Board of Supervisors Regular First Meeting   8/2/2023

Good afternoon, everyone.

I'm pleased to call to order this regular meeting of the Albemarle County Board of Supervisors at 1 o'clock on August 2nd, 2023 in Lane Auditorium.

The supervisors who are present are Supervisor Andrews from the Samuel Miller District, Supervisor McKeel from the Jack Jouett District, Supervisor LaPisto-Kirtley from the Rivanna District, Supervisor Ned Gallaway of the Rio District, Supervisor Ann Mallek of the White Hall District, and myself, Supervisor Price of the Scottsville Magisterial District.

A quorum is present.

I'd also like to mention that at the dais today we have our County Executive, Mr. Jeff Richardson, our County Attorney, Mr. Steve Rosenberg, our Clerk, Ms.

Claudette Borgerson.

and I would also like to welcome and introduce our Albemarle County Police Officers who are present today, Officer Andy Muncy and Officer Kate Kane.

As you can hear in the background, some of our first responders are responding to an emergency.

Board, we're ready to move to the adoption of the final agenda.

However, I do have a few comments.

First off, we will be adding item 8.5a

A resolution to change the start time for the August 16th meeting from 1 o'clock to 2.30 p.m.

This was added to the consent agenda online yesterday on Tuesday, August 1st.

Additionally, item number nine, sub-2023-00034, Colonnade Drive petition for abandonment, has been withdrawn at the petitioner's request and is removed from the agenda.

Additionally, immediately before our meeting commenced, I was advised that one of the consent agenda items for appropriations has an amendment modification that needs to be made

It's to delete the letter A. Is it 8.3 or 8.4?

We can now move to item number five, brief announcements by board members.

Yes, just one thing I wanted to note because I've been seeing them come in that we engaged the community often with surveys and I know that there was a survey previously that had been discussed about AC44 phase 2 which is now closed but there's a riparian buffer overlay district survey that is open until August 13th so I'll call people's attention to that and VDOT has now opened up a couple surveys based on

some road projects including Ivy Road and 250 which is in Samuel Miller district a little bit affects Jack Jouett a lot and Barracks Road as well.

I don't know what the closing dates on those are but I do hope people take advantage of those.

So these surveys are out there.

I have Street Sweeper still open as far as I know but I don't know what the date is on that.

That's a little less crucial as far as

getting it in on time.

The VDOT surveys are at VAProjectPipeline.org.

Look under the Culpeper District and I think the others are under EngageAlbemarle.org.

I just think it's important to get that input.

This is the season for revalidation for anyone who is participating in the Agricultural and Forestry Open Space Land Use Property Tax Program and the deadline is approaching for fee-free

or No Charge Reapplication is approaching very fast.

It is September 1st.

Everyone who has participated in the program or has applied to join the program should have already, weeks ago, received forms.

So if one has not received forms, please call and come down and get them from the finance department.

And if you have them in hand, please expeditiously get them filled out so that they can be received on time and processed.

So that's the sort of highest priority one.

Service Dogs of Virginia is offering a wonderful demonstration of Puppies in Training this Sunday, August 6th at the center at 1.30.

It is a great way to see how the program works and what goes into creating a companion animal for someone in need.

And they do a fabulous job.

Living Free Together is a nonprofit organization supporting veterans and military families of the greater area.

They're hosting their second annual Ruck the Ridge event, which is on Saturday, November 11th, which feels like a long way away, but it will be here in no time.

It will be held at Blue Ridge School in St.

George, Virginia, just the northwest corner of the county.

The little section, which is in the seventh district of Congress, lucky those people, and it's just 20 minutes from the airport.

Proceeds from the event will support the programs for our local military and first responder families.

It is a unique adventure.

Participants choose from multiple routes that are perfect for trail running, walking, or hiking.

Children are welcome.

They can participate individually or as a team, choose the length of course and whether to wear a ruck or a weighted backpack.

They also choose which events are obstacles to tackle.

Everyone who attended last year had a blast and I could not and will not this year either because of the conflict with our November 11th ceremony here in the County Office Building.

But I wanted to bring this to people's attention so that they can find out going to Living Free Together to get all the details.

I very much enjoyed reading the Lupeck Report that was in our Agenda Pack at this time and was especially amused.

by the cartoon.

So if you have not opened the presentation from VDOT and seen the wonderful eight cartoon things about a swing set and what one really needs goes through the whole process and leaves you at the end with the tire and the rope, which says the swing the user needed, wanted, and could afford.

And that's very much in line with what happens to a lot of our highway projects nowadays.

As I heard some surveys out there, I will throw one out.

The Charlottesville Albemarle MPO is working on moving toward 2050, which is the long-range transportation plan.

If you put in the old Google machine CA MPO moving toward 2050, it'll take you to a page where you can complete the online survey asking for thoughts on our regional transportation system.

It's a pretty clever little system that they have in there.

You know, these surveys, it's funny to me that if you don't get great participation, the presentation of the results act like thousands of people have given us input.

So we would like to get over the hundreds that have so far.

So anybody that would like to take it or other supervisors could encourage in their networks out.

for folks to put in their thoughts.

And then there will be pop-ups and open houses that are coming up.

So those are listed as well on that web page.

So again, that's Google up the TJPDC moving toward 2050 or CAMPO moving toward 2050.

All I have is just to piggyback on the surveys that Jim was referencing in the Jack Jouett and Samuel Miller districts, Abbey Road, Old Abbey Road in the Barracks Road area.

The date, those surveys are open through August the 18th, just so folks know.

Yes, I just wanted to highlight that last night was the national night out for our police department.

and they were in several locations throughout the county.

I know it was a wonderful event because the one in my location on Avmore was delayed until tomorrow, excuse me, until tonight.

So for those of you that are out there, live near Avmore in the Pantops area, it will be from 5.30 to 7.30 tonight.

I will not be in attendance unless I'm excused by the board.

But I'm sure it was a great event.

It's something to celebrate.

Every first Tuesday of August, they have a national night out for the place.

things for children, for adults, and they bring out the motorcycles and the vehicles and I was looking forward to that, but darn, okay.

Following up on National Night Out, I did make it to the first two locations and I really want to give our Chief of Police credit for

working on different and innovative ways for this event to happen.

In the past, which I thought was a great way that they did it, last year at Stonefield, it was one location, come to us, this time it was four locations, go to you.

The other thing that was nice was the opportunity to talk to the leasing manager or operational manager of several of the apartment complexes where they did meet.

Average occupancy rate in those complexes is right at 95 percent.

and so it was just another indication.

I'm also talking about the average price of one, two, and three bedroom apartments, which of course is data that we get, but it was just the confirmation of the cost of housing in our area, and I really appreciate how many of the local residents came out.

It's really good for them to see and interact with law enforcement in a non-emergency situation, so it was really good.

I think that the frozen pops and the popsicle truck were really the ice cream truck were the key.

Saturday, starting at 1030, is a dedication at Southwood.

Several of the supervisors will be there.

It's really exciting.

This staff and this board, well before I came onto the board, have been working on for this incredible

you know first in the nation type of product on a redevelopment and hope a lot of people will be able to make it.

There's going to be a blood drive at 5th Cobb next Tuesday between 930 and 3 o'clock.

Blood is always critical in demand and hope that people will be able to join.

The Albemarle County Public Schools will have their annual convocation on the morning of the 15th of August at Ting Pavilion and Supervisor McKeel will be a key speaker at that event.

I'm looking forward to being there and hearing her.

And on the 18th of August, Albemarle County will host a meeting of the Virginia Council on Women, a board of gubernatorial appointees who are focused on issues that affect women, which means issues that affect families, which means issues that affect everyone.

So I'm really excited that Albemarle County will be hosting that.

I got carried away with the cartoon and forgot to mention a very important announcement VDOT is holding design hearings for items.

There are six items in the design bundle two for smart scale and the two dates are September 19th, which is going to be at PVCC and

and September 21st at the Center at Belvidere.

Both in the late afternoon, I think five to seven is the time, so this is a really important time for people who live near or are interested in those projects.

That includes the work at Belvedere and John Warner Parkway.

It includes the Trestle Roundabout in the western part of the county on 250 and three other projects, one on Pantops and there's another one, Avon Street something or other.

So I'm sorry to be so vague about this but please check the VDOT website and show up.

Yes, I just wanted to make the, for the police night out, that will be at 1540 Avmore Avenue in Pantops.

So for those of you that can attend, that would be, it's going to be another great event and yes, you're right, the truck will be there with ice pops.

We can move to item number six, proclamations and recognitions.

We have none.

We have a couple of people speak.

During the time set aside for matters on the agenda but not listed for public hearing, individuals may address the Board of Supervisors concerning matters previously considered by the Board or matters that are pending before the Board, other than items listed on the agenda for public hearing.

Individuals are allowed one opportunity for up to three minutes to speak at each board meeting.

The sign-up sheet is managed by the clerk's office.

Timekeeping is conducted through a timer and light system at the podium.

The green light will go on when you begin speaking, which begins your allotted time.

The yellow light indicates you have one minute to finish speaking.

The red light indicates your time has expired and you'll be asked to end your comments.

To give all speakers equal treatment and courtesy, the board requests speakers adhere to the following guidelines.

When addressing the board, state your name and if you live in Albemarle County, your magisterial district, please address comments directly to the board as a whole.

Any written statements or other supporting material may be given to the clerk.

If representing a group or organization, you may ask others present to raise their hands in recognition.

Speakers may not share any unused time with another speaker.

Back and forth debate is not permitted.

Please do not speak from your seat or out of turn as all comments are live streamed, recorded, and published on the Albemarle County website.

At your last meeting, there was a question asked about where we stand with ranked choice voting and I'd like to comment on that question.

In November, the board conducted two work sessions and concluded that ranked choice voting was quote unquote not ready for prime time.

That was the correct assessment at that time.

However, by January, the Virginia Department of Elections

had issued guidance that cleared up all major questions relating to certifications, costs, acquisitions, and the like.

But by February, it was too late to implement in 2023 because you assessed, correctly I might add, that RCV should be first used in a primary before being tried in a general election.

In April and May,

You responsibly and proactively allocated $65,000 in the budget for RCV.

But by then, May, it was prudent on your part to wait to see how RCV fared in the Arlington primary elections.

Even though Arlington ultimately decided not to carry RCV forward to the general election, the conduct of their RCV election was exceedingly smooth and without incident.

Post-election surveys showed that 70% of voters were happy with their RCV experience.

By the way, the Arlington decision to pause RCV was the right decision for them.

Because post-election surveys also showed that while 49% favored going forward, 51% did not or were either unsure about going forward.

based on a poor understanding of how RCV tabulation works in a multi-winner election.

But that issue does not impact Albemarle.

It is now post Arlington and nothing stands in your way.

Every month you hesitate, action on RCV is one less month the county registrar has to plan for RC implementation and education.

RCV is a process.

The board must first pass a resolution, non-binding by the way, and then wait at least 30 days after that to address the ordinance.

Furthermore, advocates for ranked choice voting recommend that you initiate public comment at least 45 days before the resolution in order to hear from your public.

When I go to Farmers Markets and give out RCV information, the question I hear is, is this a real thing?

Citizens have no knowledge because their leaders are not talking about it.

It is now time to talk with county residents and find out how they feel about this simple change to their ballot.

I'm Johnny Hall from the Fry Spring neighborhood in the city.

I'd like to tell you that I'm picking up some really good traction on one of my inventions, a solar-powered bus shelter.

You can see in the upper left corner of the poster that I put in front here.

I was told that I should try to meet with Garland Williams.

Garland Williams is the Director of Charlottesville Area Transit and I've got an appointment with him on the 14th of this month.

The solar shelter should be viewed as government assets because they continually will pay back to the grid besides offering ports to recharge cell phones, laptops, and palm tops.

They feature comfortable stadium seating, bike and scooter racks beside them, dome lighting at night, 911 call boxes, and arrival departure screens to upgrade bus service.

I've even thought of 260 volt socket receptacles for charging electric buses and cars in the future, if that need arises from them.

that I will bring to the meeting here.

I will mention the need to work with Dominion Energy to give them a free street easement and $5,000 per mile for their engineers and planning strategic undergrounding of cable services.

Get all these overhead cables and telephone poles out of sidewalks and underground.

I think it's important to perhaps consider hiring me as a consultant to Jessica Hirsch-Bellering who's going to speak at 3.15 today and you're talking about the transportation study update that was presented I guess last year sometime

and we worked together to drive forward into the county, you know, having solar-powered bus shelters that I'm talking about.

You know, I think I'll be able to, after I talk to Garland Williams, maybe meet with our new city manager.

That was my first

step forward to bring this up.

Rivanna Station Futures due diligence update.

Good afternoon, Madam Chair, members of the board.

It's my privilege to be here once again in front of you talking about this important project.

I, along with staff, will provide brief updates on the work, the extensive work that we've been doing in the area of feasibility and due diligence.

Board took action in May.

Mr. Henry, if I could interrupt for a second.

It's not showing up on this monitor.

I'm not sure if it's not turned on.

All right.

Thanks for the technical assist.

So today we'd like to come back with an update on where we are with the work of our due diligence.

I'll present briefly out the front end and then I'll come back in and talk about some of the partner engagement work.

which we're moving into full speed over the next couple of weeks.

But before that, Blake Applinalp, the chief of our facilities planning and construction division within our facilities environmental services department will walk through an update on our due diligence work.

Jacob Sumner, our CFO, will talk financing and again I'll wrap it up.

We will break at the end of each of these sections for any questions that the board may have.

Kind of bottom line up front, we are I think in a good place for the work that we've done to date as far as our due diligence work.

We're assessing

In the ground infrastructure, we're assessing environmental, we're assessing leases, title reports, infrastructure that is out of the ground, and so far so good.

We haven't covered a few things that we'll continue to work through, but as of today I think we're in a pretty good shape as far as our

assessment of is this buildable to the degree that we think it is buildable, and so just wanted to get that out front, not to steal Blake's thunder, but so far is good news.

We're not done.

We still have a little bit of work left, but I think we're in a good place, and it's been a great team effort to get us to today, and so unless there's a question just on the agenda, I'll stand down and let Mr. Applenau walk us through the next couple of slides with an update.

Good afternoon, Madam Chair and the Board.

I am Blake Appelau, Chief of Facilities Planning and Construction of FES.

and I'm real happy to be here to give you a status update on the due diligence as it relates to the engineering side of things.

Our efforts in due diligence, just as a reminder, have been focused on assessing the condition of the land, the existing improvements, the obligations that are there, any risk factors that we could potentially run into and confirm that yes, indeed, the land is, you know, developable for the intended use of the county.

and we just last Friday received the draft report from our consultant, Line and Grade.

and currently we're reviewing and providing comment back to them.

And our team continues to meet every Monday at noontime with representatives of the Executive Office, Community Development, County Attorney's Office, FES, Economic Development, Finance, CDD if I already said that, but so it's a true team effort trying to work together to really vet this in the proper way.

And we move on to the next slide.

There we go.

And our lead engineering firm, Line and Grade, as I had mentioned, they've now completed the majority of their work.

And if you look at this slide, everything up there in green has been completed.

And only a few things left as part of this first phase, which under their contract is actually a couple different phases, but we refer to it as first phase for this presentation.

The third item there I think is of particular interest the geotechnical subsurface investigations and there we performed 20 10-foot deep soil borings and 15 of them were on the proposed alignment for the road that would go out to Route 29 but that helped us inform

the engineer as to where they might make subtle changes in that so that we can do that conceptual design and put that road in the right place.

And then the other five borings were done at potential pad locations for the future.

So we wanted to ensure that the areas that we're thinking could be potential building sites are the right places for them.

Also the ALTA survey work, that will be done relatively soon, probably in the next couple weeks.

And that will be beneficial for Mr. Rosenberg's team, where he can go ahead and it will help with them in their title examination review.

And that's kind of the final piece they need to complete that work.

We also conducted preliminary fact-finding meetings with Rappahannock Electrical Cooperative, Rivanna Sewer and Water Authority, the Albemarle County Service Authority, and Charlottesville Gas, and there'll be many more meetings in the future should we go ahead through with the sale.

All right, staff have been reviewing existing legal agreements and inspecting all the improvements on the property.

And we had representatives of FES go to the site last week and inspected the rental home that's out there, mobile home.

There's a vacant house and several barns and sheds on the property.

One thing that's of particular significance from a cultural standpoint is there is an existing cemetery, the Pritchett Cemetery there.

and that was studied by our archeological consultant who happens to be the same firm that did the work over at the courts.

And they are recommending that we maintain as best we can a 50-foot buffer between any kind of development and the cemetery.

And Virginia law also states that we have to as an owner, if we take that next step, provide access to any visitors or family that want to visit the cemetery of that nature.

There's about three or four ponds and then a number of streams that actually factor into the contours of the property.

But in this case, you can see Greens Pond.

We've inspected the dams.

We had consultants and internal staff.

Greg Harper from Environmental Services also is our county dam inspector.

And right now we've considered both of them to be serviceable and in stable condition.

Along the perimeter of that seeing greens pond is this structure in particular that's of interest, I think.

This slide you'll see some of the condition, you know, this was the inspections that I previously had mentioned out there and this was part of that inspection and you can see their varying conditions and, you know, determination will have to be made in the future.

as to their status moving forward.

In summary though, I think there's some real good news coming out of the report and the work that we've done.

And from an engineering due diligence standpoint, all the things that we've been examining, the risks associated with liabilities are very low on this property.

is what we've determined.

There's some aging infrastructure that will need some investment.

An example being that you look at the spillway there on that one particular dam and I think both dams spillways will need some minor repairs.

But I think the really important statement that was in the executive summary on the report was there's been nothing discovered to date that would suggest that the land is not suitable for purchase and development.

Alright, let me just look to see any questions at this point, Board.

So, I'm very grateful of the respect for the cemetery and it would be descendants.

I think the law says descendants can have access but not your average tourist.

So that will make it a little easier for you to manage, I think.

These water features, which you showed, I think are tremendous assets.

Even though they're tricky, they're tremendous assets for both the quality of life of the people who work on the station as well as any other healing activities and things that we've heard about lately.

Yes, thank you for this really good report and good news.

Help me understand access to the graveyards that we need to provide it and certainly would want to.

Expand a little bit on what access means.

I'm just curious.

Great question.

This is an area that we would certainly circle and work through as we continue to build out the design and the concept for the rest of the site and the ICAC, the immediate area that we talk about.

An example would be that we likely would not want to include the cemetery within an expansion of the fence line, just based on the nature of access to that sub-installation.

There's a complexity to having outside non-cleared folks access.

So it likely would be such that it would still be accessible through public access similar to what it is now.

Okay, great.

That helps me a lot.

I just wasn't sure what access meant.

Yes, so the rental home of the other, I guess that's a shed or something, that's no, you have people living in the rental home now and they would be notified and given enough time to vacate.

And last question regarding the pond, is that

The water would be provided eventually through Rivanna and Albemarle County Service Authority.

Good afternoon Chair Price, members of the board.

My name is Jacob Sumner.

I'm the interim chief financial officer for the county.

Today I'm going to give just a brief update on our financing plan, just a little reminder of where we are at in the process.

We just talked about some good news and the due diligence effort, and based on those results and the presentation today, we're going to continue moving into the next phase from a financing perspective.

So the next phase and the next time that will be before the board to discuss the financing will be at the September 6th Board of Supervisors meeting.

At that point in time, we will bring forward bond resolutions that we will ask the board to take action on.

And that really starts the formal process to issuing the bond anticipation notes.

The next phase, after we bring the resolutions to the board, is to go to the Economic Development Authority.

They will be the issuing body for the bans.

And we are on their September 19th agenda to bring the bond resolutions to the EDA.

Just as a reminder, these are public sale bonds.

These bond anticipation notes, we are, as a staff, working on the preliminary official statement and are currently working on our rating agency presentations.

So we'll need to go through the full credit review as we typically do with our normal bonds, even though this is more of a short-term financing structure which we've established for this project.

That's all the formal remarks I have.

Working our way through, really talking about the work that has been occurring outside of the assessment of the engineering and the financing.

This is with our partner work.

I just wanted to start with a reminder of what the board has taken an action on for us to close on.

The orange red is the existing facility, the Rivanna Station owned by the Army.

The green is a commercial building that has been upfitted and leased by elements of the intelligence community.

I'm unable to do the cursor thing quickly here, but if as you're coming in Boulders Road, Supervisor McKeel, you see kind of right where the word Boulders Road are to the immediate left as you're coming in towards Rivanna Station.

That is an existing parking lot.

There's a lot of staff that park there.

Just on the other side of that is where that cemetery resides and what Blake talked about a little earlier.

So that is where it is physically located.

So our effort really has been working on the feasibility and due diligence around moving forward into a closing state and so far so good on that.

I mentioned at our last meeting in July when I was in front of you

about JT Newberry and I were on our way up to DC for a regional symposium from the Association of Defense Communities to talk about encroachment.

And just reporting out from that meeting, within our defense infrastructure in the nation, there is a real clear and present threat of encroachment by foreign entities that are buying land around key military bases.

This work was mentioned and has been lifted up and it was my understanding it was also mentioned down at a NACo conference recently as an incredibly strong leadership move for local government, Board of Supervisors to take action to recognize this risk to help preserve the existing missions and to then also offer opportunities to grow it and so that's

That is affirming and it was just coincidental to the timing of our last board meeting.

Next slide.

This is a view that we have not shown the board previously.

Our focus certainly is and will continue to be around Rivanna Station.

But we thought it would be good to kind of elevate our aperture

to 30,000 feet.

And what you see on the top left is North Fork Discovery Park.

They have approximately 500 acres, a little more than that, of developable property.

You can see our Rivanna Station and the acreage that surrounds that, the 462 acres.

And then just up the road is Greene County,

They, as a county, have adopted a defense production zone, but they've also done some comp plan work in Rutgersville for about another 500 acres that is really geared in use to support the defense industry.

It is my belief the more we work with our partners at the state level that have engagement in to the federal level too is that we have an amazing opportunity to not just preserve what is there now but to turn this

this corridor into an intelligence and technology hub that will support the intelligence community and our national defense now and for decades to come.

And so there will be a lot more that we'll talk about that, but that is just a view that I thought is impactful and I wanted to make sure the board saw this.

So our focus, you know, with the state is on the blue, the aqua around Rivanna Station,

but it's within the context of this opportunity as a region that we believe will resonate well at the state and DOD levels.

This is just a slide to show some of the partners that will continue to be working through.

Our focus in near term is with state support and then we'll be branching out to federal, private and academic after that.

We have a meeting, spent about 90 minutes this morning with the state getting ready for next week.

Mr. Richardson, myself, and a few others will be down visiting Secretary Crenshaw to provide an update and workshop this with then follow-up

presentations and meetings within the rest of the state secretariats leading to the governor in August.

The secretariat meetings will be likely through August and into September.

That will launch work that we're doing at the federal level and then having preliminary discussions with academic partners September and beyond.

I also wanted to note we have been doing good partnership work with Rivanna Station and it's a bit of a segue off of expansion of this particular mission but it's really work that we're doing now partnering but I felt like it was relevant to raise, especially we have a few minutes this afternoon, just over the past month we've had a couple of engagements

with Rivanna Station and that our Fire Rescue Department coordinated training at their, if you drive up 29 North you see the tall crane that they have as part of their addition project.

It's an opportunity to do high elevation rescue training that, you know, we don't normally have that ability here in the county.

And so we had a very successful training session

with the contractor and it was sponsored through Rivanna to do that work for our public safety folks and that we're going to have return trips up there for continuing practice.

So just an example of I think really good partnership work that also led to them observing our active threat training a few weeks ago that was very successful in

and flexing that arm of response and that we have been invited to collaborate with their on-base security as they are preparing themselves for that work with a drill sometime in the fall that our public safety department will have an ability to engage with and support.

It's not really engagement related to funding and moving the project forward from an expansion perspective, but I just wanted to take a moment because I think that that is really good work and reflective of a building relationship that we have with Rivanna Station now.

I know several board members, Mr. Richardson attended the change of command last month that you've mentioned already and how successful that was.

So next steps is we complete our due diligence.

We will be sharing the formal report with the board once that is in final state over the next couple weeks.

Continuing the other areas that were not quite green as far as the ALTA survey, boundary line adjustments, etc.

And then we'll be back formally in front of the board at the September 6th meeting asking for financing action.

And with that, I would open up for questions for any of the content.

Back in the 80s when this land was brought into the growth area, it was felt to be way out there like Mars, but now it is really part of everything north of the river here as far as what Albemarle is up to.

The technical, what I call the nitty-gritty work on what we have in front of us is these folks have just really stepped up in a big way and I can't thank them enough.

You know, Mr. Richardson, this county really has demonstrated some incredible leadership, not just on the local level, but really what is on a national level.

of Rivanna Station, Rivanna Station Futures, this industrial, you know, technological zone, Southwood, you know, again, a first in the nation sort of a project.

Good afternoon Chair Price and good afternoon board.

My name is Albert Karina Plun.

I'm a transportation planner in community development and today I'm joined by my colleague Jessica Hirsch-Ballering and Kevin McDermott.

This presentation will cover most of our transportation planning efforts but we'll be focusing mainly on funding for smart skill and revenue sharing projects in the interest of time.

I'll start by giving you some updates on different projects and then I'll pass the baton over to Jessica where she will cover smart skill and revenue sharing.

So starting off with the VDOT project pipeline, the project pipeline is designed to develop a pipeline of high priority projects that address identified V-Trans needs and may be considered for implementation through smart scale, revenue sharing, etc.

V-Trans is the Virginia statewide transportation plan.

The V-Trans needs identified in that plan are aimed at addressing the state's most critical transportation issues over the next 10 years.

These needs include congestion, travel time, reliability, safety, transit access, etc.

The program does this by supporting studies with a focus on priority locations and corridors adopted during the V-Trans process.

So, this being said, the VDOT project pipeline program is about to kick off two studies here in Albemarle County.

The first study is Barracks Road.

This first project pipeline study would look at, it's intended to identify projects to address transportation concerns, including bike, ped, and transit along Barracks Road between Georgetown Road and Emma Street.

The second project is the US 29-250 Ivy Road Study.

This study is intended to identify a suite of projects to address a variety of transportation concerns, including bike, ped, and transit,

along the old I-P corridor, the adjacent U.S.

250 I-V Road corridor, and the U.S.

29-250 interchange.

The study would include the area where the triangle about had been proposed at Old Garth Canterbury 250.

This proposed triangle about is on hold until the study is complete.

Ultimately, the study will take a more comprehensive look at the area to improve operations and access more broadly.

Staff right now is currently working on organizing a corridor focus group for this project.

This is a group of key corridor stakeholders slash leaders identified by the county.

The corridor focus group element is anticipated to be used specifically for the Ivy Road corridor study.

Coordination with these groups will be led by the county with outreach designed to gain input from these select groups who live or work within the project pipeline study area.

the county will bring back to the stakeholder working group citizen concerns and identify needs as well as vet initial and preferred or initial and final preferred alternatives.

Next we have some more efforts.

transportation planning staff in collaboration with Albemarle County Public Schools was awarded a VDOT Safe Routes to School walkabout meeting grant for Woodblock Elementary.

A walkabout with stakeholders from Albemarle County, local VDOT staff,

Woodbrook Elementary, Safe Routes to School and as well local residents from that neighborhood was conducted in April and in late June we received a report from Safe Routes to School with recommendations on improvements we can make to improve walk and bike ability for the neighborhood in both the interim and the long term.

Now we are working with VDOT on how to implement the recommendations from the report.

We'll be applying for more of these grants with the Brownsville Henley Campus in Crozet being our next target for this upcoming fall of applications.

for the secondary six-year plan.

This is adopted past May with the real rustic consent agenda being adopted this past July and work starting now.

As requests come in from Board of Supervisors or from citizens, we'll reach out to VDOT to do paving feasibility studies for these roads and update the project priority list as that happens.

Finally, the three notch trail, we have submitted a draft agreement submitted to the FHW for your review and the grant agreement will likely be refined over the last quarter of this fiscal year.

We still plan to release an RFP for consultants for this project late in the first quarter of FY24 and begin work on the project shortly after that.

Now it's Jessica's turn to take over with SmartScale.

Good afternoon, board.

As Alberic said, I'm going to be covering smart scale and revenue sharing updates.

So let's see.

As a reminder, the smart scale grant program is the primary method for funding large scale transportation projects in Virginia.

Back in August of last year, 12 projects were submitted by Admiral County, the Thomas Jefferson Planning District Commission, and the Charlottesville Admiral MPO.

In January of this year, VDOT released the project scores, rankings, and recommended funding scenario for this round of SmartScale.

We presented that recommended funding scenario back at our last quarterly presentation, and we noted at that time that the recommended funding scenario was only an initial list.

Sometimes the funding list changes after being reviewed by the Commonwealth Transportation Board.

So recently in June of this year the Commonwealth Transportation Board met and they finalized the consensus funding scenario.

This is the final list of funded projects and sure enough there was a change between January and June.

Ultimately the consensus funding scenario still funds three projects within Admiral County but one of those projects is different from what was included in the recommended funding scenario.

So this slide is what you saw from last quarter's presentation.

It lists the 12 projects submitted by Albemarle County and by the PDC and MPO on our behalf.

The three highlighted projects, Belvedere Boulevard, Rio Road intersection improvements, US 250 Peter Jefferson Parkway intersection improvements, and Park and Ride, and the Avon Street bike and pet improvements from Druid Avenue to Avon Court were all recommended to receive funding in the recommended funding scenario from January.

This slide shows the three Amarillo County projects that actually received funding in the final consensus funding scenario.

So as you can see, the Belvedere Boulevard Road intersection improvements and the Avon Street bike and ped improvements remain, the US 250 Peter Jefferson Parkway intersection improvements projects was removed, and the Hydraulic Road District Avenue roundabout was added.

We're happy to see the roundabout added as it will improve the efficiency of the upcoming improvements at hydraulic and 29.

All of these projects will be administered by VDOT and they have no local match so they're largely out of the county's hands at this point but we'll continue to update you on these projects in future quarterly reports.

All right, moving on to revenue sharing.

So VDOT's revenue sharing grant program typically funds small and medium sized transportation projects, especially compared to the larger projects typically funded by SmartScale.

Revenue sharing accepts applications every other year, alternating with SmartScale applications.

So revenue sharing applications are submitted, bless you, in odd number years and SmartScale is submitted in even number years.

So in late June of this year, Albemarle County staff submitted five pre-applications for revenue sharing with a total request of just over $15 million.

Final applications are due at the end of September.

So there are some important limitations to the revenue sharing program.

Revenue sharing applications can request up to $10 million in state funds over the lifetime of a project.

So as this implies, localities can apply for funding for a single project over multiple rounds of revenue sharing.

But when all of the awards are added up, they cannot exceed $10 million per project.

Also, funding requests must have a local match, and that local match is dollar for dollar.

Further, recalling that projects can only request up to $10 million in state funds, which would then be matched by $10 million in local funds, any project costs that exceed that $20 million, 10 local, 10 state, those additional project costs fall entirely on the county.

Applications are sorted into one of four priority levels with priority one projects being most likely to receive funding Priority one projects are projects that have previously received revenue sharing funding Priority two projects are projects that are currently in the localities capital improvement program and so on down the list

Lastly, for each round of revenue sharing, the county can submit as many revenue sharing applications as we want.

There's no limit.

However, the amount of state funding that we request across all those applications cannot exceed $10 million.

So that last point may set off some alarm bells for you.

As I said on the last slide that we submitted five pre-applications requesting more than $15 million, or $5 million more than we're allowed to request for final applications.

For that reason, we can only submit a subset of our five pre-applications as final applications this year, and the requested state funds from that subset cannot exceed $10 million, which we noted in the written quarterly report.

So let's see here.

Sorry, I can't find some of my notes.

All right.

What we are requesting today is some feedback from the board.

What happens with our pre-applications is that VDOT staff will review and refine our applications and improve them to move them to the final application phase.

Given constraints on VDOT staff time, VDOT has asked the county to determine which projects we'll pursue as final applications so they can focus their time on the projects that we want to move forward.

They've also asked that we give them our decision as soon as possible.

So for that reason, at the end of this presentation, we'd like the board's feedback regarding how to proceed towards final applications.

Over the next few slides, I'll describe each of our five pre-applications and I'll note that some of these applications would benefit from additional planning work and or investigation into alternative funding opportunities.

Ultimately, we'd like the board to provide direction on which projects Albemarle County should submit as final applications and which should be deferred to a future round of revenue sharing or other funding opportunity.

Essentially, we're moving up our decision point from September to today due to VDOT's request.

County staff will still return to the board in September to share any updates on these applications and request the required resolutions.

Let's begin with the Commonwealth pedestrian improvements.

So this project proposes to construct two segments of sidewalk, one on Commonwealth from Hydraulic Road to Payton Drive and another on Dominion Drive from Commonwealth Drive to US 29.

This is approximately two-thirds of a mile of sidewalk.

This project is priority level one because it has previously received revenue sharing funding.

The current total project cost estimate is about $3.99 million.

As I said, this project has previously received revenue sharing funding.

The combination of that previous award plus our local match is $3.3 million.

As this board well knows, a lot of work has been done on this project already by our dedicated colleagues in facilities planning and construction.

In fact, this project is at 90% design and ready to enter the right-of-way phase.

However, with the ever rising cost of materials, this project is currently just a bit short and we have requested $330,000 in revenue sharing funds which would be matched by $330,000 in local funds.

This is a relatively low funding request and we're confident that submitting this project as a final application will help this project across the finish line.

On to the Berkmar Drive extension to Airport Road.

So this project would construct a new roadway with bicycle and pedestrian accommodations.

It would continue Berkmar Drive to Airport Road where a roundabout will be constructed to connect to Innovation Drive and Lewis and Clark Drive.

This project is also a priority level one project because it has previously received revenue sharing funds.

This project is at about 30% design.

The current total project cost is $18.7 million.

The combination of the previous revenue sharing award plus the local match is $7.3 million.

This project also has tele-fee funds, which is just a funding

source identified in our secondary six-year plan.

And these tele-fee funds have been already dedicated to this project totaling $4 million.

So, Almaro County would need to request $3.7 million for this project along with $3.7 million in local match in order to complete it.

In staff's recent presentations regarding our secondary six-year plan when we talked about tele-fee, we heard how important it is to this board that we complete this long planned project.

So for that reason, we'd like to move this project forward as a final application in this round as well.

onto Berkmar Bike and Pedestrian Improvements.

So this project proposes to construct a shared use path or enhanced sidewalk from Hilton Heights Road to the first intersection south of Woodbrook Drive to connect to the existing shared use path further north.

It would be approximately one mile long.

This project is also priority level one because it's previously received revenue sharing funds.

The current total project cost estimate is $12.1 million.

The combination of the previous revenue sharing award and local match is $2.7 million and that means we would like to request $4.7 million in revenue sharing funds along with $4.7 million in local match.

This project is currently at about 30% design.

Design work has identified a few sections that make construction of the shared use path technically challenging and expensive.

And further, project costs have gone up with inflation in the years since this project was first awarded partial funding.

So as a result, we would need to request that $4.7 million.

Given significant increases in residential development in this project area, the popularity of the existing shared-use path further north along Berkmar, and the county's commitment to infrastructure projects that improve quality of life for county residents, this project is also a strong candidate to move forward as a final application.

On to Lambs Lane Campus Loop Road.

So this project would extend Lambs Lane, which currently has no outlet, to Hydraulic Road via Georgetown Green.

This would include construction of a continuous green T at the intersection of Georgetown Green and Hydraulic Road.

It would also reconfigure the Admiral High School entrance to Write In, Write Out only.

This project is a priority level four because it's never received revenue sharing funding and it's not currently in the county's capital improvement program.

Total project cost is estimated at about $8.4 million.

That means Amherst County would need to request $4.2 million and have $4.2 million in local match in order to complete this project.

So as a little background reminder, this project was recently prioritized by this board and the board's strategic reserve was used to hire consultants to quickly complete a feasibility study for the Lambs Lane Campus Loop Road and adjacent improvements, specifically so that we could submit this revenue sharing application.

I want to emphasize that the consultants absolutely met that goal and provided us with the appropriate materials to submit that pre-application.

However, in doing the feasibility study, our consultants as well as staff from schools and county government identified numerous issues that warrant further study.

Just as one example, the initial designs for the loop road would impact existing buildings, so schools needs to consider where some services could be relocated and when.

Further, this project is currently priority four, the lowest level, because again, it's not in our capital improvement program right now.

In the past few rounds of revenue sharing, priority three and priority four projects haven't fared very well, and they've been very unlikely to receive funding.

If we were to resubmit this application in a future revenue sharing round, we could use the intervening time to add this project to the capital improvement program and make it much, much more competitive.

So staff see value in not moving this project to final application at this time.

This would allow staff and consultants to investigate and address those unknowns, move the project to a higher priority level, and better position this application for success.

Moving on to the last of our five pre-applications, we have the extension of Eastern Avenue South.

This would result in a new road connection from West Hall Drive with a bridge overlooking Hull Creek to the intersection of Corey Farms Road and US 250.

This project would include bike lanes and sidewalks.

This project is a priority level one because it's previously received revenue sharing funding.

The total project cost is $39.5 million for this project.

Previous award from revenue sharing plus our local match totals $16.2 million.

None of that money has been spent yet.

What you'll notice despite the overall project cost, you'll see that our 2023 revenue sharing request is only for $1.9 million and that's because that's the maximum that we can request as the project has already received about $8.1 million in state funds and it can only receive a total of $10 million over the project's lifetime.

That means to complete the project, the county would need to provide not only the $10 million in local match, but an additional $19.5 million beyond that for a total of $29.5 million in local funds.

That's a very large proportion of the overall project cost that would fall on the county.

Staff would like to consider not pursuing this project as a final application in this round so that we can explore alternative funding opportunities that might ultimately cost the county less.

If we're unsuccessful in finding alternative funding opportunities, we can always come back and request the $1.9 million in a future round of revenue sharing.

We would still maintain our priority level one status for this project and the $8.1 million that we already have doesn't go anywhere.

This would likely not even delay the project as we could move forward with the early stages of the project using the non-local matching funds.

So overall, waiting for a future round of revenue sharing is not going to harm this project or cost us anything.

So here is our summary.

Final applications for Commonwealth pedestrian improvements, the Berkmar Extension to Airport Road and the Berkmar Bike and Pedestrian improvements, the three projects that we recommend moving forward, total $8.73 million.

That's under the $10 million limit for this round and under $10 million for each project.

The two projects that we recommend not moving forward at this time would not be abandoned.

Staff would continue to refine plans and search for alternative funding opportunities for the Lambslink Campus Loop Road and the extension of Eastern Avenue South.

Moving forward in this way means that we're still advancing the county's highest priorities and putting the county in a good position to complete vital projects.

and I don't want names so much as how is that identified?

Maybe Kevin wants to speak to this a little bit more but broadly these are folks from the HOAs and businesses along the study area corridor.

These are often folks who've interacted with the county previously with other work in this area including the Triangle About.

I don't know if you wanted to add anything to that.

I will start at the bottom of my list and work backwards too.

June 8th was when I learned about the

Unbelievable escalation in cost for the Eastern Avenue Bridge.

When I first started working on this, it was $1.5 million in 2008.

And this is just a lesson to all of us to remember.

When you don't act on things in the appropriate time, they get out of the question.

I mean, this has been on the list since 1992.

More than 2,000 dwelling units have been built in the space between Corey Farm on 250

and 240, where there's a whole series of neighborhoods there.

I've spent 16 years of my life trying to navigate all different levels to get something to even be in the county budget, even be on the vision list at the Planning District Commission.

I am crushed that where we are right now.

There is no way that the county can right now deal with 30 million dollars to build this bridge today and I am sick about that.

It does totally change I think and hopefully staff will begin to consider this the ability of current Crozet residents to get around

when faced with hundreds more or thousands more vehicles in applications coming forward.

There has not been, I think, a real appreciation in the past for the impacts to current residents on many of our projects no matter where they are in the county without the neighbors who are most directly affected having to come and jump up and down.

which makes them look bad in a way because they're saying no we can't handle this but literally they can't handle this.

They can't get out of their driveways for 15-20 minutes.

I have, as I said, over the last many months been working with various levels from the state down trying to figure out how

and get the engineers and people with the brainpower to do this, to come forward with short-term solutions to solve some of these problems so that until some other alternative is found, there is better day-to-day operations for this community because they were sent 4,000 dwelling units between 2004 and 2008.

2,500 people is now 9,600 people since 2005.

So all of you have neighborhoods that are in similar situations.

Everybody, every magisterial district is facing this, but I'm just using this as a little background to why this bridge, I mean all those rezonings that were passed were based upon this bridge being built.

It was the fat magic marker on the line from way back when.

So as I said, I have no words to describe my sense of disappointment that

This new assessment of cost has come forward and I'm sure that county staff is feeling the exact same misery because they also have spent years trying to navigate the briar patches and other ways to make this to work better.

So I have no answer other than I understand.

What will be incredibly important is that this not go into some dustbin but actually stay on a very top of mind active level of trying to find alternatives.

There have been offers of partnerships over the last fifteen years that have been ignored and I hope that they can be rekindled with some staff engagement to perhaps come up with something that will be better.

Various sort of offhand comments from people at VDOT as well, the county can just do this.

and they'll probably be able to do it a whole lot cheaper.

But how we accomplish that is unknown to me.

So that's my feedback on that.

I'm also astonished at the increase in cost for a lot of the projects.

Is it taken into consideration when there's already a sidewalk on one side of the road

and we're still looking for $4.7 million of local match to do one on the other side of the road, how that fits in with the overall plan.

I'm not trying to say that take the sidewalk money and put it on the bridge because that's absolutely not what I'm saying.

But are you really doing some good value engineering to figure out where the best use is?

I guess I'll leave that to you.

That is a great question.

Transportation planning staff have had lots of conversations with finance

Broadly we can say that there is enough flexibility in the transportation leveraging fund to meet our obligations, to meet our match obligations if we were to be successful in receiving the full $8.73 million that we request.

and I guess my last question is are these, well some of them you said were only 30% designed so there's the horrible likelihood that the cost will also go out of reach next year.

So I don't know what to do with that either.

I'm just very, I have a lot of angst about this whole thing.

It is also very frustrating to me that the $200 million that the Commonwealth Transportation Board has set aside for projects who have had increased costs is not accessible to us.

Or we don't have access to that.

and also that they didn't change the $10 million cap because of all these things that they have now created for us.

So let's see.

So bundle number two, how does that fit into what you have already presented to us?

So bundle number two, I understand, is underway.

It has been advertised they have an RFP out now, and as of the June 20th, here in Charlottesville, CTB meeting, the CTB decided to add the Route 240, 250, 680 Trestle roundabout in Crozet to the bundle number two.

So that did not show up in the staff report.

I just want to make sure that that became part of your official documents.

It's Shawn Nelson's words straight off the top.

And this is the John Warner Parkway things, Belvedere, the other projects I mentioned earlier.

Because it makes me nervous to see that further down in the staff report as 2025 when actually the bid is supposed to go to procurement in the spring of 2024.

So that is a whole different category.

And I want to make sure that that is right.

And I will stop.

So anything that, you know, we don't put it here, this is 23.

If it just waited for revenue sharing, it would be 25.

So it would get bounced to that time frame.

So I'm just trying to operationalize my choices here.

However, some projects, especially if they grow in size,

So, you know, the choices here, it's really a timing choice.

Yes, it's a prioritization of projects, but it's also prioritized with the timing because you're not really punting per se, it just could be

What can we get done now versus next year versus the following year?

The only caveat I'll add, it's my understanding that if we were to take a project from, if we'd received revenue sharing funding and wanted to move that project to SmartScale, we would have to relinquish our previously awarded revenue sharing funding and it would have to be exclusively funded through SmartScale.

So what that means is that we've committed dollars, they've committed dollars.

If it goes through SmartScale, we don't get extra dollars.

They're just funding it all there, and you give up whatever they've matched.

But it also frees up our local planned match.

So if I have $3 million set aside for a revenue sharing project, and then it gets funded through SmartScale, they're just, OK, I don't get $3 million from revenue sharing.

I get the whole project from SmartScale, and then my $3 million goes to something else.

So I mean, I think we get that.

It's just a matter of keeping this.

Sometimes you're putting two or three different puzzles together on the same table.

I just needed to confer with our colleague at VDOT.

And I will need to get back to you for sure on that.

But I think that we may be able to hold on to revenue sharing funding that was previously awarded.

So say if we decided not to go for one of those first three projects or the four projects that have previously been

I mean they're giving us the money so whether they call it revenue sharing or it's all in smart scale it's really just a accounting trick really we're not getting extra money

It still frees up our money, but I'm not getting extra state money.

It's not like if I got $20 million in SmartScale that I hold onto the $3 million if that was their portion of the revenue.

I wouldn't all of a sudden have $23 million.

Once again, I'd like to verify that, but I believe that if you have an awarded revenue sharing project, let's take the Commonwealth Drive project, for example.

We have all but $660,000 of that right now.

If we wanted to make an application for SmartScale next year for that remaining $660,000,

that we might be awarded that through SmartScale and that would complete the project.

We would still have to contribute our original amount that we had agreed to, the revenue sharing amount.

Yeah, I think I understand.

Yeah, understood.

And where's your slide?

So the two basically that have been removed from 23 are the Lambs Road and then the bridge.

I think it's important for us when we mention the Lambs Road loop road.

I don't want, you know, that's true, but it's really a improvement along hydraulic and Lambs Lane loop road could, we have to figure out a way to call that something that doesn't forget that it's actually attacking hydraulic road because that's a major congestion and safety item there.

If everybody thinks of that as just the internal road, when we're thinking of it decision-wise, you can't fix it without the internal road, really.

But that's important.

I mean, obviously, from a project standpoint, the Berkmar Road is, I think, the top priority for me when I look at the project.

So I'm not in disagreement with the rationale and the way the projects are going.

It hasn't grown in scope, it's just gone in cost.

So is Berkmar Road, but we have to

it hasn't jumped up and we're so close to getting that little extra, that extra bit.

So I mean I guess I'm not in disagreement with any of the recommendation here thinking of the prioritization of the timing based on how far along we are with the first three projects.

But that hydraulic road wind that fronts Albemarle I think really needs to be in the mix here

at least in our heads to get up there for, if not this one, then the thinking both smart scale and revenue because I think that improves that whole corridor, not to mention the school benefit for the children there.

And others mentioned the focus group or the corridor study group because that did come up in the MPO that that's the county's responsibility to be there, so I would imagine Jim and Diantha will be.

being on top of that.

But there are residents and since this board made some statements during the approval of that development project over there, it's just important to know that we communicate well for those to participate in the focus group or how they can go about.

I don't know if it's an application process, appointment, whatever.

It's just we have to make sure we're doing our job and communicating out how to participate.

or what the process is to attempt to participate.

And I'm just thinking of our railroad corridor study participation.

We got a little clunky out of the gate there.

So I think that when we approve these development projects and make some claims or some commitments when we vote a certain way that we have to live up to that obligation.

I am amazed that this community has two pipeline feed out projects right now.

We have the need, and it's wonderful that they have seen the need and agreed to two pipeline projects.

So that's wonderful.

And we do need to make sure that those folks that were involved in the Ivy Road, Old Ivy Road, somehow or another would get to, because we have emails from them.

We know those folks.

I mean, there's just got to be some way to reach out to them.

I know Jim and I are trying, but good communication because a promise is made.

and I really am

Please that the roundabout at District Avenue has been approved because that is a very dangerous area right now.

And Jessica, thank you for explaining to me.

I was very confused because I kept hearing that it had not been approved.

And then the next thing I knew it had been approved and I thought either I'm whack-a-doodle here or something, but I didn't understand what was happening.

So you explained the change.

which made me feel better on my brain power.

It's all good.

So that's great.

The Lambs Lane Campus Loop Road and the hydraulic piece do marry together and are actually critical for the movement of traffic on Rio and Georgetown.

and even Barracks Road because of the congestion that all of that causes.

But I do understand the need to take a little bit more time on that.

We're working with the school board and the school system.

This was very new and it came up because of the master plan.

And so I appreciate taking the time to get it right, to get it funded.

I just wish we could do more and all of it.

and I understand why we're doing the first three regarding the funds we have.

I did want to ask the board, I am concerned that I want to make sure that we don't, we're not asking for any kind of a delay on anything because my experience with government is once you delay something then it gets really delayed and things don't get accomplished.

I guess my point being is

If we all agree, then let's move forward and get this done so we can go on to the next set of projects.

I do agree with Supervisor McKeel that the IVN 250, there was a promise there and I even heard that it would be fast tracked.

Yeah.

I believe the fast track comment was to get started on the pipeline study so that we could be prepared for a smart scale application in 2024.

And that has happened.

So let's pretend everything goes well.

Well, it really depends on what the recommendations coming out of this pipeline study are.

The pipeline studies intended to be finished next spring.

If there's immediately implementable things, then that kind of thing could go right away.

And my last question is, Supervisor Mallek mentioned something regarding offers of partnerships with different projects.

Is that something that we can do?

There are possibilities, that's all I know.

that they are feasible, yes, and that you're absolutely feasible, and we're exploring any options that we can.

No, just that, and I appreciate the question, Ms.

LaPisto-Kirtley.

I think in that second bullet, I heard you say it's important that we don't delay.

and then you went a little further in trying to explore what do alternative funding opportunities look like and I think that's the work of our staff to step away from here.

The first bullet, and I know the board and the chair has not finished your round,

but I'm listening in hard that the first bullet is within what VDOT is asking us to do under the $10 million threshold.

But the work of the staff on the second bullet, it's two entirely different projects and it's entirely different strategies.

The work looks very different but we need to have some time to step away

and to work both of those in very different ways and then have a responsibility to get back to this board at an undetermined date but not pushing it off to the side but rather saying let us do some work on this and then get back to the board and report on what our work looks like.

Bottom line up front, slide 16, I concur with what's proposed here, keeping those three working on the other two.

So as I understand it for revenue sharing, we cannot get more than $10 million per year, nor more than $10 million per project.

And we see $8.73 million, which means there's $1.27 million left out there.

It's not like we can just go find another project because it also had to score well enough in order to be eligible for the revenue sharing.

I don't think it works in quite that way.

So we'll make this set of applications and we have that $10 million limit.

That starts all over again with the next round of revenue sharing.

Because it'd be a different year.

I just want to say, and this is a really great comment, Supervisor Price.

There is that extra $1.27 million and we are not entirely sure that we've got the fully accurate cost estimates on those three projects between now and September

If those were to change, then that $1.27 million may come into play if we need to request some additional money beyond this.

Yes, at the most recent NPO meeting there was an extensive presentation about the changes underway at smart scale and I think Supervisor Galloway was requesting that this be also brought to the board because everybody needs to understand this and I need to hear it two or three times before I begin, but one of the takeaways was frowning upon small applications.

because small applications take just as much staff work for VDOT as big ones.

So I want us to be aware of that and sort of not think that this is, oh great, we'll go get that extra 500,000 because that may be changed from next year.

There was no final word on what's going on, but there's a whole lot of stewing going on in the planning side.

This last question I have for you is, did I understand you to say that now,

There is a possibility to move from revenue sharing to smart scale, which was certainly not the case a few years ago.

You either qualified for one or you qualified for the other, but they didn't have a bridge across those.

Projects could qualify for both.

As you know, the way they prioritize projects in smart scale is different from how they prioritize projects in

revenue sharing.

Revenue sharing is based on if you got the award previously, if it's in your CIP, if it's got maintenance.

But smart scale is based on those factors that they, yeah, there's five factors that they guard against though.

A project could score well in both or neither, I suppose.

And we're always looking at the possibility of

We would rather get SmartScale funding typically because there's no local match.

and perhaps there's a way to bundle some of our projects to make them big enough to bother with in a way because that's a possibility.

And the other thing is to be very concerned and follow up detail-wise on the scoring because we had a big fuffle with the planning district a number of years ago because they wouldn't give any congestion points or safety points to Eastern Avenue Bridge.

which was to me completely contrary.

It's why we have all those failing intersections there because there's no alternative and getting the fire engines across has been a major concern.

Yeah, just since it was mentioned, so yes, I mean my plan today whether it was now or

during committee business later from the MPO was to request there was a presentation done at the MPO on the current conversation the transportation board is having on the changes to smart scale and how things are ranked and rated and the rationale behind it.

And I don't disagree with the rationale behind it, but it is going to change how projects are weighted and scored.

Well, it's going to start weighting some of those five factors.

That hasn't been determined yet just how.

They haven't even discussed all five factors yet.

But we'll also determine who and what applications can be submitted by the MPO and the TJPDC.

So in the past we can submit different projects through these different organizations.

The TJPDC and the MPO are going to be limited, is my understanding, in what they can submit moving forward.

So rather than this come up and get us in October or November, I think it wise to have in my request is to have either the presenter from the MPO come and do the presentation, which was a very, I mean, it was a longer presentation.

I'm thinking it was 20, 30 minutes perhaps, but it took a ton of info and got it into an understandable PowerPoint.

and then have a second round after the Commonwealth Transportation Board has their September conversation which is when they'll discuss I believe it's economic development and let's see they've already started toying with weighting safety and congestion what are the five and then multimodal economic development and environment so I don't believe economic development environment have even been discussed yet so that'll be in their September conversation but you know

figuring out how SmartScale works and the strategy behind how to submit, what to submit, and who to submit it through, you guys have done a good job at.

So we want to be ahead of that and we should start brainstorming it and I want to make sure all supervisors

are starting to get their heads wrapped around it as well so that you don't come back later and we're like, what the hell is going on?

So that's my request.

I hope that we can get that done over the next month or two and then we can receive updates as the year progresses.

Once I figure out SmartScale, now they change it.

It's just very frustrating.

But it really would be good.

I agree with Ned completely.

I think everybody probably does.

And you know, the increased cost does not surprise me.

I mean, I'm not saying I'm happy with it, but it does not surprise me.

I was telling Mr. Richardson and some supervisors earlier last week, I got a couple of loads of gravel, $750 a load.

Eighteen months ago, it was $425 a load on average.

So, costs are up everywhere.

And the General Assembly has not been very generous in providing transportation money, to be perfectly honest with you.

That's part of the problem.

We can move to item number 12, the Virginia Department of Transportation quarterly report.

Sheppard and thank you for your flexibility as our schedule today opened up and we appreciate you being able to be here earlier than scheduled.

Good afternoon Madam Chair, members of the board.

I'm Carrie Sheppard from the Charlottesville Residency Office here to give you the quarterly presentation.

So to begin, this is a preliminary engineering update.

Not too much to update on the top part of this table except for the 5th Street hub and trails.

We held a citizens information meeting back in May and that transcript is available and I can provide that upon request.

I would like to say just largely it was very positive feedback that we received.

For our bridge project, State of Good Repair, Route 708, Red Hill, close to the intersection with 20, that has been put out for advertisement.

We expect to award that in September.

And then 667 Catterton Road Bridge, that is under construction as of August 1st.

We expect that to be complete by the end of September.

Old Ivy is still on the same schedule as before.

We expect the ad date to be March 2024.

Frays Mill also continuing along the same schedule as previous with an ad date expected later this year.

And then for Route 680 Brown's Gap Turnpike bridge replacement over Lincoln Hole Creek, we expect that ad date to be 2025 at this time.

As far as our hydraulic bundle package, right now we're expecting utility relocations and drainage installations to begin this winter, with major construction likely to begin next spring.

As far as our existing Albemarle bundle, which includes the DDI, the 150-250 roundabout, and 2649 roundabout, that is

Substantially complete for two of the projects, 151 and 250 has one last component that just started construction and that is the installation of a truck arrestor ramp as you head downgrade on 250 eastbound.

As far as Albemarle bundle number two, we have five elements in that bundle.

The John Warner Parkway roundabout, Belvedere Green Tea, the Route 53, Route 20 roundabout, Fifth Street Old Lynchburg roundabout, and the 240-250 roundabout.

The scoping and preliminary engineering is underway.

Survey is complete at this time.

And we have public hearings coming up in September.

They're scheduled for the 19th at the National Guard Armory.

I believe prior, we were planning on PVCC.

I think we're still finalizing the time.

Okay.

I can get back to you on that.

Very good, thank you.

And then 29 Fontaine still working through that right now expecting design engineering later this year if nothing changes at this time.

As far as our rural rustics, we appreciate the recent resolutions that we received.

We've finished Cove Garden and now we will start on the next set that we received the resolutions for Beam Road, Stony Point Pass 1 and 2, Old Dominion, Arrowhead Valley, and Lenum.

As far as our construction activities, Watts Passage is still under construction.

For that emergency closure, we expect completion still in target with the November 2023 date.

And then 810 Blackwell's Hollow Road is a superstructure replacement that is under construction as of July 17th, and we expect that to be complete August 22nd.

The road is closed to traffic during that time, but we do have a pedestrian bridge in place to allow cyclists and foot traffic to pass.

as far as our traffic engineering.

Crosswalk markings have been installed at 250 and Old Trail.

We have the ADA ramps installed at Bishop Gate.

All that's left is to do the actual crosswalk markings.

Route 53, this was a sign review for route 76 bike signage.

We have determined locations for that.

We just have installation pending.

Advance Mill Road, that was a sign review of a curvy section that has been completed.

Signs are installed.

Owensville Road, that was a curve review, sign review and we determined that a curve advisory sign needs to be installed and so that's pending installation.

Englewood Drive and North Bennington Road, that was a request for stock bars.

Turns out those stock bars were in place previously and they've just been worn so we're going to repaint them.

and Woodlands Road at the intersection of Route 660, Raceford Road.

We are removing the transverse rumble strips because it followed out of process.

And then currently under review is the pedestrian crossing at 240 in Music City and Star Hill Brewery.

Field investigation is complete.

We have a couple tweaks that we have to make to the design and then we will proceed with that one as well.

I understand the signs are up and very much appreciate it.

I also appreciate that I have several times had related requests about maintenance on some roads in North Garden, Faber, and others that have been attended to and really, really appreciate that.

This all looks good to me.

SmartScale discussion previously.

Is there anything in particular?

I mean, I do know that they're going through changes right now and having those discussions.

Of course, it's not finalized yet, and that's the extent that I know about the changes.

No, that's what I was looking for.

Well, first of all, I'm horrified that the rumble strips are being taken away because I had requested the same at the other end of Ray's Ford Road because they're so effective at the four-way stop there.

So, can they have the better process, the correct process, and get put back in?

Unfortunately, with that particular location, they were installed without checking with the neighboring property owners.

and as we know, they are a noise nuisance.

In addition to that, we check the crash history and there is not a crash history that supports necessarily the need for the rumble strips at that location.

Okay, so the north end of Ray's Ford Road at Early Spill Road,

It did have all of its thorough process before the stop ahead used to be raised.

And it is now worn out and totally flat.

So if one cannot have transverse rumble strips that I really want, can we please have, puff up again, the stop ahead thing, all those neighbors around there said please fix it because we had so many accidents there.

I have not had one complaint in 15 years about a little boop of the road of the car going over it.

We did have another T-bone within the last month or so.

It was not, I guess, to the life-threatening level that it got on the statistics, which is why I'm begging everybody to please call the 977-9041 number when something happens so that at least the county gets data.

on these kinds of interactions that may not show up on the statistics that VDOT has.

But anyway, that's a real concern still because we're still, every six months we have something that happens.

And not to the months in intensive care like we had a few years ago, but not bad.

The crosswalks that you did install the one at Bishop's Gate, so there was some concern about, I sent an email a while ago about what processes needed to finish at Ashlar, where the ramps have already been installed.

The playground is on one side and Ashlar's on the other, and there was something about the cost of doing that.

I mean, is there more than putting paint on the road across Old Trail Drive?

So I still need to look into that.

There were a couple of things.

I think that some of these locations had been requested in the past.

And one issue that we ran into was that some of the streets weren't accepted into the state system.

If it has been, then we can look at it for crosswalk warrants, which is what we do.

OK.

I think that was on the last old trail bundle, but I can find out about that.

And the last, Catterton Road.

Is there, I'm not sure that you were here then, but a few years ago the bridge at right angles to it basically on Buck Mountain Road was replaced in six days.

And all the boxes were ready, everything was taken down, the new ones were put in, poof.

This Catterton Road, this detour is going to take 20 minutes.

And it's over crummy roads in addition.

So is there any expedited process that can happen?

The neighbors were 100% against doing anything on this bridge.

They like the fact that it keeps 18-wheelers off the road.

They don't mind the angle.

I mean, I've had my livestock trailer across it.

It's not problematic to do it all as long as you slow down and do it correctly.

So what can be done to help out with this?

Because fire and rescue as well as the neighbors going in and out.

So this is already on an accelerated schedule.

The two months is already accelerated because it's being replaced with a metal box culvert.

So as far as I know we're doing everything we can to expedite that and that was the shortest duration that we could get to.

If that person could share that information with me then I can share something because my phone's ringing off the hook about, you know, how did you let this happen.

So we thought we were pretty clear about it during the design hearing which was a long, long time ago.

But it did not seem to make any impact.

So thank you very much.

I look forward to getting that information.

And we're still building data on the terrible speeding problems in Hillsboro.

So hopefully soon there will be some data enough to be able to then consider some structural changes that might be able to keep people safer there on that drag strip.

And thank you very much for the expedited maintenance.

on Clark Road, Fox Mountain, and Wesley Chapel.

That was very much appreciated for especially the deep ruts that the sedans can't get there and grandmas are carrying their groceries a half a mile in this heat, you know, up and downhill to get there because their car can't traverse the road.

That was pretty awful.

Cara, I just want to take a moment publicly to thank you again for your time.

We were able to meet

and discussed some specific items in the Rio district.

I know that the residents in Dunlora and the homeowners association there was thrilled that the temporary through truck restriction signs are now back in place already, which is great.

I know that the issues working out with the developer and some folks in Belvedere is underway.

And it was nice that the Commonwealth Drive, Williamsburg Road, Curb and Gutter was already on the radar, which you confirmed.

So I was thrilled about all that.

And also, I'm just going to say it publicly, so if anybody in the Rio district are living in that area, the John Warner Parkway roundabout has not moved its placement or location.

It is in the same place, and to quote, not an inch, right?

It has not moved an inch.

and Sean Nelson actually verified that again at the MPO meeting.

I wasn't reconfirming, I was just making a funny comment about that.

During our conversation, I'm saying this more as a general comment, so not really need a response here, Kerry, but the

We're making strides, as the report at the last board meeting said, about our 100 tons of debris that were picked up by the street sweepers at the last meeting, and I appreciate staff getting back to us on the clarification of who owns the property along Warner Parkway, and I'll get to that.

Kerry and I, when we met, were having conversations that we have to remember some of our medians that have these things growing up out of them are not all public, that there is some private responsibility.

They're private-owned medians.

And I know that our median management plan, it just gives me a chance to call out that I'm sure that's part of that plan to identify which ones are public, which ones are private, so that we can hold all accountable to keep it.

We don't want to start having spottiness because, oh, that one's private, that one's public, and oh, we didn't know.

So I'm just, like I said, taking the opportunity to call that out.

And then along the parkway, we've got the bike lanes.

That's really where you can see the impact with the Street Sweeper.

There's tree overgrowth happening.

And I think it was in that update, correct me if I'm wrong for who sent that out, that they said sometimes VDOT will come by and handle any trees that encroach.

into the roads.

So I don't need a response now.

I'm just curious.

I know we get mowing schedules and you guys do mowing at a certain point, but I didn't think trees because you're not really mowing along the parkway.

What's happening are some are coming down where now we've got the debris out of the way on the ground and now we're gonna, you know, clothesline them off of their bike as they drive and the tree whacks them in the head.

Or they have to go out into traffic to get, you know, because the bikeway can, you know what I mean.

So I'm just calling that out as I understand it more like, oh, is that something that's on a regular thing or does it wait to be called out by somebody?

But any update on that down the road via email would be great.

Yes, Carrie, I want to just thank you for the work that you did with the community on Woodlands Road specifically where the Methodist Church is on that bad curve.

Thank you very much because you did a lot of tree trimming back there and took care of a lot of problems.

And then I think you're going to be putting a mix on that curve that will help, some sort of a mix that will help as people are going around that curve.

So I really do appreciate that.

I just have a couple of odd things to ask you.

Let me back up a minute.

Thank you also because I submitted a request to asking VDOT to remove a large grill on the bypass ramp.

Someone discarded a huge gas grill barbecue unit

on the bypass ramp off Barracks Road.

And I knew it was so large that nobody was going to be able to deal with that.

It is amazing what happens now.

I don't know if it discarded or if it dropped off of a truck.

Maybe that's possible.

But I reported it to VDOT, and you guys sent someone in and actually took it away.

I really appreciate it.

Just a couple of questions.

The contractors, at least in two areas in the urban area, at the end of their projects, when they've been painting the lines on the road, have spilled paint cans.

and just made really bad messes.

And I'm just asking, when that happens, are the contractors required to somehow or another go back and clean it up?

There has been a bad paint spill out on 250 West and there's another one on Georgetown Road.

We go to all the trouble to have these roads

I'm sure that's not true, but it happens fairly often.

Just a question.

for you guys to think about.

Maybe you write something into a contract or something that deals with just because when a gallon of paint spills or two gallons of paint on the road, it's noticeable.

It's a lot, and we have two areas right now.

The other thing that I wanted to ask you about, I've been reading in magazines, journals, about dots across the country beginning to paint

Roads, where they have heat islands, mostly in urban areas, gray to help reduce the heat that is being absorbed into those neighborhoods.

And I'm just wondering, is our VDOT looking at doing any type of painting like that?

When you asphalt, not to have the black, but to paint them actually, and I guess there's some product that they're using.

I've plumbed the depth of my knowledge on it, but I was very interested because we do have some heat islands in our urban areas as we're going into climate change and things are getting hotter.

I think I had some answers on that.

I think largely no, but I think we might have some out of our research council, I think we might be looking at some of those things.

Potentially.

That would be great because anything that comes out of the research council is good information.

I would be very interested, yeah.

But they're not doing it yet, just in the future.

Yeah, I'll have to check.

Yeah, I'd really be because it makes sense.

It just makes sense.

Now, maybe it's counterintuitive and I don't know there's something I'm missing, but I'd be very interested in that.

And I guess really, that's all I have right now.

I'm going to jump on the bandwagon and thank you for everything you do and you are doing.

And I want to let you know that the people on Stony Point Road are uber excited about waiting decades to get the two ends of the road paved for a certain portion, so thank you very much.

And hopefully that point too can get done also with, you know, when it comes before the board next year.

I do have a couple questions.

I noticed there was an article in the paper that said the tree debris from the freezing storm that we had, what, a year and a half ago, that they brought in machines and they're chipping the debris instead of hauling them out, the trees that have fallen.

Everything's been cleared, but in the VDOT areas where there's just trees on the ground all over the place,

Is that something that we might think about doing is just chipping it and leaving the chips there to help the soil and everything?

I'm talking about areas near the freeway that belong to VDOT where you have massive amounts of trees.

Yeah, if we have areas like that, I'd ask if you could send me the location so that we can look into it to clean it up.

Oh, no, no.

None of it is in the street or anything.

It's off to the side.

It's in the forested area.

And I was told that

Okay.

So that answers that.

So the other question I had on Stony Point Road, Route 20, there's a blind curve at Stony Point Pass.

At that intersection, there is no way, if you're on Stony Point Pass and you want to make a left turn,

to go to the school, a car can come up Route 20 making a right turn.

There's no way you can see it.

I've asked staff, they may have already contacted you, but I've asked staff to look into putting up a mirror, maybe somehow changing the configuration of the road a little bit, but something that's a very, very dangerous blind curve.

if you want to make a left-hand turn going out of Stony Point Pass onto Route 20.

We've reviewed that.

I've talked to the county about it as well.

I think what would need to be done is a larger scale project, so it would just have to be prioritized by the county as something to focus on.

I thank you for the GPS marking on Blank Road.

You mentioned through truck restriction.

I note that on the materials that we received that

It's determined the plank road appears to meet objective criteria established through truck restriction that it's coming from staff eventually for a public hearing.

I only say this because there was some, I think,

Premature communication in a newsletter suggesting we were doing something on this today, which is not the case, but it doesn't mean that we're done.

So I just want to make that comment.

And very quickly, also joining the bandwagon, I've e-mailed before, but I want to publicly thank you and your crew for the work, your crews for the work they've been doing down Secretary's Road, Jefferson Mill with the scraping and the working on the ditch and everything.

You know when you drive in the rural areas where you don't have a defined curb, sometimes you lose sight of how much the growth can kind of come up onto the asphalt and the clearing of that and making more visible the width of the lanes has really been helpful and then also with the, we may be short of rain precipitation this year but when we get rain it's a deluge

and for you to be working on, your crews to be working on clearing the ditches is really, really been helpful.

I do have a question as a follow-up to that though.

It's noticeable some areas where the asphalt on the edges of the road is kind of crumbled a little bit.

Yes, we should do that, yes.

And that will depend on resources, of course, too.

We recently opened the Southern Convenience Center off Esmont Road near the intersection of Plank Road 20 and Coles Rolling.

A concern I have is if you're coming east on Plank Road to the stop sign at 20, if you look to the left,

On the backside of the veterinary office, there are some bushes that block part of the view of southbound 20 traffic.

I'm not sure if those bushes are in the VDOT right away or on the property owners, but if y'all could just someone take a look at that, it might be helpful to trim them back.

And I remain concerned about not having an improved stop sign at Plank Road just because of the increased traffic that may be coming from people from the convenience center, if that could be looked at.

Speaking of heat islands, Friday I left here, it was 103.

25 minutes later when I got home in the woods, it was 93.

Not that 93 is cool,

But that 10 degree difference by being where you have tree cover versus where you've got asphalt and cement is incredible.

I don't know if painting per se the roadways, but boy it would be nice if technology could come up with the different natural color of pavement.

to help reduce that.

And we, from the county standpoint, community development, we need to be always thinking about that in terms of tree cover and developments because, I mean, the world is boiling and burning right now.

But so much, you know, I think what you heard today is a great deal of appreciation for what VDOT is doing in our area.

I had one block in red which I ignored and the question about contractors reminded me to go find it.

There is a contractor, I guess, or several who are in charge of spraying under the guardrails and there is rampant spraying all along our streams and bridges, all along on the west side of 29 up to Greene County.

There is also spraying in the trees up the side because we're now seeing areas where in the same places where the grass along the roadway is sprayed, 10 feet up in the air is sprayed.

So I'm concerned about that because these are spray things that are going to leach right into these waterways, many of which go into drinking water.

Back in 2010 to 2014, and I can't remember the exact same year,

Another contractor, not following the directions of EDOT, sprayed a chemical called crenite, which is only to be used in rail yards and industrial places, people never around agricultural land, never around water, and required hazmat suit to work with.

And this contractor sprayed it all along Sugar Hollow Road in the Mormons River and all other people who were working in their gardens down there.

Very serious stuff.

After that happened, we had lots of meetings with VDOT and with people from Virginia Tech, et cetera, et cetera.

But anyway, the board at the time adopted a resolution to provide landowners with the right to exempt their property from this kind of treatment and to require, and VDOT said we have a process to send letters to people before spraying happens to give them a chance to opt out.

This was done for two years.

It's a long time ago, obviously.

And 70% of the people opted out because they said we take care of our own verges and we don't want anything killed down in the front of our property.

And so then VDOT said we won't be doing this in Elmore County anymore, which is great.

But so much time has now passed that all of that information seems to have been lost.

And so I would like to reactivate that information because

people are in uproar that their well tended birches are now being have three foot wide strips of killed by Roundup that's gone the next day.

I mean it's not an interval of salt or something else.

This is hosed down and dead and I really hope that there'll be some way that

that VDOT's managers can correct this so it doesn't continue to happen especially around the waterways because you and I spoke about the waterways months ago and you said it was not going to happen because they weren't allowed to and they were supposed to be shut off places but they're not shutting it off.

So all along the reservoir you see on both sides of Earliesville Road right down on the reservoir both sides three foot wide stretches of dead grass.

So it's a concern.

I have a couple of things.

The first item I'm just going to share with you all.

I was given a brief on restricted crossing U-turn intersections, and I found this so informative, but I didn't have the link.

All I had was the article.

It's a very short article, but I'm just sharing it with you because I think you'll find it informative.

I learned a lot from it, so that just is a standalone.

The other thing I just wanted to report out is that, as you know, I'm on the Java board, representing the county on the Java board, and we received our 2022 annual report, and I just wanted to let you all know

What we are receiving for our good money through Java, 17,758 people received a wide array of services.

47,500 home-delivered meals, 9,216 people provided with information and referrals.

There are 652 volunteers at Java.

worked through Java.

3,953 elders in long-term care facilities were advocated for.

3,306 people received insurance counseling.

Those are pretty impressive numbers.

Now you know, of course, that this is a multi-jurisdictional, you know, Java's multi-jurisdictional, so I don't want people to hear this and be confused that it's just Albemarle County.

But the other good news was that Java won the National Aging Innovation and Achievement Award.

So we had a, Ginger Dillard, one of our employees, went to Austin and accepted the award on our behalf, which was really great.

And as you all probably do know, Marta Kean was unanimously elected president of the Virginia Association of Area Aging

agencies on aging in 22, and that's a two-year term.

So we were really proud of MARTA for that recognition.

But just wanted to give you an update.

I'm happy to just pass this if you all want to at some point today.

I just wanted to say that I had been over to the SPA a few weeks ago and just the way I was approached by staff, they didn't know who I was, I was approached by staff and looked at the dogs there and everything.

Night and day.

I even called up Sue Friedman.

I commended her because there was a really good feeling.

Everyone was welcoming.

I even played with a dog that I almost ended up adopting and all my friends are saying, no, no, no, no.

You don't need another dog.

You already have one.

So that was a really good feeling, I have to tell you.

The other thing is we had our Pan Top CAC meeting, which was

There's a concern regarding a zoning change.

If you remember back in 2020, on the corner of, on 20 near 250, we were going to rezone for a daycare center.

Now they want to rezone for a church and a very large parking lot.

But what is interesting is that the last time it wasn't approved due to the parking lot being in the floodplain.

What the developers told us, or whoever is in charge there, what they told us this time is that FEMA, and this is something I didn't know, but FEMA is supposed to re-evaluate all the floodplains and come out with a new standard.

I don't know if it's in spring when they're going to do that, maybe before, I'm not sure when the date is, but they're going to be redoing all these floodplain areas.

That makes it very interesting for us and it really makes it interesting if we're to decide on any kind of developments prior to the new FEMA floodplain design coming out.

That's going to affect what we do and how we vote on things.

So just thought I'd mix it up a little bit for you and tell you that.

My name is Kevin McCollum.

I'm a senior planner with the planning division of Albemarle County Community Development.

And tonight I'll be giving staff's presentation for special use permit application, SP 2023-2 Community Christian Academy.

Community Christian Academy is an existing private school within Cross Life Community Church.

It's located along Rio Road at the intersection of Rio Road and Old Brook Road.

The existing conditions of the site include two buildings, a parking lot, and a playground area.

It's zoned R2 residential, and it's just over three acres in size.

The site is home to Cross Life Community Church and Community Christian Academy Private School, both of which have approved special use permits.

When the school received their SP in 2012, they were limited to 85 students.

The school is proposing to increase the number of students at the school

from 85 up to 150.

There are no additional changes being requested at this time.

On the screen here is the conceptual plan for the private school.

The plan shows the entrance along Old Brook Road, the pickup and drop-off loop, parking, the school building, and the playground area.

On screen here are staff's findings.

Staff found that the positive aspects for this application are, one, institutional uses such as private schools are consistent with the place's 29 master plan.

Two, the proposed school is accessed from adequate public roads for the use.

VDOT has reviewed the proposed roads and entrances and has provided no objection in confirming that the existing conditions of the site can support up to 150 students.

And three, no detrimental impacts to adjoining properties are anticipated.

Staff did not identify any concerns associated with this application.

and to conclude, staff recommends that the board adopt the attached resolution, attachment D, to approve SP 2023-2, Community Christian Academy, with the proposed conditions.

I'm Kimberly Moore.

I'm the executive director for Community Christian Academy.

Our elementary school is located in Cross Life Community Church and we have been existing there since August of 2012 and we've continued to grow over the years.

and we've gotten to a point where we have a lot of students who'd like to come and we cannot always serve them because of the limitations of the 85 students.

The building is sufficient in size at over 6600 square feet to house the students.

We have employed Ray Gaines from the Gaines Group, an architect who has gone through, done the architectural drawings and has agreed with the original loads for the different classrooms that the building inspector gave us over a decade ago.

and has said that the building, yes, can certainly support the 150 students plus the various teachers that would be involved in that.

We have heard only good things from the neighbors, which we had an opportunity to meet, some of which actually attend our school.

And even at the community, I guess, advisory committee, there were some folks who were there

that are in that neighborhood who thought that we were great neighbors and were a blessing to that community.
