what about having the planning commission involved in these decisions because if you pave a gravel road in the country it is de facto rezoning and you're then going to have a whole lot of houses that want to come in and live there and break up properties so that was an interesting concept to me and that I hadn't thought of before but I will share it with you all to think about as well.

Did I answer your question?

Yes, you did.

Yes, a quick clarification that you know the Reservoir Road is just an example of why I think that it's important to understand what the change of character of the road will be due to paving and that that needs to be something that the people who

are going to be affected by it, understand.

That said, I have a question and that is when you say 50 percent, it's 50 percent of all affected residents, it's not just 50 percent of those who respond to a questionnaire, right?

You have some way of identifying that you're talking about some percentage of people who've actually

going to be affected and have to get those responses because I'm a little worried about a few local people becoming the only representatives who've spoken up and others not really understanding what's going on.

So I do think this is something in rural areas that requires a lot of understanding by the people who are going to be affected and it's going to take some legwork to make sure that these are the appropriate places to pave.

So that's it.

A little over 50 would certainly be fine with me.

And that's it.

I think if it's over 50% or if it's 60%, at least that gets the ball rolling.

You know where some of the residents are standing, how they feel about that.

I have noticed dealing with rural roads versus paved roads, it is complicated.

There are people out there that don't want their roads paved and there are people who want their roads paved.

I thought that Virginia or VDOT wanted to get all roads paved eventually.

The VNOD does express interest in trying to get roads paved.

It reduces their maintenance costs.

So they are interested in trying to get them.

I don't think that's a formal policy that they say we want to pave every road.

OK, so now I know it's not something that's mandatory.

The other question I have, whether or not, so going back to what Supervisor Malek said,

If I want a road put on a Do Not Pave list, does that come from me or does it come from board action?

Or can it be both?

So I have not personally been involved in any of the additions to the Do Not Pave list.

But my understanding was that in the past the board had just said that.

But my issue really is that there's no clarification in that review policies and review process.

So this is the opportunity to say we will do that by board action.

And I think that sounds like what a lot of people or what Ann Mallek is saying and what the board seems to agree with is that we could do that by board action and then the board could also have an action to remove it from the list.

And I understand that with that, would we also have direction from the homeowners on that road?

So for example, let's say 60% of the homeowners want it paved, but the supervisor says, I don't want it paved and wants it on the do not pave list.

And the other supervisors don't know that the majority of the residents want it paved.

What would happen then?

I would always provide all the feedback from either the petition and let you know if we got what number or what percentage they got, and then also the feedback when we actually send those letters.

This is the first time I think I've heard of the juvenile paid list.

because the board only can act as a board, I think it should reserve the power to put things on the doing paid list and the power to remove.

And the public process can work itself out, but I think the board needs to retain that authority.

While I have the floor on the

And I realized that the 50% to get things on the paid list, it's just a threshold.

But I keep going through my mind that the owners of three one-acre parcels could outvote the owners of two 500-acre parcels and get on the list.

So I don't want to complicate it.

You can just leave things as what you've discussed.

I think Mr. McDermott, you've probably heard the consensus of the board, but I'll add mine in there just so you have it.

First off, I don't, well, very frequently the supervisors may defer in some areas to the supervisor of a magisterial district in which a particular item may be located.

That is more of a courtesy deferral rather than a de jure waiver.

And I believe that action should be by the board, not by individual supervisors.

So that would be the first thing.

It should be all the board action, not an individual supervisor action.

Put it on a list, take it off the list.

Secondly, I would offer that this should be considered similarly to what we went through recently with the road naming convention, where the determination was made that 50% was too low a threshold.

but we're talking about a change and if there's going to be a change and Supervisor McKeel I think was the first one to articulate it but then supported by other supervisors that there should be more of a consensus rather than a simple majority a consensus of that community in recognition of why Mr. Campner just mentioned that you could have three small holders of property out vote if it's a pure vote

but again even if more than whatever the threshold percentage is determined it ultimately becomes a board decision and as you have pointed out you would give us all of that information so the board would then be able to make that.

The other thing I would say is that we have to be very clear that if the road is placed on a list that that may

I think it's very important that these lists have the caveats included in them so that any member of the public who looks at that list, if there's a list that says this is on a road on an hour to pave,

List, but that does not mean it will be paid.

It simply is on a list that will be considered for being paid.

And I think with that, I'm finished.

Oh, but for your questions, I actually had a couple of other questions that I wanted to ask.

The telefunds on page one of attachment A,

We see four different columns, one of which is the tele-fee funds.

I appreciate that probably comes from a state calculation, but I noticed that over the years that are listed, there is no indication of an increase in those fees.

The state does increase those.

And so in the draft version that you're looking at right now, what they've done is they've just taken what they know they're going to get next year, and they've just assumed that's going to be consistent in the years.

And it was slide number six.

The Burtmar Drive extension shows tele-fee funds through FY 25 totaling $2,288,226.

And then you mentioned other funds as well.

If we're only getting about $340,000 a year on tele-fee funds,

You will see that we are still getting a few more years of that $300,000 added to this.

Understanding now that the board in previous years had decided to do that is fine.

But that is in the Pave and Place program on page two of attachment A. It talks about under the Pave and Place option the road is improved to a minimum standard of 18 feet of pavement with two foot shoulders.

that there had to be 14 feet with a three-foot shoulder on each side.

Now that's not a paved in place, but that's just the rural gravel road.

My name is Jodi Filardo, Community Development Director for Albemarle County.

I'm joined today by Charles Rapp, the Deputy Director for Operations.

We'll be presenting the Community Development Department's work program update to the board.

In case you have detailed questions, we have other members of our CDB leadership team with us who will introduce themselves and show the need to rise.

In 2021, we varied our work program process slightly by providing an in-person presentation in May 2021 and a written program update on your consent agenda in December.

Also, you may recall that last May you agreed to add desired projects to a parking lot list for later consideration.

We're very appreciative of that approach, and we're able to complete many projects as a result of that focus.

We'll be reviewing the updates today.

In 2021, we varied our work program process slightly by providing an in-person presentation in May 2021 and

a written program update on your consent agenda in December.

Also, you may recall that last May you agreed to add desired projects to a parking lot list for further consideration.

We're very appreciative of that approach and we're able to complete many projects as a result of that focus.

We'll be reviewing the updates today.

The purpose of today's presentation is to affirm the list of projects prioritized for fiscal year 23.

Today we're presenting a summary of personnel updates, mandated work metrics, updates on our fiscal year 22 work program progress, presentation of our proposed fiscal year 23 work program, a review of the parking lot lists, and then we'll close with your questions and consideration of any desired substitutions or changes from the park list or other lists you may have.

With this slide, we wanted to brief you on workforce stabilization within our department.

For fiscal year 21, CDD is authorized 74.5 full-time equivalents.

We started fiscal year 21 with 67.5 staff members and seven frozen positions in response to COVID.

Those frozen positions were released at the beginning of the fiscal year.

At the mid-year budget session in December, the board authorized three additional positions.

Of these three, two have been filled.

Sadly, the third offer we extended was rejected when countered by the individual's existing employer.

In addition to the positions, the board approved one-time funds of $50,000 to support hiring two contract certified plans reviewers.

These reviewers have been very helpful in tackling building permit review times.

Since July 2021, we've also implemented three organizational changes aimed at improving customer service.

First, the front desk team, previously known as intake, is now reorganized as application services.

Based on lessons learned from re-engineering our processes, anticipating Camino, our new

We recognized the need for both systems expertise and financial expertise as well as management acumen in our manager of this team.

This resulted in the upgrading of the vacant manager position which we recently filled and then the entire application services team was moved to our zoning division to align with a front-end focus on the application processes and to leverage the management strength of the zoning division.

As of March 14th, we finally have a fully staffed front end team for the first time in almost two years.

With the February resignation of the manager of geographical data services, we took the opportunity to explore the highest and best approach to providing a geographical information system service to the entire organization.

With the implementation of the enterprise license agreement due to be fully implemented by August 22,

The GIS team is now licensed to deploy that functionality more broadly across the organization.

As information technology provides organization-wide services through their enterprise services team, CDD, IT, and the County Executive's Office evaluated the situation and made an organizational joint decision to move the remaining GIS team.

This leverages the existing GIS technical knowledge within IT,

while also providing additional technical support and staff growth opportunities to the GDS team members.

In a reverse move at the same time,

The IT records management team moved back to CDD.

Initially part of CDD records management moved to IT in 2019 to utilize that team as an organization-wide service.

However, CDD uses so much of this team's capacity that there's no time left for support of other departments.

Now the team is coming back to CVD to align with the work at hand and is positioned to help with the process re-engineering with the Camino implementation.

Moving on, let's talk hiring.

As I mentioned before, we started fiscal year 21 with a thawing of seven vacancies.

Since then, we've occurred eight additional vacancies due to retirements, promotions to other departments, and resignations, including two retirements, one internal organization transfer, and five resignations.

We've also added eight new staff members across our divisions, two in building, one in engineering, two in planning, and three in zoning.

Outside of the regular reclassification

Process for CBD completed in September of 21, we also promoted eight folks within the department, including Charles Rapp, Stephanie Banton, Keith Bradshaw, Emily Cox, Mariah Gleason, Scott Good, Benton Holt, and Rebecca Ragsdale.

And we're pleased to announce the selection of Ms.

Candace Perkins as our new Director of Planning, who starts April 11th.

and we presently have seven openings for which we are recruiting.

For the next few slides, we'll transition to some metrics regarding mandated work we are required to perform.

Many of our CDD team members work predominantly on mandated work.

Others work on both mandated and discretionary projects guided by our work program.

All of CDD operates with an all hands on deck team approach to getting work done.

Year over year, both our volumes of building permit applications received and permits issued have increased.

Over this past year, we've also worked with our building community to make sure they realize both the Code of Virginia and Albemarle County.

require the submission of construction level drawings to accompany permit applications, not just floor plans.

More thorough applications resulting more complete plans review, which ultimately results in a better, safer built environment.

You may recall, thanks to you, we've also augmented our plans review team with two retired plans reviewers.

This additional help has enabled us to process more residential building permits, although we still have a backlog.

These charts illustrate some of the mandated work performed by inspectors and co-compliance officers in the field.

At various steps in the creation of the county's built environment, teams of inspectors deployed the field to verify the work being done on approved projects.

For example, zoning code compliance officers check projects to confirm setbacks on the job at the outset and then check the completed job prior to the issuance of the certificate of occupancy to make sure everything is built according to plan.

They also investigate complaints made by our community members

The spikes in the complaints chart on the bottom left represent the receipt of possible unlicensed homestay information from our third-party software source, Hamari.

In 2021, the CCOs performed 2,275 inspections and 337 complaint investigations.

Erosion and sediment control inspectors check private property projects under construction and work with builders and developers to ensure that sediment doesn't impact our roads and waterways.

Our E&S inspectors performed 4,962 inspections in 2021.

And building inspectors verify all steps of the building of, or renovations to, residential and commercial projects throughout the building process.

In 2021,

They performed a total of 39,246 inspections.

In our development process, applications and approvals for subdivisions precede those for site plans and related approvals.

Subdivision applications increased back in 2020.

After subdivisions are approved, the next step in the process involves site plan submittals.

Following site plan approvals, building permits typically arrive.

In 2021, we began to see the result of subdivision approvals from 2020 as more site plans were submitted than in the previous year.

As you saw from the previous slide, our permit applications are now up year over year.

With the current price of materials and labor now coupled with rising gas prices, we are taking a conservative approach to fee revenues for next year as we don't know whether demand for housing supply will overpower the negative impacts of rising raw materials and labor.

However, based on what we now see in the pipeline, we are likely to have another big year of mandated work ahead.

This is a metric informing two major projects for us, revisions to our development review process and implementation of new software.

We hope to drop the total number of touches by staff on development applications to be able to increase the capacity of our development review staff and to reduce cycle times.

In a revised approach, we intend to perform an initial review and generate a complete set of comments.

Then we perform a review of the fixes we submitted by the applicant to address our comments.

If there is something incorrectly done with those fixes, we review the corrections to those.

After that, if the application is still not correct, we are working towards denying the application.

This is a big change in approach and one we will make gradually as systems tools improve.

Presently, staff touches each development application an average of six times.

Reducing the cycle of frequent reviews and resubmissions will also reward applicants who submit thorough and correct applications the first time.

We're now transitioning to the recap of fiscal year 2022 projects.

This was the slide we used last year to present the magnitude of work we faced.

It's still just as busy as before.

In fiscal year 22, we targeted the right new work and also maintained focus on projects already started.

We sought to complete what we started, invest in tools to improve our capacity and customer service capabilities, and start the multi-year project of addressing both comprehensive plan and zoning ordinance modernizations.

We'll present updates on each of these major areas in the coming slides.

This slide reflects the magnitude of commitments of our overall team.

I'm so grateful to get to work with such a capable team of professionals.

We're also thankful for the support of the board, the county executive's office, and our colleagues in accomplishing all of this work.

As you may recall, the annual work program is comprised of those projects which are neither mandated nor under any legislative deadlines or requirements.

Each year,

We've worked hard to right the work in our work program.

That said, changes along the way can negatively impact deadlines.

Also, whenever an unanticipated, urgent project pops up, often the resources allocated to the work program are diverted to address those immediate needs.

This practice results in work program project deadlines sliding out beyond the original estimated deadlines.

This year has been a really busy year and still the team kept focused on achieving completions of these projects.

We're happy to report we've completed most of the projects from our fiscal year 22 work program.

These 11 projects or phases of projects from our FY22 work program were completed in the months noted above.

We still have two ongoing projects with additional deliverables in calendar year 2022, stream health and wireless facilities ordinance.

In addition, two projects are still to be completed in fiscal year 2022 from the initial projects underway list.

The Rio corridor study is now expected in June 2022 and the developer incentives are coming back in work session again in May 2022 with hopes for board direction by June.

The developer incentives, if adopted by the board, will necessitate additional zoning ordinance work that is likely to be significant.

As the scope of these incentives is defined, the overall impacts will be outlined to the board

with requests for additional support if needed.

After 20 years of execution and necessitated by a staff retirement supporting the Acquisition of Conservation Easements or ACE program, we added a project to our FY22 work program list.

As is customary with program staffing changes and with long-running programs, we're conducting a program assessment now.

We are scheduled to bring that assessment forward to the board at the June 15th board meeting.

As the board may recall, this historic assessment is the first step in the overall assessment of conservation programs which will come forward as part of the comprehensive plan process.

With the move of the Geographical Data Services team to IT, the third project still underway from fiscal year 2022's work program is the Esri Enterprise License Agreement completion, which is due in August.

That will move now to the IT department for completion.

Those previous slides were projects from the underway category from our work program.

Regarding fiscal year 22 projects impacting our investment and capacity, we have the following updates.

The new project management software pilot is complete and JIRA, a software package, has been selected with help from the performance and strategic management team and information technology and placed on order for deployment to the long range planning team.

The updated approach for public engagement was deployed for the comprehensive plan with help from the Community and Public Engagement Office and will continue to refine this process as the engagement and comprehensive plan phases move forward.

CDD deployed upgraded software, hardware, and training for the digital processing of applications and our Camino applications portal is in soft launch mode as of this past Monday, 3-14-22.

thanks to assistance from the CDD, Performance and Strategic Planning, Information Technology, Finance, and Community and Public Engagement teams.

On this slide, we're sharing the Go Live timeline from the community launch, which was previously sent to you via email.

We're pleased to report the soft launch of the new applications portal Camino went off without a hitch.

Until April 1st, we are in soft launch mode, which means we will continue to ask for survey feedback from folks that are using the system in case there are small tweaks we can implement to improve their experience with the software.

As for the core systems modernization, you'll hear more about that work in just a moment.

In the previous slide, I breezed by the Camino soft launch.

However, we want to spend a minute

to thank so many in our entire organization for the work contributed to make this project successful.

This is my giant shout out to the county's community, thanking them for a job well done.

We have over 35 folks from five different departments on the overall team, Pete Shipman,

Senior Project Manager from Performance and Strategic Planning did an exceptional job leading the overall project with assists from so many folks.

Of course, the efforts expanded and participation varied greatly depending on each person's role in the project.

We want to acknowledge the amount of departmental and organization-wide support we received to make this happen.

And we're sharing to provide awareness of the levels of participation needed across the organization to successfully deploy a project like this.

At the onset, the Camino project looked like a relatively simple software deployment.

However, this project required significant process re-engineering, systems integration, website redesign work, records retention modifications, staff and customer training, finance systems processing changes, and new communications.

This chart illustrates the impact of a relatively simple deployment.

This entire project has taught us many lessons as we anticipate the replacement of the 20 plus year old County View system within the next year or two.

Also, we'd like to give a shout out to the Blue Ridge Home Builders Association members who participated in the beta test of the system and who provided early feedback to us.

We are grateful for the lessons learned on re-engineering,

our processes and exploring our data.

Also, we are more clear-eyed in recognizing the enormity of the project now in front of us with the core system modernization.

That said, there are so many folks on this list.

We couldn't have made it without them, and we are so very grateful for their help.

This slide is the final update on our previous work program.

We just wanted to share status on a few key phase one aspects of the comprehensive plan project.

Development areas build out analysis.

We are partnering with our Economic Development Office and on-call consultant Kim Lee Horne to conduct a build-out analysis of the county's development areas.

The purpose of the analysis is to provide a data-based model to communicate the pace and direction of future growth in the county as input to the growth management policy.

Staff is in the process of reviewing data with the consultant with a final report expected

We received 103 applications for the working group.

A selection team made up of staff from the Office of Equity and Inclusion, CAPE, the Department of DSS,

CDD, and Fez are in the process of reviewing applications as the first step in selecting the group.

Following the selection, staff will reach out to schedule the first meeting.

Conversations with HR are ongoing to determine the appropriate training and onboarding process for group members.

Initial outreach.

The team created a project name, logo, and style guide.

The project website went live on February 1st.

The URL you can see there, that will serve as an engagement hub for the project.

Throughout February, staff conducted five in-person pop-ups and two virtual sessions via Zoom to share information about the project.

and the AC44 Working Group Opportunity.

We also sent ACM emails announcing a new website and working group opportunities.

We had two media interviews that aired on NBC29 and one interview at the Southwood Pop-Up.

Tools and Technology.

We piloted the project management software JIRA to help track project deliverables and progress.

We built an initial project frame

through which to regularly manage workload.

We're digitizing the historic comp plan growth boundary maps, dating back to the 1970 comp plan.

We plan to use a new tool to show the history of growth management in the county as part of phase one.

We're pretty excited about that coming forward.

What's next?

We're targeting our first monthly newsletter updates for the end of March to be shared with you, Planning Commission, the CACs, and community members who've registered on the AC44 website and or the ACN email list.

The first round of public engagement opportunities for phase one are being planned for the end of April, beginning of May.

We're hoping to share dates, formats, and locations for public events in the first monthly newsletter.

And now Charles Rapp, Deputy Director of Operations, is going to talk us through the recommended approach to the fiscal year 23 work program followed by an overview of projects we've not yet accommodated.

We'll then open up for supervisor feedback and discussion on project accommodations.

Good afternoon, Chair Price and Supervisors.

My name is Charles Rapp.

I'm the Deputy Director for Operations of Community Development.

I'm going to spend a few minutes today walking through our proposed FY23 work program with you.

This graphic illustrates both ongoing and proposed work program projects for the 2023 fiscal year throughout our department.

You'll see similar to last year, a primary focus, as shown on top of the chart, will be investing in capacity.

This includes the ramp-up of our County View replacement as part of the organization's Core Systems Modernization Initiative that will extend multiple years to full implementation.

Later in October, work will begin toward process improvements with our development review to achieve greater efficiencies and reduce the high number of reviews and resubmissions that we're currently experiencing on projects.

Two major initiatives that are currently underway and will continue throughout the upcoming year are the Comprehensive Plan and Modernized Zoning Project.

In our previous slide, we reviewed the status of Phase I for the Comprehensive Plan.

This fall, we'll transition towards Phase II, where we'll focus on policy review for major topics such as land use, transportation, economic development, resource, and rural area planning.

The next phase of the zoning modernization initiative will focus on updates to our development regulations, which include critical slopes, tree cutting, accessory structures, parking, recreation requirements, outdoor lighting, street standards, sidewalks, and landscaping.

We've also added affordable dwelling unit incentives, also known as developer incentives to the list.

At this time, we don't know what resources will be required to incorporate developer incentives in the zoning modernization project.

as the board will not consider the specific incentives again until your next work session in May.

However, we're acknowledging that this work will need to be accomplished.

And our expectation is the developer incentive zoning ordinance work will be prioritized ahead of other items and will cause a shifting of the remaining items further into 2024.

The items identified as proposed projects for the 2023 fiscal year have been selected based on recent board feedback and broader planning efforts.

In the first half of the year, we're proposing to adopt new water protection-related regulations that would prevent incremental development, which would address the accumulation of smaller projects underneath our 10,000 square foot disturbance threshold within the WPO.

In July, we also plan to move forward with updates to our wireless facilities policy and associated ordinance.

During that time, we'd also engage consultant services for preliminary studies for three potential transportation projects, which include partial closure of Freebridge Lane, an evaluation of additional concepts for the Route 20 shared-use path, and potential sidewalk for the Solomon and Inglewood roadways.

In response to the recently announced RAISE grant, we're proposing to submit an application to fund the study and planning of the Three Notch Trail.

If awarded, this will provide funding for planning assistance through multiple years for a project that can provide both regional and local benefits.

Additional details of this grant application and project will be presented to the board on April 6th.

With the recent adoption of the Ride 29 form-based code and the Broadway Blueprint, we've incorporated the next phase of work for both projects to start in January.

The form-based code phase two would focus on road networks, building envelopes, and the proposed realignment of Hillsdale Drive.

This work would provide the next step towards encouraging redevelopment of large, underutilized commercial parcels in the district.

The Broadway blueprint small area plan would focus on transportation access, potential pedestrian bridge alignment, and other site features to guide the redevelopment in the area, ensuring it's interconnected in the existing urban fabric of the surrounding neighborhood.

Lastly, we have two projects that are estimated to run the full course of the upcoming fiscal year.

The first follows the implementation plan of the recently endorsed stream health initiatives.

It would include drafting a stream buffer overlay zone, as well as riparian restoration guidelines.

In addition, we're hoping to engage a consultant's assistance to complete a fee simplification study, which would identify opportunities to simplify the way we currently calculate fees for work undertaken throughout the department.

Our current fee structure involves a high number of individual calculations that result in a complex and often confusing scenario for customers and administrative staff, leaving room for improvements, clarity, and efficiency.

Now we'll transition into the parking lot list of projects from last year.

For FY22, you may remember we took a stab at categorizing our projects into three categories, small, medium, and large.

We'll run through the projects in each category in the following slides.

Where we could, we've either incorporated items into an existing project or have slotted them into the work program for next year.

Staff hasn't completed specific scoping of any of these, and so projects certainly change categories once we get into more detailed planning for them.

These projects and others you may have in mind may possibly be swapped out with others we've addressed with next year's work program.

However, there are complexities and intricacies involved in moving these around, especially related to staffing, knowledge, skills, abilities, and of course, the availability to complete the work.

This is a list of the projects that we categorized as small resource demands, being less than 500 hours of work.

The examples in this resource category are the zoning tax amendments to address fill and waste, which took an estimated 333 hours, and the rural area landscape contractors.

which took an estimated 75 hours to complete.

As the years progressed, we've tried our best to incorporate or combine exploration of these projects and other projects covering similar topics.

Some projects have fallen off the list simply because the need for the project disappeared due to legislative changes in Richmond or for other reasons.

We shrugged through those projects on our lists.

And then here is the list of medium projects.

An example of a project in this resource category was the housing policy comprehensive plan amendment, which took an estimated 2,000 hours to complete.

For those projects within the medium staff category, we've suggested pairing with the comp plan work, where relevant, or we've added them to the pros work program for now awaiting board feedback.

And this final category involves the largest amount of staff resource demands.

And a large project example is the form-based code, which required an estimated 4,500 hours of staff time to complete.

And that concludes our list of park projects and concludes our formal presentation.

We'd like to turn this item back over to the board and are happy to entertain any questions or suggestions that you may have.

I expect the story around our improvements to the department will continue during the budget conversation about telling the whole story of how even those, I think your slide about who worked on the Camino project starts to speak to or tell the story of how many different departments are involved

when we think of how it spreads over the budget book and not just in CDD.

So that slide is very helpful, even though that wasn't necessarily the purpose today, but it certainly speaks to that.

So that's appreciated.

So a question on slide four when you were talking about the permits received versus the permits issued.

You don't need to bring the slide back up, but you can either way.

I guess my question is, I guess I don't expect the permits received and a permit issued to equal one another.

Because obviously something's going to get submitted that shouldn't be approved and you don't get the permit.

But is there some sort of

historical or expected variants of received versus issued that we have seen over time or that we kind of plan on or plan for when we think of capacity and how to meet the demand.

If my question makes sense?

Chair Price, would you like me to answer that question?

Okay, sorry.

Supervisor Galloway, there does not necessarily have to be a one-for-one correspondence between received and issued, although we'd really love for that to happen.

We have some permits that take hundreds of days to review and others that we can issue within one or two days, and so they kind of balance out.

We showed on that slide was actually calendar year data based on when the actual permit was issued.

So we're kind of working backwards taking a look at all of that.

So our hope and our target would be that as we improve our processes, as we improve the quality of the applications that we receive, and as we train up our new staff,

Our target is to get to pretty much a two week in the door and out and issued timetable.

That's what we're aiming for.

We are very far away from that right now, but that is our fervent hope and that's our goal.

No, I appreciate it.

I'm trying to, I guess where my head is, is I'm trying to understand

The key performance indicators of what shows the movement from the current state to what you just stated is our expected state, that two week time frame.

So there's obviously going to be benchmarks that you're going to be looking at.

to go, okay, are we making progress?

Are we making the move, et cetera?

So I think that's where I would, because my next question was around that as well.

It's like total number of, you talked about total number of reviews and they currently have six times.

Can you just say what you said again?

Yes.

On development applications, on average, our development reviewers

Touch that application an average of six times.

So they get the application, they review it.

They send it back out to the applicant who sends us some response.

We look at that response.

It's not complete.

We send it back out.

Or what they responded causes other problems.

And we send back additional comments because they've been triggered by the new responses the applicant has made.

And on it goes, and it goes, and it goes.

What we have done, because we keep trying to work with people, we keep having this back and forth and back and forth and back and forth, which has really caused

Well, we're really dealing with applications that are not very thorough or complete when we receive them.

So what Camino is doing is helping on the front end.

So we're hoping to get better, tighter, cleaner applications on the front end so we get better product in the door.

So we're hoping to reduce that cycle time just because we have better applications to deal with.

In addition, we also need better tools to enable

those kind of communications to happen differently and faster, which some of the modern community development permit processing systems enable.

So we're kind of coming at this opportunity from multiple directions at the moment.

Yeah, I just needed to hear it again.

I think that, I mean, community development is, I mean, I hate to say it this way, but I mean, you guys have taken it on the chin, you know, on review time and some of those things, which we're all working to improve, but tightening up the front-end application

is going to help with that and us saying we're not taking that application because it's not complete so we're not going to start reviewing it.

And I'm not saying that is at the fault of those submitting the application because those submitting the application knows how it's been and know the state of things at Albemarle and we're probably doing that to try to work the system to their benefit as best they can, which I don't call them for.

But at the end of the day, improving the application ends

should allow us to have tighter control over those review points and those touch points.

and I guess just for what it's worth, I know you know this, you've heard me say it before, but when we do review one and it goes back out and comes back in, if review two is hitting on things that were there in review one that were missed or missed, that's a tighten up on our side that we do.

And I'm hoping that this system allows us to track or police that if you would.

I mean, just like I said, there'll be benchmarks or key performance indicators that we should be able to watch

Then I hope that this also tightens up the performance of the people doing the actual work and you can track that as well.

So separate topics.

I'm excited about that by the way.

I think that's going to be a game changer both for our folks and for the folks who are going to business with us.

It can't happen fast enough in my view so I'll just be patient because I know it has to take some time and effort and that even links back to some of the budget conversations.

So the incentive, the point about the housing Albemarle, the incentives in the zoning changes that go.

So let me just, I'm going to say some things out loud just affirm it if I understand it.

The work that has to be done is because we're changing in writing what like the thresholds are for like a bonus density.

The 15 to 20 would be the first one.

So we have to go through and do all those changes.

Yes, there are an array of those kinds of changes.

Some of those changes you already made with the comprehensive plan update that Stacey brought forward earlier this year, actually last year.

So some of the changes have been made, but we haven't rolled them through to the zoning permits.

So it's that integration that needs to happen.

And similarly, if you offer incentives

We need, or we, whomever, if the county is offering incentives, we need to put those into regulation so that we, both we and the developers have an understanding of how those operate and what they get for what they give.

So a bonus density, so if you hit 20% then you get this density.

I mean that's one that can be just cleaned and put into the ordinance.

I guess I see incentives along the lines of some of the things we talked about a month or so ago as a different bucket.

And Mr. Kantner may need to help me with this.

If I'm a developer and I come forward and the incentive that makes the most sense for my development is, I don't know, maybe it's discounting or getting rid of TAP fees or discounting TAP fees.

That one, because of the project, might be really interesting to me as a developer.

It can be done both ways.

As the board knows, performance agreements, depending on the projects, can take a lot of time, but they do

I guess where I'm going with this is that I'm obviously, you know, like the 20% for the raising the bar for the bonus density.

I think that's a clean one that's across the board.

But if we try to say that we're back to my question when Dr. Petey was in front of us about it, we have to, if we think we're going to be exhausted in our list of incentives,

and say those are the only incentives and then there's an extra one or another one that we didn't think of and it's not the ordinance then we need to have the flexibility to still consider those and to me that performance and the partnership allows us to do that but then it can be attached to a performance agreement just like our other past partnerships have been laid out I like the performance agreement piece because then it's dictated on you get this you you achieve this then you get this

So when I start hearing we've got to layer it all into the ordinance, it gets a little too restrictive or inflexible.

If it has to be that way legally, then OK.

But I think there are some things we could say X, Y, and Z can go out, and then others can have some more flexibility in it.

And I'm just throwing that out as commentary when I was listening to the work plan.

It's probably not the right place for me to do it.

but I appreciate responding to the event there, the tangent.

The development in the CD work plan piece, there was a comment about analysis of the development area.

Essentially, the EDO working with Kimley-Horn and our team is doing an analysis of the capacity of the county

Okay, I missed some words in there.

And then the next is just a simple question.

When you were listing, Charles, the small, the medium, and the large lists, and I didn't find it to pull back up.

I remember this when I was prepping for the meeting.

I didn't see the Broadway blueprint in those groupings.

We've actually incorporated it into the proposed work program underneath our proposed projects.

It's a little less obvious, but I hope it helps on your end to go with the review.

I am curious about the review process since it was discussed.

At one point I was told that it was all sort of a first in first out process and this will matter a whole lot less when the whole review takes just two weeks which we're looking forward to but is that correct that first in first out or are there ways in which Comino will also help to sort of streamline which proposals will require

Not, I hope, six reviews, but multiple reviews, whereas which proposal will say, you know, this needs to be looked at once and gone ahead.

Okay, well if I may, I think it may be helpful to differentiate between building permit applications and development project applications.

So six touches business is on the development application.

So that would be a subdivision or a site plan, those kinds of bigger projects.

The building permit applications is where we're aiming for two weeks.

But oh well, I'm not anticipating that anytime soon.

Okay, but even with the building permits, is it a first in, first out, regardless of the scope and nature of the project?

We review them in the order received.

However, a lot of our incomplete applications

are sitting waiting for more information from the applicant.

And so that's where it gets gummed up.

We push them forward from application services into the review cycle on a first come first serve basis as they're complete.

But when they get to plans review, for example, they often sit and wait for things such as trust calculations and foundation

Okay.

Well, I really appreciate it.

I think it's a really important streamlining and helpful process.

I'm also very much looking forward to the development area build out analysis that you mentioned that was just highlighted as well.

My only other question is I'm still trying to understand the process of the parking lot.

And I wondered whether you're looking at this point for any feedback from us

So perhaps I'll wait a moment and then Chair Price certainly this is your domain is how you'd like to run the rest of this.

When we

Sweet talked you all into creating a parking lot for us so we could actually get work done, which we think we've proven we can do when given the freedom to kind of go there.

When we sweet talked you into that, we said we put everything on a project list and we would bring them back to you for consideration.

And as life has gone along, we've modified that slightly because where we found nexus between something we knew needed to be worked on and some other things you all had wanted, we tried to fold those together as best we could.

But now we really are at the place where we have this list of things we have not accommodated

We've tried our best to accommodate as much as we can in the fiscal year 23, but we did it based on our current staffing and our kind of crystal balling on our mandated work levels.

So this is the time to answer your question directly.

that we would anticipate hearing from you all about either other things you want to put on the list or other things you want off the parking lot list and moved into the work program.

But right now, we have our work program fully allocating all the resources we have.

So we're kind of in a swap it out situation where if you all want something off of the parking lot list, we're going to need to figure out what other work we aren't going to do or push it out because we think we fully allocated our resources for fiscal year 23.

If I could, Chair Price, just offer a little bit of historic context and Supervisor Mallek and others could do the same thing.

The Community Development Department is the only department that brings to the board its work program for the year and

It's done so just to some extent in an interest to make sure that there's clarity between the staff and the board about what the work is that we're all trying to accomplish because no other department has as much legislative and policy issues that come to the board during the course of the year and there has in the past been a tendency

to want to do more than we could actually accomplish and that led to frustration on the part of staff and on the part of board members and so there's been a real concerted effort to better align resources capacity with priority interest on the part of the board and so you see in this example of the work program the prior projects that were put on the program that have been completed or are ongoing

and then what we pulled off of the list to try to focus on for the coming year.

And as Jody just said, the acknowledgement that the capacity to the best of our knowledge is fully allocated.

And so there isn't room necessarily for something else, but we don't want to kind of go into

this performance year, right, aligned with the budget year, without giving the board this opportunity to go to say, well, here are some other things that we would like for you to think about.

If it's not necessarily captured for this performance year, then certainly there's some consideration about how it could be folded in later.

So I hope that that's as concise an explanation that I can give of what we're trying to accomplish

So I think I understand it better, although I have to

This is a lot of information and a little different discussion way to discuss it than we've had in the past, which is great.

I'm not complaining.

I just want to make sure I understand.

So we have in fiscal year 23 invest in capacity and we're doing that right now.

and we all have agreed about that.

Underway comprehensive plan, and I'm sorry to be such a singleton about this, but I'm really trying to figure out how I can help you and what you really wanna know, right?

So underway comp plan review, we know we're working on that and modernization of zoning and we certainly have all said that that's got to be done and that's underway, right?

And then you have on this page, not none,

So is this the part where it begins that you all want to hear from us?

Because once I look at 11, we're going to small initiatives for discussion, some of which went away because of what happened in the General Assembly for the most part, right?

But not addressed and then medium initiatives and large initiatives.

So help me frame where we are with what you all need from us right now.

Can I give an example?

So on a number of occasions recently, there has been questions about a snow removal program.

And you would see that on the list of a large item in community development that is not resourced going into the upcoming performance year.

and then we could discuss whether it is or isn't appropriate for community development because I don't know what it is about removing snow from the sidewalks that is a planning, zoning, building or engineering issue but that's where it is right now and that's where it sits.

So that's an example where I know there's been some interest discussion

Supervisor McKeel, you and Supervisor Mallek both have mentioned that recently.

That project is not resourced within community development.

Frankly, it's not resourced anywhere.

So if there's energy among the board around about how do we want to move forward with that, at least using this opportunity to kind of flag that, recognizing that the staff's not going to be working on it without further direction from the board.

I think this is what this conversation is best used for.

Yes, it is.

And so when I'm looking at what's proposed right now, and of course I'm just speaking for myself, but we have wireless facility policy and ordinance.

So what I'm taking away from this page is that you all are proposing to look in the near future, right?

And it looks like it's July, October.

I mean, I'm seeing the months across the top.

The wireless facility policy and ordinance.

And I mean, from my viewpoint, I think that's inappropriate.

That would be something I think that needs to be reviewed.

Am I getting at what we're doing here?

So I'm just trying to work my way through.

Preliminary transportation studies, three-notch trail plan, and then

Well, preliminary transportation studies is kind of a bullet by itself.

And I'm not even sure I know what preliminary transportation studies is.

I'm not sure what you're referencing.

So what that is, is this approach that we've discussed a few times now of wanting to do some preliminary engineering, a preliminary study before we dive into a grant application and find out that a project might be too complex.

So it's taking this initial stab, working with a consultant, doing some preliminary surveying, doing some concepts, figuring out if a project is feasible.

And so we've taken some projects off of Mr. McDermott's priority projects list, other projects that are in master plans and other planning documents.

So are you looking at, and that's very helpful, Charles, so are you looking at specific projects or are you looking at the criteria that would be needed to determine the projects that are not applicable?

You are.

We're looking at specific projects.

So the thing that we're proposing this year is the Free Bridge Lane.

We've talked about potential closure of that, partial closure.

We're talking about the Route 20 shared use path.

Last year, it was brought before the board.

There's a lot of concern about the proposed alignments.

We think of some other opportunities.

It's still a good project, but we want to find out, is there a better alignment that would work?

So these are projects that have been suggested and you're trying to figure out how to prioritize them and where to go with them.

Yep, and kind of do an initial stab to see other major utility issues or other right-of-way challenges.

Well, and so what I'm hearing is that with some amount of work, those are projects that we've been talking about for a while, we can either do them or not do them and get them done.

And so I'm sort of in favor of that.

Do you want us to go through this?

Because this is going to take forever if we all go through this individually like this.

But yes, I would say that we need to either do it or not do it.

So we need to figure out where we are.

And if they're feasible, they're feasible.

And if they're not, we need to put them aside, right?

Correct.

I agree with that.

Three notch trail plan, urban design.

And here's where the place, Ned, where I think Broadway blueprint, small area plan, and we're looking for that somewhere.

And that's where that is.

So I would, so foreign-based code phase two, we've done phase one.

Correct.

If you remember, when we finished and adopted the form-based code, we talked about the next steps that needed to happen.

We needed to start getting into some design guidelines.

We needed to look at the realignment of Fieldsdale Drive and how that impacted the mall property.

We needed to start looking at how do we break up a road network on those really large parcels?

and the Extreme Health Buffer Overlay and Fee Simplification Study.

So you were proposing those and just at first blush from Diantha McKeel, I would say that I agree with those.

I have no problem with those as you're proposing, right?

Now, do we want to go then?

Then how do we get to these small initiatives and medium initiatives?

Because I have sucked up a lot of time and other supervisors haven't even been able to say a word yet.

I would say, as Ms.

Villarda pointed out, staff resources are heavily allocated to what we saw in that proposed list that we just went through.

Right, so if I looked at the small initiatives, I don't see anything on there.

And exploration of public-private partnerships, I think that went back a long time ago, to be perfectly honest with you.

I think with our economic development, we've come a long ways on that.

I'm not sure that

I think we should always be exploring public-private partnerships.

I'm not getting at why that's listed separately unless it goes back to the old days of we were asking what exactly are public-private partnerships and what do they look like, and that was way long ago.

Medium initiatives, I think our lighting ordinance, from my viewpoint, is really outdated and needs to be addressed, but it says here that you're including that in the zoning modernization.

So we can, in my head, I can take that off, right?

So that's really good.

And we've had the stream held, and we've already addressed that, I think.

So that's good.

Then we're down to, and I'm trying to go through this quickly, special events in the rural area.

The one on here that I would be interested in, but probably, I guess I have to understand, home occupations in the development area.

That is an ongoing problem in the older neighborhoods.

and all of our older neighborhoods.

And I don't understand, I guess, the length of time that takes.

We have a list of home occupations and it looks like in one meeting we could go through and check those off and say this is appropriate and this is not appropriate.

Who's the who?

On that one,

That's once again going to be a code impact, so that's where the time takes.

Okay, and then the larger initiatives.

and I was just looking at these, but I think you've probably taken off.

And oh, big audacious housing project.

That was mine.

That language sounds like mine, I know it was mine.

And this was when I was suggesting way before our housing policy ever came forward, right?

That we look at properties on our school properties, you know, the school properties that had extra land and look at possibly some affordable housing for teachers and firemen and police officers.

At this point, I think we could probably take that off the list because of what we're doing right now with the affordable housing.

Because I was the one that sort of put it on there and that's been years now.

So I'm comfortable if you take that out because I think we're doing a lot of really good work around affordable housing now.

Maybe that helps a little bit.

Or is it something that is a bare bones that we then have to customize for our own locality?

No, it is not going to beat their bones.

We have figured out that that is long term more costly than buying something fully integrated up front.

It's good to know I can take that one off my list because that's thinking back to all those years ago when we were so proud of the fact that our county didn't cost less than somebody else's and then boy did we pay for that later.

So that's great.

Let me zoom down my list here.

So for some reason I thought we had a solar ordinance for sort of utility scale I mean based on the property that we very quickly instituted some rules so that we could do a special permit for the land up on 53.

Was that not an ordinance that was just a set of performance standards or something?

That's correct.

All right.

I am so thrilled with all the work that you all are doing to raise the standards for applications.

And this has been a wheel that's been going round and round and round and round for a long, long time.

While it may feel like punishment to some people who don't do a good job, it is so much better for all the people who do spend the time to pay their staff to do their application properly instead of dumping it on you guys to have to fix it for them.

I mean, this is a third graders, you know, wanting to let the teacher do all the corrections and then go fix it or something.

So I'm really glad about that.

I know it's been horribly difficult to get there.

But and if you get lots of people yelling at you, you can just say, well, I've got one supervisor, at least this is a really good idea.

And I know that it will help in the long run.

Also, it provides

That was something else.

Clarity for equal treatment is really, really important.

We can't have different rules for different people or even the perception of different rules for different people.

So that will help a lot.

Me, I'm looking for my all caps things that I've written down here.

so excited about the dashboard.

I know that used to be way long ago there were all these excel sheets that were flying around all the time and we really could check and see what was coming what was where and we have all missed that a lot so that is going to be eagerly eagerly anticipated.

Is there a relationship

in the priorities that you all see between the number of complaints that come in about a certain type of activity.

And I wrote this down in relationship to Supervisor McKeel's question about home occupations in the development area.

I think, Supervisor Mallek, I'd love to ask our zoning administrator, Bart Swoboda, to weigh in on this because that area is under his leadership.

Ms.

Mallek, Supervisor Mallek, if you don't mind, can you repeat that for me?

So I know it's impossible to have in our work plan in any one year all the different issues that each of us and our districts have.

But just using home occupations in the development areas as an example, it's not on the list right now because it requires a lot of implementation into the rest of the code.

If that or some other issue turned out to be something where there were just lots and lots of complaints that your department has to deal with, does that push it up the list a little bit to try to get those code things solved so that we wouldn't have to have all those

and staff hours spent.

So kind of speaking a little bit out of turn, since we kind of set the work program and the priorities that we do, but also using say home stays as an example, as you notice through the ears, home stays actually has not appeared on the work program.

But it did become an issue.

It was something we consulted, you know, with

the kind of executives office with the board about making that a priority, devoting some resources and understanding that it would push some things or delay some things.

So if I use that as an example, when we identify kind of a critical issue, then we would likely make those adjustments kind of through the proper channels.

It does.

Yes, now that I've had time to process everything and also through the extensive questions from Supervisor McKeel, which I actually do appreciate because it got my brain going.

On page 9, I really do like how you've laid that out and I'm really anxious for the wireless facilities policy ordinance to be updated.

I'm really looking forward to that.

I like everything you have done.

The home occupations that Supervisor Mallek just brought up, could you give me an example of something that

is or would not be acceptable, that this is like not what we want.

I'm just trying to understand it because I know so many people are working from home now, but I know that that's not what Supervisor Malek is talking about.

So what I have issues with in my older urban ring neighborhoods that have no HOAs is we have landscaping as a whole occupation.

Home occupations are supposed to be not seen and not heard.

People working from home on their computers, that's not a problem.

But when you have people with a home occupation as a landscaper, it means trailers, it means trucks, it means work vehicles.

Does that help?

No, no, no.

That definitely helps.

And I do know that we passed something saying people couldn't park on the street.

But then that means that they would be on their front lawn or maybe in the sidewalks because there's not enough room, correct?

And that's what we're trying to avoid.

And I will say that a lot of these older neighborhoods, right, that have these problems

are not folks that are tuned into complaining, right?

Totally understand and agree.

And I will give a shout out to Camino because I do know that that launched.

I do know that that went out, was sent to everybody.

And I'm just going to read one sentence from it because I sent it to a couple people I know and they're already very excited.

Our users can complete applications and send online payments

enabling faster processing times.

This is all done online.

From what I understand when people, the time it costs from getting a building permit, it's because something has to be redone, rewritten.

But if you see it and you say, no, X, Y, and Z has not been completed, we're not even going to look at it.

I think that's what you're proposing.

I'm not sure.

Am I speaking out of turn?

Toni or Ms.

No, it's a yes and.

So what we're doing now is we're walking people through all the stuff that we need to make up a complete application.

And so when they put all of that together and they pay, they actually push the submit button and we have an integration process that picks up that building permit and sends it on through the county.

And then our application services people take a look to make sure they've got everything.

But from there, we're off to the races.

It's a yes and I think is the answer to your question.

Is there a way when they fill out the application and they don't fill in a couple things that is needed that instead of that, does that go right back to them?

They can't start.

They can't submit because they've still got things that are not attached that we need.

Okay, well then that sounds like you've solved the problem, I hope.

But anyway, thank you, I like it, it sounds like it's going to be great.

All right, quickly, as I look at your work program, as I participate in the night, in the evenings at CACs and board meetings with your staff, as I look at the work that you perform, I have to ask the question, what do you do in your spare time?

I mean, really, I have to commend staff for the work that y'all do.

For Camino, does that work for existing already submitted applications?

Or is it just picking up new ones?

So if you have an existing

Yes, this really just applies to getting new applications into the system.

I appreciate the parking lot approach because even in the first two years it was obvious that the CDD was, you know, filled to the gill with all of the work you could do and the supervisors are just adding more and more.

So putting them in the parking lot allows us to mention things, not forget them.

but not interfere with the workload that you've already decided.

I would take nothing off.

I would not ask to take anything off the list that you've got.

I would say though on slides 11, 12 and 13 of our hard copy, prioritizing for the next available opportunity for consideration would be the utility grade solar array zoning ordinance updates.

I do expect we're gonna continue to get a lot of those

applications, for the medium initiatives, special events in the rural area, and for the large initiatives, the VDOT corridor studies on 250 and 29.

But again, I'm not asking to take anything off of what you've already got.

These would just be from one supervisor of the ones that are listed my next priorities for consideration when the time comes.

I want to endorse the the Supervisor McKeel was talking about the public partnership piece.

I think that can come off.

I think that we do that work in other ways.

Same with the big audacious housing project.

I agree with that comment, but I just say we need to be ready if something popped up.

We've proven that we've been ready before.

Southwood's a good example of that, so we just have to make sure that we retain some capacity for the unknowns when they come up, even though they might not be on the parking list.

I would throw into that bucket for removal the opportunity zone.

The opportunity zone continues to go, and I think that really just gets incorporated into Project Enable as a tool that, if needed, it's the same thing as a public-private partnership.

If the developer or whoever says, I want to use a P3 to help us figure it out, great.

If I want to use things under the opportunity zone, great.

I perceive, especially where we're at on timelines with the opportunity zone program and all the dates and everything that's incorporated with it, that that needs to be on your parking lot list for the future.

So I think you could free that out of your list as well.

And then my final comment would be the

Good afternoon, Board of Supervisors.

Thanks very much for this opportunity.

Yes, I'm delighted to be with you this afternoon to present the Fiscal Year 21 Report of the DSS Advisory Board.

And joining me for this presentation is Emily Dodson, Advisory Board Member of the Scottsville District, and Mary Stubbins, the very competent Deputy Director of DSS.

Yeah, so I'm Emily Dodson.

I represent the Spotsville district on the advisory board.

So I will be presenting the Department of Social Services annual report for the 2021 fiscal year.

I'm ready for slide two, Kaki.

So we've had a few changes to the advisory board roster.

Therefore, we've included both the 2021 board members along with the current board members for each of the districts.

So the theme for this year is creative pivot for community well-being.

One of the most exciting figures from the year being that the Department of Social Services provided services

to nearly 24,000 Albemarle County residents over the year.

So next, we're going to cover specific services that were provided over the year.

When it comes to adult services, 687 members of the community received support and care.

4,226 individuals in the community received SNAP or Supplemental Nutrition Assistance Program benefits.

Over 800 referrals were made to Child Protective Services.

Of those referrals, 378 were validated opening cases for further review.

Almost 15,000 members of the community were enrolled in Medicaid.

Just over 2,000 patients at UVA who were otherwise uninsured were able to receive benefits.

And when it comes to energy assistance, 1,313 households received benefits to either warm or cool their homes.

So next we'll take a little closer look at the services that were provided to families in our area and here I just want to note that the department has really focused on keeping families together.

109 families totaling 514 individuals were aided through family preservation services with the goal in mind to keep those families safe and together.

Community-based services assisted an average of 83 families per month

with the goal to build resiliency.

Of the youth who were identified as imminent risk, 75% were able to be placed with family or friends.

It's also important to note that the department is doing well when it comes to the state level in order to keep children with family.

In 2021, 13 adoptions were finalized.

So taking a deeper look into housing, on a monthly basis, 394 families received a housing voucher.

In collaboration with DCHC and Habitat for Humanity, county staff worked on the Southwood Neighborhood Initiative for sustainable permanent housing within the community.

An affordable housing policy was adopted by the county.
